Thank you so much. Visa Journey has been such a great support system. I am sure you will get  your approval soon as well. I actually called them 3 times yesterday. I am wondering if that helped. We still have  more to do but I am glad we got over the first step in this horrible process.

You are so right, it takes a special kind of strength and love to endure this process. I have no words about your husband missing the birth of his child, it makes me want to cry, honestly. No man should miss that special moment! We're all going to reach the finish line and we're all going to celebrate and enjoy our families for the rest of our lives!

I know exactly how you feel.. I am in the same situation as you...It's so frustrating especially I've seen October filers getting approved from CSC recently.
I really think USCIS should work on files according to their priority dates...
My husband used to try to calm me down about this whole long wait, but now he is even so stressed out and frustrated...
I hope we both will get approved soon... Let's cross our fingers and pray for a miracle to happen to us next week...


 

 

Thank you so much for your kind words. I swear I never want to deal with immigration after this is over. If I would have known the process would be like this I would have chosen another way. Me and my husband just had a new baby last month. It was so messed up my husband could not be with me to see his new child being born.  If you are not a strong person, this process with USCIS can give a weak person a damn nervous breakdown. If you don't believe in God you better find a damn good substitute. What makes me angry is its getting close to 7 months since our case was received and it still has not even been looked at. If there is a RFE required then the process will take longer. I am so disgusted with my country I honestly don't know what to say.

My case was transferred to CSC on 3/3. My case has not been touched since 3/6. If they were not going to work on it why transfer? This is really getting on my nerves.

We had the same message last night, my husband called up USCIS to find out where our case has gone, we are at California. :)

Can you please tell me how you contacted your Senator and what you said to get them to help you? We we're check listed for a UAE police certificate, which they received 15 Aug but my file arrived at NVC 4 April 2014 and now I am getting tired of the continued 60 day wait. Any help would be appreciated.

I am so sorry you are going though this. I went on my Senator's website.  My Senator reaches out to her constituents and explained that she could help us get through government red tape. I filled out a form she asked for giving her permission to research my case. I also sent her a copy of the 60 days letter we received from NVC and I also wrote a long letter. Explained to her that I felt that US citizens were being treated unfairly and we have priority over other petitioners. I felt that DACA hurt US citizens in this process. I explained I have not seen my husband since last July and he could not be here to see his first child born. It was personal at the same time political. It really depends on your Senator.  I hope this helps.

I received a letter from my US Senator Barbara Mikulski  It reads:

 

Dear Mrs Hampton

 

Thank you for contacting my office and giving me the opportunity to assist you. My staff and I will do our best to help you resolve your problem.  I have been in touch with the National Visa Center and have asked that this matter be attended to promptly. I will get back to you as soon as I receive a response to my inquiry.

 

 

Thanks to my Senator my case was closed Fri. I received a checklist for the Russian police certificate. The same day they received it my case was closed. I did not have to wait. I thank Senator Mikulski for all her help.

Does he make enough above the poverty guideline to self- sponsor? That is an option.

 

The AP you are in will be like that until your return the necessary paperwork for the Affidavit of support and also get the DNA test. Don;t lose hope now. I know this is a stomach punch but tomorrow is a new day and clearer heads will prevail.

 

He does not have a contract right now. So he does not make enough. I will get it together and try to make this work. I will keep you guys informed. Thanks again.

Oh no Monalisa! I am so very sorry.  Unfortunately, it is like DSWheels said Africa (as a whole) is very different.  They require much more than just NCV. NVC wouldn't require a co-sponsor, but most African embassies look at more than just the current year. DNA test is normal as well.  Please don't get downhearted, because at least they did not say no.  I know you have been waiting a while, but hang in there.Sending prayers and endurance your way.

I appreciate the kind words and support. But honestly my husband plays pro soccer. This process has delayed his career. We cannot wait any longer. We will just have to live outside the US. I cannot endure this process anymore. They also are saying pending administrative processing. More problems to come.

I am so sorry to hear of your delay. But that's all it is. All NVC looks at is current and you made enough. All African embassies I know look at previous year and current. So sorry you didn't know. Sorry to hear about the delay but hurry and get that done The DNA will take about 3 months to complete and get results in and get you back to embassy so you have a little time to find a co-sponsor.

Sorry to hear that, But I think NVC should have said it before they sent you for the interview? If you make enough according to the poverty guidelines than it shouldn't be any issue. How did NVC didn't say anything?

 

I guess every consular views the data differently. I was not even told a DNA would be needed as well.

Our interview was a disaster. My husband was told we need a co sponsor. I didnt make enough money last year but I make more than enough this year. I provided current paysubs and bank statements. They did not even consider current income. I also have to do a DNA test on our son. I don't care abou the DNA test. I wish NVC would have let me know a co-sponsor would be needed.

This is so outrageous that USCIS can do this without any explanation. 

Only government can get away with this kind of ####### because they know

we are at their mercy. 

 

Unlike NVC, I have been able to talk to USCIS staff when I call, 

have you tried to escalate your call to the level 2 staff?

I can totally sympathize with what you are going through. 

 

We are stuck on getting Russian police certificate too, which supposedly

can take about 4 months...and  Russian embassy do not provide

any type of status and you can't even call to check.

 

Basically, my fiancee has to travel about 1 hour to the embassy,

waiting in long line, only to be told nothing came in,

so she has to repeat this every week...killing 1/2 day of work each time.

How is it taking you 4 months to get a Russian police certificate. It only took my husband 3 weeks to get it. That does not sound right.

Well the thing is about lawyers (and no law school isn't a rip off) they are going to law school to learn law not forms or how to put your love letters together. Nothing we are doing needs legal representation. Honestly most these lawyers are guessing and probably reading Visajourney themselves to know what the heck is going on.

 

Lawyers don't do forms. There is no course in law school how to fill out forms of any kind. That's for legal assistance and paralegals to do. When you need to be represented in court or at a Embassy or consulate or iIf the law is broken than yes by all means get a lawyer.

 

People are hiring lawyers for things they aren't trained or knowledgeable in. How is a lawyer going to know the vast difference in Embassies of Nigeria, Morocco, Egypt, Pakistan Philippines (to name a few) compared to UK or Canada.

 

Law school is a rip off. So many graduates cannot even find real jobs in the field anymore and wind up stuck with over a 100k in debt. What the heck you mean they don't know how to fill out forms? With all the education they received they should be able to fill out forms which is not freaking complicated. Immigration lawyers are advertising they can assist with the process. What the heck are people paying all those attorneys for?  That means their education was a waste of damn money. This is the most idiotic thing I've heard.

I am so blessed to have a awesome US Senator Barbara Miluski from MD. Her office contacted NVC and helped me get my case closed much faster. I even had a checklist for a Russian police certificate. The day NVC received the police certificate my case was closed. My interview is scheduled for 10/7. What I have learned during this process, lawyers are a big waste of money. Most of them are incompetent.  Law school is a rip off.  Visa Journey and other websites were more helpful. My advice is to reach out in every way possible to whoever you feel would help you get through this process.Its your marriage. It's your life.

   IT IS LIKELY TO HAPPEN!  It has been happening for four years now.  ICE knows where she is, has her address, has her email address, and her phone number, but still she remains in the USA with her current government employee boyfriend.

Yes that has been the case. But trust and believe new laws and coming to crackdown on illegal immigration. Americans are tired of people abusing the system.

Deportation is extremely unlikely no matter what the outcome of withdrawing the AOS.

 

A k-1 visa applicant can come to the US, never get married, never adjust status, and remain in the US for the rest of his/her life.

That's not likely to happen. The person will eventually get deported.
