K-3 Spouse Visa Process & ProceduresNSO Paper

Hi!
I would like to ask if anybody has gotten the pink paper of their NSO marriage certificate.
I thought the color of the paper is only yellow.
The problem is I got mine in pink paper. Would this be alright?
I hope somebody can help me ease my mind. Thank you!

Mine is yellow. I believe they change the color every now and then and that agencies in the know can match the colors with the issue dates to reduce fraudulent documents. I believe yours being pink should not pose a problem.

K-3 Spouse Visa Process & ProceduresNBI clearance surname

Im confused what to do.i,m married but in our application in k3 i used my single surname even in my id,s and passport not my husband surname. my questions is iam going to get the NBI clearance here in phil.do i have to use his surname so that i can put in there iam married because i was married.which is in my application i used my single surname.or i will just put my single surname and of coarse i will be single in that clearance..thanks needs advice..

Your NBI clearance needs to show both your married name and your maiden name. Let them know it's for your visa and that you're married and they'll know what's required.

Welcome to the CONFUSED club. I found the same page a few days ago when it said November 7th. I've looked around at the various timelines and historic trends and can't seem so figure out how they came up with the date. My NOA1 date is November 22, so it's got me kine of antsy also. Let's see if someone else has some input as to how they came up with the processing date.

K-3 Spouse Visa Process & ProceduresI-130 and I-864 question. Please help me; I'm new here.
Talk about confusing...maybe the NSO certificates are only required at the interview...

Here's what I got from the US Embassy in Manila.

http://photos.state....0_updated2_.pdf

hmmm...I may file with just the civil registrar copies.

George

Well, my husband called the USCIS before to ask if the civil registar's copy is good enough and they say it's okay. But I still chose to wait for the NSO marriage certificate to be sure. Someone who also wrote a comment on this thread said the NSO is the one that is required. Quite confusing! But hey! You didn't get any RFE notice yet and if you will, you already have the security paper so you can mail it right away. Let's just hope no RFE for you so it wouldn't take additional time for them to grant the noa2! :D

Hi Mike,
Welcome..
I'll be filing the I-130 for my wife soon also. I'm still waiting for the NSO Marriage Certificate, which takes a while. The MC you receive from the civil registrar cannot be used to file, so it may be a while. Check out the Philippines regional forums here on VJ for info particular to the Philippines.

Give this a read...

Hello Everyone,
How are you doing? My name is Mike and I'm new here and I'm very happy that I have found this website. I want to prepare far in advance for everything to make sure that there are no problems. I'll be going to the Philippines in January to marry the love of my life Cherry. Since we haven't known each other over two years the only option we have is to apply for the K-3 visa after we get married. My question is what does the USCIS "Stand-Alone" I-130 mean? Because I have to have that sent to the Chicago lockbox. I will be in the Philippines for about 1 month and was wondering if I can turn the I-130 application in to the U.S. Consulate at the U.S Embassy in Manila? Or do I have to wait until I get back home to my permanent residence in the U.S. and send it to the Chicago lockbox?

Another question I have is about the I-864 form. Do I send this in with the I-130 form? I am aware of what documents I need to send in, but are there any other official forms that I need to pass in with the I-130? Also I understand what the poverty guidelines are. My income for 2009 was $18,271 and the poverty level at 125% was $18,213. I just barely made the cut by $58. But by the end of this year of 2010, I will end up making $38,000. Should I wait to get my W-2 for 2010 and not pass in the 2009 W-2 or will the 2009 W-2 be suffient? Or maybe I can include a 2010 pay stub with my 2009 W-2? The thing is, by the time I go to the Philippines I will not have my 2010 W-2 in hand to go to the U.S. Embassy in Manila with. So back to my original question in this post, Am I able to turn in or process any VISA applications while I am in Manila?

If anyone who has had experience with this could please help me out, I would really appreciate it. And from what I see on this site, it seems that everyone has gone through this process already. I just want to make sure that I do everything correctly to not delay my soon to be wife's Visa so we can be together here in the U.S. as soon as possible.

Thanks so much for your help and time,
Mike

P.S. Please remember that I am very new to this lenghty process and I am not familiar with many of the acronyms or abbreviations. I know over time that I will learn them, but for the meantime I hope that you understand my unfamiliarity.

US Embassy and Consulate DiscussionNew baby after interview
Possibly submit an I-130 for the baby along with and expedite request based upon the already approved I-130 of yourself and your son? You may possibly want to ask at the consulate and see if they have any suggestions. I wouldn't think this is a totally unique situation.

George

Hello,
Thanks for your response...
Actaully my wife is not eligible to file CRBA because she left the USA with her parents when she was 1 year old!!!
Any other suggestions?

Thanks,

US Embassy and Consulate DiscussionNew baby after interview
Sameer,
As stated elsewhere, your wife will file an application for a CRBA (Consular Report of Birth Abroad) for your daughter. Please check the website of your local consulate for the particular documentation they require. Also check your local laws and see if she's eligible for dual Citizenship. She's eligible for a CRBA/ US Citizenship as long as your wife has met the US residency requirements. Check with the consulate to be certain, but I believe your wife must have lived in the US for at least 5 years, 2 of which must have been after the age of 14 (maybe 16?).

George

Hello,
My name is Sameer Alomari, my wife is an American Citizen and we live together in Saudi Arabia, she filed I-130 for me and for my son, we had our interview on October, 30 2010, the officer requested a Joint Sponsor and a proof of petitioner's domicile in the USA in order to get our immigration visa.

We have collected the required documents and we will send it soon enclosed with our passports to get the immigration visa.

Please read the following situation carefully:

We had a new female baby on October, 25 2010, and we want to know how my wife should file for the infant? Is there any way to accelerate her application and to join it to our application? We intend to immigrate once we get the visa and we can't wait for the long processing time of the new application, we've planned everything to travel permanently to the USA, we are selling everything we have here in Saudi Arabia including our furniture and my car, I have formally resigned from my current job, and I have terminated my current apartment lease.
If the new application is not possible to be accelerated, is it possible to obtain a visitor visa for the infant? I know that non-immigrant visa applicant needs to show non-immigrant intent, but it is not possible! And we can't leave our daughter here!!! This is a Humanitarian situation, and we believe that this critical situation should be treated as an emergency case.

If a visitor visa can be obtained for the infant, we will adjust her status after entering to the USA.

Please, I need a detailed explanation to be able to take the right decision...

Thanks for helping...

US Embassy and Consulate DiscussionThe new process w/usem in manila

Ok well the process for the visa appointments are a drag the website doesnt fully work, and its hard to contact anyone in regards to it.........

Direct quote from USEMBASSY/Manila

I saw this quote and it refers to our situation because these went into effect Dec. 1st 2010, and our interview is for Dec 6th, 2010.

"Immigrant visa applicants who have been scheduled by the NVC for a visa appointment at the Embassy are required to visit the online appointment website to register their delivery address."

http://www.ustraveldocs.com/ph (you cant register a new address as well as their online chat doesnt work properly.)

Anyone else running into this problem?

I read about the new procedures earlier this morning, but I'm not far enough along in the process yet to try it out.

Is this the page where you tried to register the delivery address? http://www.ustraveld...nstruction.aspx

I can get all the way to the point where they ask for the passport number and case number, etc. ( can't proceed further because i don't have case # yet).

I do find it odd that it's a .COM website and not a state department or USCIS website (.GOV, etc.).

her grandma introduced us, but we are truly in love. I made 2 trips in 08 last one in november for our engagement party. We even bought a vehicle together and put it under both our names. she had at least 100 pages worth of correspondence between us, all our cards sent to each other, all my plane tickets, hotel recpts and she brought an album of all our pictures, what else could they possibly want. The only other think I can think of is the fact that her grandma introduced her to me... they might think its a set up since the Phils is such a high fraud country.

If there is absolutely nothing that will change their mind, would you agree that I should just go back home and marry then file a cr1? just in case, what would plan B be?

Hire an immigration attorney in Manila immediately, so that they can arrange for you to attempt to overcome this decision before the case is returned. The petition approval expiration is the least of your worries.

Particularly in Asia, being introduced by a family member can be a huge red flag. If you are Filipino as well, even more so. The first item on the agenda would be to get as detailed a report on what happened at the interview as possible. It needs to be as close to an actual transcript as your fiancee can possibly manage to remember.

I just saw a form that shows the 125% above poverty level for the USC to have for sponsoring. It does say however that it will change in the spring of 2009. Just wondering if it would go up from what it is now....or will they have mercy because of the economy!! LOL....

I'm sure my interview won't be until summer sometime, so it possible that Tim will fall under the guidelines, and I need to be prepared in case it's risen.

First, the I-134 is not submitted to USCIS anyway. Second, we don't call their customer service line the "misinformation line" for nothing. You'll need to provide an I-134 and supporting documentation for each intending immigrant. Give these to the fiancee or spouse to carry to the interview.

National Visa Center (Dept of State)Handwritten Tax Returns

"Schedule" is IRS jargon for additional forms that may need to be attached to the return form if certain credits are being taken.

For example, if you were filling out form 1040 and itemizing deductions, you would fill out Schedule A.  If you qualified for and took the Earned Income Credit, you would fill out Schedule EIC.

FYI:  Form 8880 is used to take a credit for contributions to retirement accounts such as a 401k or IRA.

Thank you again, I guess we don't have any Schedule.

So...should we send for 8880 or not?!

Yes, just be sure to include W2 forms and any schedules that were attached to the forms.

Thank you Ryan, we have:

Form W2
Form 1040A
Form 8880 (no idea what it is and neither does husband who doesn't file his taxes)

and Oregon individual tax return (which I'm not supposed to send).

That should be fine, am I correct? I am not sure what are those "Schedules" you are talking about.

National Visa Center (Dept of State)Sent both packages together

Hello everyone, as you can see from my timeline I am waiting on Case Complete.

I sent both our AOS and IV packages together. It took a couple of days for NVC to tell me they actually received them/it, but when I called today and spoke to a very nice gentleman he told me he could only see one package (didn't tell me which one). So I told him that we sent BOTH packages together and he said "Oh don't worry then, wait 30 business days  starting from the 16th of May".

Honestly, I had the impression he had no idea what to tell me so he  said "don't worry", but how is it possible that they only have one into their system and yet he told me I could get case complete in 30 business days?

Does it sound fishy to you?
