IR-1 / CR-1 Spouse Visa Process & Procedures	More than six months no decision.	oh, sorry.. just had lunch.. you give them your info on BOTH PEOPLE : 1) FIRST NAME + LAST NAME 2) A # if you have both, but probably just the US Citizen 3) Case Number 4) Email addresses (both).. I put both for everything.. anything else that can help.. in China, she has a China Passport ID number.. I also put down my home phone and cell phone.. maybe it's too much, but I just want to get her here.. besides, the FBI probably has all that info already.. IR-1 / CR-1 Spouse Visa Process & Procedures	More than six months no decision.	haha, well what I write isn't.. but I know the USCIS is.. how long does it take to do a background check in the computer?.. no more than a couple of minutes if their software is up-to-date.. search "name", "ssn", and other stuff.. that is all they are basing it off anyway when you do a FOIA request.. they just want your name, fingerprints (proof of identity), and a fee.. and people in China (my wife) have their own passport too, and "huokobun" (China ID), so how hard is it??	gogo	Male	China	2009-06-09 10:53:00

Also, most FBI checks take no more than 72 hours.. it even says on their website.. so anything over a week is because USCIS is stupid and retarded.. http://www.fbi.gov/h...alnamecheck.htm Electronic ?batch? submissions are searched against the UNI. The majority of the batch names are electronically returned as ?no record? with 48-72 hours. I just wrote my whole story to them this morning.. asking if our case has another "name check" and if it was real this time.. our 2nd name check happened after the interview.. that's why we are not approved yet.. read my story for more info, but they said it was "ready to issue" but at the last moment, there was a name "hit" again.. yes, some will take more than a week.. but even with us the first time (6+ months).. from November 2007 (transfer to local office), to our local office interview (February 2008), and more.. it doesn't take that long.. give me a break.. even now we are over 2 months already.. it should be about time.. IR-1 / CR-1 Spouse Visa Process & Procedures	More than six months no decision.	background check my ####.. that's what I think.. we have been through it and if you just sit there doing nothing, they will do nothing.. 1st step - write to all (not just yours) senators, congressmen, White House, any government department relating to USCIS (FBI, Dept of Justice, Dept of State).. White House (including president, first lady, vice president, his wife, secretary of state, chief of staff, whoever you can find).. 2nd step - I got letter from FBI stating I DIDN'T have security checks on my case.. so I used that in my "writ of mandamus" lawsuit.. so you need to prepare for that too.. it is best to hire a lawyer for this part.. they will write a big package stating everything.. and the USCIS will get 30 days (with 30 days extension), a total of 60 days to respond with answer.. the lawsuit isn't for money, just to force them to give answer.. we got approved on the 58th day last time and we plan on doing it again.. we have been through a lot more than others.. the different types of stuff they can throw at you.. IR-1 / CR-1 Spouse Visa Process & Procedures	USCIS Contacts	Sorry, I haven't been on the forum this last month (August) because I went to China to pick her up.. we also had problems at the LAX (entry point) too.. they told her that she had a "lookup" and had to go into the little room where they ask you questions (inadmissibility review).. so I sat far away waiting for her, and finally they told her everything was ok.. she said they made a phone call and let her pass.. we were worried because I saw others who were being interview for over 2-3 hours.. so we had our share of problems even until the end.. I would be super pissed off if she couldn't enter America when she even got off the plane here.. Here is something to help all the people who are having problems.. IR-1 / CR-1 Spouse Visa Process & Procedures	Suing USCIS with WOM for I-130 (19 mo delay)	once you file the lawsuit (well, not lawsuit yet, just federal complaint), they get 30 days to respond to your letter (with an additional 30 days extra if they want to, but only one extension, for a total of 60 days).. if they don't answer within these 60 days, then it goes to court, and most of the time the judge will be on your side.. they don't like hearing cases over and over again on USCIS's delays.. Anyway, we got approved on the 58th day out of 60.. since you went with a lawyer too, your lawyer should be getting the approval letter soon.. Also, I had a letter from the FBI stating I wasn't under any security checks, so that helped too =0 maybe I didn't tell you that, sorry.. Currently, I'm under AP (name checks again) from what we know based off of her interview and my ACHs (3 times). I asked them directly why we got blue slip and if they were suspicious of our relationship (evidence of bonafide), but they said everything was good and they were "ready to issue", but her name got "checked" on in the system, so they have to do a name check.. I figure we will do the lawsuit again this time and it will work again.. that seems to be the only way if you want them to answer really fast.. on 001, other people told my wife that since our case didn't require any additional documents, it should go really fast.. (1-2 months).. so far it's been 1 month and nothing.. our lawyer said we can do another lawsuit in 30 days, but prefer 90 days.. don't know why, but they got us the approval last time too.. so I trust them more than USCIS for now.. December 2007 Received letter in mail : ATTEND LOCAL OFFICE INTERVIEW January 2008 (set for February 21, 2008) attended with parents (they were checking for fraud and asked my parents a few questions.. interview took no more than 5 minutes.. he asked them have they met the wife, her family...) he said "everything looks good and you will receive approval notice within 2-3 weeks".. called after 3 weeks time and still nothing Writ of Mandamus lawsuit (July 29, 2008, in my signature) - ending date is September 26... 4 MORE DAYS LEFT I give them their time and just call in.. now they say I am "persistent" and call too much.. well, if they got their job done, I wouldn't be calling..so it's not my fault they are slow.. I always use this analogy when talking to them : "If the workforce of the company gets paid every 2 weeks, you expect your check every 2 weeks.. how would you feel if the company said : "Oh sorry, we couldn't give you a check this week, please wait another month.." and then doing that for the next few months with the same excuse.. I really want an interview too... they say then the lawyer, USCIS's lawyer (US Attorney), and the judge sits down and if there is no agreement, then there is a full-blown court.. but the lawyer rarely (1 or 2 out of 100) does it ever get that far.. but if it does, it could go on for a few more months.. or until the jury finds them guilty.. haha.. star_smile.gif I have friends and my parents who are willing to go with me into the court and testify.. the USCIS is stupid and have no evidence against me or my wife..
