 That's true... I only used it once because my NOA1 didn't come and it was already a whole month... so I had a good reason to call (not sure if they got it or not).. but I see some of the people here are calling everyday with so many touches.. You are causing your "touches", not them... You should probably do this "RFE" trick maybe once every 2 months or 3... at least look to see if your timeframe is being processed (compare to others near approval... for example, the current "group" that are getting the approvals are in March 2007)... they should be getting their approvals in a week or two?? so if you are probably January or earlier, then it is good to call using this "trick" to see what happened..

If you can cultivate wholesome mental states prior to sleep and allow them to continue right into sleep without getting distracted, then sleep itself becomes wholesome......... ummmmmmmmmmmmmmmmmmmm........ just relax and let things come to pass... everything has its own time and place... don't worry... ummmmmmmmmmmmmmmmmmmm

we all do =) that's ok... no harm, no foul.. I meant my posts a couple of posts before that one... it explains my thoughts on their MONEY Process that they are doing... but USCIS could have earned a lot more.. I think that they could earn more if they enable the option of "Expedited" for K3 / I-130 people.. they could charge 10x , and I'll still pay  it's worth it for 1-month approval time so I can see her soon.. :crying::crying::crying::crying: as you can see from my first "estimate" , now there is a 2-month delay (so far) with our visas... what is going on?? it's not like we will pay for the extra people hired.. they could do a lot with the extra money from the 10x "expedited" cases..

hi Pkewl,

haha, I guess you didn't read what I posted... it's all about the MONEY to them... we are worth less (1 K3 < 1 K1 < 1 I-129 Temporary Worker) in terms of speed and money collected.. will you rather collect $200 for something done in 1 day, or something done in 1 month?... that is the difference between K3 vs K1,I-129 (Temp Worker)... they have to do background checks on us, check our marriage to see if it real (please... theirs are probably not real).. this goes with a Chinese proverb I been taught... "don't bend over in someone else's garden"... you will seem like a thief to them.. even though you are doing nothing, probably just tying your shoes... they think you are stealing their food...

Currently, with the new fees:

I-129 (Temporary Workers ) -- $320 + supplemental fees + fraud prevention fees
I-129F (K1) -- $455
I-129F (K3) -- $0
I-130 (CR1/IR) -- $355

I-130 may is a little more expensive than I-129, but they don't need as many "checks" and fill out as many forms as I-130, so overall I-130 costs MORE to USCIS to process (less revenue for them per person).. they will be able to process the H1, H2B visas faster than us.. the I-129 Temporary so we are still at the bottom of the pile =( :crying: :crying: :crying: :crying: which will you rather have if you were USCIS? (someone that processes in 1 day, or process in 1 month time?) I don't have exact times for each, just using a hypothetical example..

yep, that's what I was saying... we are still "WORTH LESS" to the USCIS than those with K1 , and those especially of Temporary Workers (do they need to have time spent looking at their marriage certificate, and marriage history/work history? background checks are the same I would think... also, we have to fill out all those extra forms, so it slows us down even more)... as long as the company can support them, they can be approved very fast.. which would you rather have.. someone that can be approved in a couple of hours (just guessing, Temporary Workers), to someone that takes a couple of months to investigate on (us, K3 and I-130 people)...

it's because the K1 filing fee is $455 (old) and the K3 filing fee was ($170) , I-130 ($190)... the new fees are that the K1 stays the same at $455, while the I-130 is $355... so we still lose out to K-1 as well as the Temporary Workers.. :crying: :crying: :crying: :crying: nothing has changed and will change for us.. We are the ones that are doing it "by the book".. K1 is uncertain because they can just divorce quickly and run away and still stay in the US... Temporary workers aren't permanent.. I don't get what the government is trying to do.. the government is a big meanie ....... booooooooooooooooooooooooooooooo

I know, it's not like we ARE NOT willing to pay higher amounts than them.. The USCIS is just doing it for money... well, why don't they charge $1,000 per person then? That way, we will get higher priority

it's because they have to look at more "stuff" on a K3 vs K1.. bona-fide relationship stuff (they probably added just to slow us down).. and other things as well (verify marriage certificate)...

you can tell government is not responsible by just looking at their budget  that's why they don't care about money, because they keep going into more and more debt every year.. if they are in debt, there's no need to worry about anything else..

$10,000... you used to be able to buy 10,000 whoppers with that.. if a (USCIS) person eats 2 whoppers a day, that is only 730 whoppers per year.. you can feed almost 14 USCIS people for a whole year.. :D

maybe we should send them a letter to "increase" the fees for I-130 and I-129F, at least higher than the H2-B Temporary workers.. so it will be more "benefit" to USCIS as well as to us.. I rather pay more than the H2-B workers, so we can get our applications looked at first.. :P

if they want to make money.. why don't they just charge $3,000 per application (vs the $300 you get for H2-B workers, and the $190 for I-130)... most of us are willing to pay that amount just to have approval times within 1 month.. I can give them 10 H2-B workers money right now if they are willing to go within 1 month approval time..

I know.. not to be bad, but if VSC can approve so fast, why don't they take some of the workload for those kind of applications? They should make a similar processing time for all these immigration visas.. but then they are probably being doing the temporary workers visas... they will increase over time and will cause the immigrant visa to slow down even more.. it doesn't matter if they increase and hire more people.. The time ratio will increase..

so why don't they just charge us 5-10x as much as they do now? I am willing to pay $3,000 or more to have my application approved within a month.. I'll pay more than those Temporary Worker Visas for sure..

Filing fee for H2B Visa : $340 (Premium $1340)

That would be 10 Temporary Worker Visas to them.. maybe they can do the math and see that it's faster to process mine at $3,000... or maybe they aren't good at counting too?

You count the time when the CSC (or VSC) office "receives".. I guess it is that way for now.. it's not the date when they "transfer" over, but the date when they received..

I'm far from that right now, but this is what I have planned :

1) 6 months paycheck stubs (work for the government, so has all deductions/payments/taxes on it, Year To Date)
2) 1 Bank Statement from 7/31/07 (Snapshot summary) stating more money I have that can be used for requirements
3) 1 Year File Tax (is 1 year enough? I thought that would just look at the most recent year)

Not yet, but thinking about...
4) letter from employer stating your salary, Job title, # of years worked, their signature (and a higher level signature too)

K-3 Spouse Visa Process & Proceduresanother 6 weeks for me =(
I just called USCIS again just now before my China trip for 3 weeks to visit her.. I will be leaving tomorrow (Friday) night.. the USCIS person said that it will take about another 6 weeks (rough estimate) just to start "processing" my case.. I said I was going on a trip soon and wanted to know if I am getting a RFE.. I just wanted to be prepared and do something before going on the trip... well, in any case they said it will be another 6 weeks... crying.gif crying.gif crying.gif crying.gif I told them that I also filed the I-129F (but in June due to their computer problem in April).. she said that they will process both of them at about 6 weeks time.. so the timeframe is based on the I-130's time.. but one thing that bothers me is that she said my date is "April 27" date (ONLINE STATUS), and not the "April 16" (application received at USCIS)... that's another 2 weeks lost right there... man.. this is getting to be too long for us..

165 days + 6 weeks (42 days) ==> 207 days???

K-3 Spouse Visa Process & ProceduresCall In if over 180 days =)
Hi Everyone:

I called in 10/15 and 10/16 (both touches by me) and said it was over 180 days on my app... then it also got touched 10/17 (checked with my wife to see if I went crazy or not and called 10/17, but I didn't).. the first person on 10/15 didn't help much, but the person on 10/16 said they will send an email to the "officers" to look at my case... hopefully it will get approved in a week?? whistling.gif I'm also going to check tomorrow to see if there is another touch... yay.. at least now it's moving along..

just keep bugging them everyday after the 180... tell them it's over 180 and send an email to the "officers" to take a look at your case..

Thanks guys... happy 7 month anniversary My Honey!!! kicking.gif kicking.gif Hope we all get our approvals soon.. I think they are doing the RFEs on purpose, as to delay some of the processing due to too many applications.. Many of you guys said that the RFEs don't make any sense.. especially if you have the I-130 already approved, and the I-129F gets an RFE... I just hope that I get approved without any problems.. we will see soon enough.. still checking today on the USCIS website..
