Seems like people are getting a lot of check lists of the I-864. I did mine (no cosponsor, make about 48,000 a year) and it did not seem to complicated to me. What are the common pitfalls? I am also going to send it to my lawyer to check before I mail it in.

Quick question: What is I-864 Package?   :huh2:

 

I'm filling out my timeline and noticed this.  Is this the email "package" I received from NVC asking me to fill out the DS-261 form and pay the AOS fee?   :help:  

 

That's what's called the AOS package in all the literature here. It's the I-864 plus any other proof of income.

Correct. And the foreign spouse does not have to sign the tax return. In the box for SSN you put NRA (non-resident alien). Yeah! I know. It sounds scary.

I did that but they did not count my exemption for her because she did not have an SSN or ITIN. Should I dispute this?

OK, folks.  It's official!!!

 

CASE COMPLETE AS OF JUNE 4!!!

AND, I must have good luck - I never had to speak to either Joy or AH-thur!!!!

 

Jim was the bearer of good news.  He didn't even ask me "What can I help you with this evening?".  He cut right to the chase and told me the case was complete!

 

Then, when I gently pushed, he read me the standard line about interview scheduling and it depended on how busy the consulate was, blah, blah, blah.  But he told me he loved being able to tell people good news!!!!

 

Now....waiting on interview scheduling....

 

For those of you waiting - it does appear that an "N/A" under "Affidavit of Support Fees" is a positive indicator of case complete.  My package explaining that the checklist item they wanted was 1) not required and 2) not available was scanned in on May 9th.

Got my 2nd i-797 in the mail today. It said that the petition was shipped to the NVC, so I am pretty sure that anyone who got approved before 30 May was also shipped out (makes sense to do them all at the end of the month).

 not necessarily, they have been stopping the time to receive more calls earlier than 12. Last time I called at 11:30 and got the message that they are closed. I think the last callers they take are 11:15-11:20, then they take no more.

We used an Attorney for out K1 and AOS. He is fantastic. We knew we didnt need one but we didnt have time to do the application ourselves plus we wanted to reduce our stress and ease our minds. We paid $10000 which is basically for everything until I become a citizen. Our process has been quick, around 80 days from application to visa in hand. (If all goes well at the interview, which it will!) Out att is in LA. For us he was worth the $$$ but thats our situation and choice, I know others will think we are crazy for spending that kind of cash!

 

Please bear in mind if you're applying for your spouse and not fiance(e) there is no way your process is going to be this fast.

An attorney is an absolute waste of money, from everything we've seen with people here they slow you down, most immigration attorneys don't handle many cases like ours. 90% of immigration attorneys are helping illegals and people who came on visas besides family based who want to stay longer or have overstayed. Even if they did have any experience there's nothing anyone can really do to speed things up. From everything we have seen on these forums they seem to slow things down, remember unless you have them on retainer you're not their #1 priority and as stated this type of visa is not their forte. Avoid like the plague.

U.S. Citizenship and Immigration Services (USCIS) has recently posted a notice on its website with important information for individuals granted deferred action for childhood arrivals (DACA) prior to August 15, 2012.  If you were granted DACA by U.S. Immigration and Customs Enforcement prior to August 15, 2012 or are a DACA recipient with an employment authorization document (EAD) that will expire in the next 120 days, you must apply for DACA renewal to avoid any lapse in your employment authorization or accrual of unlawful presence in the United States.

Too bad the petition is written in such a way that 90% of the population won't understand it. Who the hell knew what and I-130 or I-129F were before they got into this nightmare???!!!!! The wording was plagiarized from my letter to the USCIS on the Idea Community thing (Which I wouldn't mind at all, if it had been used in an appropriate context), but that letter was written TO the USCIS ITSELF, so I was free to be wonky, this if for regular people so it needs to be easily understandable. No one knows or cares what and I-129F is, people just need to be told that the government is ripping US citizen families apart while letting illegals stay by the millions. Absolutely no consideration went into that, I would like to post another more easily consumable petition but I am afraid it will take away from this one. I must say whoever did that needs to stop to think things out from another perspective before they do sh!t like this.

DACA's are ALL being done at the VSC, which is where my petition is at. The VSC is still pushing USC's to the back of the line, they did over 10,000 DACA's in November but only 939 I-130's :( As of November there were over 10,000 DACA's in the backlog :(

Thanks, I really appreciate the cheerleaders. I really do !   This is so hard to watch the days go by.  I thought about calling today but it just makes me upset. The person who takes the call is usually an idiot who thinks they are talking to an idiot.   I asked the Sentor's office to inquire again this past Tuesday . I have 2 service requests in and one of them expires on Saturday. I have also been emailing the TSC every morning this week. The same email, just a different day.  I don't know what else to do.    My husband and I talk about how fast the time has gone by since we got married but it seems soooo slow at the same time because we are waiting on these papers to get approved.   I hate to rush time because I'm no spring chicken. You're supposed to be thankful for every day that you get to wake up. I am thankful  but it would be sweeter if I could wake up next to my husband.   Everything is on hold.  Sometimes I think this is some cruel joke.   I couldn't even watch the president the other night. I am so angry that he passed all that ####### that gives priority to illegals.  

 

I have enough miles for a free flight but I was trying to save that for when we have our interview .... I don't know if I can wait that long.  My husbands birthday is coming and so is Valentine's day.  Then our anniversary less than a month later.  I am missing all these things with him.  I just want to cry

 

Get involved. Write letters to the news. Get involved in the other thread we have on activism, chair a committee on something. There's no use sitting in a room without light, cursing the dark when you could get up and light a candle.

Better than the VSC, which only did 919 I-130 in November (while approving over 10,000 I-824's for DACA's!!!!!).

The border (especially once Canada is taken into consideration) is waaaaaaaaaay to long to totally seal off at any reasonable price. Instead more technology should be invested in drones and other monitoring equipment, while ICE and US Border Patrol nees to be given the authority to track and prosecute illegal immigrant traffickers inside of the US, and to deport those being trafficked. Biological verification needs to be mandated for employment in the US, and biological data needs to be taken from every illegal immigrant and every visa fraudster and used to give them life-long, permanent bans on living or working legally in the USA.

Thought about responding ur comment but it's not the first time that u comment about the " illegals". Children who were brought here illegally should have the opportunity to be "legal". How are you waiting like us? My wife cannot come to visit me, even for 1 DAY, she isn't allowed a visa and if she had one she would be turned away at the POE by the customs . I have been with my wife for 3 years and she has never met anyone in my family, not even once. You get to be with your husband, he gets to meet your family, no one puts any limit on what you can do with him. You are in immigration heaven thanks to the fact that your husband and/or his parents BROKE IMMIGRATION LAW and took by hook and crook what legal immigrants like my wife wait YEARS for, permanent residence in this country. You're not waiting like we are, you paid the same bill but you get most of the benefits (benefits others like us would kill for) right away. If your husband was brought here as a minor I sympathize with his position (not with that of his parents who chose to break the law, they should be deported ASAP) but illegals will never get much sympathy around here from people who follow the rules and get punished for it. If he came here as a minor without his own consent I hope one day he does get citizenship, otherwise he should be deported. There's a line, we have laws, don't like it, LEAVE. Unfortunately the demographic situation in this country seems to indicate that the laws aren't going to be followed here anytime soon, but thanks to gerrymandering good luck getting citizenship before 2020. I hope in between now and then whoever came here illegally gets what they deserve: DEPORTATION.

Get your Representative or senior Senator involved ASAP. Mine was able to talk directly to the agent who adjudicated my case ad that helped. I did luck out with my representative's liaison, he's awesome. But yours might be able to help, and having someone looking over their should usually makes the lazy b@sterds do their job in a more timely fashion lol. Anyways, best of luck.

U.S embassy follows N.J court order

 
All's well that ends well even if one had to get the court involved. Capitol News reported back in November that a Federal Judge had ordered the US Embassy here to make a decision in the case of an intended immigrant. The man?s case had been in limbo for nearly two years under what was called Administrative Review. Well the Embassy made a decision in the man?s favor and he was able to spend the holidays with his spouse from whom he had been separated because of his pending visa status for over two years.
 
New Jersey Federal Judge William Martini was asked by a Guyanese woman who sponsored her husband to the United States, to issue a writ of mandamus directing that the US Embassy either issue or refuse her husband a permanent resident visa.
 

The Judge ruled that while it may not be within the court?s jurisdiction to review how a consular officer arrived at a decision, it was certainly within the court?s mandate to instruct the Government officer to make a decision. The case arose from the fact that the husband received a letter from the U.S. Embassy in Guyana stating that he was found temporarily ineligible to receive a visa. That was since June 2011. The letter stated that the case required ?Administrative Review? and that new information, when available, will be communicated to him in writing. The court found that over time there was no evidence of administrative review. After the matter ended up in the court the US embassy called in the husband to continue the process. And earlier last month the US Embassy not to be in violation of the court order made a decision and issued the visa.

Several persons have complained about delays in the immigration process where US embassies in the Caribbean have put them on pause so to speak for administrative review or claimed that there is a refusal on various grounds including failure to provide documentation or allegations of misconduct. The New Jersey Judge?s order is expected to make it clear that decisions have to be made according to the procedures laid down in the law. The Court ruled that intended immigrants simply cannot be told ?your case is still pending? without a final decision being made.

Nothing you can do about AP. File a writ, get denied. Nothing you can do.

 

I think Janelle has pretty effectively demonstrated the things you can do. If they're going to deny the visa then fine, then you can take them to court for discrimination or move to a better country than the US together, but just waiting forever is not reasonable. You have the right to a speedy adjudication, even if "speedy" here is judged to be less than a year.

Waiting for the Embassy to give an answer to my complaint.


If they actually are doing a background check.  Most of the time they are just sitting on people's application. 

 

The woman who filed a writ of mandamus for her husband in Guyana had to wait 4 years.  They sat on it 4 years before she filed her writ.  They had no excuse.  Just didn't want to give her husband the visa.

 


 

When do you expect to hear back from the embassy? My guess is they will issue it before it gets to court.

I filed a writ here in Texas.  My husband's AP is over a year now.  His interview was June 4, 2013.  Sweet, right?

 

I filed 07/14/2014.  Let the good times role.  I even went to the embassy twice this summer to talk to them while I was in Sri Lanka.  The second time they sassed me.  Gotta love those attitudes of people who lives are not affected by their slacking.

What's the next step for your writ?

Already have a lawyer. All my papers were filed through them

 

Call him up and tell him you want to file a writ of mandamus. This is a court order to make the government do their jobs. Call your lawyer, get all the paperwork together, and then once it's all assembled send the DOS an email informing them of what you are doing. Once the one year passes give them a 2 week notice. That should get them moving.
