well if you are loaded and can spend few thousand dollars to flight there then go ahead, but I've seen consular and uscis instructions saying that only beneficiary is allowed on interview so petitioner presence is unnecessary unless of cause you have a very tricky case with high chance of denial or maybe consular is in the country with higher chance of fraud, and no need to explain to them why you are not there, they understand the distance factor

This is dangerous and irresponsible advice.

There is a difference between being allowed in the actual interview and the positive effect (in the consul's mind and in your beneficiary's confidence level) of being on the consular premises.

Just because the petitioner might not be allowed in the INTERVIEW does not negate the benefit of BEING ON THE PREMISES.

As stated earlier, countless borderline interviews have been turned into positive interviews, and negative-looking interviews have been given a fighting chance, precisely because the petitioner was ON THE PREMISES. We will never know the exact number, because the consuls usually won't say, but it happens. Read the embassy reviews and anecdotal experiences from members.

Please refrain from offering faulty reasoning and exceptionally damaging advice. People in this forum are early in the process and can fall for inaccurate claims.

It still scores points if the petitioner is "on the consular premises" -- in the waiting area or even outside on the grounds. If the beneficiary walks in to the interview and hands the petitioner's U.S. passport to the consul, it can turn a borderline interview into a success or convert a weak case into a fighting chance.

And, it could lead to the petitioner's being invited into the interview itself.

Yes, you can both attend the interview. The visa can be approved without the petitioner being at the interview, but most of the time they strongly recommend they are both there. It definitely looks better for you if you make the effort to be there. If the petitioner is not able to attend, it's a good idea to write a letter explaining why he/she is not there.

The only ticket that you should think about buying is the one that gets YOU into Guayaquil at least a day before her visa interview, whenever that will be.

If you're not there at the interview, she may not stand a prayer of being granted a visa.

Meanwhile, collect copious evidence of your bona fide relationship, and hope that it will be accepted when you BOTH appear at the consulate.

The visa interview is for her. In general, it's encouraged (and, in some places, crucial) that the petitioner be on the consular premises when the interview is to be conducted. Conduct a background check on yourself. See who the database shows is living in your home. See who it shows is sharing assets or debts with you. If the DB is wrong, point that out in your filing.

How does one attain access to the contents of the database -- FOIA request? Other? What if items in the database are "classified" or are otherwise ineligible for release?

I can't help you directly, but someone familiar with recent Ecuador processes should be along. Until then:

-- Have you contacted the consulate at IVGuayaquil@state.gov to explain the situation and to get advice? They typically respond within 72 hours (holidays excluded) when they're not refusing visas for spurious reasons.

-- If you're not in Guayaquil yourself, could someone do it for you?

-- If you are in Guayaquil, try asking another policeman or other authority.

*** Edited to add: It will be a while from now, but are you fully aware that the petitioner must be present at the K-1 interview, or else there's a >95% chance that the visa will be refused?

The petition has been reaffirmed, seemingly on the same day that USCIS received it (!). It's being sent back to the embassy. Expect anything from a pro forma interview (she shows up there, they grunt "we're granting your visa," she waits for it, and she's on her way) to a full repeat interview. Something in between, but closer to the former, is probably more likely.

After reading a few forums I noticed that after aos the green card comes next. Shouldn't that be enought for her to go back and forth as she pleases as long as she has the Greene card? Or even with a green card she will need to fill out forms to go on vacation?

I hope that your attorney told you that YOU, the petitioner, had better be in Guayaquil and on the consular premises during your fiancee's interview. I hope that he told you to be in Guayaquil a full 24 hours before the scheduled interview day & time, because of the monkeyshines that the consulate pulls. I hope that he had you front-load the holy hell out of your I-129F petition -- and, if he did not, that he has told you to bring the kitchen sink's worth of "evidence of bona fide relationship" to the interview in the hope that it will be accepted at that time.

If he did none of these things, and if you receive a 221g or an outright refusal from the consulate, report him to the Bar association for negligence.

Almost all of us here have sent money to our fiancé's abroad and most guides talk about sending in money remittences as evidence of a relationship.

Maybe as pertains to the Philippines, where the beneficiaries typically seem to expect American money (and sometimes -- or often -- demand it).

I struggle to see how that could possibly be seen as a red flag. Since the point of the I-34 is to show that you are capable of supporting your fiancé when he/she comes over, how is starting to help support them before they get here a bad thing? Someone explain how that can be a red flag.

An earlier poster pointed out that some recipients of the money are scammers who are building a bank account at home for themselves or their families. This could be a factor in desperately poor countries.

Also, in some countries, the beneficiaries are too principled or proud to accept donations, except perhaps as a birthday or other occasional gift. This could be a factor in a CO's analysis.

I highly recommend getting an original letter from your supervisor, on company letterhead, in which he states the exact date when you're expected to be back at work (ideally, a day or two after your return flight).
