Although it hasn't been asked for in all cases, my opinion is you should be prepared to present an I-134 to the CO in the case of a K2.  The Embassy's instructions does not indicate a 134 is not needed for the K2, but why take an uncessary risk.  I agree with Hank 100%.  It's not hard to make an extra copy and sign it for your K2.  Just my 2 cents.

I don't have experience with a K2 Follow-to-Join but from what I've learned the process will be the same as if a K1 going alone.  In other words, the K2 will pay for an interview, have medical exam, do the interview, then obtain a CFO stamp in his/her passport.  As mentioned elsewhere in this post, the K2 must have all document requirements upon interview time.

Be sure she pays for two interviews and keeps both receipts.  They will both need their individual receipts come interview time.

 

In regard to the father, if the mother was never married to the father then there will be no issue.  In the Philippines, the mother has sole authority of the child as long as she was not married at the time of the child's birth.  The father can be listed on the child's BC, but so long as they were not married she will still have sole authority even if the child carries the father's last name.

I think i may have messed up! What is needed for the K-2? I have everything done on the  K-1 where I made sure that her son was listed and would be joining us after the visa's were approved,  Do I need to file a separate K-2? Boy i hope i have not dropped the ball because it has taken a long time to get here, thank you in advance.

 

If you listed the child on the I-129F you should be fine.  The I-129F is the only time the K1 and K2 are combined on any form.  You'll have one case number for both individuals, but once you get it everything forward is separate because both will be issued separate visas. 

 

All documents required for the INTERVIEWS for the K1 are also required for the K2.  In other words, when both show up for their interview both should have their own printed schedule, DS form and Affidavits of Support.

Hello VJ Family,

 

I have a question regarding my Fiance's 3 year old son, he was listed on the I-129F that was submitted with our original packet and we do plan on bringing him to the states when both Visa's are approved.  We are at the point now that we just received the MNL # from the NVC after 5 weeks of waiting.  After we pay the Visa's fee's for both her son and my Fiance and schedule an online interview with Embassy then go thru SLEC and pray all goes well.

 

* Does my Fiance need to bring the 3 year old to the interview at the Embassy? YES.  Pay for and schedule two interviews (same date and time preferribly) and then both show up at the time of mother's interview.

* Also will we need to schedule a separate interview for him at the Embassy?  YES. See above.  Be sure to have all docs for both K1 and K2 separately.

* Am i missing anything but the CFO? Both have to have medical exams.  Both have to have CFO stamps in their passports, although the 3 year old does not have to attend any seminar at the CFO.  Mother will bring all docs + child's passport to the CFO to obtain the stamp.

 

Any help you can provide would be appreciated.

 

Everything from here forward is for two separate individuals (K1 and K2).  If I remember correctly, the only time it was combined was at the Petition step.  I also did a K1 and K2 at the same time.  Hope this helps.

NO. The next think you want is NOA2. Anything prior to NOA2 would most likely be an RFE which would delay your case.

Why are you having an interview at the embassy (I assume in Manila) for an Adjustment of Status? You may want to correct your timeline and your profile settings.:)

I'm not referring to a Packet 3/4 etc. I mean the package that the VISA comes in once you receive it. It will have documents with or attached to it. One of these documents it the IDS or Immigrant Data summary. The IDS is required to get the CFO stamp.

+1 :thumbs: Be sure to have the seminar completed and the stamp attached to the passport prior to trying to depart the country. You'll be stopped at the airport before boarding your flight otherwise.

The IDS(immigrant data summary) is actually on the outside of the VISA packet you'll receive from the embassy. Just make a photocopy and bring it with you to the seminar/CFO along with the other required documents.

I believe you can submit a letter at the time of the interview requesting to pickup the visa from the embassy rather then having it delivered. See the bottom of this link:

Cenomar is going to be Monday (or tomorrow if they are open) which gives us time to get it. The CFO has informed me that I need the visa in hand before the interview, but it is walk in so we can do it same day.

You can do the CFO seminar before the visa. Then once she has the visa, she just needs to bring the certificate and receipt to the CFO to get the stamp. This might save you a little time.

Not a good idea. Book the tickets when she has the VISA in her hand.

No idea what might happen, power outage at embassy, air21 truck crashes/gets hijacked, typhoon, flood, her passport falls unseen behind a desk at the embassy, who knows? Of course, they may also ask her to come back with additional documentation and not even approve her on the day of the interview (god forbid). Has she attended the CFO seminar? Remember, she needs the CFO stamp prior to being allowed to leave the country. Does she have her CENOMAR (CEMAR) for the interview?

It is the standard recommendation of the embassy/consulate not to buy tickets or make travel plans until the beneficiary has the visa in hand.

Sorry to barge in on condz' thread but I thought I should just post here as my question is also about the marriage certificate .

My husband (USC) and I (beneficiary) were married abroad. I've never been married in the Philippines.

Do I just bring these two (originals) to the interview? NVC already has an original copy of our marriage certificate and they've already forwarded it to the US Embassy Manila.

- Philippine Consulate-authenticated marriage certificate

Or do I need to also obtain and bring an NSO Certificate of No Marriage (CENOMAR)? Does the Embassy require proof that a Filipino, who married abroad, has no prior or existing marriages in the Philippines?



Just to be safe, I'd get the CENOMAR from NSO. Just a few hundred pesos and not really worth the wait if they want it and you don't have it.

I'm not certain, but it sounds like you think they just was your NSO Marriage Certificate. That is not the case.

The employment letter, when done properly, is evidence of income. Have him obtain a new letter that's been done in the correct format with ALL of the required information. Also have him collect all of his pay stubs/earnings statements. An "employment letter" that doesn't contain the information the embassy requires is useless. I sent you a link previously that shows the proper format and required information for an employment letter. Please use it, we all really want you to be successful in obtaining your visa and being re-united with your fiance.

Have your fiance send you an employment letter and his pay stubs/earnings statements for the current year. He should be able to fax or email them to you. Any internet cafe, Kinko's, etc. should be able to help him with that.

As far as I know, the Manila Embassy doesn't like to approve co-sponsors for K-1 visas, although you can always try if he just doesn't meet the income requirements.

Read the first paragraph. Notice the word "emigrants".

An immigrant is someone who leaves their country and comes to your country to live.

An emigrant is someone who leaves there own country to live in another country.

I assume your fiance intends to leave her country (Philippines) and live in your country (United States). This is the way the Philippine government looks at it also, even if technically the K1 is a non-immigrant visa.

i'm not sure if im posting this on a right forum post... but anyways, i need help on CFO Seminar Processing here in Manila, which would only take just for 1 day, i live in a province and i don't want, if possible going back and forth to get this Seminar done..

which is the best way to do this? walk me thru please? :)

i know there are 3 places to go to.. ST. MARY's near Katipunan LRT / PRISM in ??? / CFO Main in Quirino Ave

if i take St. Mary's , will i get the certificate and the sticker/stamp on passport done here? or i still need to go to CFO for the sticker/stamp?

St. Mary's and PRISM( on Taft across from De La Salle University in the BDO building) are the two places in Manila where you can take the seminar. The three or four people that I know that have done it have gone to PRISM. They say it's "easier", meaning a lower stress environment. The seminar will last a couple of hours and then you have a one on one counseling session. It costs 250 pesos and you receive a seminar attendance certificate (yellow). After that you head over to the CFO Main Office and pay 400 pesos and get your CFO "guidance & counseling" certificate, and if you already have your visa package you'll get the CFO sticker placed in your passport. If you don't have you visa yet, you can go back to the CFO Main Office at a later date to get the sticker or you can get the sticker at the CFO extension office in the airport. I'm uncertain of the hours for the CFO extension offices, so I'd call and verify their hours if you think you might want to take this route. You wouldn't want to show up at the airport and have them be closed. They WILL prevent you from boarding your flight if you do not have your CFO sticker.

No, I don't think it's okayt to do that, "...cover it with my clothes..." sounds like you're trying to hide something you know is not allowed. Put it in you check-in baggage. Liquids and gels over 3 ounces and blades bigger than a pair of nail clippers are normally confiscated at the security checkpoint if they're in you carry-on bags. The liquid/gel bottles should also be in a 1 quart ziplock bag. Is the body spray an aerosol or a pump spray? I've seen people being told they can't have aerosols either, even in their check-in. I've always been allowed to have my shaving cream/gel in my check-in though, although they have asked what it was.

I wanted to know which Marriage Certificate do I need from the Philippines. My wife has the one that they give to her from the Civil Registrar stamped with that the NSO has recivied and stated that this is to certify that this document was issued by the city civil registrar who is authorized to issue the same and whose authority was confirmed by the civil registrar which appears on the document is the same with the specimen signature officially submitted and filed with this office. It has a stamp with the authentication officer National Statistics Office. Can I use this to submit my I-130 or do I have to get the one with red seal from the NSO. Please help.

You do not need the "red ribbon" certificate for submission of the I-130 or for the interview. You will be required to have the NSO issued copy of you marriage certificate for the interview, the same one as in the sample everyone showed you previously. I only submitted the non-NSO civil registrars copy with my I-130, If I'd had the NSO issued one at the time, I would have submitted it.

Remember, for the I-130 submission, only send in photocopies. Originals will not be returned it you submit them. Once you move on to the NVC, that's when you'll be required to submit the "original" documents.

"ANY ANSWER" is not appropriate, i.e., what if they put "George W. Bush - former President of the United States" as their answer? What if they say that their fiance is paying for it when in fact their parents are paying for it? How is this neither right nor wrong?

Your best bet is to get a certified copy from DFA. The US embassy will NOT notarize foreign documents. This is stated in the instructions for the W7 if I remember correctly.

Agreed...it wasn't answered definitively one way or the other...some thought it was required and others didn't. Not an iron-clad case, for sure...but other countries seem to think that requirement holds as well...India seems to need these.

Apparently the word 'local' is, as far as the Philippines is concerned, the NBI...even though local police keep records and they are available.

I'm not unhappy to hear this at all...very happy I don't have to submit these..since they don't seem to meet the requirements anyway...but based on the website I read, it looked like DOS meant local as in local town...not local as in your country.

In India, based on what I've read here at VJ, for example, local really does seem to mean local police.




Of course...on her NBI certificate they put 'No record on file'...meaning she's never had any encounter with the NBI at all.


This was quite a headache inducting thread for me. I've researched and investigated the requirements for months and never once saw any indication that local police clearance certificates were required in the Philippines. See section 7 on page 2 of the IV packet from the US Embassy Manila for clarification. Read the entire document for much more useful information that is specific to the Philippines.
