IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavit of support
QUOTE (Ling Ling @ Sep 2 2008, 12:29 AM) <{POST_SNAPBACK}>
I just took a look at the I-864, I-864EZ, and I-864A, and didn't see anywhere that it needed to be notarized.
I took another look at the I-134 (used for K-1 visa) and it clearly has a section at the end where the oath of responsibility has to be notarized.
Very odd...because the I-134 is not a binding contract (per se) and the I-864 is a binding contract.
That is, once the K-1 is granted, you can still decide not to marry...the responsibilities are null, and the beneficiary returns to their home country.
With a CR-1 and the I-864, you are bound to the beneficiary even if you separate or divorce, until such time that they return to their home country or have conditions removed.

Given the vast difference in responsibility, one would think that the I-864 would require notary as well. But apparently it does not.

Thank you so much for your help,,and I finally sent it through USPS.

I saved the coversheet already.
What would be the next step that i need to do?,do i just wait for the NVC to mail me the next step?

If you wait for NVC mail it might take a looong time, a few weeks.
You can send DS-230 with required documents already, with the cover sheet included.
If you already send 864 you will be done sending docs. Unless they will find RFE.

So its fine to send the DS-230 without receiving any go signal from NVC? as l long as i have the coversheet from the IV payment?

I already sent the I-864 and I think they haven't receive it..what does RFE means?

You should get all the required documents for the DS-230 ready and print out the form to mail it to NVC. Good luck.

Would that means I don't need to wait for them to give me a go signal through mail to send the DS-230?
As long as I have the Coversheet I will be fine to send the DS-230?

K-1 Fiance(e) Visa Case Filing and Progress ReportsMarch 2010 - K1 CSC Filers

I'm kind of wondering why people say to call the NVC to get your case number. Doesn't the NVC send you a notice when they receive your approved petition? I guess I just assumed the case number would be on that notice. Am I wrong?

I hope the rest of the March filers will get their NOA2's soon!

I believe the NVC letter does contain the case number. However, for those filing in the Philippines, a copy of NOA2 and the NVC case number is sufficient for the medical exam.

Just called the NVC and got our case number. NVC said our approved petition was received yesterday and usually takes about five days before sending it off to the appropriate embassy/consulate. Hope they send it off soon.

Hang in there for all March filers still waiting on NOA2. Hope to see more approvals soon.

We are in the process of assembling our packages to send to NVC and I have a serious doubt. It ask for translation of every document that is not in the english language but it doesn't ask for an apostille on the translation.

Does anyone know if a translation is enough? How does this work?

Thanks in advance

I've read any kind of guide possible and I stil don't get what's the first step to do after I receive a NVC case number, are you sure I can do anything without him? We won't have any kind of fast communication.

I'll access his bank account and pay the fees? They won't send him anything via snail mail?

I'm being paranoic but he wasn't supposed to get deployed and..,this just sucks.

IR-1 / CR-1 Spouse Visa Process & ProceduresCase at NVC, but husband not in the US.

Hello everyone, I already posted something similar in the military forum but didn't get any info.

For military reasons, my husband won't be in the US for much longer. Our visa petition was approved yesterday from USCIS and we haven't received a hard copy of the NOA2 yet, so... I suppose we won't be able to finish with NVC within the next 20 days. Am I right?

Is there a way I could do it without him being physically in the US? Should I have him sending me everything for the AOS package and send it myself? Will they send something to him?

We are not concerned about the payments, we can both do that, but he won't have any fast internet access for the next months.

Any advice will be very helpful :)

IR-1 / CR-1 Spouse Visa Process & ProceduresBIRTH CERTIFICATE at NVC

You need to go and obtain another original birth certificate and marriage certificate because USCIS does not send anything to NVC and you were required to send photocopies at USCIS stage.

Do not panic, I'm sure it's not that hard to obtain a birth certificate and a marriage certificate. You will be fine.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-3032

The DS-3032 is obsolete. You'll now be filling out the DS-261 online. You can fill it out.  No need to sign anything. Also, they just care that the payments for the AOS and the IV come from an American bank account, not whether or not it's yours. You might want to check out the monthly NVC thread posts 1 & 2 as they will answer most of your questions.

Thank you. Not very familiar with the forum or anything honestly. We did pretty much anythinb without VJ and then I found this place but I can only go to certain things. lol.

Hello everyone,

We are at the NVC stage and gathering documents is all we are doing now while waiting on a case#. On the form I-864ez it asks for my Alien Registration Number, my husband says we don't have one because it doesn't appear on our NOA2 or NOA1,

Is this possible? Should I leave the space blank?

I was issued a exchange student (J1) Visa in 2008 but there is no ARN on that either.

Thank y'all,.

IR-1 / CR-1 Spouse Visa Process & ProceduresI864EZ: most income from W2 and small self-employment income

called NVC; having 1099s do not disqualify you from the i-864ez.  the only condition is that these 1099s are not used to help you qualify and instead you are using income from W2's.

If you send a copy of your 1040 instead of a tax transcript, they do request copies of the W2's+1099s.  This is listed in the instructions,

"If you provide a photocopy of your tax return(s), you must

include a copy of each and every Form W-2 and Form 1099
that relates to your return(s). Do not include copies of these
Forms if you provide an IRS transcript of your return(s) rather
than a photocopy."

Sorry to crash this post..didn't want to open a new one.

Form 1099 is for miscellenous income, which not everyone has.
Should I call NVC and ask if it's okay to send a copy of our 1040 with only W2's and not 1099s? (Couldn't get tax transcript because the website doesn't recognize my husband address)

IR-1 / CR-1 Spouse Visa Process & Procedurespreparing I-130 form

Hi vincesca,

The best places to look are here: http://www.uscis.gov/i-130 and here: http://www.visajourn...tent/i130guide1

Unfortunately, there is some misinformation in the replies you have already received. USCIS no longer requires certified copies of anything under normal circumstances. Legible and complete copies from a scanner or copy machine will do just fine at this stage. No need to send any original documents either--you will need those later on, but not for the I-130. Source: http://www.uscis.gov...cations-mailing

You do need translations and you can see those instructions here: http://www.visajourn...nt/translations

The USCIS instructions having to do with translations are also in the first link above. I think the term "certified translation" is what throws people off. I've never seen anything stating that the petitioner and beneficiary are not allowed to do the translations. Plenty of people on the forum have translated their own documents.

This forum is better than any lawyer. Don't be intimidated!

IR-1 / CR-1 Spouse Visa Process & Procedurespreparing I-130 form

Hi,

I am new to this forum.

I am Italian and I recently got married with my American husband and we are getting all the documents to file the petition.

I have a couple of questions and hope anybody can help me:

- Which kind of evidences of your bona fides marriage did you add? We have the marriage certificate, a joint bank account statement, pictures of the wedding, two affidavits from friends.. Do you suggest that we add anything else?

- Since we got married in Italy the marriage certificate is in italian. Do we have to get it translated from a certified US translator or is if fine if a person that is fluent in both italian and english translates it?

Also, I am a little worried about doing this alone without using a lawyer. Has anyone done this on their own and can you reassure me that we are doing the right thing?

Thanks so much in advance :)

Ciao Francesca,

this is what we sent :

Evidence of Bona Fide Marriage:

  • Letter explaining our relationship history, marriage, and our future plans together
  • Copies of affidavits affirmed by third parties having personal knowledge of the bona fides of our marriage
  • Copies of travel documents showing beneficiary?s trips to the United States to visit petitionary (Flight itineraries, passport stamps, boarding passes.)
  • Copy of Chat logs and messages (Skype, Facebook, Google Hangouts, Whatsapp)
  • Photos as evidence to our bona fide relationship and marriage

I would add some pictures of the two of you before the wedding, but I think you have pretty much everything they might need.

Anyone who is fluent both in English and Italian can translate the marriage certificate, however the petitioner or the beneficiary can not translate the document.

IR-1 / CR-1 Spouse Visa Process & ProceduresW-2 Doubt, please help.

Do you think so? Because the instruction say to not send anything State or Local related and the W-2s we have are the one to be filled with state or local taxes.

It really does not matter which form you send as long as it shows the correct income that was filed along with the tax return :)

IR-1 / CR-1 Spouse Visa Process & ProceduresW-2 Doubt, please help.

Hello everyone,

we re finally ready to submit our Affidavit of Support packet, but (OF COURSE!!)I have a doubt.

We are not sending IRS tax transcripts but our copies of my husband's tax returns. We were told several times we would need to submit his W-2 and every other attachment to his form 1040A.

Now, I noticed that his W-2s are different. I'm going to try and explain what I mean. For each year (2010, 2011 and 2013) there are two different W-2s, one says "Copy to be filled with Employee's State, City or Local income tax return" and the other one says or it's supposed to say "Copy B to be filled with Employee's FEDERAL tax return" and it's from IRS...

Now which one is the right W-2? Because my mother in law said that the federal W-2 is sent in with the federal tax form at the time of filing, so I will not have a copy of it and the one I have is just a copy of a copy and I should disregard it.

Please help me, because I was about to send the packet tomorrow but I don't think I will.

From Saylin NVC Wiki:

Original or Certified Copy of marriage certificate, PLUS A PHOTOCOPY

Add one photocopy for the husband's birth certificate and one for the marriage certificate and you are good to go.

Hey my VJ family!! First off thanks for everyone's help, I would seriously would be in the mental hospital if it wasn't for you guys! So this past week we've been able to do the DS-261, AOS fee, and IV fee, which in my opinion is great right? Sounds like NVC is getting their act together....maybe??  Anyway I've gotten our packets together and plan on sending it tomorrow or Friday.  So here's a quick run down of what I got for each packet:

AOS:

Cover Sheet with bar code

Personal cover sheet

I-864 signed and dated

3 years transcripts

Employment letter

IV Packet:

Cover sheet with bar code

Personal cover sheet

Husbands BC w/ sticky note

Marriage Certificate w/ sticky note

Husbands 2x2 pics

Husbands police certificate

Husbands bio passport page

I believe that this is all that is suppose to be sent in, but I can't help but to doubt myself and feel like there is something that I'm missing.

I would also like to know the answer to this because I'm wanting to change my last name as well. I couldn't do that in the forms because the embassy said I had to use the name in my passport.

Italy doesn't allow me to change my last name to my married name, therefore we thought I could never change my last name...little did we know that I could have change it by putting it on the thousands of form we filed, so now I was told that I might have a last chance before having to file for a card replacement and spend $450....

Is it true that when I reach POE I will be taken to a small processing room and at that time I will be able to request to change my nane to my married name or am I dreaming?

i know i will typicall be waiting 5-10 months max so im not stressing that, just nervous about any RFE'S.. and what medical are we talking about?..for me or for my fiancee?..how much would that be? i guess i havent reached that part yet..ur scaring me man! haha

The medical is for the beneficiary in the foreign country. They typically cost between $150 and $300. You can check the website for you consulate to find out for sure. Here is the link to the Panama consulate information available here on VJ, I'm not sure how up to date it is, so be sure to double check. http://www.visajourn...nama&cty=Panama

OK..just decided to check my bank statement and it seems like they cashed my check on 11/26.2010 (black friday).. i sure hope no one is having a field day with my money cause i havent got any word back , not even a text / or if its been touched!..

this worries me even more since id rather hae them not touch my check first!

Calm down. Pulling the check from the package and cashing it is one of the first things they do. The check being cashed is a definite indicator that they've received your package and haven't rejected it.

Did you submit a form 1145 with your petition and if so, have you received the electronic notification of receipt via email or SMS?

You should receive your NOA1 in 2 or 3 weeks. After that hold on for a long wait, typically 2 - 5 months for an I-129F approval. After that, enjoy sending in more checks and waiting some more :crying::bonk:. Oh, and don't forget about paying for the medical.

K-1 Fiance(e) Visa Case Filing and Progress ReportsOctober interview passed but without all documents needed

Ok, I need help here. My fiance did her interview on October 15. She did not have all the documents needed at the time. I told her to reschedule interview until I send the documents. Well, she goes to embassy and has interview anyway and passes it. So I send the proper documents and she takes them to embassy on November 8th. Now its December 7th and she still has no Visa. I was doing freelance bookkeeping and was waiting on checks is why it took so long to send documents. So I called the new call service number and no help at all. My fiance called the number in Manilla and still no help. Does anyone know a number I can call to see what is the problem with our case? I really need help, I hate waiting this long. Thanks...

A little more information may be helpful. If she "passed" her interview and was approved for her visa, why did she bring additional documents back to the embassy?

What form was she given at the completion of the interview and then again when she dropped off the additional documents?

What did the consular officer actually tell her at the completion of each of these visits?

During which of these visits did they keep her passport?

Did she pay the Air21 or 2GO fee for delivery of the visa?

The only number I'm aware of is (from the US)0116323012000 for a voice call.

You can see their fax number (and instructions)at this link http://manila.usemba...contact-us.html

I hope you get this resolved soon

K-1 Fiance(e) Visa Case Filing and Progress ReportsWe should be hearing great news from june and early july filers.

Are you serious right now?! "Longer" as in figuratively speaking. Not as in actually longer. More like the minutes feel like hours type thing. Wow, just wow.

And if we were'nt speaking figuratively, how the hell would the holidays make it shorter?! It would be THE SAME AMOUNT OF TIME. It is still a day.

For everyone else... I said NO to this post as I refered to another one made by her/him about the holidays making the wait time shorter for Oct/Nov filers. Makes no sense. If it's just me... Please explain.

I would think the the holidays would cause the process to take longer. Do to personnel at the service centers taking extra time off to go on vacation, be with family at home, etc. I'm not sure why someone would think that it would shorten the timeframe.

Not very helpful, I know, but it makes sense to me.
