What do I do with question 15c? It asks, "Did your visa limit the length of your stay or employment in a foreign country?" It then gives a yes or no checkbox. Réjean is a Canadian citizen, so this does not apply. What do I do, check no? Or not check anything? Or not check anything plus write N/A off to the side?

So on Line 16, we can put down 1/1/06 - 12/31/06 (or 8/31/07)?

Ok, I think I may have figured out the 330-day thing... according to Publication 54, "your 12-month period must be made up of consecutive months. Any 12-month period can be used if the 330 days in a foreign country fall within that period", so we could use August 31st, 2006 to August 31st, 2007. But that means I'll need to know exactly how much Réjean made based off his paychecks, and I don't think he kept a copy of his pay stubs. *rips hair out*

I got mine from the Federal Reserve website. It was the average exchange rate for the year rather than the one on 12/31.

I don't think it really matters. Réjean's income was so far away from the $85,700 that no matter what exchange rate was used, he'd still have it all excluded.

Eeeek. It depends on how much his income was. For example, like I posted earlier, my husband's income was $15,674.21 CDN, which translated out to $16,824.70 USD using the exchange rate of $1.0734 USD for every $1 CDN that was found here.

I wouldn't think it would matter, though. As long as he made a fair amount under $85,700, it shouldn't matter. The way I see it, even with the exchange rate, it would still all be excluded.

I should just go buy that, then. As long as it'll let me print out the forms so I can mail them in, then this will save a few more of my hairs from going grey. I've been trying to do this manually by following the 2555 and 1040 instructions, and no wonder people b!tch about taxes! I always used to think it was fun doing it with TurboTax but didn't think it was an option this year.

Yup - all amounts should be reported in USD. I used the Department of Commerce rate for dec. 31st; which was 0.9990

1040 married filing jointly
2555 foreign income exclusion (or whatever the name).

I am so overwhelmed by filing taxes this year. I've been doing them online via TurboTax every year without any issues, but I can't seem to be able to do that this year because of my husband's foreign income. He worked from January 1st, 2007, to August 24th, 2007 in Canada, earned a gross income of $15,674.21, then moved to the USA on August 31st, 2007. He received no EI, had no RRSPs, and did not work in the USA. We have no children/dependents.

This is what I have figured out so far (please correct me if I'm wrong):

- His income goes on line 7.
- We can enclose a letter declaring Réjean a resident for tax filing purposes even though he did not have his green card in 2007.

These are the questions I have:

- It's Form 2555 that we file to make sure Réjean's Canadian income is not double-taxed, right? How about the 2555-EZ? What about Form 1116?

- Do I send in Réjean's T4 and the "Revenus d'emploi et revenus divers" thing from Revenu Québec in with the return?

- I read that I have to convert Réjean's foreign income into US dollars before putting it on the tax return. Is it done with today's exchange rate or the exchange rate as of August 24th, 2007, or December 31st, 2007?

- Does any of the TurboTax (or TaxAct, etc.) software allow us to fill out the tax forms electronically, including the form used to get the tax credit, so I don't have to do it via pencil and paper? I know I can't file electronically because of needing to send in the statement declaring Réjean a resident for tax purposes with the return, but just having the computer fill out the form for me like I'm used to will help take some of the stress off. I want to do the return myself if at all possible... I don't know if I trust H&R Block, but if I have to have them do it, I'll let them.

Thanks for your help. I'm sorry if this is repetitous; I have read a ton of other threads on here ("Filing 2007 taxes in the US", "Filing 2006 Canadian Income Taxes", "Taxes, Help!!!", "Tax Information", plus IRS's Publication 519), but it's not making things any clearer for me.

Wow, if he planned to leave sooner I could have given him a ride in exchange for filling a tank of gas for me. I dont have any luggage space though but I could have dropped him off at Council Bluffs IA, which would have been a shorter greyhound trip for him to Kansas city.


Oh man, that would have been SO awesome, but he has stuff he wants to bring with him, plus he wanted to put in his two-week notice in at work... and speaking of his work...

Réjean called me tonight and said his boss is actually going to pay for a plane ticket for him to fly here!!!!!!!!!!!!!!!!!!!!!! *still in shock*

Yup... received mine y'day too, Visa was stamped Aug 10 Friday. The Big envelope is not to be opened and given to the CBP officer at preflight immigration at the airport or the CBP officer at the land border crossing.

I had stated in my inquiry I saw where people with similar timelines to me were getting interview dates and I was wondering whether I would been scheduled for an appointment soon also

I'm sorry if this is a stupid question, but how exactly do we get our congresspeople involved? Does anyone have a generic letter they can share?

The thought of my fiancé not having his interview until anywhere from August to October makes me sick. At that point, it would have been over a year since we started all this. This stress from this whole ordeal post-NVC has contributed to my health problems and played a role in me losing my job. And what about the I-134 and the supporting documents? How long are those good for? If I have to redo all of those, I am screwed. If they ask him what job I do, he'll probably be denied the visa when he tells them I'm unemployed, if I still am at that time, which is a possibility because of my health problems flaring up so badly.

On April 16 I posted :

Some update:

Packet 3 sent on December 8, case status = Completed as per Montreal, entered to their system, waiting for an appoitment to be scheduled.
Called today to MTL to find out if appoitment was scheduled.
As of today not scheduled yet, estimated time to be is June, July - got an answer over the phone,
she ( lady on the phone) mentioned that it takes 4- 6 month now as they have long list of applicants, previosly, when called on January 28 was told that it may take 4- 12 weeks from January

As it passed (12 weeks), I thought I may have date in the system... not yet

New update from LadyK1:
On April 23 got an appoitment letter with an interview date for May 30 .

It seems that MTL is scheduling December for May...

Posted this to let know to others how things are going as myself was looking others timeframes.


So, based on this, my fiancé isn't going to get his interview until sometime in August. And I say, yet again, MONTREAL HAS HAD OUR FILE SINCE NOVEMBER. My fiancé never even got Packet 3 in the mail; he actually had to pick it up!!!
