K-1 Fiance(e) Visa Process & ProceduresSupporting documents for Manila Interview

My fiance is now getting ready for her interview in Manila - Our question is this: Some of her documents, certified copy of birth certificate and certificate of no marriage - were issued in May and July of 2012 - They have no expiration date on them, but since it has been 8 months since we filed and almost a year since these documents were issued, will they require us to get new documents?

Again, there is no expiration date on these two documents, we just want to be 100% for her interview.

CENOMAR needs to be issued within 6 months of the interview. Get a new one. It can be ordered online and delivered right to her door.

Both CENOMAR and Birth Certificates need to be certified copies printed by the NSO on their paper. Tip: Get a few certified copies of her Birth Certificate. She will need them when she arrives in the US (ie marriage licenses, SSN application).

K-1 Fiance(e) Visa Process & ProceduresFrontloading Your I-129F/K-1 Petition. Opinions/experiences?

No Frontload. No RFEs.  Approved in 142 days.

You need just enough evidence of a genuine relationship to convince the USCIS to approve your petition.  That's the trick because it is subjective as long as you send the minimum required supporting evidence.

I just want to add that I accompanied my Fiancee to her interview.  We had a ton of evidence!  Chat logs, Sype logs, SMS logs, PayPal receipts for phone loads, airline boarding passes, hotel receipts, etc.  The USEM did not take a single piece of paper from our evidence pile because I was with her.  Not saying this is the norm, but just our experience.

K-1 Fiance(e) Visa Process & Procedureswhere to place I-129 packet?

I didn't punch any holes in my Petition.  I organized my package as outlined here in VJ and inserted all documents into a Manila envelope, sealed it, and mailed it to the lockbox.  Passport type pics I inserted into a ziplock bag, which I then afixed to a blank piece of paper.  For evidence photos, I printed two 4"x6" photos per 8.5 x 11 sheet of photo paper.  Printed 2 sheets. Hope this helps.

K-1 Fiance(e) Visa Process & ProceduresNVC Letter/Email confirmation

Once you get your MNL case # from NVC do they send you an email or letter confirmation? I know that in order to do a medical you need the confirmation email or letter from NVC with your MNL case # but what if they don't send either one? Does that mean you cannot take the medical? When does NVC actually send you the confirmation letter? Thanks

When the USEM receives your packet from the NVC, they will send you a letter.  However, you may or may not receive it in the mail.  But that's not the letter you will need.

Pay for the Interview and then schedule it.  After you schedule it, print the page with the bar code.  This is what you'll need for BOTH the medical exam at SLEC and the actual interview at the USEM.

K-1 Fiance(e) Visa Process & ProceduresPOE Question; SLEC ON-LINE REGISTRATION

Okay, so now I am really lost, I just found this :

"customs in Guam and immigration in HNL"

So U.S. Customs in Guam

Immigration in hawaii

What does this mean?

POE is Guam for sure.  1.5 hours is enough time to clear US Immigrations.  Many other folks have done so as their POE.

You will not go to Guam Customs (check your bags all the way to your final destination, not Guam).  After US Immigrations, you will head through the transit doors and clear TSA screening which is on the same level, then head to your gate.  Do not go downstairs to Guam Customs.

Upon arrival in Honolulu all passengers from Guam will be required clear their baggage with Customs in Hawaii, then re-check-in their bags to their final destinations.

I guess I was looking at the old instructions. but on the new instructions, it doesnt mention anything about specific payment option for guam residents.

i just hope i do everything right.

You can't be faulted for following the current instructions.  To my knowledge here on VJ, yours will be the first from Guam using the new I-129F.  Just an idea but if you can, use a personal check and verify your checking account after getting the I-797C to see if/when the check clears.  This way you'll have a heads up if it was payable to the correct party.  Be sure to submit a G-1145 to get the 797 Notice of Action.

I don't find where you are reading about Guam and Virgin Islands.

USCIS I-129F    This website makes no comments regarding Guam or Virgin Islands.  Didn't see anything on the form or instructions either.

Hope the link helps.

Even though the USCIS website should be the one to follow, unfortunately there are other immigration help websites that are still making references to the old forms and payment instructions.  The newest June 2013 forms (I-129F, I-130, I485) are the first versions that I've seen that have removed the instructions specific to Guam residents.  I guess it helps remove any of the confusion, but in a sense has caused some as well.

K-1 Fiance(e) Visa Process & ProceduresPayment; Guam

Anybody else in here from Guam?

I'm a bit confused as to who I make my check payable to.

The website says to make it payable to Department of Homeland Security unless I live on Guam or the Virgin Islands.

Can anyone inform me as to who I would make my check out to?

And for Guam residents, after we send our application packet to the Texas lockbox, where does it go from there?

The current I-129F instructions state to make check payable to Department of Homeland Security so I would adhere that guideline.  After September 16, 2013 USCIS will only accept the current I-129F dated 06/13/13 so you should stick to those instructions.

Send it you petition and payment to the Texas Lockbox.  It will get transferred to the California Service Center (CSC).

K-1 Fiance(e) Visa Process & ProceduresSNAIL MAIL / EMAIL ??

In addition to the responses above....

IF your mailing address is a P.O. Box, use this on the I-129F.  Be sure to use a continuation sheet indicating you receive mail at the P.O. and not at your physical address.  You will receive the 797C Notice at the address you specify on the I-129F.  If you get mail delivered to your physical address, then disregard this info.

Just follow the guides here on VJ and you'll be fine.  If you have any more questions, just post them.  Good Luck.

K-1 Fiance(e) Visa Process & ProceduresK1 visa and Fiance 3 year old son

six7one,

Thank you for detailed answers to my questions they are a big help and are very much appreciated. One question what does DS stand for?

Best Regards

s1faulk

You are welcome.  Post any questions you may have, that's what VJ is all about.

Not really sure what DS stands for, probably a designation for Department of State forms.

One more thing you should know on your K1 and K2 journey.  Both will need the CFO sticker in their passports to leave the country.  This a Philippine requirement not a US Visa requirement.  The child may or may not need to attend a CFO seminar depending on age, but the mother must attend.  Also depending on the mother's age there's the Parental Consent or Parental Advice to consider.   Do some homework on the CFO requirements to leave the Philippines.  Hope this helps.

K-1 Fiance(e) Visa Process & ProceduresK1 visa and Fiance 3 year old son

Hello folks,

I am a newbie and want to thank everyone for all the help I have received thru other couples journeys.  I have filed my K-1 visa for my Fiance in the Philippines and listed her 3 year old son on the K-1, we have received our hard copy of our first NOA.  What else will I need or should have done prior?  I have checked prior postings and I am being told that her 3 year son will be allowed if she gets her Visa and has completed all the necessary paperwork, forms, medical evals ect.

  • Should I have sent in his NOS Birth certificate with the K-1 application? No need to in the Petition Step, but the child will need to possess an official NSO one for the interview
  • What forms will I need to submit only the k-2?  For the interview, the K2 will need all the same DS-Forms (except 156K) as the K1.  Just follow the instructions on on the US Embassy's website
  • What fee's will need to be paid? You'll be paying for both a K1 and a K2 Interview.  Once scheduled, you'll pay for both a K1 and K2 Medical Exam.
  • Should my Fiance bring her son to the interview once it is granted?  If her son is to join and not follow later, you'll need to make two interview schedules.  More than likely the child will be interviewed at the same time.
  • Will her son need the same medical examination as my Fiance prior to the interview?  Yes.

Sorry for all the questions but i have not been able to find documentation on the step by steps procedures for bringing her son with us so we can keep the family together.

Newbie with sincerest regards for all the help

Steve

You don't have to put the address on the money order, just be sure to send your package to the Dallas Lockbox.

Your package sounds well put together.  They'll remove staples and punch holes where needed.  I didn't use blank dividers, but rather titled the sections.  Just my own packaging technique.  Organization is important, but the content should be the main focus at the outset of assembly.  Good Luck!

K-1 Fiance(e) Visa Process & Procedures21 years old filed for k1

hi! My fiancé who filed for k1 petition was 21 years old and he will turn 22 next year January and I'm 22 years old.... is there any problem with our age filing for k1 visa? or we are good?

No problem filing the petition, or getting the Visa.  You will need to get the CFO sticker in your passport so start reading up on Parental Advice since you are 22.  Not difficult to get, but something you should be aware of because you may need one at the CFO.

K-1 Fiance(e) Visa Process & ProceduresI-134 Affidavit of Support question

Hi everyone,

I had a quick question about one of the lines of questions in the I-134

Question #11 has me choose.... I intend OR do not intend to make specific contributions to the support of the person(s) named in item 3.  If you intend, indicate exact nature and duration of the contributions

What does that mean in that how do i answer?

Background info... it will only be me and my fiance that will be living together

For K1 you won't check either box in Question #11.  I followed the Example I-134 here on VJ and did not have any issue.

IR-1 / CR-1 Spouse Visa Process & ProceduresCFO seminar to get a passport?

guys..do i need to get or attend the CFO seminar before getting a passport? im a new applicant and im just confused about what to do first.. is it ok to get first the passport even without CFO seminar? do i only need to bring the marriage contract and birth certificate?

If you're married to a foreigner I believe they'll want you to attend the CFO seminar before getting you passport, especially if you want to use you married name. Since you will need the CFO seminar eventually anyway, it wont hurt to get it done now.

Go to http://epassport.com.ph and look at the list of documents you need to bring to get your passport. You can also schedule your appointment online.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 cultural differences for names

I-130 askes for former spouses and in russian, a mans last name can be different than a females. Also, a son can take the name of a grandparent to continue the name if the death of the grandparent end the family line. I plan to petition for my future wifes son, who has a different last name than his mother or father. The mothers name ends with ...bekova and the fathers name ends with ...bekov and the sons name is totally different. Someone please tell me that this is routine! If not, what can I do? Thanks!

The form is just asking for the name. I'm certain the consulate in Russia is aware of the cultural differences and the variations in the names if they are as common as you say. Even if the names were the same, you'd still have to prove the relationship (birth certificate, etc.).

With that said... I have got a clue about Russia or Russian culture .

Maybe someone who has encountered this before can chime in. You maybe even to to ask you the Russia specific regional forum(Russia, Ukraine, Belarus), you'd be more likely to get an accurate response there.

IR-1 / CR-1 Spouse Visa Process & Procedureshelp!!!!!!!!!!!

i had to do the same thing with my 2yr old daughter. . .need to file CRBA $205. . .It's a requirement before they can release her a visa. . .she'll get a denial coz my American Citizen husband didn't passed the residency requirement, but it's something we have to do. . .My daughter's case is in the NVC stage, I'm filing her CRBA before the interview so we'll have no delays. . .appointment for CRBA on Dec 8. good thing i know someone who did the same thing at least i'm a little bit ahead. . .

Interesting tidbit of knowledge here...I kinda thought it was something like that. Good to know.

Isn't the CRBA $100 and the passport for a child $105? Why not just apply for the CRBA if you know it will be denied anyway? That way you wouldn't forfeit the passport fee. Just a thought.

Jayne08,

Check out this link:

http://www.nilc.org/...tzshp/nc035.htm

The way is reads to ME, and I'm not a lawyer, not an immigration specialist or anything else of that nature, is that your daughter would have to be legally admitted to the U.S. (i.e. I-130 --->CR2) and then at that time (immediately upon admittance) she would be eligible for and receive US citizenship. I'm certain there is some sort of paperwork that would need to be filed in or to claim the citizenship.

That said, I'd still apply for the CRBA/US passport based upon what the CO told you at the interview. At least that way you have an actual person(and they're even there locally) to point a finger back to if/when they deny the CRBA. If not, then all's good in the world...

OMG! These rules all appear to be so arbitrary and contradictory.:bonk:

George

P.S. I'm going to the CRBA appointment/interview for my daughter on the 21st of December.

IR-1 / CR-1 Spouse Visa Process & Procedureshelp!!!!!!!!!!!
I would apply for the CRBA. Once you have the interview and denial of CRBA because of the residency requirement, appeal the decision of the consular officer. It would seem that the ones who approve/deny visas are not the same ones who do the CRBAs and don't necessarily know the rules that the others follow. NOW, if you happen to file the CRBA and it gets approved...well, just press forward. Did your denial/rejection notice state that she was a US citizen or required a CRBA?

Check out this link:

http://www.americana..._newsletter.pdf

Your situation of being a recently naturalized citizen throws a monkey wrench into the situation. There may be additional rules or exceptions that I'm not aware of or couldn't find.

Good luck with the CRBA, I really is the better route if she is qualified for one.

hello VJ's

m so uppset!!!!!! my daughter had interview today for IR2.. and something come up.. when my wife and daughter went to interview.. the officer said my daughter was a US citizen.. and need a Blue passport... REALY?? thats F-BS!!!

here is why i filed for I-130

i called the USCIS before i filed the petition for my daughter.. and the USCIS officer said that i need to file for her.. cause im not qualified on CRBA so i filed.. after waiting for more than 8 months.. this is the result!!!! wasting time and money????

You were a US citizen when you daughter was born?

You've lived at least 5 years (as a citizen) in the US with at least two of those after the age of 14?

You are her biological father?

If you can answer yes to all of those then your daughter should get a CRBA and a blue US passport.

I believe the State Department(only at overseas consulates) handles CRBAs and they have nothing to do with the USCIS. I'm not sure why they would have even fielded that question directly instead of referring you to the State Department/overseas consulate.

O God, I am then screwed. I thought I can use my brother income as household income. I did not earn anything last year. I am working this year. What should I do? Please advice Thanks

Get a letter of employment from you employer and your last 6 months or so of earnings statement or pay stubs. Search the forums here on VJ for a sample employment letter. Should simply state how long you worked for the company, your annual earnings, and state that you are a permanent employee with every prospect and intent of staying employed at the company. Remember, you have to meet the the "125% of poverty level" threshold now and into the foreseeable future, not last year or three years ago. If your current income doesn't meet this level, then you'll of course need a qualified co-sponsor who is a USC/LPR.

Hey all,

Ahh quick question ... how will one know if the interview approved or not?

some folks were telling me that they hand out slips at the end of the interview..???

and what type of question does the officer ask??

Try this on for size concerning the questions asked.

http://www.visajourn...rview_Questions

The beneficiary should have copies of all documents that you've submitted anywhere in the process. Any information contained in them is fair game. Also, any information that a husband/wife would normally be expected to know about each other, i.e., family relationships, etc.

Hope this helps...

Thanks to both of you for the responses. I do have the same instructions as George, if they are going to make a big deal out of them not being signed then I will have to correct it. As for now all that is done and now on to the pictures we are going to include. Any idea on how much is too much :)

I included minimal pictures with my I-130. I do have hundreds of picture arranged in a pictorial format with dates and descriptions, along with third party affidavits ready to send to the NVC and for my wife to bring to the interview. That said, it can't hurt to include a few pictures of both of you together, looking like the married couple that you are. I'm told that pictures are minor evidence from the USCIS viewpoint, but more important when you get to the NVC or interview/consulate. My main evidences were our marriage certificate and the baby's birth certificate. Notice in the list of valid evidences that there is an OR between each one, I'd send as many as I had available though.

Well I am hoping we dont need to have them signed. We were thinking we can send them since we want to send them asap, and in the meantime before his interview have them mail us another copy of their letter with their signatures. Which will kill two birds with one stone.. The first being letters addressed to us both and the second the affidavits being signed. I just dont want to get my packet sent back, but I am the type that worries about the anyway..lol..

Another question.. Does anyone know why we need to send a copy of the back of my birth certificate?

Thanks,

I've read the same thing here on VJ. I'm guessing it's someone be overzealous in their efforts. I'm assuming that you're asking because the back of your BC is blank, same as mine. I copied only the front and sent them that. If I had anything at all on the back, I would have copied and sent it, but I'm not sending them a blank sheet of paper as evidence. If they send me an RFE requesting a copy of the back, then I'll make a copy and send it to them.

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling for I130 in October?
I hate to be the bearer of bad news...but where have you been? Go take a look at your timeline, especially down at the bottom where they have the estimates/projections. I would normally advise not to put much faith in them...but that's when trying to convince someone that it's just an estimate and will probably take longer...

The average wait time at the CSC is 5+ months right now, although some have come through recently at 2.5 - 3.5 months. After that you still have to file for the actual visa, all you've done so far is file a petition asking for your relative to be allowed to apply for a visa.

Try reading the information in this link to become a little more familiar with process: http://www.visajourn...p/EZGuideSpouse

Good luck in your journey.

IR-1 / CR-1 Spouse Visa Process & ProceduresAOS help.

I have a complicated situation and i need help understanding and clearing things up.

From April 2008 to November 2009 i was in the Philippines. I came back to the US on Nov 25 2009 and started working 2nd week of December. As noted on the IRS website, Publication 501, Table 1. (http://www.irs.gov/p...blink1000220674) "IF your filing status is SINGLE, and at the end of 2009 you were UNDER 65 YEARS OLD, then file a return if your gross income was AT LEAST $9,350." Since my gross income for 2009 was under $9,350 I did not have to file a tax return for the year 2009. I understand would have to write a written explanation why i didnt file a tax return for 2009.
:help: :help: :help:
Now, I only work on call/per diem with my first job. I now have a 2nd job and i have only been with them for one month. when i submit the AOS package i'll probably have received my 3rd or 4th paycheck. My question is this, WHAT DO I USE FOR MY ANNUAL INCOME? last time i received a paycheck for my on call job was about a month ago. Do i use my full time job as my ANNUAL INCOME? since 2010 is about to end should i base my EXPECTED ANNUAL INCOME for the year 2011 or 2010? the dollar amount under the 125% poverty guideline, is the GROSS or NET PAY? it's very unclear to me so if someone can help explain it i'd greatly appreciate it :)

Use the expected income from the new job. Be sure you get an employment letter from your employer. Check the VJ wiki for the proper format of the employment letter. You should probably file the 2009 taxes just the get the small amount back that they withheld from your pay during those two weeks in December 2009. Otherwise you have to include a letter explaining why you didn't need to file. You may also want to include a letter of explanation as to why the 2009 income was so low(in the Philippines, etc.).

The poverty guidelines are for INCOME (from any source eligible source) before taxes, so that would be GROSS. The instructions for the I-864 goes into quite a bit of detail about what information they want.

You maybe want to consider looking for a co-sponsor in case the consulate doesn't consider you're projected income from your new job to stable/reliable.

Good luck,

George

IR-1 / CR-1 Spouse Visa Process & ProceduresPassport Size photo

I am confused about passport size photo is that 2x2 what mostly said here? I just have my passport size here in PI but the size is not 2x2 I think it is smaller would this be okay?

Thanks in advance!

No, it's not ok. You need a U.S. style 2inch x 2inch passport photo. The Philippines passport photos are 3cm x 5cm. All of the photo shops that I've seen there are able to make the 2x2 US style photos, you just have to tell them what you need. IR-1 / CR-1 Spouse Visa Process & ProceduresWill I have to start over? :(

Considering your circumstances, you might look into abandoning the process for now, and you two move to the Carribean (assuming an Irish person can do that reasonably easy), then get him a spousal visa via the local embassy (=DCF) in 4 years or whenever you are finished your studies.

IR-1 / CR-1 Spouse Visa Process & ProceduresCASE COMPLETE.. .. then GOT RFE?

I'm not guessing. The case is complete and on its way to the Consulate where based on the information provided, the visa will be denied unless the beneficiary carries an affidavit of support from a qualified joint sponsor, including supporting documentation and evidence of the sponsor's US Citizenship or LPR status. It ain't my first rodeo.

The notice was not an RFE. It was a warning.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 Standard Process interview
Exactly where are you at in the process and what process is it that you're going through? Are you the petitioner or the beneficiary?

It sounds like you were sent a notification (as the petitioner) that you would have to be interviewed. Is this correct?

If not, and you're just waiting for your NOA2 for the normal I-130 IR1/CR1 process...well, it's only been two months. If you bothered to read any of the other posts in the forums, you'd realize that people very seldom receive NOA2 after only 2 months. 3 - 5 months is more likely, with the norm being closer to the 5 month or greater mark.

It's possible I'm completely off-base here and misunderstood your question...a little more information in your profile and timeline would be helpful.
