Exactly where are you at in the process and what process is it that you're going through? Are you the petitioner or the beneficiary?

It sounds like you were sent a notification (as the petitioner) that you would have to be interviewed. Is this correct?


If not, and you're just waiting for your NOA2 for the normal I-130 IR1/CR1 process...well, it's only been two months. If you bothered to read any of the other posts in the forums, you'd realize that people very seldom receive NOA2 after only 2 months. 3 - 5 months is more likely, with the norm being closer to the 5 month or greater mark.

It's possible I'm completely off-base here and misunderstood your question...a little more information in your profile and timeline would be helpful.

I just reviewed the "packet 4" from the Manila Embassy and I don't see a requirement for a "CENOMAR" for persons in our situation.

Do I recall someone mentioning something about a "packet 3" maybe? It really worries me that someone didn't get their visa because they didn't have a document that's not on the list of required documents.

I assume that she would need a CENMAR & not a CENOMAR as she is married. CENOMAR are for single people.

My wife had her interview today, but didn't get her Visa because she didn't have the Cenomar from NSO (probably my fault). She went to the NSO immediately, and they told her that her Cenomar will be released on Nov 15, then the Visa will be mailed to her. Has anybody else gone through this? How long will we have to wait until she gets her Visa? Are we talking about waiting for a few more months, or only a few days? Ohhhhhhhhhh, what a day. Thanks as always.

Yes, you are correct! we are a married couple and am working deligently to get both of them here. So would that means that also my wife would not be eligible for an ITIN for tax purposes? since she will qualify for a SSN in the near future after she obtaining her CR1 viza?


I'm basically going through the same thing you are right now. Your wife will need an ITIN, since as of right now she is NOT eligible for an ITIN. You will file an IRS form W7(signed by your wife) with your joint tax return. Read the instructions for the W7 for the identification requirements for your wife. My wife will be sending me a certified copy (certified by the issuing agency) of her Philippine passport passport for that purpose. US Embassies/Consulates will not certify/notarize foreign documents. The other thing I could have done (at least on other person on VJ has done it successfully) is have my wife send me her actual passport. I could make a color copy of it here and then have if notarized by a local (US) notary public, who would certify that the copy contains identical information to the original. If you wife's country is a signatory to the Hague Conventions, you could also have it notarized/certified there, but I'm not familiar with that process. You will also want to read IRS publication 519, pages 10 and 26 for more information on joint filing with a foreign, non-resident spouse.

I have a son, born abroad three month ago before the turn on 2011. He is a USC through me by birth but we havent completed a Consular Report of Birth Abroad (CRBA)so he has not received a SSN as of yet. My question is would it be possible to claim him on my taxes by requestin an ITIN and earn tax excemptions from him. I'd appreciate your input.


An ITIN can only be issued to persons not eligible for an SSN. Since you son is a USC, he is not eligible for an ITIN. Go ahead and submit the paperwork to get a CRBA for your son. I also assume you are married to his mother and that you support her and him?

One or both of us is VERY confused here. :blink:

If you were filing for adjustment of status, your wife would already be in the US. If you want your wife to get US citizenship, she has to reside legally in the US for 3 years(as your wife) prior to applying to do so.

Maybe I'm completely misunderstanding what you're attempting to do...

I'm assuming that you want your wife to immigrate to the U.S. This would require her receiving an IR1/CR1 visa. Filing the I-130 is the first step to doing this. If you're living in Indonesia, have you considered filing directly with the local consulate (DCF) to get her visa? Have you received a letter from NVC or the US Consulate in your location telling you wife to get her medical evaluation done?

I'm sure I've muddied the waters here...can someone please enlighten me?

Moving this to IR-1/CR-1 since K-3 (I-129F) gets closed at NVC stage and they proceed with I-130 for a CR-1 visa.

Applicant on US Citizen's Petitioner's G-325A is US Citizen, and applicant on foreign Citizen's Beneficiary's G-325A is the foreign Citizen.

I received DS-3023 form from NVC, and also it attached a NVC #s. I paid $88 online last night. I follow guides from this site, and I am filling out DS-3023( as i am his agent) for my hubby through his email.I am also going to send the original DS-3023 back to China to him to sign it and express mail them back to NVC.So what I should do next? I have to wait for NVC to send me a package of i-864, or i have to fill it out by myself? What should it be on letter of employment?I also worry about my income that is qualify to sponsor my hubby or not? My income is around $21,000/Year<I took almost 2 months off this year to have vacation with my hubby>,and i have been putting some money to my IRAs's account monthly, it has 1800 bucks so far.I bought a house at beginning of this year,and i am on $142,000 debt. Listing of assets is optional unless you're specifically asked to do so by a CO. The I-864 doesn't ask anything about debts that I recall ( just worked on mine yesterday).

I would go ahead and fill out the current I-864 and gather all of the other documents you know are going to be required. The HR department where you work should be able to do the letter for you. They'll probably respond more amiably and quickly to your request if you show them a sample letter they can go by, maybe even email them a softcopy with all of your information already filled in :) . This way way they just have to print it on company letterhead and sign it.

Hello Journey men and women. Soon it will be time for my Asawa's medical exam at ST. Lukes in Manila and my fiancee is going crazy about this as well as other ladies waiting for the exam. Most in particular her "TATTOOS" she has 4 of them. Matching ones. one on each fore arm, stars. Then she has one on her side shoulder a ,gothic-like tribal heart, and a small one on the side of her calf, a fish. my question is will this be a problem?? A few people here on VJ stated that they had no problem and were approved,but they only had one or 2 of them but she is worrying about them and I am now also after she told me how they are viewed in the PINAS but she went through a rockstar fashion phase in her youth and had these cute tattoos done. The medical appointment is to discover medical problems that may be harmful to the US; communicable diseases, mental illness, etc. I wouldn't think that the tattoos would be problem unless she picked up something when she got the tattoos....which evidently she didn't since it was years ago.

I am probably being over-analytical...but I don't want to have to reprint a bunch of papers.

In the I-864 instructions, it says: <<If you do not print your name on line 30 and sign and date the form on line 31, the intending immigrant you are sponsoring cannot be issued a visa or be granted adjustment of status.>>

Does this mean on line 30 it has to be hand-written? Or can the name be typed in and printed out and then just signed?
Does anyone know for sure?

One more thing..if you whited something out and rewrote over the white-out...that's ok right?

You're right, you're being over-analytical. :D

The form can be hand-written or typed. Either one is acceptable. As a test, try to type on the "signature" line. It will not let you. If it was required to be hand-written (such as a signature for example), the line would not be fill-able. I would be very leery of using white-out on the form since it is a binding contract.

I know this probably seems like a no brainer question but I'm having trouble finding the answers.

I am getting ready our I-130 packet for a visa for my wife. I am almost positive that I saw something on USCIS's website saying that I can submit it at the embassy overseas (since we are both overseas). But for the life of me, I cannot find out if I can actually do it. Can I submit it at the embassy or does it have to be mailed to the states?

It doesnt state teh 125% only the 100% jaan...so im guessing that the amount for 125% also went up... it was 25,790 for 100% for family of 5 for 2010

Take a hike. You got proof of all of them that have

I'm very sorry to hear about your situation. At best, it seems that your wife contacted a not completely above board "visa service". The $450 she paid was to the visa service company (for their services) and not to USCIS. At worse, the lady your wife spoke with is a scammer, although it's unlikely she would have continued corresponding with or speaking with your wife once they received a check or money order from her.

As stated previously, all of the information your wife needs to file on her own is available here on VisaJourney. Check out the "Guides" link at the top of this page. Hiring an immigration lawyer for your case will probably provided very little value added to you situation unless your wife is just not capable of filing the paperwork on her own.

Yes, I applied for IR-1. My wife and I were married in 2001 in The Philippines. My kids are 8 and 3 years old and were born in The Philippines. I became a naturalized US Citizen in 2008. My kids were born when I was a Permanent US Resident, so would they still qualify for I-864w? I'm assuming so, since I'm a US citizen now, but then again you never know... just want to double check everything. Did not meet CRBA requirements since I'm not a US born citizen, but naturalized US citizen. Hope this information helps, if you need anymore I'm more willing to give more info to make sure i get sound advice. Thanks.




OK, that's about what I thought. From my interpretation of reading the instructions on the I-864W, I'm thinking you can use the I-864W for your children. Maybe someone who was in your same situation and has done this before will come along and confirm or deny this.

Hey guys, I'm new here. I've been lurking on the site for awhile, but now I've come across a problem.

I recently called the NVC concerning my case (my wife is the primary immigrant and my 2 kids). They are all in The Philippines. I am a US Citizen. Anyway, I called and they told me my wife's case is COMPLETE, BUT are still awaiting for my kids' affidavit of support. I assumed when filing for the I-864 that one copy would be enough since my wife is the primary immigrant with my kids as secondary. I called the NVC again and the operator told me I have to file I-864 each for my kids as well.

So now here's my dilemma...

1. Do I send out the I-864 for my kids and do I still need to send out again an I-864 for my wife again? I just want to double check because you never know what they want at the NVC.

or

2. Instead of sending out the I-864, I file for I-864w exemption, since my kids are both 8 and 3 years old and I'm an US citizen.


Just want to make sure what's the best path to take. Right now my wife is getting mad at me for the long wait. Here's some advice from me... NEVER EVER tell your wife/husband/fiance when you assume they will be going abroad. I told my wife that I THINK the kids and her would be here before Christmas. OOOH BOY WAS I WRONG!



If they're your biological children then you would be submitting the I-864W. I'm making the assumption that your wife and kids will be receiving IR1/IR2 type visas. Your children should become US citizens as soon as they are admitted to the United States. I'm guessing that you did not meet the residency requirement in order to file for CRBA's for the children. Some more details about your case would be helpful for myself and others to be able to give accurate and useful answers to your inquiries.

Correct. Looks like a repeat of what I've said many times. :thumbs:
If you file this return soon you may be able to use it with your 864. You may not be able to get a transcript for it yet, but you can use a copy of the actual return along with all of the supporting documents (W-2s, 1099s, schedules, worksheets, etc.) that were sent with the return.

I looked the posting from other people. They disagreed with me. I was getting a different answer from different people. Some said single , some married filing seperately and other jointly. Today I went to IRS assistance center and talked with tax professional around half an hour. She told me that I have to file either filing jointly or married filing seperately. She told me:

1 GEt the passport copy notorized
2 Fill 1040 form and should be signed by both husband and wife
3 Get w-7 filled and signed from spouse
4 Submit w-7 along with 1040 at IRS assistance center or by mail to IRS

I am sorry I had posted wrong information based on the H & R block, jason and hewitt, and tax professional. When I asked her if I will have penalty, she told me that filing wrong information is subject to examination. Then I realized that it is better to file jointly as I get more return and a good proof that we are married. That is my thought. It is up to you.

K-1 Fiance(e) Visa Process & Proceduressponsor is aunt of fiance/pregnancy
1. The fiance(e) has to be the sponsor on a fiance(e) visa.
2. The aunt can be a co-sponsor for support, but I recall reading somewhere here on VJ the the Manila Embassy frowns on co-sponsors for K-1 visa's.
3. You fiance(e) should file an Application for Consular Report of Birth Abroad once you give birth and receive the birth certificate from the NSO. He'll need to provided proof that you were together during the time of conception and possibly provide other proof that he is the biological father. You need the CRBA for you child to get his/her US citizenship and passport. You'll also want to get him/her a Philippine passport.

Hi. We filed for a K-1 visa last Sept. 5 2010. My fiance(e) currently lives in VA and is a US citizen (by birth). Will we have any problems later if my sponsor isn't him but his aunt? We're still trying to save money to raise a family since I am 23 weeks pregnant. He got his old job back in the states. Also I reviewed most K-1 cases and average for interview is after like 5-6 months. My expected due date is on March 5. What can we expect? What will we do if our baby is born here (Philippines). i have read a lot about the forms to be filled up with k1 visa processing both from US Embassy Manila and travel.state.gov.....

i find it a bit conflicting about the DS 160.....
the Manila Embassy says:

DS-160 ONLINE NONIMMIGRANT VISA ELECTRONIC APPLICATION – All applicants must complete the DS-160 Online Nonimmigrant Visa Electronic Application. Applicants can access the DS-160 from the Consular Electronic Application Center website.[color="#FF0000"]

but the travel.state.gov states:

•Two (2) Nonimmigrant Visa Applications, Form DS-156 (prepared in duplicate). NOTE: K-1/K-2 visa applicants should not fill in Form DS-160, Online Nonimmigrant Visa Application

we are just waiting for our NOA2 (touched nov. 17) and after we get our MNL number from NVC, i will be setting up date of my interview at the USEM.....

i have prepared DS156, 156K and 157(?).... do i need other forms?????

Wow. Did you possibly send you package to the lockbox by traceable means. I mean do you have a tracking number that you can look up to find out if it was even received by the lockbox and maybe who signed for it?

I'm no expert by any means, but I'd give them their full 45 days and then find out what to do from there. This may entail resubmitting the entire package, of course that would mean 45 days wasted.

BTW, I was freaking out just because it took 9 days to receive the electronic notification for my petition.:crying: I can truly understand why you're frustrated and worried now.

I have been patient but now it is getting old. Each time I call immagration they tell me something new. I am a US citizen and it has been over 30 days since I sent Julie's Visa Application in. they want me to wait 45. I am off to see my fiance Julie Friday in England what do I do? Julie and I are thinking of resubmiting and cancel the check.


Did you receive the electronic notification of receipt (email) yet? After 30 days I'd think you'd have already received your NOA1 (Form I-797C (Receipt Notice)). Are they saying they haven't received anything from you yet? Did you send your petition to the correct address?

OK. RFEs are BAD and you DO NOT want one. Nor does anyone else. Touches could be either good, bad or indifferent. Some people have gotten lots of touches long before their NOA2 while others haven't seen any touches at all then then had there case complete and their NOA2 just show up out of the blue. It's only been 2+ months, give it some more time.

USCIS got my file on August 3rd and other than quickly cashing my checkthe quickest I have ever seen a check get cashed ..lol.. I have heard nothing.. absolutly nothing , no mail, no email , no text.... in my opinion horrible given the ammount of money that is spent for this process.. currently My girl and I are 119 days into the process with just the NOA 1 hopefully the NOA 2 is close behind?..

I would suggest doing this AND having him FedEx it to you. That way you can at least have the copy for your interview and if you get a blue slip for the original, it will already be on it's way and you will be prepared a lot faster to respond to it. Good luck at your interview!

The guides here on VJ are great and I use them and will continue to use them. But when you're filling out official forms, your first source of information should be the official instructions. When the instructions are unclear to you, then you look elsewhere. If you look at the bottom of page 4 and top of page 5 of the I-129F instructions, you'll notice that it tells you exactly where to send the form and the accompanying documents.
