On the I-129f question 18: how much details should I put, i know its one of the most important questions to answer but wondering how much details should i put down. also 2013 is not our first meeting it was back in 2008. from 2008 i revisited on 2009, 2011 and 2013. do i write out also the past years that we met?

You could say that you first met in 2008 and have since visited each other in 2009, 20011, and 2013. They require that you have met in the last 2 years and you have. Just a couple of sentences is all that is needed.

Hello everyone,

I have a question regarding the I-134 affidavit of support question 1.

My future mother in law will be cosponsoring me. She was born on a military base in Japan and has a US birth certificate. How would she answer the citizenship question? Would she say that she is a US citizen through parents? I don't think she has a Certificate of Citizenship though, because she has a US birth certificate. Or would she attach a letter of explanation? I will be getting a copy of her birth certificate, so would she just fill in when and where she was born and attach her BC with the APO#?

I'm hoping someone else has been through this situation.

If you are at your NOA2 stage you are well on your way! If you were approved Feb. 6 NVC should have it, or be very close to having it. It takes about a week or a bit more for NVC to receive it, they then pass it on to the US consulate where you reside. Your fiance can get together his I-134 right now and send all his papers to you. At this stage you don't need a lawyer.

I will affirm that by calling and asking questions you will not delay your case as the customer service agent doesn't process your application. That being said, like many others have pointed out, you are not beyond normal processing times, they have received your RFE, so that means your case is being processed, that's great news! During this time, get all your stuff together that you need to for the K1 interview because after you get your NOA2 it feels like a speeding train with how fast everything goes. Your approval will come when it comes, there's nothing you can do.

Try looking up the consulate information on this site, it is very helpful. Your fiancee will also need to make sure she has all her vaccinations done with records etc. Try looking around in the Peru forums also for tips, every consulate is different!

For myself, a week after we got the NOA2, I contacted NVC to get a case number. A few days after that I contacted the consulate by e-mail with my case number to ask for my "packet 3". They replied they hadn't received my case files yet, but the next day they did and e-mailed me my packet 3 that contained instructions on all the documents I need to get together. Once I e-mailed them back with my packet 3, they e-mailed me packet 4. Every consulate is different though, that's why I recommend to research Peru's.

Like the others have said, it doesn't matter. You do, however, need to check that your Embassy accepts co-sponsors. Some do, some don't. Each is a little different. You yourself will need to fill out an I-134, and your co-sponsor will submit one as well and you'll hand them in on the day of the interview. They'll also need all the proofs etc (tax returns and whatnot).


Agreed! Check your country's forums and ask if they accept co-sponsors. Some people are going to interviews and denied because their country's embassy does not accept a co-sponsor.

I am new to visa journey. This month I will be sending the first package for the K1 Visa. Me and my fiance have been engaged for 3 years now. My first question is how do I send the package? Do I put it in a box or a large manila folder? There is a lot of info that I have to send. My second question is we haven't seen each other since September 2010 will that be a problem. Neither one of us could afford the trips but we are now in a better financial situation. I am truly overwhelmed by all of this paperwork but I am ever ready to be with the man that I love. If you are now in a better financial situation then it's best to book a flight to see your fiance. You have to have met within the last two years before filing your I-129F petition.

I'm just wondering how many passport photos we will need for the interview. I understand that you need one for the medical, and the DS 156 needs one, but do the copies of the form also need them?
And when the checklist asks for the photos, how many are needed and does that include the ones that need to be glued down onto the forms? (does every form NEED the photo, even the copied forms)

I didn't glue or even attach the photos. I gave one with my medical, and then 2 I had paperclipped to my forms for the interview and they attached them for me there. Your packet 3 checklist will say how many photos you need.

You might want to check in the military forums. Is this company contracted by the US army? Or does your fiance actually work for the US army? If it's a company that just does some work for the US army I doubt you can be expedited on military grounds. Others can correct me if I'm wrong.

The same thing. Wait until you apply for Adjustment of Status when you can then apply for Advanced Parole at the same time. Maybe try some nice places in the USA for a honeymoon instead and go to Europe later?

Whats an AP? and EAD?

AP is Advanced Parole (what you will be needing to travel outside the USA after your marriage if you don't have your Greencard yet). EAD is a work permit. You can apply for Advanced Parole and the EAD (work permit) at the same time when you apply for Adjustment of Status after you are married. Like I said, if you have your heart set on Europe for a honeymoon you will have to postpone the honeymoon for a bit while the application goes through.

You can apply for Advanced Parole and EAD at the same time when applying for Adjustment of Status (right after getting married). If you have your heart set on a European honeymoon, and are willing to wait a bit, you can wait until you receive your AP to travel.

Will having a domestic violence misdemeanor one, knowingly caused or attempted to cause bodily harm on my record with marijuana paraphernalia charge be grounds for denial of 129f petition? Both records are over 3 years old. My fiance the beneficiary has no record. Although I have done a state wide search for a record of the drug charge it does not come up on reports, besides it’s only one charge the instuctions on the 129f clearly states 3 or more convictions so if I only have this one conviction with drugs a certified backround check is not required on one charge but three or more is this correct?

If we submit passport photos alone and then pictures of us together at the alien finance interview would this cause a problem?

We would like to start the application asap as we hope not to spend Christmas apart and we long to start building our future together.

On our last visit we were so caught up in the moment, we didn't pause to think of photos, unfortunately we don't have any together.

However we have all other information, hotel reservations together, call records etc.. to prove a real and existing relationship.

We will be together again in a few months.

Should we wait to apply after this trip seeing we would have photos together or is it safe to proceed?


You will need photos of you together for your initial application. It is not just photos, but other evidence of having seen each other. (ie: boarding passes, hotel receipts, things of this nature) Read the guides, and all of your questions will be answered. Based on the types of questions you are asking, if you do not read the guides, I can pretty much guarantee you are going to receive an RFE (Request For Evidence) or it will be rejected.

There will be a step by step guide for the K-1 visa process including what types of photos to submit and how they should be submitted. With the I-129F package you will submit passport style photos of both of you and photos of both of you together to support evidence of a relationship. Read the guides.

I think I've read too many horror stories on here and I've been really hesitant to file this while she has been here. I've been staying in Vancouver for 6 months, then coming to Chicago for 6 months, and we've been doing that back and forth because we can afford to as 23/21 year olds... and to say the least it has pissed off the border guards a bit. She has been interrogated before at the border, flagging her and we sat around for 2-3 hours while they asked her about every single trip she has taken in recent memory. I was worried that in the interview/approval process they would see that we were essentially doing the exact same thing while I file for the I-129F (she has been here for 4 months already) and that it would flag some sort of visa fraud.

Probably irrational fears, eh?


Yes a bit irrational. You could go ahead and send it off the day before she's set to go back then, which is what my fiance and I did. It honestly doesn't matter though either way. I can see why the border guards would be suspicious as you are supposed to spend the majority of the year in your home country.

Our current plan as you all know is to file while I am in Chicago and she files in Vancouver, as opposed to getting legally married here and filing the proper papers so we never have to be separated. From what I understand, the process we have chosen is typically much shorter than the getting-married-here-and-filing-papers-after route, correct? The first line of action is more ideal for us because it allows her to work in Vancouver while we wait, as opposed to not being able to work for ~who knows how long while waiting for the files to be approved.

If you are filing the I-129F for the K1 Visa, YOU are going to be doing the filing. She is not going to be doing any filing. Therefore you can file while she is there with you, as other posters have stated, it is much easier if you are both together and can help each other gather paperwork, photos, letters, passport photos etc. (My fiance and I did this while I was visiting him in the USA). Make sure to give her a copy of the entire package that you send in.

Once you have sent off your petition, you wait until it is approved (which takes 5-7 months approximately). In the meantime, she can get all her paperwork, vaccine records etc. etc. that SHE will need for her K1 Visa interview at the consulate in Vancouver.

and YES you can visit each other while your application is being processed. Read and research all the guides offered here and the forums. It will eventually all begin to make sense and come together. Good luck with everything!

I have a question about the required vaccinations. I have all the required vaccinations except for PNEUMOCOCCAL. In fact in Italy you normally do it before you are 5 years old or after 65 years old. My doctor said I don't need it because I am not a subject at risk, and that this vaccination is heavy and risky too.
Do you think it will be a problem that I don't have the Pneumococcal?

I recommend asking in your country's forums. I don't think you need that one, and the panel physician would deem it medically inappropriate for your age, but check Italy's forums.

She is from Spain. POE in JFK.

I've actually gone there in October 2012, should be going again June 2013, and hopefully one more time November 2013, so I will have plenty of visits to her :)

So now that we have some answers, we've re-done our thought process and will most likely start the K1 process when she arrives in July 2013 for second visit. Now when she comes in Jan 2014 for the third visit under VWP, the K1 will be pending so I want to restate my original question about providing evidence of strong ties:


1. What evidence suggestions do you have for this case: She will have graduated college by this time. Lives at home with mom. Might still have a job teaching young children daily and a bartending job once a week (have to confirm). Will also have to confirm about bills she specifically pays. But what do you think would help with convincing evidence? She has lots of family there, but we are wondering what else we can gather for proof.


I think the jobs will help. She'll have jobs to go back to and a return ticket itinerary to show. When entering the USA she would just say she's visiting her fiance. They may or may not ask about a petition pending for her. (I was asked only once).

I would go over the checklist that the embassy provided for the forms you need to bring to the interview. I needed to have 2 copies of the DS-156 and 1 copy of the DS-156K.

So I still have at least until August to hear back about my NOA2 but I'd like to be prepared. I would require a co-sponsor for my visa IF I am still working part-time when the NOA2 arrives. Can someone tell me what the process is like when you have a co-sponsor, what stigma it puts on your case? I'm young and broke due to college loans and education debt. How badly does this reflect ? What advice would you give? What steps can I take to prepare?

It does not put a stigma on your case but you should find out if Ghana's consulate accepts co-sponsors for the K1 visa. Some countries do not.

It's a notable effort, but trying to get 100,000 people to sign a petition when they have no idea who you are, who your fiancee is, or the circumstances of your case is far fetched. I would put my efforts into finding out exactly why the visa was rejected by calling/writing USCIS. Then perhaps trying a different route to get your fiancee here. Call your congressperson, senator etc. also.

Our information left NVC on Monday, March 4th to the US embassy in Algeria. Do we have to wait to receive information from the embassy before we can schedule an interview or can we schedule one now? How about the medical? I do have a case # from the NVC.


Check the embassy info or in your regional forums. Some embassies allow e-mail communication and allow you to choose a date and others choose the date for you. Give at least a week to 10 days to contact the embassy to see if they have your case as it will take a bit to get there and then a few days for them to enter it in the system. Good luck!

I have had a couple of financial setbacks that have prevented me from submitting my K1 Packet. A few of the dates on the forms are atleast a year old. I have since recovered financialy. Is this going to be an issue? It will be two years since we have visited in person in August. Thanks in advance.

which dates? dates on forms that you signed? can you cross them out and initial them? as far as seeing your fiancee, if you have met within the last two years before filing your petition then you are fine.
