I have had a couple of financial setbacks that have prevented me from submitting my K1 Packet. A few of the dates on the forms are atleast a year old. I have since recovered financialy. Is this going to be an issue? It will be two years since we have visited in person in August. Thanks in advance.

which dates? dates on forms that you signed? can you cross them out and initial them? as far as seeing your fiancee, if you have met within the last two years before filing your petition then you are fine.

You could send any chat logs where you are talking about future plans, but I think that a letter from each of you should suffice.

If your consulate accepts cosponsors then both your fiancee AND the cosponsor will fill out the I-134.

Folks, Does anyone know the answer to this one?

I was ultra prepared and obtained my fiancee's documentation regarding police and court certifications of no criminal arrests or convictions at the time that I submitted the original Petition, which was Sep 2012. I included copies of it with that to the USCIS but kept the originals. Will it be a problem if at the interview this Spring, I bring these certificates which will be several months out of date, or should I have my fiancee new ones?

Thanks for any info you may have.


New ones. Most police certificates are considered expired after 6 months I believe.

I assume this means I fill both of these forms in and print them off twice?

Yes, do exactly what the instructions tell you. Print them off and sign both if needed. You should make a copy of anything you are sending, but follow their instructions. They will be very clear as to what they want.

You will need to bring the original of your birth certificate and a photocopy. You also need to bring the original of any divorce certificates if needed, and a photocopy. You also need the original of your police certificate and I would make a copy for your records. They will take the original of that.

The consulate will have your original package that was submitted.

As far as the medical, and interview timing - you may want to ask in your regional forum.

PLEASE fill in your timeline also, the data is very useful on a site like this. It will also help us answer your questions.

Thank-you. I have actually had that post bookmarked for awhile, and it has helped with some of my worries, although I still worry with me not holding a job that it could be seen as a bigger issue due to that seemingly being the best proof towards recovery and not becoming a 'public charge'.

An article on ccdonline in regards to disability and immigration makes it sound very straight forward in regards to what they'd likely see as an issue where mental illness is concerned [if you are likely to be of harm to yourself/others, or have been in the past - which I never have been], but then it also states "The INS looks at the totality of circumstances in making its determination including their age, capacity to earn a living, health, family circumstances, employment history and whether or not they have ever received public assistance." and I get to worrying again.


Well, look at it this way, your fiance is going to be signing a document that says he is financially responsible for you and that you CANNOT receive financial government assistance.

You receiving disability is not an issue. You can be unemployed; they care about your US fiance's finances. However, your mental health history will probably be mentioned at your medical exam. I don't think it would be a reason for not being approved though. I would use the search tool to look up other posts about mental health issues.

I used some staples, but I wasn't excessive. I kept all my relationship evidence in chronological order with notes on the papers for boarding pass photocopies etc. I put a cover sheet, listing what was in the package. I wouldn't worry about the two hole punch thing. As everyone says, paperclips and binder clips are good.

I am American. My fiance is Canadian. In September of 2012 USCIS received our application packet for our I29f. On February 28, 2013 we received I-797 Notice of Action Letter stating that we have been approved. It said to follow directions listed on this letter.

The only directions are that we can call a consulate to change consulates.

I called the USCIS number but they said to call the consulate.

We tried calling the consulate in Montreal. My fiance called. They said it could take up to 5 to 7 months for them to call my fiance. Is that true??? They then said they don't have the file and that the USCIS was wrong.

What do we do next?

It was too my understanding that the K1 process takes around 6 to 8 months.

I am very grateful for any insight anybody can provide.

Congratulations on your approval!

First of all, it is very beneficial to fill in your timeline. The guides are very helpful in finding information on what to do next.

You need to call the NVC and they will give you your case number. From there, you can e-mail the Montreal consulate with your case number in the subject line and tell them you are ready for packet 3 and they may e-mail you. Once you follow the instructions on packet 3, you will either mail it to the consulate in Montreal, or e-mail/fax it and then you will receive packet 4 with your instructions on how to set up your interview.

I am the beneficiary. I was in Canada for 2 years. I came to Canada from the U.K. as a visitor (my ex husband was Canadian), and overstayed my visit! However , i left Canada March 2011 and never went back again. Do i need a police certificate from Canada? If so, would i have trouble getting one because of this? (I never got into any trouble with the police at all over there.)
Also.. do you think the fact that i overstayed in Canada will be a problem in my K-1 application?

Would just like to add that i have never overstayed any visits during times present in the U.S.


Yes, you do need a police certificate from Canada if you were there for 2 years. I don't think you'll have an issue getting it because you overstayed. I don't think overstaying in Canada will be an issue, but someone can correct me if I'm wrong.

You are at the packet 3 stage, you are almost there. It's a little difficult to expedite at this stage. Your fiancee is Canadian? If that is the case, there may be a temporary women's shelter she could go to for women in crisis? Or maybe a friend (fellow nursing student?) she can stay with for a couple of months? She would be eligible for financial assistance if she has no job so she could offer the friend a bit of money. But yeah, your case is pretty much done, hang in there.

Hi vj members it has been long since I was online hope you guys been ok. Anyways, I have a question of concern, and if anybody out there been through the same thing please advice. So I been placed under administrative processing for more than six month and should I say is good sign or a bad sign? I am not sure. On Monday this week I received I call from the embassy saying that my case has been reviewed but my medical examination and police certificate has been expired and that I need to go and get the updated ones. My question is, is the administrative done and is just to update my police and medical or still even after I do that I will still be placed under AP? Another thing is that the lady on the phone said that I need to submit my passport along with the police certificate and medical examination, but I told her they already have my passport and she said just to submit the two then. I am just scared to waist my money and be told your case is still pending under AP. So please anybody from Nairobi embassy or any one from any other country who have ever experience this share your experience with me.

Well, usually if they want your passport that's a good sign. They can't give you a visa without your passport.

It is an enhanced driver`s license then. You cannot cross with a regular driver`s license. I`m Canadian, I know this.

You definitely need a passport to fly to Canada. You CAN use an enhanced DL if entering by sea or land.

After it is approved it's another month or more for her interview and after her visa is approved she has 6 months to enter the USA on it. This all gives you quite a big window to get affairs in order.

You can go in together. They don't need to grill you, you have your papers saying you're allowed entry. When you go through you just say you're moving to the USA with a K1 visa. They will send you into secondary. You can both go in and they'll process your papers and stamp your passport etc. They say to have a list of items you are moving with you, but they probably won't ask to see it. All in all I would say it probably took about 45 minutes or so and the only reason it took a little longer is that they needed to wait for a computer to become available and the guy needed a little help in processing it as he had only done a couple before.

No, I wasn't asked for a name or address or anything like that (fortunately!!).
But I feel like it might be considered suspicious as I'll be going to the city every time, and I'm sure it was recorded last time where I said I was going. It is true that I could have a few friends in that particular city, and I do know a few people there, but I haven't gone to school with any of them. They probably wouldn't ask if my boyfriend is the same person I went to school with, or anything like that. So, yes, I probably really am just over-thinking it!

And I will definitely bring evidence of ties to Canada, and I will definitely tell nothing but the truth! :)


The border guards ask a lot of questions to see what your intent is, when visiting the country and to see if anything sounds suspicious. Sometimes they'll ask a ton of questions (where do you work, what's your occupation, what hotel are you staying at...etc etc) and sometimes they'll just ask you the purpose, who are you meeting and for how long. Never give more information than they ask for and always be honest in your responses. Since you didn't give a name as to who you were meeting, you are absolutely fine. They may or may not ask you next time, for a name. There is nothing wrong with saying that you met online, this is quite common these days! You're not doing anything wrong, so there is nothing to be worried about.

When I go across the border though, I admit I'm always worried they won't let me across for whatever reason! It's like talking to a police officer, for some reason you feel guilty even though you haven't done anything wrong! :P

but did he not think as soon as he had the blood test he didnt clock on that illegals would be found its like any medical they check for things like that and also what did your fiance say when the doc asked if he ever took drugs ????

She already answered these questions. Also, it is a moot point - what's done is done: visa is denied due to drug use. Mistake made, learn from it, move on.

I thought I would update people on my experience yesterday at Chicago O'Hare at 3:30pm and hope it helps other people. Before I start the story, just to say I got in.

We are still waiting for our NOA2 and I have come in for 6 weeks. I was made redundant and left my employer on 23 November, so have no job and only have a room in a flat as I have sold my flat in preparation for my eventual move to the US. Better to sell it a reasonable leisure than sell it in a hurry!

So. I brought a folder showing all my ties to the UK and our lawyer provided us with a letter saying that I was only coming for 6 weeks and then leaving again. Our lawyer has constantly told me 'do not come back to the US without the K1 Visa in your passport'. So it was good of him to provide the letter - I expected to only provide one saying that he was acting on our behalf.

I was nervous at passport control but controlled the nerves well.

All he asked me was:

What are you here for?

Answer: holiday

How long are you staying?

Answer: six weeks - I return on 12 January

And then it was the usual - 4 fingers - one thumb routine and I was through.

Collected my luggage and made my way to the customs guy with my completed form. This has always been quick - hand the form and through. However, this time he had questions. As I had bought my fiance's children a couple of London t-shirts and mugs, I declared them although it was under $100, which I know is the limit. I did this last time too. He saw the total on the front and then turned over the form and saw the items.

He asked:

Who are you here to visit?

I was thrown as I didn't expect him to be asking that question - I expected that from passport control.

I said 'pardon?' He didn't repeat the question - he just looked at me.

I said 'My fiance'

He asked 'When are you getting married?'

I said 'March or April, whenever the K1 Fiancee visa comes through.'

He asked 'What visa are you on now?'

I replied 'An ESTA'.

He said 'You know you're going to have to go home, don't you?'

I've said 'No!' and as my heart fell through the floor. My fiance is just yards away from me - waiting for me at the other side of the door I can see.

He said 'You can't stay until April'.

I said 'I don't want to. My return flight is on 12 January.'

He said 'OK. Have a nice day.' and waved me through! He didn't even ask to see my return ticket!

I think my mistake was putting anything on the customs form. Everyone else was being waved through. I only did it as I had left the tags on the presents to give to the boys. In hindsight, that wasn't really necessary as I'm not going to be able to return them as I'm in the US for 6 weeks! I should just have removed the tags and not declared anything.

There's also another possible explanation for the questions. If I did show up at passport control as having applied for a K1 visa, passport control might have tipped the wink to customs whilst I was getting my luggage to ask me more questions. The customs guy did look down at my luggage as if to assess how much was there - I was about 3kg under the 23kg allowed and had my carry on bag and laptop. However, I have a brand new passport, so no stamps in it - I would think their computer system will link my new passport to my old one but I don't know what detail it would show.

I walked out into the arrivals hall and into the arms of my fiance and just wanted to cry. He said 'You're shaking but you're here and that's all that matters'.


It sounded like you had a fairly straight forward experience. They're supposed to ask at least a few questions and you had answers for all of them, so everything is fine :)

We have already filed the correct forms for her to immigrate legally for the K-1 visa and it is in process. She will be staying at my home and I will be supporting all costs of her trip during her stay. I have attached copies of my recent pay stubs, a lease of my home, flight itinerary with return ticket booked, copy of I-129F form intended for the K-1 visa, and a document showing that our I-129F form has been submitted and K-1 visa is in process. I'd skip the letter too. As long as she has a return ticket itinerary she should be fine. A copy of the I-129F form might be advantageous, but a document stating that you're not going to be getting married or breaking any laws is not needed.

I can't wait to visit my fiancé. I just booked the plane tickets for December 6th, just for a 10 day visit flying from Manchester to Chicago. I was planning to wait until we got the visa, but as CSC seems to be slowing down, I really need something to look forward to. Last time I went to America I got a pretty intimidating TSA agent, I completely panicked and said I was here for pleasure when asked why I was here, even though I was visiting, my boyfriend at the time, now fiancé. I think I've watched the terminal too many times, and was expecting the question; 'Are you here for business or please'? I hope that doesn't come back to haunt me. But I do plan to get a letter from my employer to prove my ties in the UK, just in case I need it.


TSA is not customs. I believe they're just looking for reactions to their questions. There is nothing wrong with saying "I'm visiting my fiance". As for customs, just answer the questions you are asked. Last time I crossed the border all the border guard said was "why are you going to the airport?" me: "to drop him off (pointing at my fiance), border guard: "ok, have a nice day". All you need is your itinerary showing your return flight and they'll probably ask you what you do etc. I know the anxiety, I go through it every time I cross the border because I feel like I have so much to lose if they deny me entry. But if you've got all your ducks in a row, there's no reason for them to deny you.

Just wondering if anyone can give me some advice. My husband won't be getting employment medical insurance until October when it kicks in. I just found out I'm pregnant! I want to get it verified by a clinic, and I was thinking of using Planned Parenthood. Am I allowed to use their services? I guess I want to get confirmation first that I am pregnant and I will need to see a Dr. before my husband gets insurance. Is PP considered government assistance?
