K-1 Fiance(e) Visa Process & ProceduresK-1 petition denied

this is just not right!

Gary's post (#50, just a couple above yours) adds some crucial context to the seemingly not-right quote.

At any rate, the OP has the firm answer to refile.

K-1 Fiance(e) Visa Process & ProceduresDeferment of K1 Visa?
I forgot to add above that if the visa is granted, an option is to ask that it be issued at a later date. It's not cast in stone that the visa has to be issued immediately upon approval.

K-1 Fiance(e) Visa Process & ProceduresDeferment of K1 Visa?

Is there a formal process for this extension? A normal path to be taken? Or do I just email them? And would it be wise to alert them of the situation now, or should I wait until the k1 visa is in her hands?

Sorry about the situation. Prayers.

Never presume issuance of a visa. You have no timeline and don't indicate the country, but if she's put into AP (administrative processing) for any reason, you'd have an indeterminate amount of extra time.

If the visa is granted and its period of validity is approaching expiration, then contact the consulate to explain and to ask for an extension. Don't wait till the VERY end of the validity. If the visa is good for the typical 6 months, see how things look at 4.5 months, then proceed.

K-1 Fiance(e) Visa Process & ProceduresAssembling I-129F. How's it looking?
If you send a receipt for a wedding band, your I-129F petition might not even make it out of USCIS. The I-129F is for fiance/es only. Avoid giving the impression that you're married!

Idea: I would include a detailed relationship timeline, addressed, in big bold letters, TO THE GUAYAQUIL CONSULATE. Do a detailed, objective story of all of your trips and activities, with dates or date ranges, concentrating on the time that you spent together. Rather than sending a bunch of photos randomly, why not intersperse within your timeline? They'll be more meaningful that way. If you have some left over, include them at the end, taped 2 or 4 to a page with a header of "Additional Photos as Evidence of Bona Fide Relationship." Put one-line captions beneath each.

You might search the Vietnam regional subforum for tips on how to construct a meaningful relationship timeline -- those filers have to do it all the time. If you don't see anything obvious, post a message there with the title "Ecuador filer wants to construct Relationship Timeline - help please." People will respond.

In regard to assembling the package, don't staple anything. Leave pages loose or held together with a very few binder clips. USCIS will organize things in its preferred way.

In your cover letter to USCIS, you can list your enclosures. Put a big bold statement in there that the extra materials MUST go to the Guayaquil consulate upon approval of the petition.

You're a very smart lady to know that you need to front-load any petition that will end up in Guayaquil -- and very lucky that you have the chance to do it.

EDITED TO ADD: Sometime soon, go into your VJ Timeline and change the consulate from Quito to Guayaquil. Captain Ewok was kind enough to correctly add Guayaquil as a choice awhile back. I'm working with him to eliminate Quito altogether and to merge the ratings of the two places under just Guayaquil.

K-1 Fiance(e) Visa Process & ProceduresI was just curious about when giving things at ur interview..
Make at least one other copy -- you should have one for the petitioner, one for the beneficiary, at least one for safekeeping in your home files.

The consulate won't want another copy of the package that they already have. However, they might ask for the original versions of certain official documents (marriage/divorce certificates, for example) if copies of those things were sent to USCIS with the petition. It's good to bring everything that you can -- better to have it and not need it than to not have it and get a 221g because you can't provide something that the consul asks to see.

K-1 Fiance(e) Visa Process & ProceduresI was just curious about when giving things at ur interview..
It's very wise for the beneficiary to have a complete copy of the petition package in hand -- well before the interview, for study and review purposes.

It's good to have the packet at the interview in case something is asked.

It's best to have originals of important documents -- birth certificates, divorce certificates, etc. -- to provide for the consul to look at. The originals are not kept; sometimes, the consul may make a photocopy of it there and return the original to the beneficiary.

Both the beneficiary and the petitioner should retain complete copies of everything that is ever submitted to USCIS or the consulate. After naturalization (citizenship), you can hold a ceremonial bonfire of all that paperwork.

Doesn't seem very fun... Just read your entire signature.

It was hell. Others around my time had it even worse, and the Guayaquil consulate's monkeyshines have continued, although apparently not as consistently.

I can't even begin to imagine the nightmare...

I wouldn't wish the nightmare on anybody, no man. See these two threads for just how bad things were and can be:

Does he have a permanent address of someone trustworthy (parents, relatives, stable friends or neighbors) that he can use? This should enable mail addressed to him to arrive at the stable address: for example, John Doe c/o Richard Roe, [stable address].

If he chooses this option, he should be sure that his relatives or friends notify their mail carrier to deliver all U.S. government mail as though he (your fiance) lives at that address.

K-1 Fiance(e) Visa Process & ProceduresAfter the k1, getting married, and most important - the honeymoon
This question comes up regularly. Here is a good thread to read: http://www.visajourn...virgin-islands/

In short, take your honeymoon in any of the 50 actual states. If you travel within a 100-mile radius of either U.S. border (especially the southern), have her passport with valid I-94 and your marriage certificate with you at all times. If you're married but beyond the 90-day validity of the I-94 and you haven't yet filed for AOS, avoid all internal CBP checkpoints.

K-1 Fiance(e) Visa Process & ProceduresOne Way vs Round Trip Ticket

If I remember something I read some time back, if you don't cancel a round trip ticket, the beneficiary might be accused of leaving the country. Do I have have that information correct? I know the advice is to cancel the two way ticket once the fiance is in the county, and I think it has something to do with being accused of using the return ticket when you are not allowed to be out of the country. Correct me if I am wrong on this?

This is correct and the reason for the advice above. A round-trip ticket was bought for cost reasons; the beneficiary arrived in the U.S.; the return portion of the ticket wasn't cancelled; when the original passenger (beneficiary) didn't show up for the return flight, a standby passenger was given the seat; the airline didn't properly update the passenger manifest; and the beneficiary got into major, deep trouble when it came time for AOS, because the records showed that she had left the country.

There's more than one report of this on VJ.

However, if the return portion is far enough in the future so that it enables a beneficiary to apply for and receive Advance Parole (or a green card), it's OK to retain the return portion in the beneficiary's name.

K-1 Fiance(e) Visa Process & ProceduresOne Way vs Round Trip Ticket
Oft-discussed topic. In short, count on nothing until the visa is in hand.

Buy round-trip if it suits your budget. However, be sure -- as a priority -- to cancel the return portion once the beneficiary is in the U.S. Record the date, time, and name of the airline agent with whom you speak. File this information safely with your file copies of the other immigration papers. As easy as it might be to let a "detail" like this slip from your consciousness amidst the excitement of arrival, etc., do all of this FIRST.

K-1 Fiance(e) Visa Process & ProceduresK1 beneficiary wants mother to come to wedding in US
You may face what we did. A year after our marriage, Mrs. T-B.'s parents traveled 14 hours by bus to interview for tourist visas to visit us. They had plenty of evidence of ties to home. They were ejected from the visa interview in 2 minutes with a dismissive "You need to visit another country first, like Peru or Colombia, and THEN maybe we'll consider it." I've never been so embarrassed on behalf of my country as I was when I heard about this treatment.

If I were wagering my own money, I'd bet heavily against any visas being issued for attending a K-1 wedding. I'd bet on a higher (but not guaranteed) chance that a second attempt at a tourist visa, later, might prove to be more successful.

Frankly, knowing what I know today, I wouldn't dream for one second of wasting the money on an attempt at a tourist visa to attend a K-1 wedding.

Rest easy -- once you're married (in the U.S.), you're married. Just be sure to do so within the 90 days of the beneficiary's entry. Rites or ceremonies that you participate in afterwards are purely up to you; in fact, that's what many of us did. I married Mrs. T-B. in a Justice of the Peace's office on Hallowe'en and we did a bigger ceremony on Pearl Harbor Day (!).

Write something to fit in the box and satisfy USCIS's question.

However, depending on the consulate where the beneficiary would eventually interview, bear in mind that considerably more information (evidence of bona fide relationship) might have to be front-loaded before the petition is sent. There are many threads about this.

Depending on the consulate where the interview would take place (and you don't specify this), it could prove very helpful indeed to "front-load" your I-129F petition with additional evidence of bona fide relationship (which USCIS would forward to the consulate upon the petition's approval). You've met the requirement for "having met within 2 years" to satisfy the USCIS petition filing.

The consulate or embassy WILL BE another matter entirely. They could give you all kinds of grief as to why there hasn't been a visit in so long.

Failing to visit for so long could, in the worst event, result in the outright refusal of the visa, with months and several thousand dollars of extra expense that would have been completely avoidable. I recommend making even a brief whistle-stop visit soon (thoroughly documented with travel receipts and photos, which you'd bring to the interview and hope they'd be accepted), and being on the consular premises for the eventual interview.

No thumb drives or electronic media can be looked at, so printouts are the way to go.

Pick meaningful messages that YOU want THEM to see. Avoid overwhelming them with too many. Print the overall log (message titles only). Perhaps print a bunch of full messages, pick the most meaningful to hand over at first, and keep some "secondary" ones with you to offer during the actual interview.
