When I submitted my I-130. despite showing it to my useless lawyer, the foreign consulate field for question 22 was filled with "NA." The address in America was also listed as "NA." What should I do? From what I have read, there is nothing to do but wait. At this point, though, your US spouse can contact her congressman and or senator. She could also start looking into a lawyer for a write of Mandamus (best to wait till about 6 months for that one, I reckon). (agar kuchh meri baat meyn samajh meyn nahiin aayi to mujhe bataaye aur main to dohraauungaa urdu meyn).

My wife is facing some financial troubles in her country and I am not in a place where I can help her too much right now. She is considering moving to somewhere cheaper, but we don't want to screw things up as far as the visa is concerned. Just FYI, I just submitted my I-130 in November and am still awaiting NOA2. My questions are:

 

1. Would the effects of changing address be so disastrous that it should not be changed?

2. What would the process be for updating her address while the I-130 is pending? Will I have to send in a new G-325A?

Immigration is usually considered a life changing event, which would allow the addition of your wife when she arrives. It truly makes no sense to get her health insurance which can't be used in the country she resides in.

I am currently listed as single on my employers insurance. I do not want to put my wife on their, because it's really expensive and especially because she is coming from a high-fraud (read:non-white) country I have no idea when she's going to get here and I don't want to pay thousands of dollars for insurance she is not able to use. On the other hand, I am afraid it will look bad if I do not put her on there. Right now, open enrollment is going on at my place of work. Would it be worth it to put her on my plan?

Filing a mandamus action to compel a decision prior to AP being completed would be a great way to make the embassy deny your case.

 

After filing they have 60 days to respond, and then the entire length of the case to adjudicate. More often than not they adjudicate the case before the 60 days is up. Most of the time it's nothing more than sheer bureaucratic weight and gross incompetence that is holding things up. IMO if they had held my wife's vise for more than 1 and 1/2 hours after the interview (and after the USCIS stage, the NVC stage, etc. etc.) I would be thinking about going to another country anyways. At least Mandamus would give you a timeline and let you know one way or the other, though as I said it usually results in the visa being granted.

What these guys are saying is not true, you can file a suit of mandamus to force them to do their jobs. Be aware, it could result in them denying the visa, which everyone here will warn you about, but more than 90% of the time this forces them to adjudicate it, which if you have no real security concerns forces them to grant the visa.

Green Card: $165

 

AOS and IV will be available during your time at the NVC. The Green Card fee becomes available after your visa is issued and should be paid before arriving in the US. You will also have to pay for the medical, which varies in cost by country.

But the program she is doing will only be 1 month and she'll be staying with me....I have heard that the US Immigration Service will accuse us of using the F-1 as a vehicle for her immigration (even though she is an English student and her childhood dream has always been to study in the US!)

I would definitely go back first, especially if it is a difficult consulate to get through.

On top of that, Boarding Passes without passport stamps are next to useless. They often times do not have the year on them, just the day and month. I've seen more than a handful of RFEs in the last year I've been on the boards for people who supply only their boarding passes and itinerary/receipt, to send in their corresponding passports with stamps. This is primarily due to the fact that the year is not on there. And apparently, to the USCIS, it does not prove that the person made it pass immigrations and into the country. There are some instances where not needing passport stamps are ok, but that tends to be in the cases for couples going by way of Canada or Mexico.

On your next trip, take more pictures. Save your boarding pass. Save the receipt for purchasing the tickets. Make photocopies in color of your passport with the stamp. You could try for the scan that's on file. Does it also have a scan of your biopage? But, when dealing with a difficult consulate, sometimes more trips are better. Good luck!!!


Well, like I said, I have the visa with the stamp? But ONLY the entrance stamp, not the exit stamp. (I lost my passport but got a photocopy of the visa (taken just after my entrance into the country) from the institute where I studied). Should I still go back before filing?

If you wanna try your luck, make sure your package is very well prepared. People with way more evidence still get RFE'ed and, I assume, probably declined in what they consider high-fraud consulates. Best of luck, whatever you decide.

I have to admit that after reading this post it appears that you are a little Ill prepared to file at this point. Especially since the beneficiary will interview at a particularly difficult consulate, however that isn't the problem at this point.

What evidence do you have that you and your fiancé have met IN PERSON in the past two years?

Primary evidence is critical here. What do you have that proves your were with her in her country or she was with you in this country? You may consider making a trip now and gathering a solid amount of primary and secondary evidence. From what I understand getting a K-1 approved in India takes a strong petition. It may seem like additional cost and time now but it may work to your favor in the end.

I don't know how you would prove that you made online credit card purchases from any specific location... I was thinking along the lines of stuff that you paid for with a credit card in local restaurants, shops etc. I did that since I didn't have passport stamps (EU citizens usually don't get them while traveling within the EU - my fiance and I only met in "third countries"- not his nor mine, before we filed.) But I also had boarding passes and lodging receipts so I don't know...


Problem was the program gave us cash so I only used the card to buy tickets online......It raised a red flag at the credit card company, though, because they called me to make sure that my credit card info was not being used to make purchases by someone in India.
