K-1 Fiance(e) Visa Process & ProceduresAdvice on I129F

In a case such as this, a psychological exam of the petitioner may be warranted.

Answer Kay's question, please.  Inquiring minds want to know.

K-1 Fiance(e) Visa Process & ProceduresI will use the I-129F 06/22/12 edition of I-129F to file next week.

T Bone has a great line for this but I can't find it. Here it is (Your success and your comfort level throughout your visa journey depends on your ability to read accurately and to interpret that information literally)

I appreciate the attribution, but I took the line from the awesome pushbrk himself, which was very much like this:  "Read accurately, interpret literally, and answer completely and honestly."  He may have also noted the part about success and comfort level.

Anyone on this site who follows every post that pushbrk contributes -- and who absorbs the information and understands why pushbrk is offering it -- will be far better off.  My own (wife's) visa journey is finished, and I still make a point of reading everything that pushbrk writes.

K-1 Fiance(e) Visa Process & ProceduresCan I visit fiance before we file?

How could any CBP agent possibly react negatively to the following?

1) Being presented with ties to home country

2) Being told that the visit is to support the petition and the consular interview

Sounds like a slam-dunk to me, si man.

Please don't be spread that autism FUD, which has been entirely been revoked and the doctor responsible for starting it struck off. Do your research. It is NOT well documented, quite the opposite.

This is 100% correct.  See this link.  One of the world's premier medical journals was appalled at its mistake in publishing the data, and it retracted the paper.  See especially the paragraph about the Centers for Disease Control and Prevention herein.

[...] they won't need to take a flight especially for the interview. No consulate would demand that.

Educate yourself by doing some basic reading throughout multiple threads, embassy reviews, and embassy-info reports.  Afterwards, come back and report your findings.

If you're clueless about where to start, please inquire.

You can send it U.S. Priority Mail with delivery confirmation.  Attach everything inside with binder-clips.  Put payment on top.  Most important, write "Original I-129F" on the outer envelope or mailing-label.

K-1 Fiance(e) Visa Process & ProceduresHow to organize the "evidence" for the K-1 package.
QUOTE (Nik+Heather @ Jun 12 2009, 10:49 AM) <{POST_SNAPBACK}>
The interview in a few months is where you provide evidence of an ongoing relationship: ie letters, trips, pictures etc. You can include all the things you are suggesting so that they will hopefully be in your file when it gets to this stage; VJers call this "front loading" the petition.
Highly recommended, in many if not most instances.

It's helpful to put "Original I-129F" on the very outside envelope that holds everything, or on the mailing-label.

K-1 Fiance(e) Visa Process & ProceduresConfusion o the Letter of Declaration of how we meet (merged)

Si, man.  Brevity is better.

However, readers here should bear in mind that for some countries (Vietnam comes to mind), including a detailed "timeline of relationship" within the I-129F petition package can prove to be crucial at the consular stage.  USCIS will not care about this detail, as long as you're eligible to marry and have been together in person within the last two years, but USCIS will pass this along to the consulate, which will care greatly.

Always consult "Embassy Info" and "Reviews: Embassy" (links atop every VJ page) and your VJ regional subforum for insights about front-loading the petition package with evidence of bona fide relationship.

K-1 Fiance(e) Visa Process & ProceduresConfusion o the Letter of Declaration of how we meet (merged)

"We communicated online, met in person in the Philippines on [date], and stayed together in hotels and a town home for my entire 2-month visit, [date] through [date]."

Try the above, if it fits the "met in person within the last 2 years" timeframe.  If there has been another visit since, report that in as concise a fashion as the above suggestion:  "We were together again from [date] through [date]."

That's far too detailed.  Look for other examples.  For your embassy, you can get away with whatever fits into the box on the I-129F form.

K-1 Fiance(e) Visa Process & ProceduresHow can a K-1 misrepresentation denial be overturned?

We followed the step-by-step guide here on VJ (found here: http://www.visajourn...content/k1guide) and it says "The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also)" so we blacked out a few things in emails and letters. But we shouldn't have blacked out anything?

Good question, and good catch -- I'll report this to Admiral Ewok. If someone handed YOU a document as proof of something, and it had lines redacted, wouldn't YOU want to know what was being hidden? That reaction is heightened in the minds of COs, who are geared to be suspicious and to sniff out potential fraud.

If pushbrk comes back, listen to him on this subject (and every other on which he posts).

K-1 Fiance(e) Visa Process & ProceduresHow can a K-1 misrepresentation denial be overturned?

As I was just realizing, my fiancee's sisters have been calling me brother, and so then I in turn calling them sister. Her nephew is now referring to me as uncle. My fiancee has been calling my mother, "Mom". So I should put a kabosh on all that as well, do you think?

Your earlier questions (all very pertinent) have been answered superlatively by others (thanks, si man).

The thing to remember, whether you're enclosing extra material with the I-129F petition or bringing it to the consular visa interview, is that you have and need to maintain control of what others see, at all costs. You have the power to prevent cans of worms from being opened. Ruthlessly cull your correspondence where there's ANY mention of "husband/wife." Purge your Facebook and other social-media pages of any such references, and be sure that all of your relatives do the same.

Whether with the petition or in materials for the interview, present NOTHING that's redacted or blanked out. Someone recently posted, or I heard about it outside of here, that a CO issued a 221g (formal hold on visa-issuance) until a couple presented the unredacted version of an e-mail that they'd presented in which a line had been blacked out. Fortunately, they had it and the original text was nothing untoward, and they then got the visa.

Even if you present a message-log only, be SURE that the titles of the messages or e-mails do NOT contain references to "husband/wife" or any other relationship that would indicate marriage. Your goal is to present yourselves as fiance/fiancee only, with no possible shred of doubt that could occur to even the most suspicious reader.

If you accept this advice and follow it, then we here have done what VisaJourney is for -- provided input to ease and facilitate your efforts. It's really good that you spoke out with your questions at this stage, when there's still time to take the appropriate corrective actions!

K-1 Fiance(e) Visa Process & ProceduresHow can a K-1 misrepresentation denial be overturned?
Besides the above warnings in regard to photos, every K-1 couple should take care NOT to refer to each other in writing (playfully or romantically) as "husband" or "wife." The "wrong" written materials that get into a CO's hands can lead to a 221g (at best) or to refusal of the visa.

K-1 Fiance(e) Visa Process & ProceduresPresence of Petitioner for the Interview

A great misimpression among VJ members is that "if the petitioner isn't allowed in the interview, it makes no sense to go/makes no difference," etc.

The blunt answer is that it never hurts and could help if the petitioner is on the consular premises or nearby.  See the pertinent passages in this thread:

K-1 Fiance(e) Visa Process & ProceduresQuestion about K-1 visa and past convictions of a controlled substance.

It depends on what consulate your fiance will eventually be interviewing at.  If it's a rough, bad, or ####### one, you'll want to front-load your I-129F petition judiciously, with material that you want the consular officer to see.

USCIS will not care about this extra material but will pass it on to the consulate, where it can be of great value.

Go atop the upper right of any VJ page, click "advanced search," and type in "front-loading."

It is not incorrect, affidavit of intend to marry is not just to say that you intend to marry within 90 days, it should contain who you are, who your fiance is, when and where you met each other. Would be best if you include how many times you ve seen each other in person.

"Affidavit" means you have to state that you will marry your fiance and briefly why you have to marry him/her

it must be very brief containing all what i mentioned above

This is revolutionary news.  Please provide a link to your source that demands these requirements.

K-1 Fiance(e) Visa Process & ProceduresRFE: Letter of Intent!!!!!

Both of you need to write a letter briefly describing your relationship, you can include how you met, talk about the times you've spent together, how your relationship started, how you fell in love, talk about how you communicate, what you love about each other, etc. they just want a brief summary of your relationship.

No, they don't.  Not for USCIS purposes.

The only time this is advisable is for "front-loading" purposes -- for the benefit of the consulate, which will receive the I-129F petition upon its approval by USCIS.  Front-loading is advisable for certain tough or ####### consulates, of which the Manila embassy is certainly not one.
