Waivers (I-601 and I-212) and Administrative Processes (221g)	Administrative Review	Hello, my fiance (lives in Algeria) had his interview on March 29th and when the interview ended he was asked what did he expect of the result...and he said the best of course..they said that his visa was accepted and they gave him an appointment to go back on April 9th and get his passport and to get some informations about his duties and right in the USA and he traveled 5 hrs cause Algiers is far to him..when he gets there he was not even allowed to go in cause and they said to him that the appointment was a mistake that his file was not ready yet...I emailed the consulair and they said that his file was sent to Administrative Review and they didnt know the time it will take. I have no idea what happened...how can they make this mistake and didnt even let him know before he got there. It has been a month since the interview and there is no information that they can give me..which is very frustrating and depressing...we even had given them so many of our printed conversations and they said they didnt need it...so I dont know what is going on and why they said it was accepted and then they did this..his criminal background check was clean..i make enough to support him, he has no issues with anyone....i just dont understand...can anyone give me any insight of this or if have had any issues similar to mine? If this makes you feel a bit better, my fiance has been undergoing AP since last June 21st, and just a month ago after many emails to DZ, they replied stating that we were being investigated by the Anti-Fraud unit. WHATEVER! They can go ahead and investigate all they want as there is nothing to worry. We also believe that my fiance's last name is being checked as his name is very well known. It will be an entire year this comming June since his interview. So "FAITH" is a most!! I have been here in Tunisia with him for the last 2 weeks now, won't be going home for another 2 weeks. Hi VJ friends!    Have a question, need input....   My fiance ( from Algeria ) has been undergoing AP for almost 13 months. On June 24th, we received an email from DZ stating that they were getting ready to make a decision on our case within 10 days..  This is what it said:    From:  "IV-DV, Algiers" <IV-DValgiers@state.gov> To: Sent: Monday, June 24, 2013 4:46 PM Subject: RE Dear Madam,   We acknowledge the reception of your email. ALL your messages has been received and forwarded to the appropriate unit. According to our record, the case is still under administrative process. A decision will be made regarding the case within 10 days.   Regards,   Consular Section     It has been almost 3 weeks since receipt of email and have heard nothing yet. Would it be wise to write them an e-mail asking why is it taking so long for a decision to be made? I am wondering, since I have read here that it isn't  a very good idea to write emails since it will only create a delay on your case? Correct me if I am wrong please. Ning.....   I am so thankful for your words of encouragement and advice. I have truly exhausted all sources leaving me with one option now. I  feel that getting married and filing for a CR-1 is the wisest  way to go about. Like you said, "married is married" , indeed is! So know that I am taking your advice to heart. I thank you again for recognizing my effort in this journey. It was a great sacrifice that I will never regret. Our love for each other is utterly and this K-1 journey was only considered a "bump" in our paths. The reason I ask is because a case that is sent back right after a 221g has a chance to be reaffirmed,  unlike those that were giving a 221g and told the case was being returned instead kept at the embassy for 13 months in AP like it happened to us. Tebessa I have to say after being on AP for almost 4 months your story scares me!! Who would ever think you could be on AP for 13 months. Do you have any advice? You said you emailed the DOS but who specifically? PLEASE HELP!!     LivA...... I am so sorry my story scared you. It wasn't my intention! When you are in AP, your are pretty much in a black hole. You just sit there and wait. I have compared AP to being in jail, and decided that I rather spend time in jail. You at least know when you're getting out. In AP there is NO WAY to know. Wait, pray, contact the embassy , DoS, your senator/congressman. The more people bugging on your case the better. I have an email to DoS I could give you if you feel you need to file a complaint against the Embassy as this was my case. Keep the faith strong as you will need it. Try to live life in harmony, go about your daily routine, don't despair, talk to your friends, family for support, just DON'T GIVE UP. I assure you there is a RAINBOW beyond that black tunnel.. Posted Today, 09:21 AM We were denied after 17 months of AP and received a letter from USCIS, 6 months after the case was returned, that we can refile. You don't have to wait to get married or withdraw the petition, it will just expire.   Ebunoluwa.......   Oh wow! So sorry to hear that! That is totally insane! I am quite confused as what to do. Some say " don't have to wait or withdraw petition, it will just expire" and others say "no way, don't get married until USCIS contacts you". Well, I don't think I am willing to give another 6 or more months of my life waiting to hear that my petition has expired as we can utilize this next 6 months preparing for our wedding and refilling for a CR-1. Posted Today, 06:09 AM Im sorry to hear about what happened..........   before getting married you should wait to find out if the the petition was sent back as expired petition or if it had any issues that could make a problem with marriage visa......its really important to find out what issues they found with the k-1 if any so that you can address them.   sara..... thank you for your kind words. Posted Today, 05:58 AM Doesn't K-1 expire after 6 months of reaching the Embassy?  I believe it's something similar to that.  As others have said it'll be expired when it gets back to USCIS. So sorry with all your trouble!  I'd definitely start planning another trip and get married to start the K-3 process.  Best of luck to you, please keep us updated!   DaveyKins...... I am not sure as when the K-1 expires. I thought It was 6 months of reaching the Embassy as well. I just emailed the Embassy requesting diplomatic pouch#  this way I can track the return of my petition. I will keep you posted and thank you so much for the kind words. Hi Roni!   Thanks friend for your kind words. It means a lot to me. Although the end result was not what we were expecting, at least we now know which direction to go from here. We are so relieved to be out of this black hole. So we thank God for that. I can't tell you how much we both have prayed for a decision to be made on our case  . Do you think once our file gets back to USCIS it will be expired? I have been wondering how long before it gets back here, and weather or not I need to wait for them to contact me. Hi all!    Our K1 was denied in Algeria after 13 agonizing months of AP. Don't know why we were denied. We have been together for 4 years. Recently we've spent 1 month in Tunisia. All of our documents were in order. My I-129F was approved in just over 4 months-no problems there-. Interview went great. CO even paid compliments to my fiance about his well spoken English and his appearance " You are a very handsome man" LOL!, he said!. At the end of the interview he was handed a white slip - 221g-  It stated that the case was being returned for further review and processing. We will advice if case is reaffirm.... Case was never sent back to USCIS, instead remained at the Embassy for the next 13 months.....    We had followed up with many, many, many emails and phone calls. Made contact with Senator/ Congressman. Wrote complaint letter to DoS. Also emailed the White House while in AP. While in Tunisia back in May of this year, I personally called the Embassy several times. I was able to connect with a staff member of( Algerian nationality) and was denied to speak to the Consular section. Hmmm.... I proceeded to contact Department of State and was instructed to file a detailed complaint letter and to forward it to a specific department. I did. For the following 2 months my case was touched and worked on. Finally on June 24th we received an email from the Embassy where they stated that they were making a decision on our case within 10 days. A month an a half went by and we decided to start emailing to inquire about their decision. In my last email I was firm, to the point and pretty much said that we were aware our case was not a priority to them but  it was to us, and to please just make a decision, didn't matter at that point what the outcome would be. We just wanted to move on with our lives. So after 5 emails they finally replied on August 1st. with a denial. Thank God we are out of this black hole!    Now...   Case being send in a diplomatic pouch to USCIS. Our total visa journey 2 years next month since process started. See timeline.....   Question 1: Since it is a K1 visa, would it be recommended and wise to wait for USCIS to make contact with petitioner ( myself)  once it arrives to US. REPLY if NOID/NOIR is received?    Question 2: Is my K1 expired by now?   Question 3: Should I just go to Algeria, get married and start again with process......?   Please any and all feedback would be greatly appreciate it!  Thanks!!!!   My best wishes to all of you in this journey.   Diana   Is this true?????.  Posted by one of our members.....   At least with CR1 or I-130 one can reaffirm, if it is sent back. Carolyn....   No, they did not keep his  passport. You are right about trying to slow things down. I have and still am. The embassy has a new website now with many more options. I emailed them today and should get an answer in the next 1 to 2 days. Crossing my fingers that the emailed I received 16 days ago was nothing but a huge mistake, and that we are still in AP pending a decision. We believe our case was forgotten in a  pile of S*#^@ a on someone's desk!. So who knows they are now trying to come up with an answer. The reason they can't even reply to my State senator's office. If you ask me, I think this is a sack of #######!!.No reply either about why we were "refused". And to answer your question, No, the embassy can NOT deny a visa, although the email I received clearly read "denied".  I have emailed the embassy numerous time after the refusal, no answer beside" we will forward your email to the appropriate person" . So confused. This is totally insane! UGH!!   Our K-1 was refused after 13 months 8 days undergoing AP in Algiers. On August 1st, we received an email from the embassy stating that we were denied, no explanations whatsoever! Contacted my State senators office. After 3 inquiries allowing the embassy to provide a response within 30 days each time, NO REPLY, they are FURIOUS!. How unprofessional is that? Uh huh  that's what they said! . Proceeded to contact DOS, ( 3rd time today this month) they keep on arguing with me that my case is still pending AP ( HA-HA). No notes from the embassy as far as a refusal goes! WOW, confusing right?. DOS highly advice that I make contact with DOS Director and file a complaint (already did that 4 months ago) .Tried calling Mr. Director, message left. No calls back as of yet. How frustrating.....   Meanwhile, I am trying to stay focused on my upcoming trip to Algeria, so we can finally get married, begin our second journey and blah, blah, blah......   Anybody with similar situation? Any suggestions? Any advice?  . Would it be advisable to continued to Digg-in to this K-1 mess?. After almost 14 months undergoing AP, "REFUSAL" on AUGUST 1ST, Today August 18th got a call from my fiance at 5:00AM.........	A MIRACLE just happened!!    VJ members.... thought I would share with you the news!   So after almost 14 months undergoing AP in Algiers, and at refusal email from the embassy on August 1st....., bright and early this morning I got a call from my fiance. He said " baby get on Skype and check the CEAC website," so I quickly jumped out of bed and did just that...... WOW, couldn't believe my eyes,  " Ready" it is our new update today. Did not know what to think, because our entire journey has been a nightmare..... We were jumping up and down from excitement!. Then an hour later, the call I have been waiting for the last 14 months, my fiance again, he said "baby, guess what? I said WHAT? Just got a call from the American Embassy, was told to bring or send my passport, they are ready to issue visa!", I almost fainted. This was truly a MIRACLE!!   Whatever happened at the Embassy we probably will never know, but that is irrelevant at this point. We really prayed hard and asked God to intervene. At that moment we had let go of that heavy burden and gave it all up to HIM.    We are positive that the outcome of our journey was 100% Divine Intervention. Thank you my GOD!.
