Because Cambodia is a high-fraud country, you would do very well to include a "relationship timeline" as front-loaded evidence with your I-129F petition.  USCIS will not care about this, but the embassy certainly will.

 

Vietnam is on a par with Cambodia in terms of challenge.  Go to the Vietnam regional forum (well down the list on the main forums page) and read what they do as far as constructing and providing a relationship timeline.  If searching the forum doesn't yield specific answers, you might post a new topic there, with title "How Best to Construct a Relationship Timeline?"  I'm confident that the very experienced members in that forum will rapidly advise you and refer you to appropriate threads/resources.

 

Your goal is to convince a highly suspicious stranger -- the consul at the embassy -- that your relationship is bona fide and worthy of his granting the K-1 visa.  The consuls' minds are largely made up ahead of the actual interview, on the basis of what they see in the approved I-129F petition forwarded to them by USCIS.  Be smart by anticipating this later phase, and it can pay off positively for you.

To answer the inquiry, don´t file until you are free to marry. You still being married, 10 years older and getting engaged after one trip are all red flags. You are not the first nor the last to be in this situation and just as many visas have been issued as have been denied with these circumstances. It is up to you to prove a bonafide relationship to the CO. Good luck on your journey.

USCIS was not prepared for the influx of petitions that it was about to receive or the ramifications of what the agency would need to do to take care of it.

This is the heart of the matter.  Complicating the situation is that the USCIS has long had the reputation of being "our very worst Federal agency" -- this from a Congressional staffer (2008).

 

Here's an assumption that's just as valid as others of above:  Sen. Cruz's staffer might have contacted USCIS multiple times already during the day or week and been blown off, either rudely or by having hit a brick wall herself.

 

When I met Sen.-to-be Cruz before his election, I told him my story, in brief:  On the advice of a huge law firm "with connections," I called then-Sen. Kay Bailey Hutchison's chief staffer to try to discuss our immigration challenges.  After no luck all day, I finally reached the woman, who cut me off with "The Senator has far more important things to do than to concern herself with one person's K-1 application."  I was shocked enough that I could say nothing before I was hung up on.

 

I asked Sen.-to-be Cruz, "Will you please ensure that your constituent services' representatives tackle issues like tigers on meat?"  He soberly looked me in the eye and said "That goes without saying."

 

I too have an active immigration-related request (sent earlier this month) in with his office.  I'll follow up on it and publicize the reaction, to show whether it's (dis)similar to what the OP reports.

Sorry that no one has answered there.  Regrettably, this thread here is being closed as a duplicate.  Your friend should contact the embassy directly for an answer -- or maybe you can do it on her behalf.  Sometimes, delays can be something as simple as a printer problem at the embassy.

It's automatic.  The approved petition goes from the USCIS center to the NVC, which is typically a whistle-stop, then to the consulate (in your case, the London embassy).

I'd be incredibly careful.  I don't know how the CO in Cambodia would view such material in light of what you say about tradition and culture, but USCIS would be well within reason to reject the petition.  Then, you'd be in the pickle of trying to "prove a negative":  "No, we're NOT married!"

 

I would personally not take the chance of including ANY such material with that language.

1.  I am not sure. I should probably inquire more as to their specific situation. I guess they were applying out of the Philippines, which I've heard may just beat Cambodia for difficulty.  Perhaps I'm just thinking too much.  sad.png

 

2.  BTW: TboneTX, thank you so much for your help these last few months.  My fiance and I are so, so grateful.  

 

3.  For your visa, did you have to do any massive printing jobs?  My fiance and I followed your advice and were researching cases on the other S.E. Asian pages. We read about a couple that submitted 1000 pages of online messenger chat info, which really impressed the interviewer.  I think we could probably top that (we try to talk a lot when the electricity/internet situation permits)  but we're having trouble finding an affordable place to print a job of this size. Particularly because we've been making three copies of everything (one to keep, one for the fiance and one to submit) 3000 pages is a lot of ink.

3.  The 3,000 pages is overkill.  Pick strategic chats/e-mails, sent over time, that you want the CO to read.  Most might not have time or the inclination to review more than a few dozen pages.  To validate the volume of your correspondence, print overall chat logs or e-mail "sent/received" logs.  (Crucial:  Be sure that in no included paper and in no message title do you refer to yourselves as "husband" or "wife," even if it was in fun!)  I knew someone who had an office copier, which helped with that expense; the ####### Guayaquil consulate ordered my personal presence, which was the chief issue.

Oh, he's going to go buy one...  How did he sign the G-325A?

If he lacks a pen, does he perhaps have a pin, with which he can stick himself?  Signing the documents in blood might impress USCIS and the embassy.

 

When he goes to FedEx, he can look for a photocopy machine and take a sheet of paper from the paper drawer, or he can look in the trash can for a discarded sheet that's clean on one side.  This is what we often do here in the Colonies.

 

Seriously, the advice given earlier has obviously been pretty good.

This "front-loading" of a petition package is something that won't concern USCIS, but it does affect things at the consular level.

 

An immigration attorney (and former consular officer) told me that such letters are normally not a good idea, unless the relationship proof is very weak... and if it's that weak, then the letters won't help that much.

 

The lawyer continued:  More than one letter from a foreigner, especially a relative of the beneficiary, can make it look as though the family is "urging" the beneficiary to immigrate to the U.S.  The consular officer can perceive this as a motive for the rest of the family to try to immigrate afterwards.

 

If the mother is a U.S. citizen, perhaps she can write a letter.

 

Such letters do NOT need to be notarized.

 

In North Carolina and other states, a Notary Public can be found in banks, title companies, perhaps insurance agencies, and similar businesses.  A small fee might be involved.  If the Notary is being asked to witness a signature, the person signing the letter or document is to sign in the Notary's presence.
