K-1 Fiance(e) Visa Process & ProceduresRequirement For POE

I plan on heading North on I-45 to Dallas, then North on I-287 to cut accross to I-40 and then head West. Then North on I-93 into Vegas, then later I-15 South into LA.

In 2003, while still single, I took a getaway vacation -- flew into Amarillo, took U.S. 287 to Dumas and U.S 87 west through Dalhart to Clayton, NM (overnight), then east directly through the Oklahoma panhandle to the next civilization (plus many bored constables) in Guymon, then south on U.S. 83 all the way to Childress and back up 287 to Amarillo. Except for the bored constables and a displeased cat when I got home, very relaxing.

Apologies about the timeline but I have my reasons.

Respected, si man.

We plan on doing lot's of sight seeing before little Gowons come into our lives.

This is some of the sagest wisdom ever, si man. I wouldn't trade little Mini-Bone (now 19 mo. old) for anything, no man, but children will absolutely change your schedule, sigh man.

I've only been to California, Arizona, New Mexico, Nevada, Colorado and Texas. This is a crying shame.

You could have done far worse, si man. In fact, if you're flexible on your route, very strongly consider taking I-10 or U.S. 90 west through San Antonio to Uvalde, then head north on U.S. 83. Garner State Park, the Frio River, et al. are so beautiful in non-winter that they sincerely defy description. She'll love it, guaranteed. If you can't do it now, you must take this trip sometime in your lives, si man.

K-1 Fiance(e) Visa Process & ProceduresRequirement For POE
Good idea, si man.

There will be at least one inland CBP checkpoint, outside El Paso (if you're taking I-10). If you're a trucker, you're familiar with it. This shouldn't be a problem, because her I-94 will be quite fresh.

If you detour south, however, watch out for the checkpoint south of Alpine, Texas. Their attitudes and actions lend intensity to the term "De-Constitutionalized Zone," sigh man.

The VJ member luckytxn is also a trucker, si man, but he has become inactive on VJ recently, sigh man. Maybe shoot him a PM and get acquainted.

Edited to add: Where's your timeline, huh man?

K-1 Fiance(e) Visa Process & Proceduresis my fiance a fraud?

A system of questions and answer helps to rationalize things the heart cant see sometimes allowing us to proceed in a more decisive fashion.

You're exactly right: we get more advice on how to buy a car or a washing machine than we do on how to pick a mate. It's a bit more helpful during the screening process than during "damage control," but at least the OP has time to rectify any mistakes before more are made. And your correctness here doesn't change the reality that your earlier statement about the purpose for the K-1 (also said before, by many) has been regularly debunked. The purpose of VJ is to provide accurate information. Consider being happy for the OP that people are trying to quell inaccuracies while advice is being presented.

K-1 Fiance(e) Visa Process & Proceduresis my fiance a fraud?

if all these answer are negative then i say go ahead and cancel the petition.

One of the biggest contributing factors to busted relationships is when one partner ignores even one element of the relationship that causes that person to compromise his principles, character, or integrity. A dozen or more factors can be highly positive... but if just one integral characteristic of the relationship is something that one partner can't compromise on, the relationship isn't right.

If you however can get some positive answer to these i say let him come and you have 90 days to see if he is genuine or not.

Nothing personal, but this advice has been regularly debunked. The K-1 is not a "check the other person out to see if he/she is real or right for me" visa. The petitioner and beneficiary have committed via letters of intent that they WILL marry within 90 days of the beneficiary's entry. The relationship is supposed to be "bona fide" already.

We probably have enough beneficiaries using the K-1 (and the petitioner) as a vehicle to get into the U.S., bail, and disappear.

K-1 Fiance(e) Visa Process & Proceduresis my fiance a fraud?
I've read this entire thread and the one from 2009, for which QS so helpfully provided the link. (I vaguely remember that thread, from that time.)

OP, from the details in your opening post, his behavior is indeed of concern. However, an even bigger alarm is this: who would apply for so many tourist visas -- and keep applying and applying and applying -- without having very serious immigrant intent? Most people would give up after a couple of denials, three at most -- but he persisted.

I'd bet real money that if he came to the U.S. on the K-1, he'd either bail on you immediately or after he got his green card.

Only you know all the details, but from what you said, there's better than a 50% chance that you're merely his vehicle into the U.S. (in my opinion).

Your intuition caused you to express your concerns here. In addition, your sister is alarmed.

For withdrawal, follow the procedures in the 2009 thread. Keep us apprised, and keep the faith, si man.

K-1 Fiance(e) Visa Process & ProceduresUpdating with the USCIS During the Petition Phase
When you filed the petition, it was presumably accurate and up-to-date as of when you filed it. You couldn't report (or be expected to report) something that hadn't happened yet, and there's no need to report it now. :)

K-1 Fiance(e) Visa Process & ProceduresK1 denied-determined circumvent us immig law
Before you do anything else, it's crucial that you learn the precise reasons for the refusal and overcome those reasons. It could be that the beneficiary is permanently ineligible to immigrate to the U.S. under any circumstances. Find out everything before jumping into something.

It's not clear from your post, but did you two meet in person? You mention pictures that were submitted as proof, but were there any documents that showed actual travel such as passport stamps, receipts, etc.?

Good points, but the OP was definitely past the petition phase, because his visa was refused after the 2-hour interview (as I read the post).

K-1 Fiance(e) Visa Process & Proceduresadjustment of status question

This gets asked often. There is no deadline for filing AOS but you should do so as soon as possible. The foreign spouse will be out of status when the I-94 expires and they cannot work, go to school, get a license or travel outside the US and re-enter without their EAD/AP or green card.

Very true, si man. Also, if you plan to drive within 100 miles of either U.S. border, you do NOT want to be out of status. The CBP agents at their inland checkpoints lack a sense of humor and are usually looking to nail somebody.

It's best to apply for AOS as soon as you have the marriage certificate in hand. Order more than one copy of it, because you'll probably need another at some point.

K-1 Fiance(e) Visa Process & ProceduresAOS pending decision
[If you need to separate physically to meet your state's requirements for filing for divorce (for example), that's separate from USCIS processes. If I were you, I'd take a copy of the letter that you sent, set an InfoPass appointment, and show it to the officer in person. This will ensure that it's entered in the databases where it needs to be entered -- or confirm that it has been entered -- and you'll be off the hook as far as USCIS is concerned. What happens between you and your soon-to-be-Ex is then between you and her.

K-1 Fiance(e) Visa Process & ProceduresProof of ongoing relationship?

Perhaps I will just pay her another visit between the I-129 filing date and her interview to solidify our case.

This is smartest -- collect lots of evidence then. Also, being on the consular premises (whether you're allowed in the interview or not) ALWAYS helps and NEVER hurts. Hand your U.S. passport to your fiancee to show the CO, to prove your presence.

K-1 Fiance(e) Visa Process & ProceduresProof of ongoing relationship?
Moved from K-1 Process to Latin American subforum -- questions are specific as OP looks ahead to interview at Bogota.

---

OP, it's unclear whether you want to "front-load" your I-129F petition with the cited items, or if you plan to have your fiancee bring them to the embassy interview (it appears that this is it). In either event, your questions can be meaningfully and most promptly answered by the Colombia filers in the Latin American subforum.

K-1 Fiance(e) Visa Process & ProceduresLetters for k-1 visa petition

The letters are best when written from the heart, they can state when they met them and what they think and feel about the relationship.

If letters are to be written, this is good advice. Just avoid going overboard in length or sappiness.
TBoneTXMaleEcuador2012-09-02 23:53:00
K-1 Fiance(e) Visa Process & ProceduresLetters for k-1 visa petition

Should I have my family and friends sign letters saying my relationship is legitimate, and put them together in the K-1 Visa package? If so does anyone have any examples that I can see?

This action ("front-loading" the petition package so that crucial information gets to the consulate) depends on several factors: how many visits and how much "face time" you've had with the beneficiary; how tough your consulate is; and the track record of others -- who have gone through your same consulate -- who have or haven't done this.

If you proceed, I wouldn't overdo it: perhaps 2 or 3 letters (for example, from your parents, minister, and someone with objective standing in your community) should more than suffice. Do not include anything from the beneficiary's side at this stage.

This sort of front-loading of the USCIS petition would NOT prove to be necessary at many consulates once the petition is forwarded there. Be aware, too, that some consulates expect (or will later insist upon) a detailed "relationship timeline."

1. Scope your regional forum for information about YOUR consulate.
2. Wait for the knowledgeable replies sure to come from experienced members -- pushbrk and Darnell are just two who bless VJ with insights about Guangzhou.

If any prospective Ecuador filers read this, I recommend front-loading the USCIS petition in this way, to perhaps avoid a Stokes interview later.

K-1 Fiance(e) Visa Process & ProceduresK1 Visa with a substantial age difference

In MENA countries a larger age gap will often invite more scrutiny than in other parts of the world. And it seems that when the USC petitioner is a female and older it's even truer.

OP, do some reading in the regional forum to learn from other members who have married younger men in the region.

This is the answer in this thread to pay the most attention to. As a gentle general reminder, what happens at the Manila embassy does NOT automatically happen elsewhere.

and the truth comes out. You are intentionally assisting a foreigner to commit immigration fraud. How do you expect to be approved?

Si, man. Another way to look at it is that this woman is essentially unavailable to you -- situationally (perhaps still married) and legally (perhaps facing a lifetime ban).

If I were in your shoes and had learned even part of what you have learned, I'd have extricated myself from the entanglement as a priority, cut off all contact, and run in the opposite direction with a feeling of relief. You're in pretty deep dog-doo already; perhaps your first question to any immigration attorney should not be "How can I salvage this seemingly unpetitionable relationship" but "What kind of trouble am **I** in?"

K-1 Fiance(e) Visa Process & ProceduresWhether to include western union receipts in evidence of relationship
I disagree wholeheartedly with the previous respondents. Including money-sending receipts can backfire. The CO at the visa interview can accuse either party of "buying" the relationship. The receipts open cans of worms that are best left sealed.

Receipts like that aren't primary evidence of meeting (for the I-129F petition) or good evidence of bona fide relationship (for the visa interview).

If you're that fond of the receipts, take them with you to the consular interview, but avoid producing them unless you're directly asked.

K-1 Fiance(e) Visa Process & ProceduresHow reliable is DOS?

Kiev typically takes 2-3 weeks to update their system when they receive a file from NVC. They do not do the Packet 3 return thing but it seems the consulates that do typically take a couple weeks to update. I would say it is normal.

Si, man. During our dealings with the consulate, a sharp immigration attorney told me that the consulate will ALWAYS have fresher information than DOS will. The best situation is that DOS would have the same information as the consulate, but DOS will never have more.
