IR-1 / CR-1 Spouse Visa Process & ProceduresDS 230

Well folks I've got some bad news. After paying the AOS and IV fees, sending in all the required forms, and waiting for nearly a month... I get an email yesterday from the NVC saying they also need my wife's DS230 and all civil documents. HUH? The embassy website clearly states these documents will be collected on the day of the interview. So I call the NVC and they confirm that the documents are required before an interview date will be set.

Fortunately we had completed the DS 230 two weeks ago and it only needed to be printed out. So she sent a Fed Ex envelope with all the documents to me yesterday and when it arrives here I will include the email letter and cover sheet and send it to the NVC for another month of delays.

For those of you at the stage of AOS and IV fees do yourself a favor and triple check everything. Even call the NVC with the list of documents you have and see if they are going to work.

Good luck to all....

Can you please post a link to the page that says the Immigrant Visa application (DS-230) will be collected at the interview? I was never given that impression by the Embassy Website, the NVC website, nor anything posted on Visa Journey. All of the guides and the information on the NVC site state that it gets sent to NVC along with the coversheet you print online after your IV fee is marked as PAID. I'm just curious as to where this contradictory information is located at on the USEM website.

Thanks,
George

IR-1 / CR-1 Spouse Visa Process & ProceduresPRISM and CFO address in Manila

I have the PRISM address which i got from their site (Taft AVe.) and CFO (quirino ave) but i need a more specific description of the place and landmark so I could tell the taxi driver. And does IR visa holder needsthe prism seminar? is it the same with pre-departure seminar. thanks!

PRISM is right across the street from De La Salle University, in the BDO building. Once you're done with the seminar, everyone else there will be going to CFO also, the taxi drivers out front are very familiar with where you need to go from there (CFO). The people that work in PRISM can also tell you how to get there by jeepney, bus, etc.

George

P.S. My wife just completed hers recently.

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling taxes as married

I have been working on my taxes this weekend. If you take time to read the instruction book, it explains very clearly that if you are married to a non-resident alien (your spouse lives outside of the US) then you need to file as single (or head or househols if you have a dependant living with you.)

Read IRS publication 519, especially pages 10 and 26. The 1040 and 1040A instructions are not all-inclusive.

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling taxes as married

If you were married by Dec 31, 2010, then you can and should file married taxes for year 2010. As stated above, if no SSN, ITIN is possible, and it is also possible to file without any number at all and just put "NR" for non-resident in the appropriate box. Further instructions can be found at irs.gov for non-resident spouses. So yeah, he's wrong on both accounts ;)

Received my NOA2 email today!

For those of you who are keeping tabs on their I129Fs, my petition went to the California Service Center and they received it on 09/13/2011. Had a touch on 09/19/2011, but absolutely no updates on the USCIS website since then. Then BAM!!! Today's email 142 days later. Fantastic news for me and Good news for those who filed in September 2011 and thereafter. It looks like the pace is picking up again at the CSC. Hang in there to all you VJ members and Good Luck to you all. I'm on to the next steps at last!

K-1 Fiance(e) Visa Case Filing and Progress ReportsCase Number Issued!
Just called the NVC number, and got the news. Case Number issued on 02/08. Took 6 days from CSC to issuance at the NVC. Was pretty simple and painless and if I may add, nice to talk to an actual person instead of an automated system. Whole process took about 3 minutes!

I did ask how I could track the package when it leaves the NVC, but was told they don't provide that. How do you manage to get a DHL tracking number?

K-1 Fiance(e) Visa Case Filing and Progress ReportsNOA2, Sent to Embassy 1/18, then....*crickets*

Everyone,

I got my noa2 on 1/5, it was sent on from the NVC to the Phillippines Embassy 1/18, and since then...Crickets.

I am concerned that my fiancee and I have been lost in the shuffle, esp when I look at other people's timelines and I see approvals fairly close to the NOA2.

My questions are:
1) Am I just being a whiner? Is a 2-3 month delay standard?
2) If this is beginning to look serious, would it be appropriate to have my Fiancee stop by the embassy to check it out?
3) If the Embassy does take action, do they use our email contact information to let us know? My fiancee has had mail stolen from her in the past.

Thanks for your attention,

Whan

If you've confirmed that the NVC sent your case to the US Embassy in Manila then you will have a MNL Case Number. Contact the US Embassy in Manila and give them your MNL Case Number. If they have it on system, then you can go ahead proceed with the necessary steps in the interview process. If you are waiting for the letter mailed by the US Embassy to your Fiancee that says "Your case is eligible to be scheduled..." then you may be waiting forever.

I know exactly what you are feeling. We went through the same thing regarding the tests, and more (DOT). In the end all will be well. If negative, then that's great news. K-1 Fiance(e) Visa Case Filing and Progress ReportsSad Medical Exam

I did my medical exam today in St. Lukes. I was asked to undergo sputum test due to the abnormlity they saw in my cxray. It really made me feel crying because I never expect to have it. Starting Monday until Thursday, I am going back to the St. Lukes for the test. Then, the result would be in firstweek of January. Anyone the same situation? :(

It's happened to many including my Fiancee. Always keep in mind that this is for your benefit to ensure that IF you are indeed positive you are treated according to the standards required for immigration into the US. My Fiancee had to undergo DOT for several months, but we both understood her health was the most important thing. All will turn out well no matter what the outcome of the test. God Bless.

K-1 Fiance(e) Visa Case Filing and Progress ReportsFinally Approved. Thank You Lord and everyone <3

I Cant believe the day I have been waiting for has finally come. We are approved July 29th 2013

''On July 29, 2013, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.''

My fiance and I has filed January 31st and Received Noa1 February 4th and we were very persistent. Although, there were times we felt hopeless because we saw so many people being approved and ours has been over 170 days.

I just wanted to share to everyone that you can file an e-request online so that they can check your case status if its over the case processing time. It wasnt too long before they checked it and now we are approved. Not to mention, we called every other week or 2 just to follow up with any update.

Thank you everyone who has been so helpful and been following us this whole journey its just the beginning and I can't wait to be with him soon. I hope you guys have your approval as soon for those who didn't you can try message me and we can do what I did smile.png.

Ps. for those who is already approve what did you guys do right after? waited 2 weeks for the number? I was following the checklist but its so complicated >.<

Congratulations!

Wait about 5-7 business days then call the NVC.  They should have your MNL number by then, if not keep calling until you get it.  Once you get the number, you can pay and schedule the interview.  The USEM should get the package from the NVC in about a weeks time once they issue the number.  Good Luck!

K-1 Fiance(e) Visa Case Filing and Progress ReportsIF ALL GOES WELL..

thanks... ya i don't like leaving things to chance either, but it would be awesome to arrive together. i especially want to be there when he goes thru customs... you're from guam.. you know how vicious some of those guys are lol... i have friends who are officers and i think they might mess around with him.. oh my!

i guess its ok if we don't come back together... as long as I'm there... thats important..

btw... what was the interview like from the petitioner's point of view?? and was it a long wait?

Good point about Guam Customs, and yeah sometimes they do their jobs to the extreme.

You can always go back to pick him up.  You may think it costs more, but if you consider the potential re-booking fees and penalties for 2 tickets it comes out almost the same as your one ticket to go the second time.  Just food for thought.

For me, it was a great benefit to be there.  I've written about it on a few posts as well as my review of the US Embassy in Manila.  The CO asked me just as many questions as my Fiancee.  I think it was like 3 questions each.  We were confident and I had assembled a ton of evidence so we were very well prepared.  I do have to say we had a long long wait.  If I remember correctly, we arrived sometime around 6:00 AM for a 7:30 AM interview and we were done sometime past 1:00 PM.  We spent the time relaxed and talking about other things like what to eat for lunch.  LOL

K-1 Fiance(e) Visa Case Filing and Progress ReportsIF ALL GOES WELL..

Great to hear you will be there for his interview.  It is possible for him to fly back with you, but it will be tough to predict a date that he will have the Visa in hand.  That's the challenge.  I went to my fiancee's interview, and then flew back to Guam alone.  I went back to the PI the following month to fetch her after she received her passport and had enough time to pack and say her goodbyes.  The whole visa process taught me not to leave things to chance, but that's just me.  Good luck.

K-1 Fiance(e) Visa Case Filing and Progress ReportsAppointment Cancellation / Spteum Test

Thank you to all that replied.

Bebe and I have been together going on 4 years now. She graduated from PWU in March. Her education is very very important to me. I wanted her to have her BA from Phil University before coming to the U.S.

When she gets here and after a 1 year break, I want to send her to University of Houston or Texas A&M for her U.S. degree.

After that, she will be set for life. Her future good will, career security, and financial security are extreamly important to me. When she finishes her U.S. degree, then she can work. There is always time for work.

If she wants to go in the job market after her studies, that will be her choice. If she wants to stay home full time, she has that option as well, If she wants to go in business with me, she can do that as well after working in the job market for 5 years or so. I want her to have practical experience so she is familiar with how society works. I always want her to be in the position of choosing to do something and NEVER in the position of she MUST do something.

If and when she ever wants to return to the Phil to retire, she will be in GREAT SHAPE.

I simply cannot understand some men who DO NOT allow their Phil wife to attend school, get a job, or improve herself. It simply boogles my mind why you would want to keep a woman under lock and key.

By giving her the opportunity of growth and freedom to choose, you will know exactly where and how strong your marriage and freindship really is or is not.

I pray the culture is negative in 2 months. We have both come to the point where we are ready to be together. In the beginning she was very skeptical that long distance relationship could grow and cultivate into something real. It's been a long road. There have been very few rough patches or bumpy roads. She knows how I truly feel towards her and that her health, happiness, and love are most important to me. For the first time in her life, she truly knows, feels, and understand what UNCONDITIONAL love is from a man towards a woman. I remember when she told me she felt it in her heart. That was a day of rejoice and celebration in our heart. She finally felt PEACE in her mind and heart knowing that I would never "play" her. I would never "leave" her. I would never "desire" another woman.

Now that we are at this part of the I-129F process, missing each other has intensified. So the pain is becoming more noticable and real in each of our daily lives. Healthy depression sets in a little more often than in the past. My business and her job keeps both of us busy for 12 to 14 hours per day, it's the down times where the thoughts drift east and west across that great big pond we call the Pacific Ocean.

Now we have to wait until the 27th of November to see where we are at in the process.

I still think and will always thinkv it was simply a shadow on the x-ray. I simply do not understand why they do not do an additional set of x-rays on day 2 of the medical for confirmation.  That would seem the logical path to follow for me.

To my Bear, I will always be here for you. I will always Love you. I will always support you. I will always believe in you.

Great post.  Now your love and support will help you both get through this.  When SLEC does reschedule her interview, have her double check all the info on the print out (you can do the same online).  SLEC messed up my step-daughter's schedule a tad and I had to fix it (We did a K1 and K2).  Good Luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about medical

So..I read the document and saved it. I don't know if I'm 100%, but it seems like they are likely to give transfer treatment to children under 10 years unless they find overwhelming evidence of active TB. All we know is our son's skin test is positive according the doctor, but he's been given the BCG vaccine like most filipinos. Also, they only saw a small singular calcified lymph node that she claims looked like it was healing. I'm not sure if that's possible, or if that counts as a "cavity" or "scar", but to me I have some more hope on not being delayed 2-6 months. I think might do a sputum and just wait for the smear results(?).

It's really hard finding info on children for this. He's 4 years old and my wife is worried he may not be able to provide sputum. Do they have any techniques for acquiring sputum for the young ones?

Thank you for your help..that was a great read..we at least have some more hope about this.

Even if you have him do a culture prior to the SLEC Medical Exam, they will still do their own tests.  I don't mean to sound negative, but chances are high that you will be delayed.  Since he was already given a PPD test and it was positive, he'll more than likely be required to do the SLEC sputum and culture tests.  Can't say for sure, but more than likely.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about medical

I can't say for sure in reference to children and the CXR results as my experience was with my wife.  SLEC will adhere to the CDC requirements for TB Screening for Immigrants to the US based on the CXR or if there are any positive results from the sputum or culture.  You  can read more about the Transfers HERE. See page 14.

You can read FAQs about the TB Screening for children HERE.  Includes information on possible waivers.

I undertand your concerns and I hope someone else can chime in with some sound advice or experience with children.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about medical

Would taking the medicine now be credited towards treatment? Or should we wait for the medical and results? We don't expect to wait long before attending the medical.

Yes, depending on the medication and the duration SLEC will classify this as a Transfer.  Bring all pertinent materials from the treatment to the SLEC Medical Exam.

If the same spot is seen by SLEC, discuss the outside treatment with the physician.  This is will be the time the physician will decides if whether or not to allow the classification as a transfer.

We may be able to help with a little more info. The next step should be sending your AOS package and DS-230. Who did you select as the agent on the DS-3032?

I select myself as an agent,,and what I did with the DS 3032 is i sent it to my husband to have it sign
and luckily my sister was heading back from philippines so she was able to bring it to me with the sign of my husband.
and i sent it myself..I don't see any mistake in that right..coz mailing from philippines would take i while.
and it's been a week when they received it,,so im just waiting for the next step..

Thank You so much you guys are helping me a lot..

Your co-sponsor needs tax transcripts (or W2 + 1040 tax return), photocopy of US passport or naturalization cert or birth cert to prove US citizenship, if he is a household member, you will need to submit documents to prove relationships between the sponsor and co-sponsor i.e. birth cert, marriage cert, etc.

May be you can tell us how is the co-sponsor related to the sponsor, then someone can tell you exactly what documents you need to submit to NVC.

I just took a look at the I-864, I-864EZ, and I-864A, and didn't see anywhere that it needed to be notarized.
I took another look at the I-134 (used for K-1 visa) and it clearly has a section at the end where the oath of responsibility has to be notarized.
Very odd...because the I-134 is not a binding contract (per se) and the I-864 is a binding contract.
That is, once the K-1 is granted, you can still decide not to marry...the responsibilities are null, and the beneficiary returns to their home country.
With a CR-1 and the I-864, you are bound to the beneficiary even if you separate or divorce, until such time that they return to their home country or have conditions removed.

Given the vast difference in responsibility, one would think that the I-864 would require notary as well. But apparently it does not.

Thank you so much for your help,,and I finally sent it through USPS.
