I do not seem to have the passport and the stamped visa from her country (India). Without the passport and stamped visa do I have enough evidence to apply? I do have a copy of an unstamped visa, my itinerary from India, photos, emails, and skype calls.

We have decided to apply for a K1 visa. Looking now at the evidence we have, I am afraid there might be a problem in this area. I have the itinerary for my trip but not the tickets (I went on a scholarship program and did not buy them myself). We have a very large number of e-mails and also a long record of Skype calls, mostly Skype to her phone. However, it would appear that I have lost my passport with the visa and stamp in it while moving out of my old apartment :( I have a copy of the passport itself as well as a copy of the visa (before it was stamped) and my birth certificate. Assuming I do not succeed in finding the passport, do we have even have a chance? FYI we have sent in no paperwork as of yet.

No. Just because someone fills out the I-134 as a co-sponsor does not mean that they have to fill out the legally binding I-864 later. You can use another co-sponsor for that, or if you make enough by then, don't use a co-sponsor at all.

To get the Adjustment of Status you will also need co-sponsor for 864. In this case you are on the hook until citizenship or your fiancee earns 40 credits for social security (working 10 years as resident). If they did the 134 only, you are right. But s/he will have to leave the country if you cannot adjust status.

The 864 is only need for AOS, which is a long way down the road...I intend to have a better job by then. If they 134 do they also have to sign the 864?

OK so I am a recent college graduate. I have a pretty crumby part time job and after going back to my fiancee's hom country for more evidence I will be looking for more jobs. In the meantime, though, I am afraid I will not be able to get enough of an income and assets to meet the sponsor requirement. I am thus trying to get my parents on as cosigners as their assets are quite sufficient, but they are afraid that by just signing the I-134 they will be on the hook for her until she becomes a citizen. How can I prove to them that this is not the case? From what I can see the I-134 is only valid for the duration of the K1 process (id est until we are married in the US) and in any even is not a legally binding document (DESPITE what the instructions and the document itself state). What proof can I show them to convince them that they will not be responsible for her until she's 30 years old?

Hello all, 

I asked this question a few months back, but I didn't want to revive an old thread, and I am just looking for more specific advice.

 

So, I received my NOA 2 (electronic copy-although still no text and email :/ ) on September 6th, and I am the beneficiary, and I am still in the US on a student visa, which expires in December. With this all considered:

 

When should I be going home to continue this process?

 

Is there a time limit on how quickly I need to send in packet 3?

 

Am I considered out of status, currently?

 

We are provisionally setting a wedding date of May 24th. Is this too late? Or is this feasible?

 

I have one online class, an internship, and one class where I am able to participate online (I have talked to the professor already.) I have a return flight home in November 14th, but this can be changed for £70 so it is no real issue, but is this date of return pushing it?

 

I know this is a lot of questions, but any responses are greatly appreciated.

PS. And I know we could have just got married now and adjust my status, but we don't want to do that, and we are not doing that, for a number of reasons, so there is no need to bring this up in your responses, I am perfectly aware of what I could have done, but this is what we are doing. Just to quickly revive a dying thread for one more question, Am I right in thinking, I can't physically do anything until I receive my case number? And would I be right in thinking that one I physically receive packet 3 that would be the time to head on home. I hear they are processing and applying case numbers pretty slow, so might even out to work out ok. Sorry if it sounds as if I am asking very similar questions. Yes, but you do know that you don't schedule? You can have that medical and wait 4+ weeks for them to put you on the Interview schedule. And that appointment could be another month away. Then it could take 10 days to get the passport returned. Or if you have any middle east, Muslim, India, etc personal or family connections or highly scientific education, maybe months to get the visa issued. It is impossible to predict a timeline.

There are three things London must have to give you an interview:
1) application forms
2) medical results
3) DS-2001 readiness for Interview form

You can slowly dribble those in to London. You don't have to send the forms for a month. Include a cover letter to explain why they are slow coming in...you are studying in America, yes you still very much want the K1 visa, but not until the semester ends. Then maybe in November (after you have made a medical appointment) send the DS-2001. Give the Medical date and also the desired date you want to return. It says give wedding date, but if you want to return well before the wedding then make up a sooner wedding date. By keeping them informed along the way, they don't think you changed your mind. They know why it is taking you longer.






 

Well fortunately, (in this case) I have a very simple family and background, no muslim or middle eastern ties, or more relevantly no IRA or protestent paramilitary family members.

 

I know I don't schedule the interview, when I said that I meant when I would be able to start the interview scheduling process. It isn't the being away for a certain time that we are concerned (too much about) it is more about the immediate need to leave before I absolutely have to. Although my classes are online, it would be handier to stay until at least the middle to end of october.

The medical is NOT step one. The application forms are. In fact, the most effective way to delay an interview (if you wish) is delay having the medical.

So theoretically, if I figured out how to fill in and post packet 3 and my police certificate while still in America, I could return to the UK for my medical, for instance at the start of December and then schedule my interview without concern of my i-797 expiring?

Interviews are currently taking a while in London currently there are some who have been waiting for well over 6 weeks to get a interview date. In my opinion you would be cutting it fine. Now have you'd received packet 3 documents at all? If so do you ALS realise that as of September 1 we are now required to fill out ds-260 online. You would also need a invoice I'd number to do this. Currently packet 3 letters aren't indicating the form is needed but according to NVC it is a requiremnt. You would have to call them to get the invoice I'd so you can fill this out. Also your medical needs to be booked. You may need to wait a further two weeks hot get a appointment for that.

 

I don't know yet. I figured once I got word that I received packet 3 to just head home the next week, I had just heard it takes a while to get the packet 3. My parents are currently on vacation, but they came back last night. We are going to skype tomorrow, and I will ask them to let me know if it has arrived. I will fill out both the ds-260 and 230, just in case, better to have too much, rather than too little I bet.

All the i797 have a 4 months life span. This basically means you need to have completed your medical and returned all your DS forms and interviewed within that time frame or it expires. It can usually be renewed if for example a file goes in to AP and further checks are needed it will automatically be renewed. I really do think a good reason for not getting things done in the time given is needed if they are to renew it. Best you work out how to do this before yours expires. And you do need to one to London to complete the process. Everyone has to do it that way people travel from Scotland get a hotel overnight and go to their interview in the morning. Also same process with your medical.

 

Ok. I am still in the US. Do you think if I left at the end of October/start of November this would leave enough time, or am I cutting it fine.

 

I am ok with going to London (didn't hurt to check), flights are pretty cheap. Is there anyway to book the interview for later in the day, so I can fly over early in the morning, and fly home later that same night?

Hello All.

I received my hard-copy of the NOA 2 or i-797. I noticed it has a section which states that it will expire on 1/5/13. 

So I have two questions.

 

Currently I am still in America, preparing my stuff to eventually return home, a date which I have still not decided on. My question is, what does this expiration represent? Does it represent the time that I would have to have my interview? What if I can't schedule an interview before then? 

 

Also, I see that it states in the hard copy that I can contact the consulate to forward it to a different consulate. I am from Northern Ireland, and it would be less hassle if I could get processed in Dublin rather than London, something I previously thought was impossible. Has this changed recently, or am I still clutching at straws?

Thanks for responses. I think it is weird. Noa2 vaildity is 4 monts. If we wait for nvc more than two monts as some fillers it just doesnt have sense cause we know that appointment for interview also takes a month in some countries. Plus the time papers get to the embassy. It is really tense deadline!

 

I have been assured that the expiration date, is a soft expiration date. You will just need a new notarized letter of intent to be married from the petitioner, and they should automatically "extend" the expiration date. 

 

I think that is the case for London anyway, from what I have been told from Nich-Nick, who is one of the most knowledgeable people on these forums.

I know one thing. I am not going to wait 30 minutes to talk to some call center agent to state " we don't have that case number on file, wait 8 weeks".

 

Waste of 30 minutes this morning. I will e-mail them. 

 

Unlike some, I am in no mad rush for them to receive it. I am still studying in America, and the longer this sprawls out, the longer I can stay here :)

 

Best of luck to you all. Try emailing, certainly less hassle than waiting 30 minutes for a 20 second call.

It took about a week for us to receive noa1. I think the later in the week you do it, the longer it will take (from my own experience). I would be expecting it on Tuesday or Wednesday.

Received my "A# change" notification today. Cautiously optimistic. Got two text notifications 15 mins apart, hoping that the second one is for NOA2 approval. Online the status still states - Initial Review though

 I literally checked the USCIS website once I got the email notifying me of you quoting me.

August filer here... Sent everything away on 8th August got E-Notification on 12th, Had NOA 1 in paper on 15th, and changed my registration number on 14th.

 

Currently it says under initial review. Whatever that is.

Have you tried calling or emailing NVC?

 

I call them every week Monday and Thursday. Without trying to sound too offensive, it is kind of annoying the way they answer the phone, very rude, like you are an inconvenience. I think I have also only talked to one operator where english was his first language. Nothing against those for those which english isn't their first language, I just don't understand why they work at a call center, very hard to have a conversation with, or gain further information.

Still waiting for NVC to issue a case number/recieve our file, or whatever the terminology is.

 

Got NOA 2 September 6th, so is on the verge of becoming ridiculous, but no worries this end, I am still in America, and not leaving until I recieve the letter(package 3) at my UK address. Planning a late spring/early summer wedding so in no mad rush.

I used a lawyer and still waiting on my NOA2 I received my NOA1 on August 19

 

The process normally take about 5 months in between Noa1 and Noa2. Those getting processed within a month arent typical, myself included.
