K-1 Fiance(e) Visa Process & Proceduresworried about k-1 being denied

i had been living in thailand with my fiance for the last three years. we decided to get married back in may and come back to america ASAP. we got all of our paper work sent in for a k-1 on july 27th, NOA1 on july 31st. i had my own internet business that was generating income, but i had no proof of it. pretty much i was spending what i was making, not really saving any money. after doing research on this site, i found out that thailand does not allow co sponsors and that i needed proof of income to get her back to the states. so, i just arrived back in the states two days ago (on the 5th of january) and i have been looking for work so i can send her the documents to show the immigration officers in bangkok that i am working and have income to support. i have no proof of income from the last three years because i was in thailand, doing my own business. no w2's, tax returns, nothing. i have a little bit of money in a few banks in america, but much less than 10k.

i have a few questions:

once i find a job and can provide a letter from my employer stating that i make "x" amount along with pay stubs, will that be enough for them to approve a visa for her?

i dont have many bank statements. i have money in two bank accounts, but it does not amount to much. will this affect the decision?

on special occasions, will the embassy in bangkok allow a co sponsor if we write to them, explaining our situation? my father would be the co-sponsor. my father has pictures of my fiance and him together so there is proof that they have met before and have a friendship.

thank you in advance to everyone who replies!

Someone correct me if i'm wrong, but if you're married, your K-1 is no longer valid. you have to file CR-1......right?

K-1 Fiance(e) Visa Process & ProceduresWondering????

You do not have to wait until you return to file the petition. Sponsorship issues are dealt with after the petition is approved months from now. Yes, permanent residents can act as joint sponsors but I would avoid using the foreigner's family members if possible. Using those family members in the USA to sponsor adds to the suspicion of a fraudulent relationship and you're already dealing with one of the more difficult Consulates. A job of your own, or using your own family as sponsors if needed would be a better choice.

I was thinking the same...

K-1 Fiance(e) Visa Process & ProceduresI don't have enough proof of having met in the past 2 years

i think your visa and stamps that you got in the united states airport should be enough.pictures are NOT primary evidence,no matter what they are,or how special they are, still not the primary evidence

+1

The passport stamps should be more than enough proof to satisfy the "Having met in 2yrs" requirement. Good luck on your journey!!!

K-1 Fiance(e) Visa Process & ProceduresG-1145

The instructions at the bottom of G-1145 state, "Complete this form and clip it on top of the first page of your immigration form(s)"

Should i clip it to the Cover sheet, which will be the first page they see.. or clip it to the I-129F, which will be the first "form" they see ?

Also i am using a money order, as i do not write checks.. debit card only user.
Should i attache the money order to anything or just put it in the package ?

Clip the G-1145 to the cover letter so it's the first thing they see when they open the package, and you can clip the money order to the G-1145...Remeber don't use staples just paper clips.

Here's a link to sample questions they usually ask..... http://www.visajourn...ent/exampleq#k1

Also I've read different post on here that suggest that having your fiance with you at the interview is usually a good sign of a vaild relationship, but may not always be the case...Good luck.

K-1 Fiance(e) Visa Process & ProceduresOverstay K1 Visa

Come on --give the guy a break . we do not know his circumstances and he do not wish to explain . He have a job that requires him to be away for a while or on a ''special mission '' or deployed in a foreign country etc . He know the consequences and is willing to pay for it . Best wishes .

My point exactly!! It's just sooo annoying sometimes when ppl jump to conclusions without knowing what situation the OP is in...someone even had the nerve to say 'Why apply for the visa if you didn't plan on getting married'... we're all on VJ to seek advice, if you have nothing good to say then please just don't say anything at all...

OP, Good luck with whatever route you decide to take. God bless.

Sorry to be so ignorant BUT what exactly is this?

An RFE is a Request For Evidence...They usually send you this when they need more evidence from you about your petition.

Mexico, Latin & South AmericaHelp! Need lawyer in Colombia
I have had friends in the same situation and most likely what it is going to take on your part is a CASH PAYMENT to get the father to sign the papers. Most likely he is holding out for this as this is a common practice in some latin countries. lawyer, not going to help really and the money spent on the lawyer would better be spent on the payoff. But you need to understand that most likely you will have the father bothering you for your whole marriage together. Hopefully you are prepared to deal with this. i wish you much luck and just know that your situation is not unusual .

The interview may not necessarily have happened in Guayaquil; they also process the tourist visa in Quito at the embassy. However, I believe all K visas and CR-IR1 visas ARE processed in Guayaquil.

Absolutely true! Thanks for the reminder/clarification.

A Tourist Visa is amongst the most Difficult Visas to obrtain. The Applicant must show "SUFFICIENT REASON" to return to said country. Usually they need to have a considerable amout of assests such as Property, A business, Hefty Bank Account and usually they need everyone of them to be able to even be considered for a Tourist Visa. The majority of Visa skippers that travel to the USA do so through a Tourst Visa. The part about not being ready to get married I would suggest that they never disclose. The fear is that a woman might come to the USA on a tourist visa to try to circumnavigate applying for the K-1 or CR-1. This is not just the Consulate in Ecuador, but most Embassy's throughout the world. Bogota Colombia is very liberal on the isuance of K-1 and Cr-1 Visas, but are completely the opposite on Tourist Visas and are very condisending in there Interviews.

The Embassy in Quito has given several of my mother-in-laws friends a rough time as well. My mother -in-law is not interested in trying to get a tourist visa now even though she has a lot of homes and assets in Quito. The goverment of Correa is trying to play hardball with the US so the US is going to make everyones life difficult that is in need of a Visa to flex there muscle.

Hi All
Been a while sense I was here and the consulate in GYQ is the same I see. My advice to all of you is to relax and understand that each embassy in the world can by law set there own protocol on issuing visas. I have spoken to number of Immigration attorney's on this subject and the law is clear.you can complain to your congressmen all you want but it is not going to change anything. The consulate seems to require a 2 interview process minimum and you might as well accept this as what is the process. If you cannot accept the conditions of this embassy, then look in a country that does expedited processing like Colombia where it is normal to get the visa the same day. If your Ecuadorian is worth it, then the conditions are as they are. Actually Ecuador has one of the highest numbers of visa overstays in Latin America and I am sure this is one of the reasons that the process is more lengthy. The law is very clear in that you have the right to marry anyone in the world you want, but you do not have the right to bring them to live with you in the USA. Just because you are a US citizen makes no difference. The actual fiance visa was originally put out for US servicemen that had lengthy stays abroad to bring there fiances and wives back when there tours were up. This was not originally intended for Internet/marriage broker reasons. As much as you want to be with your woman, I suggest to forget the negative and revengeful posters and just allow the process to take place as the protocols for its embassy dictate. It will only make your bloodpressure go up anyway. The facts are that most visas will be issued with time or additional evidence, but not all visas will be granted just as not all are granted in any embassy in the world. My process was long just like everybody else's and I got all worked up too. I will say that the second interview dates can be moved up with being persistent by calling the embassy, but the rest is just luck of the draw.

Thanks All For The Congrats

My wife is now with me. She arrived yesterday in Miami after a 2 hour flight delay leaving Quito. Her POE was an Unreal Breeze
because the Immigration official that interviewd her was from Guess Where ? Quito, LOL. He did not ask any questions about me, only talked about Quito and then tried to get my Wife's phone #, so did the AA Flight Attendant too, LOL. I told her how it would be here with Guys, ( Bastards) LOL. The whole process was 10 minutes she said and then had to wait forever for her bags to come . All in all, touchdown to in my arms was 1 hour. Tjanks for everyone's support here on VJ and if I can ever help anyone here, please do not hesitate to ask.

VISA APPROVED AND IN WIFE'S HANDS !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Guys, just wanted to let the Ecuador Applicants know my wife's visa was finally approved after 2 different interviews and 13 months . She will be arriving to the USA August 27th. I will refrain from giving a full review of everything until later as not to cause problems for some of the other people here going through this consulate because I do feel they monitor this site. Please feel free to PM me if you need details. This was a most unpleasent experience and one I hope I never have to endure again.

The news is everyone of us that you are in contact with are in "ADMINISTRATIVE PROCESSING"
Seems every case that goes through the consulate in Guayaquil seems to get put in Admin Processing. The D.O.S is not helpful. Our Congressman's inquires have gone basicly unnoticed and they do utilize some practices that border on the Illigal, but they go unchecked. Anything else, PM me. Big Brother watches this sight.

Hope we can all meet for a drink or something. Good for our ladies to meet and have a common country friend once they are here living in the states. You have Fer's cell, so call whenever you like. As far as the Aposstilled, I am very familiar with this as I had to get all of my legal documents Aposstilled before the Government of Ecuador would accept them as proof so we could marry in Quito. It is an agreement of the 1954 or 1958 Haige Convention for Legal document sharing and acceptance. Arlington, you will not need this appostilled for use in Ecuador. If once you are here in the states and your wife would need to show this to someone other then the Ecuadorian Embassy here, then yes you have to have that Official Seal, but for your interview you do not need to have that Document Aposstilled.

4 couples having to come back and have a Matrimonial Interview and all in the next week. This is not a coincidence, there must be something up that has caused the Consulate to really put the brakes on giving out visas. This is just not normal in most Embassy's nor seems to has had a history of this in the past at this particular Consulate. This is not the Embassy in Bogota where they process maybe 100 Cr-1 and K-1 visas a week. This is Ecuador and the number is at least less then half that. Something must be going on and unfortunatley our cases are a victim of bad timing.

My Congressmans office just called me and I spoke to a woman who has delt with Immigration issues for my Congressman for 24 years and has never , ever heard of a Matrimonional Interview being requested for an I-130 Application if all documents were in order from the USCIS/NVC. This was most interesting to her since she just returned from an Immigration Conf. and again, never has she heard of this happening. Also she said that Ecuador ranked low on the Fraud Scale for Immigration Visas. This Consulate really has a bug up there ### for some reason. T-Bone, could be like I said on the phone " THE EMBASSADOR IS A WOMAN" and does not like to see men marrying outside of America, who knows. The next week or so will be very interesting.

Toban

great talking with you on the phone and we both have to stick together being that our interviews are 2 days apart in Ecuador.

Guys

It took me several phone calls and some demands on the part of the embassy that you have to purchase a PIN, but they gave me the direct number of US Citizen Affairs at the Consulate in Gauyaquil and I spoke to a lady there and about half way into my story, she said let me put you in touch directly with an officer in the IV section. So, I spoke with a pleasent gentleman of Latino decent and explained that I could not for job reasons come to an interview in September but that I would be in Ecuador June 27-July 5 and would like to come to the Consulate for the "MATRIMONIAL INTERVIEW"
He siad wait a moment, came back and asked if I could come July 2 at 2pm . BINGO !
So, I will post about the Interview and the results aftetr the interview.Wish us Luck

Bad News Guys
My wife's visa was denied because I was not present with her at the interview for a "MATRIMONIAL" interview. Same as the other poster exactly. She presented 2 documents to the officer, they said where is your husband and she said not here because you said he could not be present, and they said, come back september 11 with your husband, chao !!!

They did not look at all the proof she had with her, emails, phone docs, an album of photos, airline tickets, ect. And then they gave her a disapproved letter and in this letter which she emailed me , it says, and I quote
" YOU DID NOT SHOW SUFFICIENT EVEDENCE THAT YOUR MARRIAGE IS LEGIT. YOU DID NOT HAVE EMAILS, PHOTOS, PHONE RECORDS TO SHOW ANY EVENDENCE OF A REAL MARRIAGE"

Can you see the smoke pouring off the page???
She had all that and more. What a bunch of fregin incompatent boobs if I ever saw any. Well, I called the embassy and spoke to them, explained that I talked to the NVC and to the Consulate when my wife was assigend the interview date and they told me that ABSOLUTLEY, I could not come to the interview, and now they say where is your husband ? GDBOFI !!
I explained that I would not be able to attend the september interview because I was going to be in a trade show for my company, but will be in ecuador in the end of June until July 4 and that I would be most happy to attend an interview , just as I wanted to in the first place. Of course they give me the"I WE CANNOT BE SURE, WE NEED TO TALK TO THE CONSULATE OFFICIAL, WE WILL CALL YOU, YEH, BLAH BLAH BLAH

Bottom line is I am going to have to try to go in September and most liley they will find a reason to not give us the visa then, MORE DOCUMENTATION, GO BACK AND COME IN OCTOBER
Bunch of absolute morans if I ever saw any.

I filed a complaint directly with the consulate per the email address the lady on the phone gave me and I worte my Congressman and Senator, but of course, that will produce nada. Maybe I will just show up at them embassy in July and see if they will see us. Anybody got any experience with that ?

Guys, whatever you do, go with your lady to her Interview regardless of what the petehtic morans say.

Thanks for the insite. I am CR-! also and have made 6 trips to see my wife in the past 2 years, so hopefully that will be enough because there was absolutely no way I could get there for the interview. She is on the plane to the coast now and the interview is tomorrow morning. Like most here, she is armed with documents and photos out the wazoo, including te dead to her home she owns in Quito, letters from her employer, ect. Thye will most likely not ask for those things, but she wanted to e able to show them that she has asstes and land and property in Ecuador and the only reason she wants to come to the USA is to e with me. Will post as soon as I hear anything tomorrow

Enjoyed reading your review of the Interview process in Ecuador. My wife has hers on June 19. I am not going to be able to be there due to work committments, but will return to Ecuador first of July and hopefully be able to return to the states with my wife. If you can think of anything else that was said or done that you left out, by all means let me know.

IR-1 / CR-1 Spouse Visa Process & ProceduresAttending my wife's interview
Hi

If at all possible, I would go to the Interview with her. Check out the Carib/Latino subforum and see all the problems myself and 3 other gentleman are having in Ecuador. We are all being required to come to the Consulate for a "MATRIMONIONAL INTERVIEW " 2 of us are filing for CR-1 visas and the other 2 are K-1. In all cases the consular official did not want to see the evidence that our wives/fiances brought or proof of the relationship. They only said come back with your spouse or fiance for the joint interview even though they state on there webpage and all of us also phoned the consulate and were told we could not attent the Interview, but you can bet if we had been there or even outside the Embassy, they would have brought us in at that time to do this Interview. My advice GO TO THE INTERVIEW !
