The consuls most definitely have an impression in mind as to whether they might grant or refuse the visa.  At rough consulates, the petitioner's presence on the premises (or just outside the building) can make a big difference.  Imagine making eye contact with the consul and handing the petitioner's U.S. passport to him as a first move.  That act can establish the legitimacy of the relationship that the consul might have been doubting.

 

A denied visitor's visa shouldn't have an impact on a K-1, unless the first visa was denied because of fraud.

Scenario 1:  There are residency requirements that apply until U.S. citizenship is achieved; otherwise, either green card can be revoked.  Being granted AP is no guarantee of being granted entry to the U.S. upon its attempted use.  The beneficiary's presence in the U.S. is required for biometrics appointments.  AP can be for "one-time" or "multiple" use.  It's not recommended that a green card ever be mailed overseas -- there's too great a risk that it can be lost.  Scenario 1 is not an option.

 

Scenario 2:  All things being equal, the chances of a second approval are pretty good.  Just be sure to notify USCIS and the Nairobi embassy that the beneficiary is leaving the U.S. within the 90 days, and that further progress through the immigration system won't be pursued at this time.  Save concrete evidence that the beneficiary has left the U.S.

There are a lot of situations where the CO has already made up his/her mind about the validity of the relationship and they refuse to accept or go through and read any further relationship proof at the time of the interview.

This statement needs to be enshrined in the pantheon of All-Time Most Valuable VJ posts.  Never, ever underestimate the consular phase of the process!  (See my signature.)

In response to my question at the time, an immigration attorney said that the status is "Adjustment-eligible."  After applying for AOS but before being granted it, the term is "applicant for Adjustment," or, more simply, "Adjustment applicant."

Well before the interview phase, and optimally before filing an I-129F or I-130 petition, one should go atop any VJ page, click "Embassy Info" and "Reviews: Embassy," and study both the overall trends and the recent reviews.  Pay closest attention to the worst stories.  Also search your regional VJ forum for relevant threads.
 
A kindly meant hint:  More study and less asking will reveal more thorough and reliable answers than you'll get purely by asking.  Other members shouldn't have to reinvent the wheel for you when most information is already there for you to locate and absorb.  If you've searched and read all the available material but still have questions, then come to the forums and ask.

Read the reviews, paying attention to the WORST stories, and prepare yourselves (both of you) for a possible Stokes interview.

To be successful during this process, one needs to read carefully, interpret literally, and follow instructions accurately.

 

USCIS says this:  "Submit Evidence of meeting beneficiary in person within the two-year period preceding the filing of the petition. Primary evidence may include airline ticket stubs and receipts (that include month, day and year), copies of passport pages that show the identification page and admission stamps, militry orders, letter from Commanding Officer, or any evidence that will help the USCIS to determine that the petitioner has met the beneficiary within the two years."

That won't be a problem because the USCIS don't make moral judgements on whether either of you committed adultery etc. or not. [...] Their main concern is that it is a genuine relationship and not a scam in order to enter the country etc.

1.  All that matters is educational qualifications in regard to the immigration process.  The others are irrelevant.

 

2.  "How practical it is" is the only story.

 

3.  When we're new, we don't know what we don't know.  Please ruminate on that, and perhaps in the future your wording will improve to the point where what you say could not possibly be misinterpreted and could not possibly mislead anyone else.  A good self-guide is, "If everyone on VisaJourney followed exactly what I say, what is the worst outcome that might result?"
