National Visa Center (Dept of State)AOS Package Question

At this stage, 'intermingling' is not important and most times not possible with the spouses living in different countries. The fact that you have been sending her money (and maybe gifts) is all that you can show to the CO. However, the CO may not even ask to see such evidence.

Should I include the transfers or her withdrawal receipts in the IV package? Thank you.

National Visa Center (Dept of State)AOS Package Question

This shouldn't be a problem.  I didn't change my withholding rate after we got married either.  I went through with no problem whatsoever.  Since we were married in 2013 I filed for us jointly in our tax return so that may have been helpful, but I'm positive as long as you have plenty of other resources to show you are intermingling finances you'll be fine.  I wouldn't sweat the pay stub one bit.

I actually don't have any evidence of "intermingling." I am not able to put her on my bank account without an SSN (I did not now about ITIN until recently) and I was unable to find a bank that would open a joint account for me in India. I have sent her a lot of money, the transfers are the only proof I have. Should I show that at some point?

National Visa Center (Dept of State)AOS Package Question

On my pay stubs and my offer letter for my promotion, my last address is listed. Also all of my pay stubs up to now list me as single. Both of these problems are because I forgot to update my HR portal at work when I moved and got married, respectively. I changed it last night, but I think I am going to mail my AOS package out pretty soon since my USCIS case arrived on the 11th of last month. I don't think a pay stub with the correct address and my true marital status. Is this going to be a problem? Do I need to include an explanatory letter? Thanks.

Ya I have already written "N/A" there. I wrote "Same" initially but changed it just to be sure :D

And I scan the entire package and keep a digital copy of it.

National Visa Center (Dept of State)My Letter to Obama About the NVC's Wonderful New Processing Times

Dear Mr. President,

My name is thedude6752000 and I have petitioned the government for my wife, who is currently an Indian national residing in that country, to get a visa to come live with me here. I just wanted to thank you, you majesty King Obama, for your DACA amnesty, put into place completely in defiance of the US Congress and Constitution. Although I doubt you care, in addition to the 7 months at the USCIS I had to endure without my wife, I am now coming to find out that the National Visa Center has extended the wait time for every piece of paper they process from 30 to 60 days as a result of the backlog created by your brazenly illegal amnesty polices. I really appreciate all the help you've given to people who have no legal right to be in this country at the expense of people patiently waiting in line to come here the right and legal way. I especially appreciate the fact that I will pass my first wedding anniversary next month alone and without my wife. That's hope and change I can really believe in, because unlike your empty promises to "fix the immigration system for people playing by the rules" I am sure this will come to pass.

In closing I would just like to say that I cannot wait to vote straight Republican in November (and I say this as a former OFA Deputy Field Organizer in Florida)and even to help the Republicans here in Virginia organize and get out the vote, in order to do my small part to further ruin the last years of your useless Presidency, just as you have ruined my life and shattered my marriage.

Sincerely, thedude6752000, spouse of a non-resident alien who was dumb enough to follow the law in your new lawless America

I'm not convinced it's only the previous backlog which has stung us for this entire process this far. We are getting lots of reports that the 2014 DACA renewals are already passing the USCIS and are now at the NVC. I wouldn't doubt the NVC is being further slowed by this.

Whoever told you that does not know what the hell they are talking about. DACA doesn't grant any type of visa to enter the US so it never goes to the NVC and State has not to do with it.

*Also vote Republican in 2014, my apologies.

Do believe that anyone that received the letter is actually getting pushed back while others cut in front of the line? Or is this just a case of huge volumes now and everyone getting delayed, even the DACA folks?

I'm going to send the letter cathymac linked above.

The only ones getting pushed are the DACA folks, ad they got pushed to the head of the line back in 2012. You're still feeling the affects of that today. Remember, vote R in 2012

It looks as if we are being pushed to the back of the queue behind the illegal immigrant apps so what price being a law-abiding tax-paying citizen?

60 days for each and every section is  spaghettification of the process......

You've already been pushed there. If you're at the NVC, the new DACA apps will have no affect on you. What we are suffering the backlog accrued thanks to DACA back in 2012.

Called the NVC hotline and the very helpful lady told me that August interviews are out as they just "got" my AOS on 6/30 (even though it arrived a week prior), and it takes 30 working days to get it processed. No idea when IV is available.

If my marriage holds, and I'm now completely unsure where my wife and I are heading, it would seem that September may even be out of reach for the interview.

I hate this process, I really don't want to put a negative light on those people working hard at USCIS and NVC but they don't know their lack of resources is killing my marriage and god knows how many others.

Actually, I think they do. I can't help but think this process is designed to discourage immigration by means of US citizen marriage, which is one of the biggest categories in terms of sheer #'s of visas each year. They either want your marriage to fail or for you to leave the country. Pretty sick and twisted.

No, because I was married. Married is married, whether or not they're in the country. You have to file married filing separately . You need to file an emendation immediately as this can cause problems at the interview.

US Embassy and Consulate DiscussionBeneficiary Passport Marital Status

You send the original certificate to the USCIS? If so, you should have send them a certified copy. When your case gets send to the NVC, the IV packet is where you send the original certificate (they will ask for it). You could tell your wife to go and make a duplicate original marriage certificate and use that. You have to have your name updated on your passport. You will be sending a image of your passport to the NVC, so you don't want the C/O officer confused or neither do you want to give them an excuse.

No I sent them a copy. But the certificate is with me here in the States and not with her over there in India, and I do not want to send it through the mail, since it will just have to be sent back to me when our case gets to the NVC.

US Embassy and Consulate DiscussionBeneficiary Passport Marital Status

So my wife in India is trying to get all of her documents updated way before we get to the embassy interview, since she's been using her old address for like a year now lol. She went to get a new passport with her new address on it. But at the passport Seva Kendr (service center), they told her that they needed her original marriage cert, not the certified copy from the court house, to issue the new passport with her marital status as 'married. So I have question for this forum:.

Will it make any difference at our interview if her passport says single instead of married if all of the other info is correct?

Thanks!

United KingdomAnother extension of i797 question. Last one I promise

So, Mrs Srvman is going to re-write, and get notarized the letter of intent extension.

Would the following suffice? I got this from the visajourney site, but I just wanted to make sure that all this is still relevant and necessary to include, and we are not missing anything.

Many Thanks,

Chris

(Date)

From: (Your name, address, phone, SS number)

To: (Name and address of consulate)

RE: (name and vital data of your fiancé, including I-797 approval notice number, date of birth, address, phone number)

Dear Honorable American Consulate of London:

It is my understanding that pursuant to 9FAM 41.81 N3.1 (Period of validity), the consulate can extend the approval notice, if my fiancé and I remain legally free to marry and continue to plan to marry after my fiancé enters the United States.

Therefore, please be aware:

  • I and my fiancé continue to be legally single and free to marry.
  • I and my fiancé love each other and plan to marry after his/her entrance in to the United States.
  • If my I-797 approval notice has expired by the time of my fiancé?s interview,

I sincerely request that you extend the approval notice (copy attached) so that my fiancé, (name of fiancé) may receive the K-1 visa.

Sincerely,

(Notarized Signature)

United KingdomParts of UK culture you WONT/DONT miss?

First of all, huge congratulations!

I am from Northern Ireland. So things I will not miss....

Morons rioting about flags, bonfires, weekly bomb threats, the Northern Irish accent, the Northern Irish smell, the Northern Irish attitude (they can never be happy for you), chavs, petrol prices, VAT (I am going to live in Montana 0%), Rizzle Kicks being a relevant thing, high tides flooding my town every 5 minutes, 4 quid beer ($1.75 in MT), English coverage of the world cup (we get it, you won it 50 years ago, get over it), the 12th of July (seriously despise that holiday, even though I am protestant), Protestants, Catholics, Boots (the pharmacy, horrific staff where I live), no drive thru banks, and no drive thru pharmacys, and finally the sign on the wall as you enter Belfast City Airport (named after a drunk btw) which reads "Welcome to Belfast, please set your watches back 30 years, to conform with local time"

Apart from that, not too much.

United KingdomHow late have you been to your interview (London-K1)

i dunno... A flight (or bus or train) into London could be subject to delays etc... I'm not sure if I'd risk that, but then I don't know until what time they let people in, i.e. I think you have to be in by a certain time in order to get service that day. Even though I got in at 9am i was one of the last ones to leave at 12.45. I got the impression no further interviews or customer facing services took place past past lunchtime, leaving them the afternoon free to get on with the paperwork of everyone processed that morning. I don't know what the situation would be if you missed the hours during which they normally admit people, whether you're rescheduled as an emergency appt for the next day, or what.

Good information. I will probably end up going the night before. For the sake at 80-90 quid at this stage im not too bothered, but it is nice to have the option.

United KingdomHow late have you been to your interview (London-K1)

my appointment was for 8am and I got there at 7.45am and then realised I'd left my passport at home. Raced home and back again in a taxi (I only lived a few miles away) and rejoined the line at 8.30. Finally got into Embassy at 9am. Interview times are not exact, they are staggered so that people don't just all show up to join the line at the same time.

Yeah, see I reckon I could make it for about 9.30. I am just trying to weigh up if it is worth the 90 quid saved in hotels to just fly in and scoot over to the embassy as quick as possible.

Just a curious question,

Has anyone ever turned up late to their interview in London? If so could you share your experiences?

I am a London virgin, and I am curious to see the level of leniency given to those travelling distances and arriving slightly late.

Yes, I was with my papa. It was my first time in London, and he has been a few times before so he took the day off to help me around.

All they are essentially doing is printing off a sticker, and sticking it in your passport one approved, or am I missing something?. They have the best part of 6 months to do the necessary checks for visa's like the K1, and plentiful time to check other non-immigrant visas.

It is 2014, you would imagine that a technologically advanced nation, could figure out how to print off and stick a visa in a passport while you wait.

I am not complaining, I am just giving reasons as to why I still think it is ridiculous.

I would still call them up, and explain your situation, and ask them to hold your results, until you call them to give them the go ahead. Although the office sounds like a big huge set up from what people post, the actual place is quite a small set up. I lost a sheet they gave me and I emailed them, and they sent it within ten minutes. So even if you want to email them, I wouldn't see the harm.

They need a London case number. Starts with LND2013#######

I would give the knightsbridge people a call, and tell them that you havent got your case number yet, but would it be possible to get the medical now, and for them to hold on to it until you get you LND number.

A five minute phonecall should solve your problem hopefully. They are normally pretty helpful!

Dublin is great. And yes POE is in Dublin. So if, and that is a big IF, you have any issues, you find out in dublin, instead of at the end of a 6 or 7 hour flight.
