Im a US citizen and i have lived in the Philippines for the past 7 years now. My family is moving to the US. In the I-864 they asked for my domicile, should i list my domicile as the US or the Philippines? help pls...




Your domicile should be the United States. You are going to be a Sponsor of your fiance/wife and a sponsor should have the US as domicile. Even if you dont reside there, you consider the philippines as a temporary residence and you eventually will go back to the States.

Domicile:

The final rule does provide in section 213a.2?1)(ii) a single exception, under which a sponsor who is not domiciled in the United States (i.e., cannot show his or her residence abroad has been only temporary) may submit a Form I-864. The sponsor may do so only if the sponsor establishes, by a preponderance of the evidence, that the sponsor will have established his or her domicile in the United States no later than the date of the intending immigrant's admission or adjustment of status.

The intending immigrant will, however, be inadmissible as an alien likely to become a public charge if the sponsor has not actually become domiciled in the United States by the date of the decision on the intending immigrant's application for admission or adjustment of status. Thus, the sponsor must arrive in the United States before, or at the same time as, the intending immigrant, and the sponsor must intend to establish his or her domicile in the United States.

Hi all,

First I would like to thanks all Visa member for helping me through out the year. It's been a very though journey for me and my wife to get her VISA. Our journey is almost at the end. Hopefully this time she will get pink. :)

My wife just get a letter from the consulate asking for DS-230 today. When she fill out the form, she run in one problem. Her parent only have the year of birth. When she try to fill out the date of birth for her parent, it wouldn't allow her to put only the year. Can she leave that blank and fill it out with a pen??

Any one have bad experience mailing document to the consulate? Is the mailing system over there safe? I don't want my document get lost some where. My wife is planning to go to the consulate to hand in the DS-230 but it very far from where she live. Any sugguestion??

I know the US Embassy controls the medical exam at the country in question. They also have approved medical facilities that are allowed to perform these exams. I think medical exam information is sent out along with the appointment interview notice but I am not sure on that.

My wife is currently working in her country but will stop working once things get close to VISA Time. Does anyone know if there is a way to get the exam performed in advance at one of these facilities while my wife still has insurance coverage from her place of employment?




She can have her medical (walk-in)as long as she already has the case number. Unfortunately, her insurance may not be used to cover expenses for the medical.

it depends in the doctors what vaccination they will give. She will have a blood test,xray,urine test, immunization interview and physical examination. I had my vaccination when I was young but when I went in my medical last week they gave me MMR and anti tetanus..




Did you bring any record of your previous vaccinations? If you merely say you had it as a child and has no record to bring, would they still administer? How about the one for chicken pox?

This is mainly a self-help, DIY type site. It's unlikely you'd get a fair sampling of people using a lawyer for the K-1 process. Most people here would probably recommend not using a lawyer unless you have major problems or issues with your case. I'm sure someone else can come up with examples of what would be "major" problems or issue.

Hello everyone,

As some of you know my fiance had his interview on 1/12/11 in Cairo and was approved, but was told he had AP and should receive his visa in 4 weeks. Well with everything that is going on in Egypt we were unsure what was happening with his case. On 1/27 I emailed the embassy (before they closed) with a question about our case, and finally this morning I received the following reply:

The Embassy regrets the inconvenience caused to the Egyptian public by our current inability to provide visa services. In light of current situation, please note the following:

The U.S. Embassy is currently providing only emergency American Citizens Services in the Consular Section. Americans needing emergency services can come to the Embassy's West Entrance (Consular Entrance) from 9:00 am-12:00 noon Sunday-Thursday.

Due to the security situation and reduced staffing at the Embassy, no visa interviews are being conducted until further notice. The Embassy will inform Vodafone and the public when we are able to begin visa interviews again.

Any visa applicant who was interviewed on January 27, 2011 or earlier and whose passport is currently at the Embassy for visa issuance will have his/her case processed to completion. All issued visas will be returned by DHL. DHL will contact applicants regarding the delivery of their passports.·

Visa applicants should not come to the Embassy to inquire about the status of their cases.

Not sure if I'm interpreting this right, but it sounds like since his interview was prior to 1/28 and they have his passport, then they are still processing his visa, even though the visa department is currently closed. What do you guys think?

I had posted a couple of weeks ago regarding our case
My wife had applied the I-130 for us back in August 2010 from NY.
in Octomber - We received the RFE for the missing passport style photpograph, strange it was sent already

We send it again to the lawyer, and he sent the packet back to immigration within the allowed time frame

December case was approved, repoened the same day then denied - Then for three months we got nothing,

Sadly, The denial states that we did not submit the required photograph for my wife -

Sometimes we get so consumed with immigration errors and shortcomings that we see nothing else.

They denied us on reasonable grounds, they requested the pictures and we sent the wrong set.

Did I do the wrong thing to trust our lawyer blindly to submit all the required evidence..? I dont even think we have grounds for an appeal -



Exactly what wornge "set" of pictures did you send? The I-130 only requires 1 passport style picture of the petitioner and 1 of the beneficiary. You seem to have put a lot of faith in your lawyer. Did he happen to give yo a tracking number for the "packages" that he sent in? It all sounds kind of fishy to me.

Hi to all,

I really need your advice.

Me and my husband plant to start the visa process this year and we try to fix his tax return above all, also for the affidavit of support purposes.

He has a daughter on his first wife.(she is divorced , no children. She message to my husband last few weeks if it's okey to claim my husband to be her dependant.

On the first place, my husband have no stable job, like work on the company. He will be considered as self-employed. He generate income by doing some painting jobs, car repair,selling stuff on craigslist and any possible work he can do. He called the IRS and stated his job. The IRS said, its not a job its a "hobby". we don't understand either why the IRS called it as hobby. Besides, his income annually qualifies him to be my sponsor for the visa.

We were considering his daughter to be a co-sponsor in any case.

The question is: If my husband be a Dependant of his daughter, and his daughter will be my sponsor, does it any have negative effect on my visa process? Or has a negative effect in our lives in the future? How does it work?

I am really hoping for your kind reply...

I'd suggest consulting a tax accountant or a lawyer, but I believe it may be ILLEGAL to claim someone who does not live in the same household and whom you do not support as a dependent on your income taxes. He should probably file his own tax return claiming all of his income and business deductions, and you as his wife. This will show that he has the required income for the AoS and filing joint with you will likely reduce his tax obligation.

If you're legally married then you'll want to file a petition (form I-130)to enable your spouse to apply for an IR-1/CR-1 visa rather than a K-1 fiance(e) visa. The instructions for the I-130 do not mention any age limitations for the petitioner. You definitely have to be 18 years of age to sign the affidavit of support though. Depending upon your birth date, you may want to file the petition now, with the hope of having another birthday prior to the petition approval and your having to send the AoS to the NVC.

You'll use the earliest marriage certificate since it's the one that counts. I assume that the Singapore marriage certificate is from January 2009 and that you're aiming to get an IR1 visa? I'm still not certain why someone would have two civil ceremonies with different dates...usually it's civil and church. You'll probably have to explain the two separate marriage certificates and dates, since it sounds like you used the later one to file you I-130. Good luck with your NVC Journey.

Ok, so my wife went to go get an updated passport with you married name, and they told her that she needs the Certificate of Attendance from the CFO. My question is, what paperwork does she need to just get the certificate. She doesn't need the sticker and shes not leaving the country yet. I haven't even sent off the I-130 yet. There seems to be no info on what exactly she needs just for the certificate. Help guys! Thanks.


She needs to attend the seminar. Marriage certificate and old passport, along with birth cert and NBI clearance should do it.

I'm an American living abroad on a 2 year work visa and my boyfriend and I want to get married. It's not easy for us to marry in this country, but if we are able to, I'd like to bring him over on a CR1. We'll be applying for it from abroad as I won't return to the US until he's allowed to come with.

My questions:

1) I don't have anywhere for us to live other than my parents' house back home. They can't co-sponsor him, and I have been a student so my savings are minimal. Do I have to provide proof of support?
2) How soon can he start working?
3) Someone mentioned to me about residency requirements for US embassies, with regards to applying for the CR1. What does this mean?

Knowing what country you were speaking of would be both enlightening and beneficial.

1. You must submit an I-864 Affidavit of Support showing that you have income equivalent to or more than 125% of the poverty level. See form I-864P for the poverty guidelines.
2. With a CR-1 visa, he can start working almost immediately. Basically, most employers will want to see his green card and SS card. Those usually arrive within 4 - 6 weeks.
3. For most countries, you must have been legally resident in the country for 6 months prior to filing if you want to do a Direct Consular Filing at the Embassy/Consulate. Otherwise you'll submit your petition to the USCIS in the US.

Hi everyone,

I'm the (USC), and my wife back in her country, she has a small business opened Jan last year for Physical therapy, with all expenses she didn't make no money last years. We got married at the end of last year also. I sent her W-7, she signed it and returned to me. I'm filling for my tax return now, and the tax preparer suggested if she didn't make any money we can put her as unemployed, honestly I didn't like the idea. I'm just worry if we do that, it may haunt me later in her interview and in other process.

In another note, the tax preparer said, I have to send the papers with W-7 to TX for federal then they will issue the ITEN, when I get that number that I can file for the state. Is this correct ?

Any body with the same situation, would you please advice, I really appreciate your help.

P.S: I have till Monday to send the papers to TX

There is nowhere on the tax forms to say employed or unemployed. If she had no income or "make no money" as you put it, then her earnings would be zero (0). There's not a separate place on the 1040 for your income and her income, they are combined. Selecting "married filing joint" would benefit you both financially. In addition to the W-7, don't forget a statement/declaration signed by both of you stating that she want's to be treated as a US resident for tax purposes. Read IRS publication 519 (especially pages 10 and 26) for more information concerning this. http://www.irs.gov/p...rs-pdf/p519.pdf

I don't have to file state taxes, but you would need her ITIN in order to file. My federal taxes have been processed and refund was direct deposited already, but I'm still uncertain where they will send my wife's ITIN number (her foreign address or address in US).

we have not yet received any mail. is it possible that the mail is already NOA2?


Yes, that is your NOA2. Congratulations!!!

How about updating you profile and timeline to reflect what visa you're a petitioning for and what service center you used. "embassy" isn't really very enlightening as far as filing locations go.

our lawyer send all documents 6months ago and nvc only noticed that our form i-864 is missing this feb.. is that mean we have to wait 4months again before they review our papers.. that's so sad..

how common is it for NVC to lose documents? I'm super scared to send my original marriage certificate because it's the only one we have...- i have no idea too, that's why im sharing my experience for VJ members to know.. (do you really have to send the original marriage cert at nvc? that's too risky, is a copy not allowed? i dont know that too cause our lawyer is the one who send all papers and i can send him copy of original marriage cert anytime cause we can get as much copy as we want at NSO here in our country.)


First off, did the lawyer really send it or did HE lose it. Secondly, why hadn't your lawyer followed up with NVC to find out what the hold-up was? You'd think that after 3 weeks or so of not hearing anything from NVC, the the lawyer or the petitioner would be on the phone with them to find out the status of the case. If you fiance had sent it in himself, maybe he could be sure that it was really sent in, but I wouldn't try a lawyer to care and do it right even if you paid him...oh, wait....you did pay him. Honestly, any lawyer worth his salt should have at least notified you that the paperwork was late from NVC and that followup was needed.

ok im confused i sent the i-864 on thursday 3/31/2011 but it didnt come in the mail my lawyer already had it so my question is for ds-230 do i wait for it to come in the mail or can i go ahead and fill it out so i can have it ready for when i do need to send it?? the lawyer told me its going to be 4-6 weeks after the i-864, but i've read other forums n saw that some people were able to send ds-230 a couple of days after i-864. can anyone help me please. You're lawyer seems to be giving advice that is going to slow the process down. Try reading and following some of the guides in the VJ Wiki to speed things up a bit. http://www.visajourn...p/EZGuideSpouse You should have had the DS-230 pre-filled out and ready to go prior to completing the USCIS/NOA2 process. Get the fees paid and the visa app (DS-230) sent in ASAP. Hopefully the lawyer advised you of the documents that need to be submitted with the DS-230 and the documents the beneficiary should have on hand for the interview.

Why are you waiting? Follow that steps. Step 1: Call NVC and get your NVC case number and your invoice number. Also give them your email address along with the email address of your husband (the beneficiary)...

The reason for the link is because it tells you EXACTLY what you need to do and exactly what you're expecting. Please take time to read it thoroughly and understand it. Remember, you're through with the USCIS portion and are now at NVC.

Hi I received my notice of action I797 and so far my husband is approved

Now my next question is what is the next step????
I contacted the NVC they said they received our case but it hasn't been viewed yet..??

They said to contact them in a couple of weeks??? huh :unsure: , so while I am waiting what should I be getting done in the meantime so whenever I do hear from them I will have everything I need and my husband lives in Jamaica what should he be doing while we are waiting to?

I do know he got to fill out some forms and I plan on filling them out online for him as well is that okay?? can I fill out all of his information so i know it going to get done correctly???

I saw a link on here where it gives you all the step by step on how to bypass quickly through nvc I do not how to get it again I did a search but it came up under google when I did a search on 1797 before it was on visajourney not google I cannot find that search button on here..

I filed my I-130 in the UK, and it was received on Nov 17th and processed last week. My wife received notice that the "petetion was found incomplete and/or requires additional evidence".
The letter is asking for:

1. Please provide a sworn affidavit that complies with 28 USC sec 1746. Explaining how and when you and your spouse met and the background leading up to your marriage on May 30, 2009.

Q: Does my wife (my sponsor) need to compose this, or do I?

2. Please provide 3 affidavits that comply with 28 USC sec 1746 sworn to or affirmed by third parties having personal knowledge of the bona fides of your relationship with the beneficiary.

Q. Do these affidavits come from my wife's side? Other Americans? Can her family compose them?

3. Please provide photocopies of commingling assets

Q. I think we are going to have difficulties with this one. My wife and I married in the US in May 2009, moved to the UK in August 2009 (her on a UK spousal visa), moved into my house which was never in her name. She returned to the US in Nov 2010 for work. We have no evidence of co habitation. I *think* we could probably find evidence that she was receiving mail to the same residence. But is there anything else we could use? The utilities were all under my name.

4. Other: In your own sworn affidavit, please explain why you and your spouse did not reside together from the date of your marriage on May 30, 2009 until May 1, 2010 (11 months).

Q. This must have been an error in the paperwork (on my part?), because we have been living together since our marriage (I stayed with her on a tourist visa from May-August). Do I just need to say "I made a mistake"? I *may* be able to find document of flights, which I think would prove that she moved with me in August, and of course, she has her UK visa.

1) If you're not the USC then you could not have filed the I-130 petition. Only USCs or LPRs can file an I-130, thus this requirement and all others are directed towards the petitioner.
2) Affidavits can come from anyone familiar with your relationship. I'd suggest both family and friends/co-workers of hers and yours. Provide more than they request if possible, they're cheap. :)
3) I'm at a loss with this one, maybe someone else can come up with something.
4)Find and provide the evidence and have her explain that you have lived together in HER affidavit. It wouldn't hurt if you provided your own affidavit also. On the I-130 is asks you to list the last address where you resided together....did she put NONE here?

From what I understand, once you submit your reply to the RFE, your case gets worked again right away. Someone correct me if this is in error.

You send it the DS-230 and supporting documents after the IV fee is paid. THe IV fee is $404. This is unrelated to the $88 AoS (I-864) fee mentioned above.

Title pretty much sums it up. Just paid my AOS Fee(online) and sent off the Choice of Agent too. NVC marks the fee as "Paid". So my question is; Do they send me the I-864 or do I just go ahead, do it myself and send it in?

450 pesos and 2 - 3 weeks is what I'm told. I recall reading that some people have gotten them sooner. I would guess that it takes the same length of time as a CENOMAR since they check the same things.

NEGATIVE. The CEMAR is not the same as the marriage certificate. From reading the forums here, it seems that it's asked for every now and then but not always.

This is a sample the the NSO marriage certificate that you're probably familiar with:

If you go to NSO and request a CENOMAR and you've been previously married (meaning previous to requesting the CENOMAR), what you will get is a CEMAR.


My wife will have a CEMAR in her possession when she goes for her interview. We don't want to take any chances.:D

Hello everyone, My name is Akbar and I am from the State of Maryland. I have a wife that is located in Karachi. After the Osama Bin Laden thing, it is getting worse and worse, and I fear the worse. The Taliban and the wars are right where she lives. I was their for an entire month and just returned on the 24th of May.

I am going to be filing for a Spousal Visa. I am hearing a few things but people and the research I have done is saying to file a CR1 vs a K3.




I know that this is the following materials and documents I will need

1. Marriage Documents
2. Legal Divorce Certificate (I was married before)
3. Two passport style pictures from her and I
4. Pictures of our wedding
5. A Cover Letter
6. Copy of my passport and ticket stubs
7. Copy of her NIC and Passport


I am not sure what else I need and I can not find this CR1 form anywhere on the net. Can someone also tell me if I am able to put her name on my bank account and on our home that I bought this year? And how to register our marriage with the state? I am a bit lost for as I was planning to do a Fiance Visa but now I have to do a Spousal instead. Can someone please give me proper guidance on what to do and what is missing from the Visa Kit?

I just received an E-mail from NVC stating that they are just missing my affidative of support and my Lawyer had already sent it almost 2 months ago i am very upset... this waiting game is sooo frustrating i hope they didnt loose it... :angry:


If they did loose it, maybe you can just call and ask them to "tight" it. :rofl:

Just print out the I-864 again and resign, and then copy the rest of the documents and send the package to them again along with the coversheet they sent you.. Be sure to send it with delivery confirmation (not a signature). They can easily have it in less than a week.

Well folks I've got some bad news. After paying the AOS and IV fees, sending in all the required forms, and waiting for nearly a month... I get an email yesterday from the NVC saying they also need my wife's DS230 and all civil documents. HUH? The embassy website clearly states these documents will be collected on the day of the interview. So I call the NVC and they confirm that the documents are required before an interview date will be set.

Fortunately we had completed the DS 230 two weeks ago and it only needed to be printed out. So she sent a Fed Ex envelope with all the documents to me yesterday and when it arrives here I will include the email letter and cover sheet and send it to the NVC for another month of delays.

For those of you at the stage of AOS and IV fees do yourself a favor and triple check everything. Even call the NVC with the list of documents you have and see if they are going to work.

Can you please post a link to the page that says the Immigrant Visa application (DS-230) will be collected at the interview? I was never given that impression by the Embassy Website, the NVC website, nor anything posted on Visa Journey. All of the guides and the information on the NVC site state that it gets sent to NVC along with the coversheet you print online after your IV fee is marked as PAID. I'm just curious as to where this contradictory information is located at on the USEM website.
