K-1 Fiance(e) Visa Case Filing and Progress ReportsNovember 2013 filers?

We got our NOA1 on Nov 22nd? and got our NOA2 last night.. it said on Jan 9, 2014 they sent our letter out saying APPROVED!! (I had the email status report thing set up, I haven't received my letter yet.)

This is quite fast compared to the timeline I got when I called the USCIS to change my address and ask about our status while I was talking to the officer.. He told me averaging 5 months right now.

My fiancee told me this morning (she hadn't seen my emails or apparently noticed my frantic Skype messages trying to get ahold of her from the night before.. right after we had logged off..) that her friend got her "P2" today and we submitted the same day.  So I told her Oh.. did you check your email this morning yet baby?  I sent you a picture, I think you'll like it.  It was a screen shot of the USCIS page with the last circle lit up in blue!  LOL.. She did indeed like her picture!

K-1 Fiance(e) Visa Process & ProceduresK-1 big problem
Im sorry, but I just dont find he "i didnt know it was a fiancee visa until I got to the interview" story to be realistic. My Chinese fiancee's English is not as good as your boy 's, but she still had to not only write and sign a letter of intent to marry me within 90 days of entry, but she also had to write up a statement telling how we met and how our relationship progressed through to falling in love and getting engaged. Se had to sign these and snail mail them back so I could send them in with her original signatures.

She's proving she is single by getting documantation of this status too..

A lot of us here who are sufferring through long separations from our loved one and the "indignity" of jumping through so many hoops to prove we are legitamate couples (because so many others have tried to game the system can certainly be excused for finding ourselves feeling a bit offended by this hard to swallow tail.

Its of courese wholly possible that this time its the real deal. But I do hope as the US citizen, you are being cautious here and know what your getting into. If I were the consulate officer, Id find it hard to believe the story. Its like admission to prior purgery, or trying to claim complete ignorance to get out of having to admit it. Either way you will have a tough road ahead of you so I hope for your sake that you have some great documentation...

If I end up denied or waiting through long RFE's to be able be with my fiancee, or my mother, who has very bad metasticized lung cancer cant be at our wedding due to the delays, its these kinds of stories that are going to make it that much harder for me to stay calm and not flip out.

K-1 Fiance(e) Visa Process & Proceduresmarriage between first cousins

All of the anti cousin stuff comes from the worry that you will compound genetic conditions that can lead to problems with offspring but really that wouldn't happen unless it was going on for generations..

LOL, I have some very cute cousins.. but then Im adopted..

I believe since it is an issue in some states but not others, that it must not be a federal law.. and therefore has NOTHING to do with your visa for entry.  I wouldn't bring it up, but do know that there are about 10 states where its legal to marry first cousins.  Colorado, New Mexico, Hawaii, Alaska, California.. and a slew of states in the deep south where they have a saying,"Nothin says luvin like marryin yer cousin!"  I've also heard,"If you can't keep it in your jeans then keep in your genes!"

My lawyer suggested I have a wedding officiant hired via deposit and we drew up a "fake" or hypothetical wedding announcement naming the time and location etc of our intended wedding.  I know, kind of stupid since we have no idea when she's allowed into the country, but doing both of these things in a California location will probably suffice for evidence of your intention to marry in CA.  You can just look up Wedding officiants California (City of your choice) and get in touch, explain your situation and make a small deposit to get a receipt and the plan for the ceremony naming the hypothetical location etc..  For the Wedding announcement, I just bought a pretty generic card from a stationary shop, then in a computer art program with a nice script font wrote my own inside and glued it in.  Voila? California wedding plans, hired officiant and location etc.. at least as close as you can get for evidence of future plans in CA.. I think I just put down $25 for the deposit.

Additional advice, even if you will marry in a state where it is legal and OK.. and mind you I don't have any issue with it at all, (if you are happy and your family supports you guys then you are luckier than most people walking around this earth) is to of course not act like its a bad secret or anything but really, knowing a lot of the judgmental people I run into in conservative states like TX or where I live in Western Michigan.. just don't bring it up unless you have to.  If others hear your maiden name and ask you about it, you can laugh and admit it with a joke like the cousin luvin thing.. and they probably won't believe you and will think you are joking with them.. even though you never lied..

Good luck with your application.  Mine's moving along a bit ahead of schedule but Im still going crazy waiting.

K-1 Fiance(e) Visa Process & ProceduresIs China considered a "High risk" country?

Just do it.

I didn't know my fiancee that long when we started the process.

6 months later we speak every single morning and night on Skype.  She just got her packet from the Guangzhou consulate and we made a small change and are waiting for a reply from them but then she will schedule her interview.

She's shopping wedding dresses now..

We really haven't had a single problem..though as i said our interview has not actually occurred yet.

What we have done is used the 6 months time to make sure we keep showing all this ongoing contact. We speak on Skype like I said and mostly w video that is no-varifieable so we make sure to send emails relatively often too even though they are kind of BS since we talk about everything face to face.  Still they are a constant back and forth. printable form of evidence.  We also send each other cards with silly little love notes so we have these.  She goes on QQ duly and there is a great group on there for women (and a few gay guys) to advise each other on the process and we have learned a lot of valuable info.  I really didn't need to waste all the money i dropped on a lawyer for this.  Her QQ friends have been for more helpful overall and occasionally provide us with some comical drama that both gives us a lugh and also makes us feel better when we are stressing because seriously? If these some of these people are getting accepted we hardly need to worry!!  Just use the time in process to continue to generate maximum evidence.  You don't really need to worry about how much evidence or time you have NOW.. Its how much you have BEFORE YOUR INTERVIEW that counts.

As for Chinese girls and how much time is enough? When you know its right.. you know..  I knew,.  I had other Chinese girl friends before and I lost the one I should have married after losing my job and losing my ability to go back and forth to China several years ago.  Now I have met another girl who I clicked with in this amazing way and Im head over heels for her and I wasn't going to let her get away. LOL.. Im lucky to even have a second chance to have what i thought was lost and I didn't want to wait another year before even starting a potential year long process to have a life here, together.  So I feel ya man.  There are some manipulative materialistic beeyatches in China.  you have to watch yourself, but there are some amazing, good hearted, beautiful girls there too and they will treat you so well and fall so hard for the guy who treats them right.

Good luck and don't let the long process scare you.. Just do lots of Skype.. keep sending each other verifiable "evidence of relationship" and in the end it will all be worth it.

K-1 Fiance(e) Visa Process & ProceduresSkype Chat Logs as Evidence

I just highlighted n copy pasted from skype to word..

Then em we also take screen shots showing us both on cam... On my ipod you press the power button (upper right top) and the "reset" round button at bottom under screen, simultaneously and it puts the screen shot in your photos w date taken meta data.  I then put them in photoshop so I could put three to a page with dates under them and an explanation of where they and the dates came from.  I have almost one a day for the last 6 months since I learned to do that.

so we have daily text style chat logs with date/times and a daily screen shot showing us both in the video.  Lol it's actually really sweet to look at because you can really see the natural smiles and all the expression and love on our faces in those pics that just some text could never express.. Plus there's pictures of me playing games on screen with her 3 year old son grinning at me and pointing or waving etc.. And her mom leaning into some.

Its ridiculous to to assume people would hv phone records these days when things like skype are not only far superior as they are hs video and face to face AND free... Even the random short calls we do have are quick calls via phone card w restricted or otherwise numbers.. Actual calls from USA to China are serious budget busters and who can afford that with all the fees and expenses plus travel they kill us with trying to get through all this.

good luck!!

if you need more explanation or wanted to see examples email me..

K-1 Fiance(e) Visa Case Filing and Progress ReportsNOA2!!

Hello Everyone!

We sent our package on September 14th, we received NOA1 September 19th and got a notice that our alien registration number was changed on September 28th. We just found out we received NOA2 October 8th! We saw some questions about what the change of alien registration number means, and now we're sure it means NOA2 is just around the corner. A few questions we have now!

We are hoping for an interview date in March since we need some tax papers for me and to collect money for the payments. Is it possible to switch interview date easily to the next month if we are assigned an interview too early? (this is all a bit earlier than we expected but we are SO BLESSED)

What is a round-about time frame we might be expecting to hear from the consulate that everything is ok to set up interview?

Thank You for all your help through this, we couldn't have done this without this website and all the great posts from everyone!

Gus and Crys :)

K-1 Fiance(e) Visa Case Filing and Progress ReportsISSUED!

Thank You everyone! It has been a great Journey so far.

Jeff,

My fiancé wanted to spend the least days in Rio since he had to pay for hotel and such...he lives in Fortaleza. He flew to Rio on the Sunday before the interview. We could only set up the medical exam on the Tuesday before the interview. His interview was on the Thursday. You can do everything in one day, if you want to cut down on costs...(even advice given by the doctor) It took 2 weeks+1 day to have our update to ISSUED. He knew at the time of interview that we were APPROVED, pending the results of the medical exam, so we knew that's all we had to wait for. Hope this helps :) anymore questions just ask.

Good luck to everyone else still in the process of waiting.

K-1 Fiance(e) Visa Case Filing and Progress ReportsI-129F, approved!

Hi all,

Our petition has been approved recently now we are waiting for our case to be transfer to NVC, I would like a please a request or an advice on this forum which is mention below:

My Fiancé, she is a self employed and she in the Real Estate business and in the year of 2013 due to the severe surgery she was not able to keep up with her cash flow during the period as she was completely bed rest. Now we are wondering that if she will file the Tax Return ( 1040 ) that will might be below the Poverty Guide Line set by HHS that is 125 %, we are kind of stuck  here and we can?t introduce any co ? sponsor in our case  to certified our affidavit of support. Whereas as per her last year tax return 2012 we have no issue with the HSS guideline.

Hence we are kind of looking for advice or suggestion on that, is there any other proof we can submit to support her stability of the income keeping her nature of employment in mind or should we can go with extension of time to file U.S. Individual Income Tax Return ( Form 4868) ??

Please help.

Please don't hijack someone else's thread. Make your own, it takes away from the OP question.

K-1 Fiance(e) Visa Process & ProceduresName confusion
Hi everyone.

We are new to this site and this process and we have been confused about My Brazilian Fiancees' name. It seems he has 2 GIVEN NAMES and 2 FAMILY NAMES(surnames). as in

given name: NAME1 NAME2

Surname: LAST1 LAST2

on the forms we have put his first name as NAME1 NAME2 and his family name or last name as LAST1 LAST2, we have left middle name blank on the forms but are worried if we leave it blank they may think we didn't look closely enough and forgot to fill it out. The way we are looking at it, he doesnt have a middle name, because he goes buy NAME2, and his LAST1 is his mothers last name, NAME2 being his fathers last name. Any help would be greatly appreciated! Thank you so much!

K-1 Fiance(e) Visa Process & ProceduresG 325a Question about address and employment
Hello again, please help us :)

on the G325a My fiancee lives in Brazil and on the question where it asks to put the applicants last address outside the United States for more than 1 year, should we put HIS address where he has lived all his life since it is in fact outside of the United States? His address also doesn't fit, so we need to do an attachment sheet, and he presently lives there, but we cant put 'present' into the 'to and from' boxes. Will they think he moved if we put '01/2013' in the 'to: Month and Year'?

ALSO! I have had quite a few jobs in the past 5 years, in one job I have worked at was the same company, but different locations, First location was for 3 1/2 years and the second was for 6 months. Should I put the different addresses in the employment history?

Thank You!!!

K-1 Fiance(e) Visa Process & ProceduresPoverty lines Question

2012 is your past income. Provide your current annual income gross total(your weekly salary times 52) and use letter from employer and most recent pay stub(s) to prove that amount. This applies for the K-1 I-134 and the AOS I-864.

K-1 Fiance(e) Visa Process & ProceduresPoverty lines Question
I went a month unemployed and a few months working for minimum wage in 2012. We are at the 100% line but 2k under 125% for 2012. I am now working 2 jobs and well over the 125% since the past 6 months but that does not show on my 2012 tax return. Will pay stubs or any type of letter prove I am making above the poverty line by the time we AOS if it is before the time 2013 tax comes around? Thank You!

I made 20k in 2011 which would have been considered 125% of poverty line, but only 17k in 2012, what amount and year will they take into account?

Any other tips or help about the poverty lines would be greatly appreciated.

K-1 Fiance(e) Visa Process & Proceduresevidence older than 2 years, plus meeting within past 2 years

hello.

My fiance and I last met in person August-October 2012, but we are wondering if we should also include evidence we've met in 2011.  Our first meeting was in March-April 2011. I realize that trip would be overdue as we are sending our application in august 2013; so it will be over due by roughly 3 months. We are wondering if we should still include the 2011 evidence as a context to our relationship. We also have it stated in our question 18 that we met in 2011 first then in 2012, is this ok? Will they just look at the 2011 right away and turn our application down or is it ok to include that in question 18.  And do you think we can include one photo of us in 2011 and 8 of us in 2012.

thanks for your help!

K-1 Fiance(e) Visa Process & ProceduresI134 and DS130 QUESTION! UPCOMING INTERVIEW

Hello Everyone,

Reading the i134 instructions literally and thoroughly it says to include duplicate income and evidence, as appropriate.....We will put 0 in for assets or savings since nothing amounts to acceptable assets. I was wondering if anybody used a bank letter to support proof of current income rather than assets. I do not have a significant amount of money in the bank that would add up to any amount of acceptable assets, but I wanted to get a bank letter that states how much I've deposited from paychecks in my account for the past year. Would that be useful at the interview if the bank letter doesn't show where the deposits came from?

ALSO

ON the DS130 it asks for trips to the US...do we put POE or the town I live in my fiancée came to visit and spend most of the time at?

Thank You everyone for your replies. Our interview is coming soon so we are just getting the most info we can!  Good Luck :)

K-1 Fiance(e) Visa Process & ProceduresDescribe how you met question

We did just a few sentences on an attached form....of that we met online in 2005. We met in 2011 in (LOCATION) and stayed together ____months. we met in 2012 in (LOCATION) and we stayed together ____ months, and we met in 2013 in (LOCATION) and stayed together ___ months. We also briefly explained that we met each others families, and locations we visited while we were together. Every case is different depending on country and your specific case. For some a few sentences is the right amount, for others they feel a page is fine. The most important thing is telling about your meeting FACE to FACE within the past 2 years. Hope this helps! Good Luck. :)

K-1 Fiance(e) Visa Process & ProceduresWhat to tell to the CBP officer?

Yes, that is correct.  If the CBP officer asks you how you know your friend, then I would suggest to say something like this: we've met on international tourism chat through a mutual friend.  That will show the officer your interest in American culture itself, and not just a person who might be your potential future husband ;)

She may not have met him through a mutual friend, or even on an 'international tourism chat'......

TELL THE TRUTH, plain and simple.

And bring plenty of proof of ties to your home country (that you are willing to do this process the legal way)

Hello Everyone,

My fiancé will be entering Detroit, Michigan using his K1 on May 17th. He previously had a B2 visa in his passport. We were wondering if the B2 should have been voided by the CO when he was issued the K1? Would there be a stamp or 'VOID' stamp on the B2, or may it have been voided internally, and how will the CO in Detroit know the B2 is voided and not being used when he does POE? Please help! We only have 3 weeks till he travels.  Thank You all so much in advance.

K-1 Fiance(e) Visa Case Filing and Progress ReportsRFE - I129F - Request for primary evidence of meeting in person

My fiance and I just recieved an RFE, because they want primary evidence of us meeting in person. We originally sent 5 photos, many many emails and facebook messages, and they are saying they want primary evidence...He is from Michigan and I'm from Ottawa, Ontario. We travel by car only so perhaps we should send credit card bank statement and receipts of our gas bills? We dont have passport stamps, no hotel receipts (as we always stay in each other's family home when we visit), and no plane, train or bus tickets. They said they don't need more photos or telephone bills, as they don't want more proof of an on-going relationship but rather they want evidence of us meeting. Please make suggestions of what else we can include as primary evidence.

People have mentioned sending affidavits with their I-129F for the section of "proof that they've met in the past 2 years", which i agree is a good idea because it helps as a witness of others having met us together. Is there a link someone can send me for filling out affidavits? There are many online, but I'm looking for what you guys have used. My thought exactly. Do you have any additional photos, even though they said no to additional photos, of the two of you with a visible US or CA landmark in the background? If so, send those. Photos that are dated too.

We have lots of photos of us together! We submitted 5 and they said they don't need more photos. We wrote the dates on the back of the photo as well as the location and our names. We've been together since October 2011. They want 'primary evidence'
