Introduction
Customers who have an application and/or petition which has been filed with USCIS but has not yet been decided (also known as a 'pending' case) should notify USCIS of any change of address as soon as possible after moving.

The law requires nearly all non-U.S. Citizens1 to report a change of address within 10 days of moving by completing a Form AR-11. Thanks for the reply! My COC does not say "pursuant to an application filed with the Attorney General" , my COC was issued in 2003.


Another silly question: my COC says "It is punishable by U.S. Law to Copy, print or photograph this certificate, without lawful authority" I was going to send a copy of my COC in with my forms. Is it ok to do so? (I'm assuming it is)


You are actually required to send one, but make sure you cross it out ( like you would on a void check ) ...and above the line write "NOT VALID, USCIS USE ONLY" ...that's what I saw my attorney do on mine.

I don't think you should freak out... just don't forget to mention it on the interview. Thay way they can compare your name to your identification and fix it... it would be a big setback if it was misspelled on ALL the forms (since the begining of the case), but not if it's just on the DS-156.

I am going to the interview with my fiance the middle of this coming June.. It is in Manila.. If everything goes well, and the visa is approved, i would like to return home with her. It has not been easy at all to get a coinciding airfare one way for her, but the travel agent said i could get a roundtrip ticket with my same itinerary, and just not use the first portion of the ticket to get to Manila.. She would then use the return,,.. Is she able to do this . This is already somewhat of a gamble that the visa will be cleared, and i cannot afford to make those kinds of costly mistakes.. It is not a cheap way to go, but from what i have seen , there really is not a inexpensive way to do this.. grrr... Any advice, or experiences would be greatly appreciated, .. I think the best route will be to wait until the interview and then try to buy the ticket either onlina, by phone or at the airport... I'm sure the airline can accomodate. They handle with those kind of situations often with people like you (having their relatives approved) or even with death situations. Sometime ago a relative of mine died over seas, nobody had a ticket, we all went to the airport (luggage ready and averything) and we got on a plane. All you have to do is explain the situation.

Might cost a little bit more than buying it ahead of time, but you will not be risking loosing your money.

Let's be careful about using terms like "you need" when in fact it does not exist. I can find no reference for this requirement in the instructions to the I-129F. You can, you may, you might but not need.


I have to admit, you are right. After reading your comment went to "books" and there's no reference, the reason I said it was becasue my attorney sent ours with the application. I guess just to have EVERYTHING on the file.

I was just following the old saying: "A mother knows best" ...I just thought that by being a lawyer she would know better ...I'm human, can make mistakes, realize when I have made one and apologize ...as I do NOW. :blush:

She said it was $750 for each child (K-2) and $1,500 for my fiancé (K-1)

Now that I know... the only reason that I can suggest a lawyer is, if you have had "problems" with the law before... other than that... forget it!

I can honestly tell you now, that if I were in the same situation you are now... I wouldn't done it!!!

With VisaJourney you don't need no lawyer, unfotunately for me I found VJ after I hired the lawyer... you still have time to get out of that road. The money can help you have an extra trip or help you pay for the inmigration fees. I think that even though you said you are a little messy, you'll be fine if you are able to follow instructions. I just realized I forgot to send an "Intent to Marry Statement" with my first packet! I did get the receipt back from California. I purchased a book at first to help fill all this out and on its checklist, it did not have the "intent to marry statement" I assumed writing the letter to Question 18 on the I-129f from would have been good enough.

Was that really bad? What can I do to help fix it?

It is unlikely that she would be given a tourist visa unless she can prove strong ties in Mexico and prove that she is not obtaining the tourist visa with intentions of immigrating to the US. This will be difficult for her to proves since you already have a K-1 petition in progress. My opinion would be to forget about the tourist visa and save your time and money. When they see that a K-1 visa petition exists, they will deny her the tourist visa.



That is what I thought, but I called USCIS and they said since we are going through the correct process to not try and sneak here in, it should not be a problem? Were they wrong? Also I am hoping her working for GM would be a strong indication of her going to return to mexico. Would her trying to get the tourist visa hurt the K-1 process at all?

In any case I wanted to know if I was to get an RFE will they send me an e-mail alert to that affect as well as the letter? Or will the letter for the RFE just magically show up in my mail? I ask because I travel a lot for work (currently in S. Korea), so do not get to check my mail and would like to know if and when an RFE is floating out there.

I believe the 'long form' and 'short form' birth certificate distinction refers to the foreign fiance/e's birth certificate. As long as you sent a certified copy from the state you were born, you have sent the correct one.



This is going to sound stupid. What makes is certified? I just made a photo copy of birth certificate.

Did you send any other proof that you are a U.S. Citizen? For example, if you included a photocopy of each and every page (including cover) of your current U.S. passport, then there would not be the need to rely on the birth certificate alone.



I only sent the first page of my passport, because it was in the Korea office for a work visa at the time.

The base answer is this: If you have a pending petition, they are not allowed to issue the tourist visa. Sorry. Trying to save you a wasted visit. We wasted one.

It's not that they are not allowed.
It's they are very difficult to get from some countries.
Prople have done so with the right ammo.
Even from the Philippines which is one of the most difficult to do so from.



What do people think the right ammo would be? I am thinking a letter from her work at GM, and then I was also thinking I could write a letter saying something along the lines of that she is just visiting and to tell them again we filed the K-1 to get married the correct way.

We are trying right now. My love's interview is thursday .. we know the chances are slim and the cost for failure financially punitive (no refunds of any fees) sadly our "ties" are limited as she has nothing that isn't in her family name except her daughter which is enrolled in school. We read all the information everywhere, talked to attorneys and everyone agrees that we basically have a minimal chance, but there is always a chance. Looking outward, we have at least 4-6 months left to go (if you believe the VJ timelines) and I'm completely out of vacation except for 3 days which I have saved to be there during her interview or to go get her ... We've put a large package of circumstantial documentation together and I wrote a letter stating our intentions. We've been completely open about her plans to immigrate on a K1 and bring her daughter later.

In the end it came down to this .. we will never know if we don't try, and if we some how make it. somehow get to see each other again while this slow process unwinds, it was worth it .. if we don't .. then we at least tried, and if you don't try, you've already failed.


It all boils down to the interview, the mood of the officer, if he or she will believe our sincerity. Wish us luck, we will report back to VJ on Friday what happened.



Please let me know how it goes and what information other then proof of ties back home they might be looking for. I am with you if denied for tourist visa then OK, at least we tried. But I do not want it to slow down the process any! Also I am concerned now about even if she gets it will they let her in at the POE? To many what if(s) for this situation. You would think they would know we are doing it the corret way and not being tricky by the fact that we did the K-1 visa.

i apprecaite why you want to post. i guess there may be another american/mexican couple out there who had the same problem! personally if you have the cash i would go for it. if she has a valid tourist visa, a return ticket, and ties back home, i am sure they will let her in. why would you bother petitioning for the K1 and raising the red flags if you wanted to sneak her in?

I am doing the same things for mexico. Keep in mind their passport size is smaller, but should not cause an issue. But like many have said it depends on who looks at your stuff and what kind of a mood they are in.

K-1 Fiance(e) Visa Process & ProceduresTourist Visa was granted!
FYI: Though the K-1 visa is in the first process at the USCIS, she was still given the tourist visa!!! Though I think a lot of it had to do with her working at General Motors (GM). They did ask her about me but nothing more then her saying she has a fiancee. Just thought I would share... Next step is getting through Immigrant at the border, but do not think it will be an issue? Any thoughts or comments?

K-1 Fiance(e) Visa Process & Proceduresmissing documents . .what do i do???
I,m putting together my petition and a few quick questions if anyone could help . . . .I visited mu girlfriend in the philippines 3 different times and i have a few missing items several boarding passes . . .we traveled on boat to an island to spend some time together but i seem to be missing the boarding documents for that, but i do have itinerarys and other items such as hotel documents for everything else . . .DO you think ill be able to get by??

also, should i make a note someplace in the petition of missing items and where , on the contents page???

finally, fir my trip documents, should i just include the major ones such as plane and hotel OR do i need every single little thing such as luggage reciepts, taxi slips,meal reciepts ect . . . Thanks for the help
