Hello everyone,

 

I have read a few threads on this, but none seem specific to my issue, or option.

 

I got engaged to my now fiance, on July 2nd 2013. I am here on a f-1 visa, doing a masters which expires in December. 

 

Due to me being from Northern Ireland, and my family wanting to attend, we were hoping to get married about this time next year, so Summer 2014.

 

Here is my question. Can I file for my K1 visa, while still here on my f-1 visa to cut down on the months that we will be apart. I am aware that I will have to go back for interview, medical etc, but I am eager to get the ball rolling, especially after looking around finding out that they have slowed down the processing times considerably.

 

I am able to go on OPT, but I am not confident of getting a degree related job, (Masters in Organizational Management), and I am unsure if when applying for this OPT if I am able to get the extension, as I now knowingly have immigrant intent. I just want to do this the right, and legal way from the start.

 

I know this is a lot of questions from a first time poster, but I would really appreciate any help or advice, as we are both a little bit unsure on where we stand.

So after more discussion, with my out-of-my-league beautiful fiance, we have decided to go down the K1 route, while I am still here.

 

We discussed getting married before Christmas in a bunch of different ways, but we just didn't feel the timing was right, and we don't want to elope. We want both sides there for a meaningful service and reception. Only way this is feasible is next summer. We are aware that OPT is an option, but we are not taking this route, because I want to spend one last Christmas at home in Northern Ireland, and we both feel OPT for me (right now) is a 50-50 shot on whether I can get a job, and we don't want to be stuck in december waiting 9 months to do this thing.

 

Ok, now on to the reason of my post.

 

We are planning on filing probably somewhere around this time next month (middle of August) so we have a few questions.

 

1. After what stage will I NEED to be in the UK? Is it after NOA 2 arrives?

2. Am I able to schedule my appointment, or is my appointment given to me, without flexibility?

3. If I file in August, do you think that leaving for home around the start of December will give me a little bit of time before my K1 interview?

4. After (hopefully) I get my K1 approved, how long do I have before having to reenter the US?

 

Thank you all for your help so far, this is a great time in both our lives, and although this visa stuff is proving to be very stressful, we are both optimistic about being married and having our first golden retriever this time, next year.

 

I am a little lost as always, and I appreciate all suggestions and advice, but we are going on this K1 route, and have decided against, cr1, Aos on Opt, and Aos on my F1 visa (which expires in december)

Hello all,

Well actually, I live in Montana right now, but I am going back home soon, and we are filing for a k1 visa. My understanding is that Northern Ireland Residents have to go to London, which seems stupid to me, because I only live 100 miles from Dublin. 

 

I have had since 2009, an F-1 visa, B-1 visa, and another F-1 visa, on my British Passport. Somewhere in the middle of that I got an Irish Passport, as I have a right for both a british and irish passport.

 

My question is, if i were to apply for this K-1 visa on my Irish Passport, would I be able to schedule my appointments to the Dublin embassy? Or would this create a whole new issue?

And guess what? London doesn't want to see a bit of your relationship at the interview. Really, they won't look at it.

(I still haven't figured out why you are wasting time to go back to the UK to get a visa that allows you to enter the US, marry and adjust status when you already have a visa that allows you to marry and adjust status without ever leaving.)



 

It is a difficult situation. After reading this I actually walked down to the University to have a long talk with the DSO person there. She knows about my intent to get married.

 

She gave me some assurance on the OPT option, and gave me some job ideas too...She said it has its downside, but suggested that I could always go home before Christmas and come back before the end of the year.

 

Was going to mail off everything today, but going to delay it another day, and have a chat with my darling wife-to-be.

Hell-yeah leave out 200 pages of anything! They don't ask In the instructions to prove you talk or in love. The requirements are pretty simple (1-4 in my post) for most people. We have been from K1 petition to US citizen and passport application. And we never sent any submission that exceeded one of those flat, cardboard Priority Mail envelopes. Have you ever thought of the guy working on petitions? " Hmmmm...Do I want to pick up this small and concise one to review, or wade throught the one that was delivered in a box? Maybe next week I'll try to do that one."

 

Haha, this made me chuckle so hard. You are so right! That is an awesome quote and ideology...

do you have flight itneries or boarding passes.. two different things.. board passes are best

 

i also copied our PASSPORTS>. every page.. to also so the stamps that we did visit each other.. 

 

i was petitioner.. 

 

The problem is, I didn't keep any boarding passes, I never thought to save them...I have maybe 2 random bits of boarding passes for connecting flights to places that weren't my final location...and even then I haven't seen them for a while.

skype logs were actually relatively short, since I have been here for the past year and a half, so we didn't have that much to put in a log. I think it was like 5 pages.

 

facebook logs, I copied and pasted from the message area on facebook. It took 10 minutes of holding down copy and scrolling. ended up with over 75,000 words and 280 pages..

we signed the g-325 a form in the box beside the "this form was submitted in connection with an application" area.

 

It is the box below this that we are unsure whether to sign or not as neither of us have an alien registration number. would we just put "none" in that area requesting for the alien number"?

Just about to send off our K-1 stuff, but just want to make sure that we aren't missing anything obvious.

So far we have:

 

  • i-129f form 
  • g-325a x2 (we haven't signed the bottom black box, because unsure if we have to or not, if someone could clear that up for me that would be awesome- I dont have an alien registration number which is why we are unsure if either of us should sign it. I am the foreign citizen, she is usc)
  • The electronic notice form
  • 9x photos over a period of our relationship
  • all the flight itineraries from all trips to America and her trip here. 
  • facebook log from beginning of relationship
  • skype log for past year...we both have new laptops, and couldn't figure out a way to go any further back
  • passport photo of each of us with the g-325a form
  • color copies of my passport visa's and identification page
  • copy of her birth certificate
  • cover letter
  • letter of intent, and ability to marry each other within 90 days of me entering country from both of us
  • statement on how we met, and progressed our relationship

 

Does anyone see anything we are missing?

Many people have to spend time apart on K-1. It is such a pain-in-the-backside visa. 

 

Is there anyway for him to extend his visa without handing in a passport? Might be worth having a discussion with his schools immigration personell.

 

Hope everything works out for you. Just remember, anything worth having, don't come easy... Be patient, any wait you will have will be a relatively short one in your life together.

What? There is nothing illegal. My Fiance has been studying in the UK for over 3 years now. Way before me and him connected again and got into a relationship. Well we really want to start our lives here in the U.S. but God only knows what can happen it's not a guarantee. So his student Visa in the UK is close for it's renewal time also. It was not planned this way, but we had no idea how long exactly this process would take. And we can't just stop our normal lives waiting. So he has been studying in the meantime.  He wants to continue his school there if this Visa does not go like we would like and plan B would be for me the U.S. Citizen to go live there with him. No he is not a UK citizen. He is there with a Student Visa. 

 

So where is he from? I don't see how having a visa to study in the UK would stop you filing for a K-1 visa. Your original post, and this one doesn't really clarify anything, and both are quite confusing, so excuse me if I misunderstood. I am merely trying to get you to break it down a little so we know what you are saying.

 

So answers to questions like the following would be helpful.

 

Who is US citizen? (You)

Where is your fiance from? 

Is he legal to work/study in the US?

If he is legal to work/study in the US, when does this expire?

Are you, the citizen, planning to stay in the US? (If not, I believe you are on the wrong forum, and not many here would be able to help)

When are you planning on getting married?

 

We all want to help, but we got to have some details :)

1. Who is who? Who is the US Citizen, who is the UK Citizen. 

2. The "Plan B" option is illegal from what I understand you are saying. You can not enter a country with the sole purpose to kill some time, get married and adjust your status. It isn't impossible, but it is certainly riskier.

3. You need your passport for the K-1 visa interview and any entry to any country... There is no way around not having a passport at an airport or visa interview. 

4. I don't understand why you are planning to do both at near the same time. Once he is in the country (guessing he is UK citizen) then you have two options. Either file an AOS there.. or apply for K-1 visa. You dont need to be in the UK to file that.

 

You will need to break down your situation a little bit if you want a better response I would imagine.

Do you mean DS-160?  DS-260 is for immigrant visas, and K1s are non-immigrant, therefore they do the DS-160 (see the instructions here: http://london.usemba...gov/iv_15.html)

 

hmm... I did the ds 160. but on the blue form in the packet 3 it said I need to fill in the ds 260 too. Or am I misreading.

I am finally getting around to filling out my ds-260. However, I can't get "logged on" to do it.  I fill in my NVC number (the LND one) and then I put in my Date of birth, as I haven't got my Invoice ID number, or I can't find it in any documents. But it is saying they dont have the two numbers together, as in my invoice ID must be wrong. Should I just call up, or should I have this Invoice ID number already? If so who do I call, I am going through the london embassy if that helps?

That is such a hard story to read, I really feel for you, and I really hope your 2nd journey goes a lot more smoothly, and your fella is on the mend long term. 

 

I would advise you attach a supplemental document, with supporting evidence, more is always better, especially if you have nothing to hide. Nich-Nick, and Wheatley created an extensive K1 document that you may want to check out, as there have been some changes in the process (especially after NOA2) since you would have last replied. Knightsbridge normally need documentation for injuries, illnesses, and conditions which are prevalent to your fella being a public charge on the American health system. If he is fine, I wouldn't bring it up and make a huge issue about it, but be sure to have documentation handy, as I believe there are questions regarding recent hospitalization, which is always a good thing to have extra documentation for. 

 

I am really wishing you a rapid journey. You gotta look at it as, if you can survive this in your relationship, you are already there, you have beaten the statistics, true love triumphed. Stay patient as hard as it is, and the bestest of luck, sincerely.

Say you marry on November 1st, and send your papers off by November 2nd. You send of your Advanced Parole along with the application. From what I am seeing, most people get their AP along with their EAD in around 70 days after filing. You can't apply for it in advance. The visa is valid for a year from the time of the medical. If he gets it in November, a much more simple option would be to wait until January 2nd to come over. Would save a lot of time and a lot of money.

Hi there everybody,

I m still kinda new here and having a hard time to understand it right so first of all my name is nadja, I m form Germany. I recently got married while I was visiting my boyfriend in the US. He surprised with the engagement ring and a couple weeks later we got married his name is Derek and he is in the Air Force and stationed in the US right now. So we found out that my husband has to file for an I-130 so we can be together. I read so much about it and did research and everything but still have a couple questions.

Like

1. do I have to change my german passport, ID from my maiden name before we file for the I-130?

2. can I file with my married name even if all my documents are in my maiden name?

 

We planed to change my last name after I get the visa is this possible?

He got the NOA1 a while ago, our friend sold the house we suppose to live there after the visa is done but now i m kinda worried cause we filed with that old address and all I could find was a form change of address when I move but nothing when he moves so I hope you guys can help me out?!

Glad you got something back! Sorry it's an RFE :( Try calling the disinformation line and be specific in wanting to talk to an supervisor. They can tell you what it was.
