Hi,

It's been over 4 months since we received our NOA1 and we're still waiting (impatiently) for our NOA2, in the meanwhile I moved and will be moving around until I get the K1 visa and move to the US.
How do we change my address?
Since there is no info on this on the website we tried calling the California Service center with no success, my finance could not get through to an actual person.
Does anybody have info regarding contacting them?
Do we have to contact the National Service Center first?

Another question, I have a tourist visa that's still valid, can I go visit him while we're waiting?
Or should I wait until I get the K1 visa?

??? I think you mean that you hope the trend reverses. Otherwise your I-130 approval (and mine) will take longer. I believe the point of the original post was to highlight why I-130 approvals were going so slow at the present time.

It doesn't matter. Look at your Visa....does it mention the POE anywhere on it? Do you have ANY kind of paperwork, letters, or forms from the consulate, NVC, etc. stating that your POE is a particular location? I would guess not.

What's the point of asking for advice and then arguing against what you wanted to hear? I'm assuming that you actually WANT to use another POE rather than NEW YORK. BTW, exactly what POE in New York would that be? I hear that they have several.:whistle:

Also be sure she has a copy of everything either of you has sent to USCIS or NVC(orignials of certified/official documents). Also pictures, receipts, etc.(anything that documents that you were there and did things together) from every visit you made to her. Anything that might be able to prove your relationship, it's much better to be over-prepared than under-prepared. Also, be sure she gets a CENOMAR from the NSO...YES, I know she's married and a Certificate of No Marriage doesn't really make sense...get it anyway. What she will actually get is a CEMAR which lists all marriages she's ever contracted. From my reading in the forums here, this is often asked for and not on hand. You can see a sample of a CEMAR/CENOMAR in the above link.

Also, not interview related, but make sure she attends (if she hasn't already) the CFO Guidance and Counseling seminar and gets the CFO sticker placed in her passport.

I called USCIS and they said there is nothing they can do at this moment. They are currently working on applications that were received on May 28 and would soon move forward and eventually begin working on applications that were received on June 10 (my date). Is this normal?

Also, how would I go about soliciting congressional assistance?

Sorry to hear that. Are you eligible for USAA? I believe they'll take the form by mail or fax, and they're a great bank also. They're almost all online with very few walk-in offices. I know I sound like an advertisement here, but they normally have the best rates on car insurance also. http://www.usaa.com

Your spouse either files joint with you or is listed as a standard dependent deduction on your return. The amount you spend or didn't spend is irrelevant.

you know this is what i didn't think of if ya just get it notrized there it would work. The problem the IRS kept running orund and round with me was it needed to be a notarized copy and due to high fraud rate in phil there was not authorized notary for us tehre. But if you go to embassy have it done there I guess that solves that. That is why i had to send in all the "extra documents" because of teh no authorized notary bs.


The IRS would not take a notarized copy of the passport from a Philippines notary because the Philippines is not a signatory to the Hague Convention. Of course, personally, I would either. My wife has in her possession, a "notarized" copy of a document/statement that she supposedly signed and the notary attested to. NO, she did not sign it, the signature looks nothing like hers, and she's never even seen the so-called notary. FRAUD IS REAL AND PERVASIVE in the Philippines, so everyone be careful, and remember, normally, you can do it the legitimate way much cheaper and quicker than going through any type of "fixer", etc. BTW. Fixers are ILLEGAL.

I filed my taxes with my wife W-7 and got rejected (they wanted an original document and I couldn't get it to them on time).
I called them up after I got the rejected letter and they said since it has been over 8 weeks, they will process my tax return WITHOUT the W-7 and adjust the return money appropiately.
They say that they get the situation all the time and if you don't do anything further after receiving the letter, the IRS will process the tax return and make correction themselves (they will alway make correction to their benefits). Like someone suggested, I will file an appeal now for my wife (she has her SSN now).

FYI, paper tax return takes up to 8 weeks AND the W-7 takes up to 8 weeks so if you file a W-7 with your tax return, it could take up to 16 weeks.
The IRS has also told me that electronic filing is much much faster than paper filing (up to 4 weeks for electronic filing but usually get done in 2 weeks)!



Do not appeal. Just file an AMENDED tax return that includes your wife, you have up to three years to do this. (1040X I think, look it up).

Also, the to 8 week periods run concurrently. That's one of the reasons they make you file them together. :whistle:

For the Philippines specifically as I just did this a few months ago and just got my return. You need to fill form w-7 and send it in with the tax return or an ammended return. Documents to include: NSO copies of her Birth certificate, Marriage liscence a copy of Passport both notarized by a notary and also have the spouse go to dfa and get them to authenticate true copy. This is usually a picture with the DFA putting her passport number ect and stamping it with thier raised seal. In this case considering it is already in they might just adjust status to single this is what my state did without even consulting me. But send in amended return to Austin Texas like Loto said with above documentation, w-7 and amended return. Of course you also have teh option since you are already in NVC process to just wait. It was a major pain for me as the one who processed my package was unfamiliar with phil i guess and ended up having to send her orginal passport which they lost "in the mail" but i got 3g's extra on my return because of situtation. So she had to go file and get a new passport which she finally gets the 16th of this month. But for 3 grand it was worth the trouble i guess. considering the post and a new passport only cost around 100 bucks :) If you get soemone there that says the orginal passport is needed DO NOT LISTEN! The can take DFA authenticated copy if accompanied by copy of passport notarized by notary there.


DFA authenticated copies of Filipino passports do NOT need to be notarized or accompanied by a notarized copy.

New passports in the Philippines cost PHP 950 standard or PHP 1200 rush, plus PHP 200 for the lost passport fee and PHP 120 for the delivery fee. The most you should have paid for a Filipino passport is PHP1520 or about $34.50. My wife also had the bad habit of going to "fixers" or "travel agents" that she knew. They are unable to provide any value added since you wife had to show up at DFA anyway with all of her authenticating documents. The appointment for the new passport could have been made by calling 737-1000 or going online to http://epassport.com.ph/. I've only placed this info here for future reference for anyone searching for it.

Our plan is to get a copy of Elsa's passport certified/notarized at the US Embassy in Manila while there and use it as proof as required to establish the right to have an ITIN and include the completed W-7 and it when I file next Spring. We'll already have our ducks in a row by the time it happens. I was under the false assumption we could pre-file but since we don't fall into an exception, the paperwork must be sent to Texas as Loto stated and you clarified for me. If I read the directions correctly, the certified copy of the passport is the only document that can stand alone for both proofs. IRS Obtaining an ITIN from Abroad Hope this helps and thanks again George,Loto!!!

Here's an excerpt from the instructions for the form W7 that apply for folks in our situation...

• Have the copies notarized by a U.S. notary public legally
authorized within his or her local jurisdiction to certify that the

the copy conforms to the original. Consular offices at U.S.
Embassies and Consulates overseas may not certify true
copies of foreign public documents and will refer applicants to

When I called the folks at the link I gave you earlier, they basically told me the same thing that the instructions above did.
Your choices are:

1. Get a certified true copy of you wife's passport from the DFA. This is acceptable by itself.

2. Get a notarized copy of your wife's passport. Any notary in the US is acceptable
- THEY CANNOT DO THIS AT THE US CONSULATE/EMBASSY. (see instructions above)

**While I'm in the Philippine for Christmas I plan to have my wife sign several copies of W7 and W8BEN and I plan to bring my wife's passport
back to Guam(USA) with me and have it notarized here on the military base where I work. I'll then send her passport back to her via FEDEX,
etc. (do NOT trust the Philippines postal system to transport your vital documents.)
The W8BEN is so I can add her as a joint owner of our bank account. This will allow the tax refund to be direct deposited to our account.
This way we wont have the hassle of trying to cash a joint check (she's not here in the US to cash it and cashing a large check with my name in PI is difficult also.)




YOU DO NOT NEED BOTH A DFA CERTIFIED AND A NOTARIZED COPY. I'M NOT SURE WHERE THEY WOULD HAVE GOTTEN THIS MISINFORMATION

I'm in the same boat for 2010. I researched and in Angeles City, there is an approved agent for issuing/taking the ITIN info. I'll see if my wife, who's in Manila, can contact them to see if she could obtain the number there. There's also approved agents in other countries listed on the site.ITIN Acceptance Agent list I hope post adds to the solution........and not the problem. Also my accountant stated that in order for us to file jointly, we'd need SSN or ITIN and that if we got the ball rolling, we should have our ITIN's in plenty of time for tax season. Good luck!

The phone number is right there on the front page. They're great folks that operate off of donations only. I don't believe you have to be associated with the military to get help from them but I'm not sure (since I'm retired mil). They helped me file a Tricare claim.

You have to actually file your taxes through them also if you want their help getting an ITIN. Remember, the W7 has to be attached to a tax return, so you can't get the ITIN in advance for tax season. You'll just write applied for on the 1040 with the attached W7.

The beneficiary will not get SSN in your case.

You need to send the tax return to IRS Austin, Texas address with completed W-7 and documents. Completed W-7 will process your ITIN (Individual Tax Identification Number).

If you need to know more about the process, let us know.

Also, this process can take around 8 weeks since it is paper based processing.

+1 :thumbs: Yes, tax return should have been submitted with a form W7 for you. See here http://www.irs.gov/p...rs-pdf/p519.pdf for the IRS publication that covers your situation. You husband should consult with someone at the base legal office (it's free) in situations like this. Anyway, you want to pay special attention to pages 10 and 26, and once again the legal office is there to help out with anything he doesn't understand.

If the form is rejected just refile with the W7 and the "declaration of choice" letter and you should be fine. BTW, on the 1040, etc. just put "applied for" in the block where it asks for SSN/ITIN.

DISCLAIMER: :rofl: I only know all of this through my own recent research on the subject that came about because I'll be filing for myself and my own foreign spouse very soon.

I should think that it wouldn't be a serious problem for them, but I know I would personally be bothered by pages in the same document being of different sizes. And it might seem obvious that the document was not all printed at the same time (although I can't imagine there is a strict rule against that). If you're truly OCD, you could always go buy some A4 paper and reprint that page on A4 to keep it consistent. :)

I was just researching the same question this morning. I've read several threads where the beneficiary was able to schedule the medical clearance using the NOA2 letter. I also read that some were able to schedule their interview earlier since the medical was done earlier. Do a search here on VJ for "early medical" and you should run across some of the same threads. Also pay close attention to what they say about showing up early in the morning for the medical. :innocent::whistle: I know what I'd do If I had to go..haha.

Hi everyone, just new here in VJ. My husband USC applied our I130 last June 7 2010 in California and got NOA1 June 10 2010. Since then we never had any email from them. Last November 18 my husband tried to call the customer service to check the status of our application coz its more than 5 months of our time frame we should have receive any email by now..Today my husband received email from USCIS saying that our application status are being adjudicated and we should receive Notice of Action within 45 days...we are praying to receive NOA early December. I was wondering if we receive the NOA2 then we can start medical..anybody out there who have the same case...hoping everything in our application will going to be ok.

what did u put in that question asking the places u lived after reaching 16, since ive been here where i live since i was 11 so i just put july 2001 to present, but i turned 16 april 2001.. do u think it will cause an RFE?



i turned 16 in january 1995 (waaaaay before you were born! tongue.gif ) and i entered june 1996 when i left my province for to study in manila. they asked me where i was prior to june 1996... that is my stupid RFE story. hehe!


woooow i wish they would accept that, its just 3 months... biggrin.gif i think i should call them everyday to find out if i got RFE...

Hello, My husbands case is complete at the NVC, Do i just have to wait till we received a notice from them for my husbands medical and interview date? or do i have to call and schedule it myself to them?

And also how long does it usually take before you get your appointment for medical and interview,,

You can pay for it anytime at any Metrobank branch in Phil. it costs P650. read sheriff Uling's pinned post for the newbies under Philippines forum. all the link you need is under his signatire. However you have to wait for tne MNL number and letter before you text your payment information to the Delbros. But it will be good to pay for it earlier so when you have the letter you can imediately inform Delbros.

no need to show metrobank anything aside from the deposit slip u will fill up. The link i told u has the pdf file for Delbros' instruction. /and wait for the letter before sending delbros an sms, coz ur letter is the signal that ur file is with the embassy and they have sent a request for your DV to delbros. remember always ask for a date from delbros as to when they have sent your paper to NSO.

Congatulations,,mine was completed 09-19-08, I don't have sched yet for USEM,
