IR-1 / CR-1 Spouse Visa Process & Procedureswhy DCF get approve faster than VSC???????????
QUOTE (reehon @ May 2 2008, 02:56 PM) <{POST_SNAPBACK}>
People who applied in their countries such as India, (Embassy of usa), why they process the case so fast and give a visa with in 5-6 months where VSC only get approves in about 6 months? Why so big gap?????

I should have applied DCF if I only knew VSC is a BS system where people have to go through so much...

I hate this system..............

why DCF is faster than VSC???
Why can't VSC is like DCF.

Mannnnnnnnnnnn......they have to do something.
Sorry for whining but i'm depress of all...... mad.gif crying.gif crying.gif crying.gif

YuAndDan is right: "DCF is faster because USCIS has only a small part of the process, and is handled by the USCIS field office overseas"

"Note only US Citizen's residing in the counselor district for 6 months or more can DCF, a person in foreign country for short stay as a tourist has to file their petition to USCIS in the USA." -- This is not correct. Requirement is different for different countries. For India, it is 90 days.

For India, it is 90 days. One my friend, went to Delhi and submit I-130 for his wife on Feb. 8, 2008. I send I-130 for my wife on Feb. 8, 2008 to chicago lockbox. I am still waiting on my I-130 approval. and my friend's wife has interview on May 19, 2008. Big difference.

I wish I stayed there for 90 days and filed DCF. blush.gif

IR-1 / CR-1 Spouse Visa Process & Procedurestax advice -does it affect immigration process
You can file jointly since you married before Dec. 31. I do not think that you have to live together to file jointly. Living together requires to get some credits or deductions. If you file jointly, it should not effect immigration process at all. You will not be able to qualify to get rebate since you will be using ITIN for your spouse rather than SSN. But your standard deduction will increase and you will get one more exemption by filing jointly.

sure I can give you idea but I am not sure how reliable that will be.
According to VJ timeline, you will get approve around mid september 2008.
According to USCIS information, you will get approve around Oct. 2008 (9-10 Months).
According to human rights, you should get approve around May 2008 (60-90 Days) star_smile.gif star_smile.gif star_smile.gif

Just to check our background and to make sure we are not doing any fruad, it should take them 60 to 90 days. Anything more than 90 days is not appropriate and violating human rights by keeping us away from our family. blink.gif

They might be faster or slower but they told her 30 days crying.gif It doesnt matter at this point, I doubt she will be here before 2009 anyway so im not going to try to rush things. VSC is setting a pace of atleast 10 months for the I 130 as it is now, so they are really 10-12 months just for the I 130. If i get approved in November which is 1 year from when I filed there is no way to have everything done before 2009, i will be lucky to be done with NVC in Jan of 2009.

its one year from the day you get it, so if she got it tomm, it'd be valid until 05-27-09. you'll definitely need it before then so might as well get it. you never know when you might get a surprise approval.

The only part of the K3 that was faster was the NVC stage, that is where you would save those 2 months, but now with the online system up there is not a big difference. Before July both the I-129f and the I-130 would be approved at about the same time, you can ask your lawyer about it and I am sure he will tell you the same thing, I didnt use a lawyer for mine but i called a ton of them before i filed to get a good idea of what is what. If you are ready for the NVC part of things you could expect to be done with NVC in about a month. The only thing that stops me from being ready is my wifes police reports, in Brazil they are only good for 3 months and take 1 month to get. Since I am on month 6 of waiting I cant really say that I will be done with USCIS in the next 4 months. So I lose a month even when my petition is approved because I cant ask her to get her police reports now to have them ready because i fear that USCIS VSC is not making any progress. Ive pretty much given up on America though, my wife is getting ready to open her own Pharmacy and I agreed that it was a good idea so if she gets everything in order I will be moving there within the next 4 months or so.

i'm not sure if this varies from country to country, but in Dominican republic, even though the police reports say they're valid for only 3 months, for immigration purposes(sent to NVC), they're valid for 1 year. i'm pretty sure i need to take a second recent one with me to the interview, but the one i mail in could have been taken out anytime from a year ago to today. might wanna check up and see if thats the case for other countries as well. i thought it was 3 months only also cause i just sent my wife to get hers.

A validity period assigned by the country issuing a police report has not meaning. The US Dept. of State is only concerned with the criminal status on the date of issue. They use their own standards for how recent the report needs to be.

thats what i thought, so if the NVC told me one year, then its one year for all countries then, no? someone else might want to try calling and see if they get the same answer.

Removing Conditions on Residency General DiscussionLeft US mid way through process due to family crisis
dont worry about it. i have a friend that went to dominican republic, and finished high school there(3 years) and he was still on his 10 year green card(dad petitioned for him when he was 7).

since he had been out for 3 years, he did need some paperwork, but him and his dad had it straightened out and he got in with no problems.

he just cant file for citizenship for another 3 years. other than that, no problems. i'd do what everyone else said and get to your embassy with documentation of family emergency.

Do you have to be living there for 30 days or something before you can use that address? its too late for me now, but i was thinking, what if i had just rented a shitty apartment somewhere in the west so my application went to the CSC instead of the VSC? and then just changed my address after a month or two. would it get transferred back to VSC? if not, icould just leave it till i got my approval, and then change my address when it went to the NVC.

something to think about for people who are planning on sending out their packets.
