My Honey, we are in a similar situation.. hopefully we will get approved real soon.. I called yesterday, and FINALLY they said they are working on my case.. so it takes them 6 months just to START PROCESSING.. and then another month or so to finish up??.. crying.gif crying.gif

Thanks for all the responses... I just want to wish everyone a fast (well fast enough) journey!! This has been a long wait for all of us.. I hope that the steps after the NOA2 will be much faster (NVC)... I hear that is the case?? I'm still thinking about what the last USCIS person said to me.. it takes 30 days just to do a background check.. oh ... just call up and find out.. I can find out my credit history in less than 1 day... surely my other information is just as fast to search...

oh... you are a March filer? how come you haven't been approved yet? crying.gif I still can't believe it takes 2 months just to give out our I-130 NOA1... My went from 4/16 up to 5/29.. almost 2 months time.. just to send out a receipt.. that is ridiculous.. they should have a minimum quota everyday... not just finish approving when you feel like it.. mad.gif mad.gif

I am so mad about this.. just because we apply one month late, we have to wait much longer now.. crying.gif crying.gif I actually cried this time when I left China... she made me cry at the airport.. crying.gif crying.gif I really miss her and want to be together.. why can't we at least get approved?.. That is better than nothing.. they say they are looking at our case now.. but they said they need up to 30 days to do a "REQUIRED INVESTIGATION".. these kind of cases require it, they said... I already work for the government, so they already did a background check on me... that is so stupid.. they should do background checks (and IQ checks) on these USCIS officers.. they should put quotas as to how many they should finish in 1 day... mad.gif mad.gif...

people who apply in March already have their interview set in October... I want one in November please... I probably won't even get approved by then... sad.gif ... I'm looking at the clock everyday... so sad... ClockWatch2.gif... time goes by everyday that I can't be with my baby... why is it taking so long? .. Even my "estimated time to arrive" of April 13, 2008 seems not optimistic anymore... crying.gif crying.gif crying.gif

I tried calling after I reached the 180 days.. The first time I called with this "batch" was 10/15.. that was over my 180 days limit... so I THOUGHT I had a good reason to keep calling them.. doesn't the site say that they will PROCESS the case within 180 days? (meaning, completely approved or denied?).. Thank you guys for all your words =) I hope that all of us get approved soon... this has been a tough trip for all of us.. waiting so long just to be with our loved ones.. I will also celebrate with you guys once I get the approval letter.. but that is just Step 1.. there is still much to do with the 'Adjustment Status' as well as getting the green card ==> Citizenship.. her school.. getting her acquainted with life in US.. so much to do.. and we aren't even past the 1st step after 6 months ... booooooooo.....

I called the 1-800 number and just did the RFE tricks all this time.. I don't think there really is a special "phone line" or "email" we can use..

just got a mean person on the phone who said I called in to "request" too much.. I called from 10/15, 10/16, 10/19, 10/22, 10/23.. to bug them to hurry up and take a look at my case.. she said just call once a month from now on even if it is after 180 days.. I tell her that I see March people who already have their interview date and she said that "each case is different".. no other explanation.. she was just a mean person who probably hasn't waken up yet.. crying.gif crying.gif crying.gif What do you guys think? Should I call more and bug them or wait some more? If I do call too much, they might put my case back at the bottom again... Isn't there somewhere we can complain about that? I was going argue and tell her off, but that might ruin my visa chances.. They said they are looking at my case and doing the "security checks".. do you guys know how long that will be? Is that the 1 year checks I see some people getting??.. I asked to see which "security check" it was to (me or her?) and the USCIS person said she didn't know..

It will be really sad if this "security check" does take another year... =( I already work for the government and they did my background checks already... so I really don't know what is going on here.. crying.gif crying.gif crying.gif I thought at least we will zip by the security check portion.. What does it take to hurry it up? You have to be related to them or something?.. even with a US Citizen (government worker), it still is uncertain when it will get approved...

Yet most people come on a K3 visa (I-129F)... because it is "supposedly" faster than processing the I-130 alone.. even you, YuandDan came that way (according to your timeline).. happy.gif

ok, thanks C and J... I called in and they told me they are basing it on the "official received" date, when they first received your I-130... that is so messed up.. I sent it in on 4/13, and they received it on 4/16... it's not my fault that it got entered on 4/27... then I got my NOA1 on 5/29... and that's why I sent the I-129F so late.. sent it in 6/4... got a 6/11 NOA1 date for that..

5/29 + 6 months ==> 11/29... wow crying.gif crying.gif

Basically we will love each other in 80 years just as much as we love each other now.. I get to spend my life with a wonderful woman and I feel blessed everyday.. She takes good care of me and our son (and soon to be daughter) ,.. I explained it better in my letters to the Director before..

 

haha, now all that mushy stuff is over, back to the immigration game..

oh no, she is a good wife.. she saw that I was really tired from working on her case, so advised getting the lawyer.. you have to admit, my case was one of the worse ones on here and took a lot of time.. haha, I meant "sleeping under a rock" as in taking time off from visajourney, since I had enough for a while.. she knows the most about the time and effort I spent on her case.. we had a few sleepless nights wondering if we will ever be together.. it's ok by me.. let's just say it's Round 2 this time.. I'm more experienced this time and know when the immigration dept will pull some BS on me.. yeah, we were hoping her parents will come soon, but I guess we will have to wait a few more months.. She didn't get to go back to China (I told her not to) when she came here since 2009 because I thought it might affect her getting a passport and to become a citizen (haha, you never know with immigration dept, and because of her case I was really nervous about it happening again)..

 

we have a super-duper relationship haha dont' worry.. this one is going to last forever.. honesty and trust and all that good stuff dancin5hr.gif basically because we understand how hard it was to be together..yes, we may argue every now and then, but that's it.. I think everyone should have this kind of "journey" of being separated and trying to get back together.. then they will understand the meaning of truly being in love.. a lot of people get divorces mainly out of politics or money or whatnot, but don't understand something until the other person is really gone..

Our lawyer knew about it.. her reasoning was that for EP, the beneficiary will have to bring lots of documents to the interview (more than regular), and her parents don't have a lot of education, so it might confuse them with showing "this" or "that" document.. There is truth in what she says, but I think it was just an excuse.. my wife recommended this lawyer because she helped out a few people from her town before.. The lawyer is very nice and she always responds fast (even if we have questions at night, she said my wife can just call her).. but not too good with the computer.. she had problems with downloading something I sent to her through Dropbox.. so maybe that's why I think.. she might not know how to compress files and folders and that kind of stuff..

 

oh well, what's done is done.. right now it is just waiting (but waiting time I could have skipped using EP)..

yeah, this EP thing came after my time.. they started in late 2009 I believe.. so by that time my wife already came, and I took a little "retirement" off of the visa stuff.. yeah, this time we hired a lawyer to do this for her parents (which I could have done blindfolded) and cost us some time because the lawyer made some mistakes too (we got RFE because our forms was a old form - I saw you and others getting that too during the interview.. saying the I-864 was out of date.. Also, we got another RFE before that because the lawyer didn't fill in the $0 dollar amount for our bank account stuff for I-864.. we had over $100k in salaries alone, so I thought it wasn't necessary they look at bank accounts stuff.. I checked last time too, and we didn't fill out that line and it passed.. guess we just got a strict person looking over our application.. anyway, I learned about the EP when all these mistakes were made by the lawyer.. so I went back to "detective" mode again.. but that was when I asked you and you said it didn't matter anymore (based on the timeframe between regular vs EP).. so here I am again waiting for them to receive our case... so yeah, I was "sleeping under a rock" lately.. but I'm back at it since lawyers are stupid.. I didn't even make that many mistakes back then..

yeah, I know.. is everything slower now? I saw from other I-130s that it may take over a year now to process.. this one seems to have a delay too.. at the rate they are going (by my posting everyday), it is having a big delay now.. as of 10/18, they are doing 8/2.. even now, after 6 days, they are supposedly doing the same.. I'm also including a wider range now in my daily posting in case some files do have a delay and mess up my estimate..

 

it is another 38 days (again) for me.. estimate went from end of November (November 25) to beginning of December (December 1 now).. at this rate, they will START WORKING on my case in January now , instead of giving me an interview..

yes, you are 17 days ahead of me.. looks like a early to mid February for you.. mine took 15 days.. but that didn't include the week off from the China National Holiday.. so yours should arrive soon..

 

I'll watch the DHL every day (I did this past weekend and no movement, still don't know if there is any movement during the weekends.. will have to check this one) and post the oldest date I see..

Yeah zhaozi, I'm doing it for my case everyday.. basically the cases from 8/2 are still in DHL.. that's how long you have to wait until they start working on your case.. then add 1 1/2 months until interview ..

 

has yours been delivered already? or under custom clearance?

 

Mine was sent 9/9, and delivered 9/24.. like I said before.. I'm basing the DHL tracking off of the "NVC Sent" date letter..

I think it just means they started working on it.. received by consulate officially (not just arrived at DHL warehouse).. my case got there Sep 24 (from Sep 9, that is the date on the email NVC sent me saying they delivered the case to Guangzhou..already a long time) and is just sitting there.. I'm just experimenting on what I think it means.. take a look at my signature for estimates..

 

basically they will start to work on it (2-3 weeks to send out appt letter + 1 month from letter to interview).. so add +1 1/2 months from the "estimate guangzhou received " date..

 

what does your tracking say? when was the date you receive in the letter from NVC stating they had sent it? (I'm basing it on that)..

 

Example for mine

NVC Letter Date : 9/9/13

Estimate time to "Receive" date : 38 days (as of today)

Estimated "Receive" date : Today (10/18) + 38 days => 11/25/13

11/25/13 + 45 days => 1/9/2014

 

and of course things will change everyday.. for every day that goes past, they should finish a day, right? hopefully that's true.. or maybe even faster..

 

so my original estimate went from 1/15/14 to 1/9/14 now.. still a long ways away ClockWatch2.gif
