Depends on the fowardly deployed gaining commander. Make sure he contacts his CoC in his deployed location. One CO stateside can tell you one thing, and the deployed CO could be directing you to another. When it comes to deployments, it best to get that stuff done prior to him leaving, or better when he gets back.

I got 2 NOA2 notices in the mail. Apparently they processed it twice and sent me an NOA2 for 6 Jan and then I have another one for 9 Jan...BOTH NOA2 FOR APPROVED PETITION.....I ONLY SENT IN 1 PETITION!!!

Yes, we got NOA2 on 01/12/09 and got a touch on 01/13/09. I think it was the day they sent it off to NVC and they scanned it before it was sent out. It happens to many of us!

I believe that rule shouldn't exist in my opinion. Two people who will join in matrimony should meet in person. If the parents are arranging everything, then the interested parties wouldn't be the fiance' and fiancee, IT IS THE PARENTS! if someone arranges it, thats already a red flag in the process for bona fide relationship determination.

Your best bet is to travel over there, meet her and get to know her in person, then make the call for yourself. It's your pursuit in finding a wife and in MY opinion, it shouldn't be your parents. It's good for you to get to know this woman, because you bring her over here and get married, she decides to leave you, legally she has rights to your property and livelihood. Would you want to share your life's work or savings with a stranger? This is mainly my opinion and you can probably get better advice from other users. This is something to think about. I don't know the marriage laws in India, but here in the U.S. and many states have community property laws which stretch from your home to your investments and your bank accounts.

You can't reset the interview date. You will have to submit another I-129F petition to your local USCIS office and pay another $455 fee. Until your annulment/divorce is done, you weren't qualified for the K-1 anyway, which you wouldnt even be a fiancee.

Signature is not important for your file copy. Send a copy to your fiancee in case she needs something at the interview. Send it with everything else you send her, I-134 etc. and be sure to keep a copy yourself, ALWAYS keep a copy of anything you send to USCIS or the consulate, or your fiancee for that matter

I don't know if this will apply to you. Some of my records have the "JR" suffix (birth certificate) and some don't (passport) so I left the "JR" out on #1 of the I-129F form but wrote in my full name with the "JR" at the end on #7 "Other names used." My I-129F petition was just approved yesterday without any RFE's. Hope this helps.

Hi,

Sorry if it's the same topic which has been posted.
I submmitted I-129F in AUG and was waiting for the Notice of Action (I-797C) letter.
But, I realized that I filled out my resident address on the Part A of I-129F.
My resident area is not in the delivery service area, so that I should have filled my P.O.Box in there.
I visited local Immigration office and asked the officer what to do, and I was told to call USCIS office directly.
At the same time, the officer checked for me if I-797C has been sent out, and the officer said it has been mailed to my address in I-129F.

Later, I called to the number I got, and explained the situation. But the problem is, English is not my first language and the person who answered the phone spoke really fast!!!!!! and I was not able to understand what she was saying. (so embarrassing... )

I will probably try to call again, but does anyone know if I will need to re-submit I-129F?

You need to apply for an IR-1 visa instead of a K-3 visa for your husband.

What is you native language? Maybe someone who understands your native language would be better able to assist you. Also, all payments you make should be paid by check directly to the Department of Homeland Security or electronically to the National Visa Center.

Just a heads up for any financial transactions anywhere, NEVER GIVE YOUR PAYMENT TO A THIRD PARTY! and then trust them to apply it where it belongs.

Take care of and local requirement for leaving the country: CFO stamp, exit clearance, etc.

Make travel plans to the U.S.

Arrive in the U.S. and process through the POE.

Wait for your Social Security Card and "Green Card" to arrive in the mail.

SS typically takes 2-3 week and "Green Card" typically takes 4-6 weeks.

If you don't receive your SS card in a timely manner, visit the local SSA office and fill out an SS-5 to apply for an SSN.

At the 21 month point, submit the proper documents to file for removal of conditions and receive a 10 year "Green Card"



At least those are the plans that my wife and I have once she gets her visa. :thumbs::innocent:

Make an appointment at the embassy to get an "Affidavit in Lieu of Certificate of Legal Capacity to Contract Marriage". If you were married previously, you'll need to present evidence that the previous marriage(s) was/were dissolved (divorce decree, death cert., etc.). I made my appointment for the day after I arrived. You can make an appointment using the online appointment system at: http://manila.usemba...v/marriage.html and clicking the link in step 2.

The same or next day you can apply for the license at the "civil registrars" office in the city where your fiance(e) lives. There is a ten day waiting period while the application is posted on a bulletin board in front of the office. This allows time for anyone with any grievances or reasons why the couple shouldn't get married, to make those reasons known. This is mostly just for show, but it is the law and must be complied with.

You should pre-arrange to have a local official perform the ceremony on the 11th day. I managed to get is done during a 14 day visit. The "Affidavit in Lieu of..." was done on the the Monday after my arrival and the ceremony took place on Friday of the following week.

This is of course assuming that all you want is a simple civil ceremony. A full-fledged wedding blessed by the Catholic Church is another matter entirely.

Thanks trudger24, :thumbs:I think we've got winner!

I missed that option when I was reading the instructions for the W7. The current W7 instructions still has that option available.

I believe this is what I'll do: I'll bring Gina's passport back with me after my Christmas visit and then FEDEX it back to her after I get the certified/notarized copy required to file the W7 and get her ITIN and then file our income taxes.

Hi I got ITIN number for my wife last year. How I did it was
1- had her DHL passport to me , then had notarize here in USA. then took back to her on my next trip( only need trust to mail once)

2-filed for and extension because would take me past April15

3- sent copy of passport and form for ITIN number with tax return to Texas , they will give you number and process taxes
