Hi, my marriage was annulled. I changed my surname to my maiden name however, my children retained their surnames. With a copy of the court order , finality, annotated marriage contract and letter request/ or the forms for change of name, i applied with the different government agencies like the PRC,GSIS,HDMF, Philhealth, my employer and all other institutions i have business with, for a change of name. The PRC issued the new license after 3 months,the HDMF made the changes right there and then, all other agencies effected the change in a matter of month. The NBI clearance and passport were also issued in my new name. I even secured a SOLO PARENT ID from the DSWD to show proof of my relationship with my children who has different surname from mine(of course, thats aside from their birth certificates).

Nothing,the only difference is that,they will have different last names star_smile.gif .I also had my 1st marriage got null and void,I went to DFA to have my last name on my passport be changed from married to single again. My son and I had different last names,it never had any effect during the K1/k2 process,neither at our point of entry.

hello, i am processing my case too, and after this, my name will be change again in my single name and my son bcoz my case is null and void too... sooo happend that the father's name registered in my son's bc is the wrong name too of his father, so my son will be in my maiden's name too.... star_smile.gif

Hi everyone! has anyone heard of two records of birth of same person?

In 2002, i requested for my birth certificate from the NSO and find out that i have no record. I have a copy of the form IA which was issued by the civil registrar where i was born. I was instructed to request the local civil registrar to forward the record of birth to NSO which i did. After several months, i received a copy of my birth certificate in NSO security paper. From that time on, i have requested copies of the birth certificate and there had not been any problem at all.

Last August 2009, i requested for 3 copies of my birth certificate from NSO. I was shocked when i received the birth certificates coz the entries were hardly readable at all. My first birth certificate issued by NSO in 2002 was typewritten and it was an exact copy of the form IA, however this one is an exact copy of the birth certificate which was handwritten and cant even read the first name. Family name is even mispelled, however, the entry as to birth date and birthplace and names of parents were the same.and my mom was the informant in the birth certificate however, her name is mispelled. The next day i came back with the photocopies of the birth certificates i had requested from NSO in 2002 and 2004. I asked for a remedy to be able to get the correct birth certificate. i was told that i should request the local civil registar where i was registered/born for a consolidation of records. My birth place is in luzon while at present am in mindanao.

I made another trip to NSO to check again and request that they open my file coz there might be some errors. I was told that the latest birth certificate which was not legible will prevail because its the exact copy of original birth cert form while the one issued by NSO in 2002 was just an exact copy of the form IA. I was told i cannot request for a consolidation either. So i was given two exactly conflicting remedies.dont know what to do. I was really disappointed coz if this is the case , then i need to apply for a correction of entry coz the family name was mispelled. I requested that they open again my files and check coz there is a chance that the 2 records does not refer to one and the same person. But they didnt grant my request. Another trip and was denied my request.

For the 6th trip to NSO, I asked them to open the files and check it coz i will not give up till they do what i am requesting.The latest record that they gave to me the birthdate was same as mine(1968) however, it was registered only in 1970 while the first that NSO gave to me the birth was registered in 1968 which was my birthyear. I carefully studied the two birth records and pointed the flaws. told then if it was really my mom who signed that birth certificate then she should know the correct spelling of her name and her birth place( i have a marriage contract and other records of my mom).I made a careful explanations of my predicament. At last they did as i requested. they opened the files and saw that there was indeed two records however, since the first record was registered in 1968 then it prevails.presto they printed the 1968 record of birth.

It was a relief that i finally got the correct copies of my birth certificate. By the way, my mom told me that it was my dad who signed my birth certificate as informant and not her so that second record of birth does not refer to me.Wheewww!!! I dont know how it happened.

Im just wondering if she was able to secure a new school ID (year 2009) which was issued by the school then it means that she has records with the school and thus, she can request for a school transcript or form 137 from her school. Then why not request for a school records/form 137/ school transcript and present it to DFA. Another thing, if she graduated from highschool , even if she didnt buy a yearbook,but maybe the school has a copy of it or maybe her classmates bought one. Am sure coming from small place,where almost everyone knows everybody then she can get a copy or borrow yearbook from her classmates

When i secured passports of my children, there was one lady who was asked if she graduated from highschool and she answered yes. Then the DFA staff asked her to bring a copy of the yearbook. I was thinking "are they out of their minds, why would they ask for a yearbook. and when i read your post, i said " never thought a yearbook is now a means of identification.

I know how frustrating it is at this time.

She doesn't have an old school transcript (or school form 137), and she never bought a school yearbook! So how can she obtain an "old" form of ID if she doesn't have any?

I dont think SLEC will require you to present the report made by your psychologist. That is not necessary.You can always refuse to present it unless it is with your consent and with the consent of your psychologist. Should they force you,then a court order is a requisite.Besides, had they plan to use that report then they will not require you to see their psychologist. They will conduct their own independent evaluation and assessment. Just be prepared for some questions which they may raise during the process.

Who would have thought that after the annulment ordeal that one has to go through, then SLEC will somehow give the beneficiary another nightmare. My annulment process took 5 years and all the emotions and anxieties attached to it make it a dreadful experience.

Im looking for a legal article abt psychological incapacity(i read it before) that i know will make you feel better and confident but cant find it.should i find it,promise will post it for you.

My previous marriage was annulled on the ground of psychological incapacity and my ex husband was declared psychologically incapacitated. I havent undergone yet the medical exams and interview.

I believe there was nothing wrong nor was it you fault that you told them the truth. Guess it is part of the assessment of the beneficiary's health status not only physically but also to determine one's psychological and mental health.

Being psychologically incapacitated as ground for annulment under the Civil Code of the Philippines does not mean one is insane. we both know that.

I have undergone the psychiatric evaluation which lasted for several sessions and took the psychological exams for one whole day as part of the evaluation conducted by the psychiatrist and psychologist for them to render an expert opinion on my psychological capacity and that of my ex husband. It was really tough and heartbreaking .

I know it will be another ordeal for you since you will go through this psychiatric and psychological evalation again. Just keep the faith and go take the psychological evaluation that SLEC requires.

Will be praying for you. Remember this "Even the falling of leaves has its own reason".

Hope your mom gets her visa soon. seems it take a long time before visa is issued once the consul requires another document. It would have been of great help if it was clearly indicated in the requirements that those with corrections/ previous name get the NBI certificate with alias.

If done correctly it should be #2. In our case the Consular Officer wrote out that she wanted to see it as #1! probably because she was confused. I think if the original one we handed in had an AKA as #2 she would not have rejected it. Either way - I suspect the Embassy will accept it. It is a game - korek ka dyan - the NBI does not pick up the name on the background check - so that value of the listing is meaningless.

Hi guys, has anyone of you here ever secure an NBI Certificate after a change of name due to an annulment of marriage?

Here is my experience. My previous marriage was annulled and immediately thereafter, i filed for change of my surname from the surname of my ex husband to my maiden name. The different government agencies as well as my records of employment effected the change and i was issued the new IDs.

I went to the NBI office and ask how will i apply for an NBI Certificate with my new status.I was advised by the staff of the NBI to pay 2 applications, one using my maiden name and one using my ex husband's surname. Since it was already 11am and it was the cut off time, so was advised to come back at 1pm. Upon my return i went to the cashier and informed her that im requesting for 2 NBI certificates, one for my maiden name and one using my ex husband's surname. The cashier told me that i just have to apply for one NBI certificate and the form has a column for me to fill out my husband's name. I asked her " In that case, then the NBI Certificate will show my name using the ex husband's surname, which should not be the case. I want an NBI certificate with my maiden name in it, however, before i was using my ex husband's surname." She said i apply and pay only for one.

I was confused with what i heard, and so i filled out the forms and then used my maiden name. Of course, i was able to secure an NBI in my maiden name.

Days later, i read the blog of MikeinWyoming about his fiancee's NBI Certificate and all the intricacies and bureaucracies of securing it. Thanks to him, I learned that my NBI certificate has to bear my previous married name as A.K.A.

I went back to NBI and wrote on the column for alias/previous name, my complete previous name. To my surprise, when i claimed my NBI certificate, it does not show any alias or my previous name. So i talked to NBI staff again and he said "You didnt tell us that you want your alias to appear."

I told him " I filled out the column for alias/previous name"

He said " we just picked up the data on the first name and surname"

I replied " In that case, my filling out the column for alias/previous name is useless at all if you have not check it."

He answered "No, its not useless, we will change your certificate". And i was advised to come back after 10 days.Good thing i was no longer required to pay for the new certificate.

Today, i went to NBI and finally have my NBI certificate in my maiden name with an A.K.A /alias.

After my experience with the NSO and now with the NBI, i just wanted to make sure that the NBI has provided me with the correct one which i will present to the embassy soon. May i know for those who had an annulment and secured an NBI certificate, how does the a.k.a appear ? please refer to the choices:

You said he was confined due to overdose of medicine. Do you know whats his illness and what medication/s is/are he taking and why was there an overdose? If so, do some research on the net abt it. It will give you more or less an idea of what to expect or the information will somehow lessen your worries.

At this point, being apart and not hearing a word from him will trigger your anxiety level to shoot up.Be careful on that. I have my fiance's neighbors number and office number so i think maybe you have theirs too, then call them. And as what other suggested, if you know the hospital then call the hospital.

By the way i was advised by the staff in the NSO that everytime i request for a birth certificate, i attach a photocopy of the correct birth certificate in NSO paper so they can retrieve it from file and print it. Hope this helps

To lessen her anxiety, just let her bring with her the medical records, in case it will be asked. She just have to request a clinical summary of her previous confinement at St Luke's hospital. Normally hospitals issues that for a minimal fee and will take about a week or less from the date of request.

I understand her feelings coz I myself requested for a clinical summary of my latest confinement.

I understand that the US embassy requires your birth certificate to be issued by the NSO and printed in NSO security paper. so i dont think a photocopy will suffice.

It happened to me before, but i persisted that the NSO print the other one and after 6 trips they granted my request.

we also got an approval last Nov 23,2009. My fiance will be coming here next month to spend christmas with us for the third time. We will be leaving for the States on Feb 2010. This is because i have to much to do before leaving my work. As a government auditor , am required to make some year end reports and secure clearances and authority to travel abroad before the immigration office will allow me to leave the country

This is the threatening and alarming scene in Mindanao. For a number of times, I saw that place as we always passed by every time we go to Cotabato City. Its a basically poor one, where most of the houses are made of poor and cheap materials, bamboo and coconut wood and leaves, yet the only structures that stood noticeable amidst the poor community are the beautiful mansions of the elected government officials. Even the provincial capitol building is nothing compared to those mansions. and take note, I heard that the government was even renting the one of the mansions and used as government office while the capitol building was under construction.

Lets hope and pray that Justice be given to the victims. Or it might be one of those cases which will be classified as unsolved ones.There were rumors that during the heat of "hello Garci controversy", Garci was housed in one of those mansions. who knows!!! and add that to the fact that during the last national elections, the Administration got all the votes while the opposition got ZERO!!

Mindanao is beautiful but our government officials who are working in cahoots with some ill willed groups will turn this island into another Afghanistan. what a pity!!

The cost and time frame varies as to the manner as to how will the process be done. It can be done in a legal and regular process and surely will take time coz the cooling off period from the time of the filing and before the time the fiscal will investigate to determine if collusion exist is 6 months. then all other processes will surely take time, not to mention the possible postponements due to the conventions, meetings and seminars that the judges and fiscals and lawyers will attend, add that to the holidays and leave of absences of those in the agency.

The annulment process is a long and tedious one. My close friend's annulment took just a month but it was filed in cotabato city and she paid P120,000.There was no court appearances done at all. she just paid and 3 weeks later she got the finality. They made the documents and it appeared that she filed the petition year ago. It was incredibly unvelievable but i saw the court order and its finality.

what a bizarro world..tell you , my petition for declaration of nullity of my previous marriage was filed in jan 2004 and was granted in 2009. I went through all the emotional turmoil in appearing in court before the witness stand, facing the fiscal and the public attorney. Likewise, I hired a psychiatrist and a psychologist and took all battery of tests to prove that im psychologically capacitated. Take note, my ex husband didnt object nor participated at all during the process which was to my advantage. Despite this, its the bureaucracy and all the postponements that i faced that caused so much delay. Finally after 5 years i got the court order and its finality. The cost involved was even more than what my friend paid for the expedited process. I availed loan twice just to pay for my annulment since it was my personal battle and didn't ask my fiance to pay for it. Am just blessed that my fiance love me so much and waited for almost 7 years since we met and until my visa was finally approved last Nov 23.

So the options are ..either she will take the long process and suffer through it but fully appreciate the importanced of her freedom OR just go through the expedited process and just pay!!
