K-1 Fiance(e) Visa Process & ProceduresHow long should I know my fiance before applying for k1 visa?

It is completely country dependent and relevant to social norms. For the Philippines, a few months of internet chat and a week in Manila was enough for us, despite being a high fraud country. For other countries, that is not enough. The main requirement is that you two have met in person in the last two years, and have maintained a continuing relationship. There is no real formula - what may work for one, may not be enough for another,

This answer is dead-nuts accurate.  Some elaboration could be helpful for new folks.  The requirements for the petition (the initial USCIS phase) are that you have met once in person within the last 2 years, are eligible to marry, and intend to marry within 90 days of entry into the U.S. if the visa is granted.

The consular phase wildly varies, which is what the experienced member alludes to above.  In general, "time spent together in person" means a great deal to the consul, who determines the bona fide nature of the relationship (the strength of the "continuing relationship" that the quoted member mentions).  Most times, it also scores big points if the U.S. petitioner is on the consular premises when the beneficiary is interviewed.

If you haven't filed the I-129F petition yet, I suggest that you complete your 21-day visit first, and then file.

Some further elaboration, including a snapshot of the entire K-1 journey, can be read about here:

(OP, in the future, please either search for your answer or post an original topic -- avoid reviving unrelated or older threads. :) )

If you've been together in person within the last 2 years and are available and willing to marry (see the original petition requirements), you can file again now.

K-1 Fiance(e) Visa Process & ProceduresSent I-134 documents with petition, is new information needed at interview? (split topic)

missik,

I also included the I-134 with the I-129F petition.  For the interview, send the beneficiary an updated I-134 with the fresh materials that you mention.  You can create a cover-letter for the consul that includes the "under penalty of perjury..." section from the I-134 form itself.

(Moderator hat on)

We have had to remove 8 copies of the same message as above from 8 unrelated threads.  It's necessary to post your question only once, in a related thread or one of that you've started.  It's even better that you search threads to find your answer before you post your question.

Spamming the forums is extremely serious and draws heavy penalties from VJ Moderation.  You're being given a break this one time because you're a relatively new member.  Should you ever repeat this, the full penalty will be applied.  Acknowledge, please.

If you married in Georgia and wished to bring the beneficiary to the U.S. to live, you'd have to file the I-130 petition and, upon its approval, apply for the CR-1 visa.  Please go atop any VJ page, click "Guides," and read thoroughly.

she's just trying to help you and both posters already gave you the answer. rudeness is totally unnecessary.

Agreed.  Fineline222, your success in the immigration process strongly depends on your ability to read accurately, interpret that information literally, and respond completely and honestly.  Answers to your questions are found very easily on this site.  You can waste members' time and risk exhausting their patience if you apparently neither study the information nor appear to comprehend it once you find it.  In addition, it achieves nothing to dismiss the worthy advice of people who are trying to help you.

If the process remains confusing or overwhelming, you might decide to hire professional assistance for your petition's filing, or get a friend or associate to help you interpret the information until you get a handle on it yourself.

From a personal standpoint, most would probably agree that you owe an apology to the member to whom you were rude and dismissive.  This is up to you to offer or not offer.  From the standpoint of VisaJourney Moderation, any further such offensive posts will draw official administrative action.

K-1 Fiance(e) Visa Process & ProceduresWill the petition be faster if you use an agency?

If you're able to read accurately, interpret literally, and answer completely and honestly, you'll have the best chance of submitting paperwork successfully yourself.  If your case has no "red flags" (illegalities, visa overstays, etc.), your petition and your visa application should be approved.

For anyone to say "you'll be fine" as a blanket statement is premature at best and irresponsible at worst, because no one knows all the details of your case.

K-1 Fiance(e) Visa Process & ProceduresBC birth certificate for interview

Each state manages it's own vital records, so the appearance of an original birth record and the information contained on it will vary from one state to another.

Earlier this year, when I ordered our new baby's birth certificate from the Texas county where he was born, I learned that if I had ordered the certificate from a different county, it would contain less information than would the certificate from the county of birth. The clerkette explained that the birth-counties printed out more in regard to the infants born there. I had not known that before, and it was interesting, although I'm unsure of the reason why. Of note, I was able to order the certificate while I waited, for a whopping $23 per copy (I ordered 3 copies -- urgh). Even our marriage certificates were only $7 apiece, si man.

I'm a big fan of having (ordering) multiple copies of official documents like this, si man. Of the 7 marriage certificates that we ordered (and received, while we waited), 2 remain in our hands. The doting grandma got one of the 3 birth certificates, and I hope that it was framed and hung on the wall before it got dog-eared from being shown around. :)

A gracious message.

OP, collect the documents and get ready to schedule the interview.  Go atop any VJ page and click "Embassy Info" and "Reviews: Embassy" to read about what to expect.

It's always a boon for the petitioner to be on the consular premises when the beneficiary is interviewed.  If your trip coincides with the interview date, wonderful!  If you're allowed in the waiting area but not in the interview itself, hand your passport to him to show the consul.  That scores points beyond belief, and you might even be invited in.

K-1 Fiance(e) Visa Process & ProceduresRed flags

To the issue, the Phils. is more easier to get by with a great age difference, as my friend that took me there to Cebu the first time, is 59, his wife is 19!  No problems.  The other guy that went with us that just had a baby girl here in the US is 40 years older than his wife, and I am 35 years older than my wife.

To me, your finical situation, your tax returns, any previous divorces, or some kind of charge aganist you for domestic violence, is more of an issue than age in the Phils..,.,.,., hope I did not offend any one.,.,.,.!!!

Part of one post and a post quoting that part have been removed.  Acceptable portion of original post (above) is returned to the thread.  Future infractions by anyone in this thread might earn a thread-ban or worse.

Such a letter isn't needed for the USCIS petition, but it certainly could be of use for the consular stage.  Include it in the petition package, and USCIS will forward it to the consulate.

K-1 Fiance(e) Visa Process & ProceduresGot the K-1. Now what are our options for getting married?

1.  [...] get her SSN [...] before you marry because she will get it as a K1 and legally as soon as you marry, your K1 is invalid.

2.  [...] The officer told us that she needed to get her SSN before we married otherwise they would not be able to issue it.

1.  The K-1 visa is "dead upon arrival" into POE, not after the beneficiary marries.

2.  The SSN officer was misinformed.  See the guides and the "Social Security Numbers" subforum here.

What if you came here, got married, and then went back to Russia?

This suggestion isn't a viable option.  To (possibly) be permitted re-entry into the U.S., the beneficiary would first have to apply for and receive AP (advance parole) or the conditional green card.  Then, time spent out of the U.S. would be a concern.

If a declaration of meeting seems to be required at your embassy (see "Embassy Info" and "Reviews: Embassy" for insights), include one.  Otherwise, your passport stamps should suffice.

For clarity, the "relationship timeline" of above is separate from the "letter of intent."  Use the VJ template for the letter of intent.  Include a separate "relationship timeline" for the benefit of the consul who will later conduct the interview.  See the Vietnam forum!
