K-1 Fiance(e) Visa Case Filing and Progress ReportsMay 2011 Filers
NOA2 approved on july 18th, NVC received our petition today, it took 3 weeks to enter the petition in their system,
because in fact when they say that they did not receive a petition, its because nothing show on the screen operator, that just mean that they did not process the petition into their system yet.
I called friday, they told me to scan a copy of NOA2 and email it to them, wich I did, no answer. So I called again today and the operator told me this time "We just entered your petition in the system today".
The ones on july around the 18th, keep on calling, several times a day, it changes every hour i'm sure :)

K-1 Fiance(e) Visa Case Filing and Progress ReportsMay 2011 Filers

Hey folks, how's it going?! Still waiting here in England. I hope you don't mind I stole the 'where will you go first' question for our blog. I'm trying to stay busy whilst we wait so anything helps, right? That's why I don't post on here too much but I actually check about 100 times a day to see if anyone else has been approved from May.

It's so cool to see the support for eachother! Haha by the way we're hopefully moving to the Florida Keys and we'll be 90 miles from the nearest Walmart...what will we doooo?!

I bought the dress I'll get married in...eventually! I also found some shoes the other day so even though I'm going insane waiting I've had a little bit of fun looking forward to that day.

Good luck this week, everyone!

IR-1 / CR-1 Spouse Visa Process & ProceduresChild's paper required

Thank you very much !
Matylda

Thanks a lot Corinne! Your help will be so helpful!
I sent you some more questions on your profile...
Thank you again!

Yes Matylda, show the judge that you are already in the process and give him a date of establishment, you have to tell him also that you need this decision before your interview in order to be able to get your visa.

IR-1 / CR-1 Spouse Visa Process & ProceduresChild's paper required
I have a child also 10 years old, and since the father did not approve his departure to the US, I had to go in front of the judge (JAF) to obtain the authorization.
The consulate requires at the time of the interview, an approval letter from the other parent SAYING THAT HE ALLOWS HIS CHILD TO LEAVE THE COUNTRY AND TO ESTABLISHED WITH THE MOM IN THE US or a judge decision to be able to deliver the visa k1, I am sure its the same for yours.
hope it helps :)
good luck!

K-1 Fiance(e) Visa Process & ProceduresVisa Refused

My fiance' had his interview in Copenhagen on June 23. They refused his visa because they want more documentation relating to a diagnosis of schizophrenia made several years ago. The diagnosis was apparently incorrect -- I knew him through that whole period, and reviewing the situation a few years ago we believe it was more likely a depression brought about by some extremely stressful circumstances that was then improperly medicated -- we have evidence between his medical records and our chat logs that he did not start hallucinating until after they gave him medication, and the diagnosis was clearly made on the basis of his hallucinations. The medications he was on affected his mind such that it prevented him from putting that together until much later.

Unfortunately, he's effectively considered crazy until proven sane. Fortunately while he was visiting for six months last year he decided to see a psychiatrist here, who supervised his coming off of medication and agrees that, even if he may have possibly needed medication several years ago (he can't say because he didn't see him then), he certainly doesn't need it now and shows no signs of schizophrenia or any other potentially dangerous mental health condition.

The consulate said if he provided a letter from the psychiatrist he saw last summer, they would reconsider. We obtained the letter and submitted it to them almost 2 weeks ago. They acknowledge they got it, and we know they have contacted his other physicians. I am trying to be positive, but it's hard. His psychiatrist in Denmark doesn't speak Danish well (she's Ukrainian) and many of her notes in his record (what few there are -- six years in the system and his whole file is less than a cm thick) are nonsensical, largely due to her poor Danish. It's hard to say what she would say if contacted, and it worries me because she logically would be more interested in defending her diagnosis and treatment than admitting she may have made translation mistakes.

Anyway, I just needed to vent a bit. I'm anxious and frustrated, but I'm sure it will all be okay in the end.

Thanks for listening. :)

Keep faith, I hope eveything will go well, sometimes psychiatric doctors are worst than the problem itself :bonk: . Good luck to u guys.

K-1 Fiance(e) Visa Process & ProceduresK1 fiancè visa
Hi all!
The first time I came to visit Lee it was under the waiver program, I stayed 3 months and returned to France with him. We stayed 1 month in France and we travelled back together to US,with the waiver program again, at Chicago Airport the immigration officer kept me in a separate room for 5 hours.. I was refused entry because they thought I was trying to get married, I explained that I could not get married and Lee either because we were not even divorced yet from our first marriage, they did not believed me (and it was true, I just wanted to spend sometimes with Lee while my divorce was processing, they put me in the plane that very same night to France. I was not allowed to come back to the US (I was refused not deported)under waiver program anymore. I aplied for a B2, I got refused also, for the same reason. It was in 2009!!! Hopefully Lee was able to travel alot during those 2 years.
So now, we got NOA2 approved on july 18th and we are waiting for packet 3, 4 and the interview.
That was my experience of getting refused port of entry, means that even if you are sincere, as long as you have an american boy or girlfriend, the best way to make it right for immigration service is to apply for the K1 and be patient :)

K-1 Fiance(e) Visa Process & ProceduresSingapore fiancee

To the point

Can my fiancee be with me in the USA while we are preparing her paperwork and filing for our K1?
Singapore is a visa exempt country and she has her visa waiver done and has been traveling back and fourth with me. I was told that she cannot file for K1 because this is considered a visa and you cannot hold one while filing for another

Thanks Chris

3.15)...Can I, while my fiancee will apply for a I-129F package, be with her in the US ? So we can stay together while the application is being processed or do I have to go to back home again ?
A..As long as you do not go beyond your visa expiration date and leave in plenty of time to do your part of the application then it should be ok. Many couples file the I-129F while the fiance(e) is in the US. However, the visa application itself is accomplished in the fiance(e)s home country, so the fiance(e) must return home to complete the visa application process and the interview at the US Consulate. So the bottom line is that you should follow all USCIS rules if you are here int he US and if your visa requires you to return home on a certain date that you do so on time.

Thats what I found on VJ.
Hope it helps :)

K-1 Fiance(e) Visa Process & ProceduresWhat is in packet 4?
I don't know about England, but packet 4 is the interview date and the list of doctors to make an appointment for your medical exam. At least for France consulate.
The checklist and other forms are in packet 3.
good luck!

My fiance put his child too because he pays child support, but what about the ex wife, knowing that he does not have to pay maintenance for still one year? Do you think he has to list her too?
Thank you spikedog :)

K-1 Fiance(e) Visa Process & ProceduresDo i have to list the ex wife on affidit of support ?
Hi all!
I have a question as my fiance filled the form I 134 Affidit of support, the question 8: "The following persons are dependent upon me for support"...
He did not put his ex wife because he paid her maintenance for 3 years at once, 2 years ago, so he does not have to pay maintenace for still 1 year.
So the question is:
Does he have to put her anyway, or just put the current dependent persons (his children)like he did????
We are waiting for the interview soon, and suddenly we wonder.
Thank you for your thoughts.

K-1 Fiance(e) Visa Process & ProceduresPackets 2-4?

Hi everyone,

This might be silly but I can't find information about the "packets" that everyone is talking about receiving and sending back in. I have looked in the other forums and done searches but can't seem to locate exactly what they are and what documents are in them. Is Packet 2 just the NOA2 and the other packets the information for the affidavit of support, etc.?

Please help or direct me to links on here that I missed.

Thanks!

Bonjour,
Where are you at for now, you should edit your timeline so we know what you are dealing with.
Are you waiting for Noa2? Or are you approved yet? Packet 3 and 4 are the ones the consulate send you when they receive your approved petition (NOA2)... Respond on my wall if you want, I'll help you :)
