The point is: the petitioner (your fiance, my husband) needs always submit an affidavit, as he/she is always the main sponsor. Don't waste much time trying to make sense of the rules hermana, they svck. Just make sure you follow them to the "T".

If you have a co-sponsor, then the petitioners income at the moment is not that critical, but he will have to fill out the affidavit for themselves. in which part of the affidavit he have to write unemployment? and state that him is received this money?
They would list their current income, with the unemployment, and provide evidence of such. like back account?
Of course, the use of a co-sponsor depends on the embassy you are working with, some do not allow that. Guatemala embassy allows co-sponsor

Hi guys a few days ago, i started a thread, complaining about the Guatemala embassy, they change the originally interview date to a whole month later, but miracles exist, and they change his mind, the thing is after the long long wait for the NOA2 (221 days) and all the stress in this entire process , our visas was approved yesterday, the consul was kind,nice charming!! just made me 4 questions, dont ask for evidences, dont ask for NOTHING huh.gif and now i just cant believe that all are finish, i look my passport and really i cant believe guys, but anyway i wanna say thank you , for all the support, for all the advices, and for all the patience , i'm so so so happy!!!!!!

we are in the same situation, just in case, i went to my interview whit a co-sponsor, and the taxes of both (my fiance and the co-sponsor) and the other stuffs like I134 Pay stubs etc, my fiance in the affidavit put in the line of actual work that he are received benefits. my fiance was in the same boat like you, he worked very hard for the last past years, so his income are pretty good, over over the famous line (125%) , so the consul say me in the very begining of the interview, that i dont need a co-sposor and pass me all the papers of my co-spònsor, i dont know if she really see that my fiance are unemployed or just take a look the amount of his taxes huh.gif , but the visas was approved, so this my experience in the Guatemala Emmbassy, i supposed that every emmabasy has his rules, good luck, and put your experience after your fiancee have his beautyful visa in had, i think that thread like this one can help to others in the same situation, now is not rare see cases like ours! blink.gif

Maybe somewhere in the UCSIS rules that if the petitioner don't meet the 125% federal income guideline you must have a co-sponsor to guarantee the US Gov't that the fiance being petitioned will not be a public charge. If however the application was denied (base on income) eventhough you have a co-sponsor (close relative) who is a US Citizen & earning well above the federal income guideline then the best action is for the petitioner to talk to his/her local congressman.
By the way jokalu, did your interviewer ask you lots of questions before you got your visa?



No really, just 5 questions, how many are you been married before, how many your fiance have been married before,how many childrens you have, and the same question on my fiance, and the last was, are you have any problems whit the police? so everything was very very easy, she give us the 3 visas !!! why you asked me this?

Does anyone have any recent experience with this? Or should I just have my husband be ready to go to both, just in case?

Hi guys, we need advice.....my fiance and i have a two years old baby, our son born in Guatemala a year before he became a USC , so we cant get a USC passport or a USC birth cetificate here in Guatemala Embassy, we are in a k-1 visa process righ now and the baby was added, the question is: what is the next step to our baby when we are in the united state? how or what my fiance have to do for the AOS of his son?

This is something you should talk to a lawyer about.

If your son enters on the K-2 he will not be an automatic citizen upon entry because the K-2 is not an immigrant visa.

It might be a good idea for your fiance to file an I-130 for your son now and request the embassy schedule the K-1 interview for you and the IR-2 interview for you and son together,
or it might be possible to continue with the K-2 for your son, adjust status, and then make a claim of citizenship.

In my opinion your case is to complicated to get good advice here because what is best for you depends on legal questions such as physical custody, your fiances status, your financial situation and the time period you have. Check out a lawyer in your town or if you cant afford one try something like Catholic Community Services they have immigration lawyers in many places.
Yes there is the catch. In this case it would have been better, simpler, and less expensive to have married first, then apply for a SPOUSAL (CR-1) visa, and CR-2 visa for your child.

The child would enter the USA as an IMMIGRANT, and could simply file an N-600 for citizenship.



OMG no way, we already in k-1 process, and it pass 7 months since we recieved the NOA1 , and give up whit this petition to start another one, sad.gif . no i dont think so!!!

If your hubby adopts the child then the child will get their US citizenship sooner.


Since he is the biological father and hopefully on the birth certificate, he doesn't have to adopt the child. I think, all they have to do is file form N-600 after they entered the States. Since the child is younger than 18 and its father is a US citizen, the child automatically receives US citizenship.

yes, he appear like his father on the birth certicate, so fill the N-600 is the right way? i read in the link that USCIS dont work anymore in cases like this? or i'm confuse?

You have to file for AOS for the baby also. $1010 for you and $600 for thr kid.
Separate I-485 and I-864. No need G325A for the baby.



This mean our baby will be first a temporal resident, then a permanent, and 5 years later a USC ? it means nothing that his father is now a USC? blink.gif
