"Give US Citizen I-130 & I-129f Petitions Proper Priority

 

The USCIS handles millions of petitions and applications for this country each year--an honorable and needed task. Even the agency's most ardent critics will readily admit that the workers of this agency face a daunting and serious challenge in speedily and fairly adjudicating all of these application while at the same time protecting this country and its laws.

What no one understands is how the agency decides to prioritize the adjudication of this massive workload. That some petitions and applications will have to wait longer than others is a given; that the spouses, children and fiance(e)s of US citizens should have the longest wait times is a proposition more than a bit harder to understand. For the past two years, first thanks to the President's extra-Constitutional Deferred Action for Childhood Arrivals (DACA) program, and then for his also extra-Constitutional Provisional Waiver program, the immediate family members of US citizens have been made to bear the burden of increased USCIS Service Center workloads (all, it might be added, to the benefit of people who broke US immigration law to come here and have been retroactively given psuedo-status by Presidential executive order, without the express permission of the US Congress to do so). The first victims of these programs were I-129f filers for K-1 fiance(e) visas. The wait time for these petitions ballooned from 3-5 months to over a year in 2012, while DACA filers were granted speedy approvals (almost never refusals) in less than 5.

In January of 2013, the wheel turned and I-129f filers began to see 3 month processing windows. To compensate for this, and for the President's new Provisional Waiver program for unlawful immigrants filing from inside the US (not approved by the Congress of the United States of America), filers of I-130 petitions for US spouses and alien children (!) were simply stored and delayed for almost 10 months, until a backlog of over 400,000 of these petitions had accrued. The USCIS is now working to end this backlog, but this tremendous backlog has resulted in wait times in excess of 10 months for an I-130 petition, and this for a visa which must face two more lengthy steps, the National Visa Center step and the US embassy step, in addition to any additional administrative processing which results from a US visa interview, before it can be granted.

Asking the spouses and parents of aliens to wait for something approaching two years (or more, depending on the additional Administrative Processing the embassy in question decides to take) to see their loved ones while unlawful immigrants are quickly and efficiently granted permission to reside here and even legal status is unacceptable and, what's more, unlawful, since the Immigration and Naturalization Act mandates US authorities to give first priority to the immediate family members of US citizens. The USCIS must in the future give priority to the applications for legal entry to this country of the spouses, children and fiance(e)s of US citizens. The USCIS must dictate that each month it will adjudicate a certain percentage of US citizen relative and fiance(e) petitions, as this is the priority which the law demands these petitioners be given.

it shows that the service centers processed teh following I-130:

CSC: 7679

NSC: 6040

TSC: 4002

VSC: 939

 

the backlog for service centers as of November 30 is:

CSC: 14175

NSC: 52885

TSC: 20621

VSC: 14598

 

I'm not really sure why USCIS is transferring petitions to Nebraska when their work load is higher than the other 3 service centers together.

 

This is crazy and shows that USCIS does not have a clear method of what they are doing!!!!

 

Only 939 for VSC!!!!!!!!!!!!!!! That's pathetic!!!!!!!!!!!!!! VSC has as many as the CSC but it's not adjudicating at 1/7 of the rate! That's 14 months for an NOA2! WHAT THE ####

My pd is feb 22 2013.. case was transferred to nbc. Now date is 20 March but no noa2 yet... what to say..I m speech less...

 

You can now call the USCIS and open up as service request. Please do so immediately, the California call center will still be open if you call there.

Ok but in my opinion being two months behind is just stupid realistically ... Cuz they know where they are so just be upfront and honest and put the real dates .. Instead of showing workloads from two months behind ..

 

No it's not, it's incredibly smart as it gives them tons of leeway when dealing with customers. The current date is really what they were processing 2 months ago, so if someone gets "left behind" they have 2 months at least to get to them before they can file a service request. Terrible but very smart on the part of the lazy bastards.

We are in January now so why can't they just be more current and show where they are in the workloads as of now ? Not November ??

 

Their updates are always 2 months behind by design.

Losing faith in the USCIS process day by day... I'm a June filer and thought I should follow the process by applying for I-130, never in million years I will suggest anyone to do that, not to even to my enemies. Not sure what I was thinking when I applied for I-130 instead of a visitor visa and get married here. What a joke this is by the US immigration system. How happy do you really think newly wed couples are when they have spent total of 25 days together within 9 months??? By the way, did I mention this was an arranged marriage, meaning I didn't have the luxury of dating my wife before our wedding. In this case, I met her for the first time 3 days before the wedding, boy am I lucky to have her or what... oh wait, I don't know what's that like since I have barely spent time with her.

May be we should send a harshly worded letter about USCIS number fudging/lies and 130 delays with well supported data to all US District attorneys (93 of them , hopefully at least 1 would take interest to nag USCIS) ,US Government Accountability Office and Whitehouse Office of Management and Budget... Inquires from these offices cannot be taken lightly by USCIS..

My wife wishes to move from her home city of Lucknow to Mumbai, both because she wants more independence and because I have heard/read on here that the Mumbai consulate is easier to get a visa from than the Delhi embassy. We put in our I-130 in November and the way things are going I expect that we will be done with that by April/May, and sending our first NVC documents in July. We have a couple of questions though:

 

1. Is there a length of stay requirement in order to be processed by a certain embassy/consulate?

2. What is the absolute latest she can move before the interview? And what proof will the consulate request of her for proof of address?

3. Will she have to get multiple police certs? If so how soon after moving to Mumbai can she get a police cert? 

4. Will there be any possible negative effects of doing this?

When my wife went to get her PCC, they requested she update the passport in order to say she's married on the PCC. When they got the certified copy from the court, they told her this is not good enough and they need the original! So my wife just applied for the PCC with her original passport, which lists her as single. Her PCC will list her as single. Will this cause problems? Please help.

As said earlier, just send them a letter with the USCIS and NVC case #'s and let them know you want to cancel it. You can also call them up and ask to have your case # cancelled I believe. Think long and hard about doing this because if you do so and then change your mind then you'll have to start all over again at the USCIS and it'll be tough to explain at the interview. IMO I would not do it (and if you look at my history I did contemplate this sad choice at one point) until the ink was dry on the divorce documents.

At this stage, 'intermingling' is not important and most times not possible with the spouses living in different countries. The fact that you have been sending her money (and maybe gifts) is all that you can show to the CO. However, the CO may not even ask to see such evidence.

 

Should I include the transfers or her withdrawal receipts in the IV package? Thank you.
