I am applying for a K-1 for my fiance while I (USC) am living overseas. I am serving in the US Peace Corps. I have to keep a formal, physical 'Home of Record' back in the states. I use my sisters address.
When I filed the form, I stated that address was my residence but also included information about living overseas. I sent the form to the USCIS office governing that state (Vermont) I did not have any problems at that stage and received an approval.
Since I don't know exactly what all the information you put down was....I don't know if you did it the same or not.

I went through a different USCIS center, but I never received my NOA1 either. No problems for me at all, I got my NOA2 and it was all shipped to NVC. I agree with the previous posters though, you really should ensure that the USCIS has your address recorded correctly. There is always the possibility of human error when entering in your information.

On my I-129F petition, there was an incorrect date for two of my fiance's children (twins!).
We didn't realize it until it was all at the embassy and we were about to send in the DS-230. We put the correct information on the DS-230, and emailed the embassy with all our case information and asked them to note the correction. They took care of it with no problem. I was freaking out about it too...but it was pretty unnecessary.

What about reversing you original idea?

You buy your round trip ticket (I'm assuming you need to do that and can't get away with a one way)

When her visa is approved and in hand, if you can't get her a flight matching yours,

Scrap your return flight and buy two one way tickets together.

It seems to be about the same amount of money at risk, or maybe even less.

Your travel agent may have suggested the othe way around so s/he wouldn't lose the commission on the return trip!

i made mine a bit longer (almost 2 pages) I got a little more sentimmental about it too. In retrospect, this was not necessary or gave me any extra advantage. It did however convey the needed information, circumstance, dates, etc. But it probably just ended up being lunchtime conversation fodder. (a little embarrassing). If I had to do it again, I would stick with the short but sweet declaration.

I see that you have a pending RFE? does this have anything to do with your thoughts on marrying on a tourist visa?
Without knowing the rest of the story, it sounds like there may be significant issues in obtaining a tourist visa for her, or for her executing one she may already have. (meaning they may turn her away from the Port of Entry).
Like i said, I don't know the nature of the RFE, but it is often the case that petitions are approved within a month of a successfully handled RFE, then the petition is forwarded to NVC and then the embassy. I don't know what the wait times are in Japan, but perhaps the three month visit (if successful) will bring you very close to her interview date. This means there will be a relatively short amount of time she needs to be with her parents during the waiting period.
Take all of this in only after you read what KitKat said. First and foremost, you need to make your decisions on how you want to proceed. My strong suggestion is that you do this legally at every step. The process is complicated enough without making it muddled up with extra issues.

Many people choose to send their petitions through registered/certified mail or by over night express. This gives people a tracking number to see when it was accepted at the service center. If you did not do that, waiting for the check to cash (and getting the WAC# from the back) and/or receiving the NOA1 are the next best options.

if making copies makes you feel better...copy away. But there really isn't anyway to know what they are going to ask for. But you'll need to send a complete copy of the paket to the foreign fiance for the interview anyway.
I agree that it is rarely country specific. sometimes the USCIS asks for random things...but on the bright side. I often see the situation where an RFE was issued and within a couple weeks of the information being submitted back to the center, an NOA2 is issued.
It's good to know someone is dealing with your case and going through it for completeness.

ok...first things first...Breathe!
I hear you loud and clear that you are frustrated at receiving and RFE. However, it is not the end of the world, and hardly a waste of three months. and RFE does not put you back at square one. It allows you to send in the requested information directly to 'you case' via your case number. So the successful processing of received RFE information tends to get you an approval within a couple weeks...but I can't say this is definate.
My suggestion for the evidence is to resubmit the boarding passes and what-not from the trips to Mexico, and any relevent pages in your passport (if any). I would also attach a signed supplemental letter that explains the lack of stamps in your passport. It sounds like you may have older stamps in there and they are looking for the ones that correspond to the most recent trips you claim. The USCIS workers wouldn't always know which countries would give a stamp and which wouldn't. (This letter is what I am doing for the interview as I have run into a similar issue.)
I'm sure the frustration you let out was just a little vent, but just in case, I will caution you to be as sweet as pie in any phone calls/infopass appointments or correspondence as a perceived nasty tone (frustration in our world) will only make things harder when trying to get information.

The way I understand it is that the USC has been able to be supported, by themselves or by a parent/someone else. So the embassy doesn't worry about it unless they have a history of being a public charge. The USC is just that...a USC and therefore can not be denied means tested benefits. The embassy just wants to know that the new guy (non-usc) won't try to collect the same benefits reserved for citizens. After 5 years, or naturalization....it doesn't matter any more, the new guy can collect benefits. Although it seems like someone with a medical degree won't have to worry about it at that point!

The aunt has to make enough to support herself, any dependants (doubt her partner qualitfies) & you two. That's THREE total, not 2 as some have said.


This is an exerpt from the I-134 instructions. It makes mention of 'the alien' and not of the USC

"II. Supporting Evidence.
As the sponsor, you must show you have sufficient incomeand/or financial resources to assure that the alien you are sponsoring will not become a public charge while in the United States."

And this is from the I-864...again, no mention of supporting the USC.

"How Do I Count Household Size?.
Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or FormI-864 EZ affidavit of support whom you are still obligated to support. If necessary to meet the income requirements to be a sponsor, you may include additional relatives (adult children,parents, or siblings) as part of your household size as long as they have the same principle residence as you and promise to use their income and resources in support of the intendingimmigrant(s)."


If the USC fiance is not part of the sponsors household, it does not appear that that person needs to be included in sponsorship expectations. Please show me where it instructs you otherwise if I am wrong. I can't even find any appropriate place the USC fiance would be reported on the form.

Possibly yes, if her partner is not a dependent (or married filing jointly) on her then her partner doesnt need to be included. I'm not really sure if your fiancee would be considered a dependent in that calculation or not. But if her income meets the level for a household of 3 you should be more than fine.


If the Aunt makes at least $17,113 she can sponsor him as she only shows support for her and the non-usc.

The USC does not need to be included in any I-134 except the one they file themselves. The support forms are only to show that the non-USC will not go on public assistance. There is no need to show the same for the USC.

Although, on a side note, if the USC shows a history of living on means tested public assistance the embassy could deny the application for increased risk the non-usc would end up the same. This does not seem to be the case here.

Those tickets and hotel receipts sound good. If she doesn't have the original, she may be able to use the credit card statemtent used to pay for it.
You sound correct about the I-134....she needs to show support of 2, you and her. The only issue would be if her partner relies on her for financial support (indicated on her taxes), then it would be 3.
And yes, we are all more or less in the same boat. I went through the USCIS process in February. due to a remarkably fast office, I was forwarded to NVC and then the embassy very quickly. Unfortunatly, all the stages can have their hiccups, mine have to do mostly with international postal systems.
But my fiance will be going to his interview in July, so we can see the light at the end of the tunnel.

Remember she just needs to show support (125% poverty guideline) for everyone she is responsible for ie. claims on her taxes (sounds like just herself and maybe her partner) and the non-USC...you. It sounds like you have done your homework. Your evidence sounds fine at this point too. The only other thing I could suggest is if you had any receipts from dinners together, or tickets purchased...preferably with pictures to illlustrate the event.

Best wishes on your potential situation!
Albeit a little early to make definate plans, it doesn't hurt to look around.

Regarding entering the US on a VWP, you can continue to do that as you have as log as you are planning on returning after each visit.

If you were to get married while on your VWP you would have to prove that you did not come here intending on getting married, as that would be the fraudulent part. If you file the I-129F and the come and get married, it would be very difficult if not impossible to prove that you weren't intending on getting married when it is time to Adjust Status (apply for green card). This may also be difficult knowing that your fiance is/may be pregnant.

the visa process still seems like the best option for you. You could potentially visit while filing the I-129F if you can show sufficient ties to your home country until you are planning to come on your K-1. The people in the regional forums may be able to better guide you on those requirements. I am not aware of any circumstance where a normal pregnancy sped up a visa at all.

Look at the timelines for the California/Nebraska USCIS centers and for the UK embassy, this will give you a better idea of how long the process will take.

An option that some people chose is to have the USC live overseas and wait with the foreign fiance while the visa processes. (That is what I'm doing)

As far as the passport, maybe. If you are using the passport as identification/proof of citizenship then yes every page needs to be copied (even blank pages). But if you are not using your passport for that purpose, I am pretty sure I have seen that others have just copied the stamped pages plus your bio page. (Someone please correct me if you have had a different experience).
I used my passport for evidence of citizenship since the certified copy of my Birth Certificate is of really poor quality so I copied every page and just highlighted and marked the pages that have stamps on them indicating our meeting.
12 photographs seem quite reasonable. I sent in 9 and USCIS seemed to think that was fine. It's good that they are in different situations. A person from the Embassy told me that the best ones show the couple together with other people/relatives or in front of well known landmarks. The candid ones in a crowd show that the couple 'acts' like a couple by going out or to family functions.

My husband used his passport for citizenship proof and we just sent the biometrics page for that and then the entry stamps for visitation proof.




Just to clarify. In the I-129F instructions it states that every page should be copied to use the passport as proof of citizenship. see bold type


5. What Documents Do You Need toShow That You Are a U.S. Citizen?
A.If you were born in the United States, give USCIS acopy, front and back, of your birth certificate.
B.If you were naturalized, give USCIS a copy, front andback, of your original Certificate of Naturalization.
C.If you were born outside the United States and you are a U.S. citizen through your parents, give USCIS:

The DS-156 is looking for information regarding US visa's only.

I just went to my fiance's interview where we turned in our DS-156. My fiance has had previous ties to Canada including attempts to gain residency. None of these were brought up at the interview since they had no relevence to a US visa.

You are not withholding anything by not reporting it. If you reported it as a visa petition, that would be misrepresentation.
If you look at that whole section it is asking only about US visa's...if it suddenly were asking about visa's to other countries, it would state that.
Remember, the DS-156 is a non-immigrant petition, they are just looking to see if the benificiary has immigrant intent. But since you are filing the DS-156k concurrently, there is no need to prove non-immigrant intent.

If you are woried about it. Fill in the form correctly (not listing the Canada petition since it's not required) and just put a letter into your own folder you bring to the interview. If the inerviewer brings it up, you can submit the letter for documentation on the issue. If the interviewer doesn't ask, don't bring it up and don't give him the letter. This is not 'withholding information' in the way that some people forget to list children or things like that on their forms.

There were lot's of things our interviewer didn't ask, that we were just as happy not needing to answer...so we didn't bring them up. We brought home a lot of documentation we had 'just in case' that was never asked for. We were glad we were more than prepared, but also glad we didn't have to explain everything.

Don't give yourself more trouble than you need.

Did you call around to the banks? If there is an international bank there, they may be able to do it. I am also abroad and had the Bank draft written in US dollars. it worked just fine.

At the very least I would write Volunteer instead of Unemployed. It shows it in a more positive light.

ok, there are pro's and con's to going to the interview while missing things.

I went with my fiance to his interview and we knew we were missing a couple things. Some of the things we didn't have we found out we didn't need...such as any documentation for his children that we will apply for K-2's in the future. We chose to go ahead with the interview as it would be the only time I would be able to go to it with him.

What we were missing and did need was a police certificate from Canada (as my fiance had lived there for a couple years). What we did was bring evidence that we had applied for it and that we had followed up with canada to try and get it in time. We got through with the interview and the interviewing officer said 'congratulations'. we passed the interview but he couldn't give us the visa until we sent in the police certificate. He gave us a 221-g form that will hold our case for up to a year.

We still don't have the certificate...but as soon as we do we'll send it right in.

Without knowing what you are missing, it's hard to say what you should do.

If you are missing evidence of support...I would definatly wait until you get that sorted out.

Don't forget....even if you don't qualify to sponsor her on your own, you still need to file an affidavit for yourself in addition to the sponsor (joint-sponsor).
I mention this in case you need to catch up on filing taxes or getting any documentation you will need for the form.
I was also living and working abroad when we filed for the K-1. We got through just fine with my sister as a joint-sponsor.

You'll be fine going it alone. If you are comfortable with the amount of research you'll end up doing!

My hubby is in the same boat as your fiance, that distant glossy look at anything that is hyphenated (G-325a, I-129F, Etc.)

I did all the paperwork for each step of the way. Just make sure you make a nice simple chart with all the info in it so he know what to expect at the interview. I made my hubby a study guide and quized him...hahaha.

Butit was worth it at the interview because we knew how to handle ourelves.

We just competed AOS but if you were to ask him one form I submitted he wouldn't have a clue!

I suggest having your fiance sign SEVERAL copies of each form to send to you, that way you have some back ups if you make a mistake. He'll also need to send you passport photos, copy of birth cert. and such. You can mail the packet from abroad but it just might take a bit more time and money (I highly suggest a carrier like DHL or FedEx).

Any time you have more information that there is room provided you can attach and addendum to the packet. State on the line on the form "see attached addendum" and then put the page at the end of the application. make sure you include all pertinent information on each addendum sheet for easy cross-referencing.
