So many questions, so little time.

So I will list them. And hopefully someone can help!

1. I got NOA2 yesterday, when do I called NVC?
2. What is NVCs phone number?
3. With Packet 3 on the DS-160 applicatin it asks for the applicant's fathers name, address and DOB. My fiance hasn't spoken or heard from his father in probably 15 years. Will this deny us, if we put UNKNOWN?
4. The birth certificates that need to be brought to the interview...I am not 100% sure I can attend the interview with him due to my job. Does he have to bring my ORIGINAL state sealed birth certificate? Or is a photocopy with my signature certifying it is an exact photocopy of the original ok?
5. My stupid self was so excited to send in the petition that I forgot to make a photocopy of everything. Should I redo the forms from the original 1-129F petition and just date and sign everything again?

Any information helps! Thanks everyone. I think I have a good grasp of the rest of it, as I did most of the paperwork already. Just need to sign and date everything.

1. From the looks of it, I think you (the USC) are in fact residing in the States right? I asked the same question once and got this answer "You do not have to prove your petitioner's status unless they are only a permanent resident of the US and not a citizen. Evidence of domicile is only required if the USC (US citizen) does not currently reside in the US. For example it's common that many americans live with their canadian spouses in canada; in this case evidence of domicile is required."

2. The Petitioners income needs to be 125% of the poverty line for a household of 2 (assuming you have no other dependents) which is $18,913. Even though the K-1 visa states the petitioner needs to make 100% of the poverty line; In most cases they look to see that you make 125% (AOS requirement) since they know that K-1 visa applicants will soon have to file for AOS once they marry and will need to meet the AOS income requirements. http://travel.state....pes_2994.html#8

OK thank you for the response. Regarding income...the last two years I did not make that, but December of last year I got a really good job and am going to make way more than that. Is this going to be an issue if I submit my tax transcripts, employment offer letter showing my annual salary and also a few recent pay stubs?

1. What type of proof of domicile do I need to provide? We are planning on living with my parents who are sick to take care of them.

2. What exactly is the income requirements as I have seen several things stating different things...especially for Montreal?

Is there any advice I can receive on tips for the Montreal embassy?

My fiance and I just started the K-1 Fiance Visa application process. We reviewed the application process on this website, and I'm glad that the instructions here are easy to follow. However there are some concerns that I have and hopefully someone with experience can help.

My fiance and I have many pictures taken together and various receipts of purchases that help prove that I've visited her in her country. But I'm concerned that I don't have all my plane tickets, I have some of them and I have all of my itinerary. Will it be ok for me to not have all the plane tickets? I've visited her two times in the last two years, will not having all my plane tickets cause the application to be denied?

Also if anyone has any tips they would like to give, that would be much appreciated!



This is all great advice! Also, pictures, receipts, Passport, ATM receipts, dinner purchases, parking slips, tickets to events you've been to together (movies, concerts..etc).

Yeah its a frustrating wait. I've done all the paperwork for our case and now I'm trying to get my fiance to understand the process incase I can't go with him to the interview he's not like "Well, I don't know. I just signed it where she told me to" haha. And kicking him in the rear to get his birth certficates. We went together and got his police certs Monday so thats done at least.

Don't sign up for interview yet, but it will tell you when the next available interview is. :) And this is also where you will sign up for your interview and your courier services so you can get your passport back after approval. :) You're on the home stretch now! Its all going to go smoothly. Not much of a wait. Start preparing for the big move, wedding...etc. Keep your mind occupied.

You can always check back for cancellations. If theres one, snatch up the slot! The thing with Montreal, is the time of day doesn't matter as much as the day itself. Its on a first come first serve basis. So you still end up getting there at like 6:30AM and getting in even if your appt isn't scheduled until 2PM.

Montreal is running about 68 days between sending you Packet 4 and interviews. So you've got a little bit. :) But thats plenty of time to get your medical done and get all the paperwork together that you might need for the interview. We are sending in Packet 3 this weekend. I checked and right now, the next interview from today is 68 days away. So good luck.

On our NOA2, it shows an expiration of 12-03-2012. Due to my work schedule we are trying to plan my fiance's interview in Montreal for like the 3rd week of November so that I am able to go with him.

Is this going to cause an issue with the NOA2 expiration so close? Should we just try to get an interview asap? We aren't planning POE until after Christmas, so we just wanted to take our time with this part of it so that we can guarantee that I can go to Montreal with him.

Any opinions/advice?

No pictures? No receipts of things purchased by either one you in the other's country? Bank statements showing withdrawals in a foreign currency? Otherwise you can have people write letters, sign them and have them notorized that saw you together. Family, friends..etc.

But you should probably get on the no pictures thing. You're going to need them when you adjust status or its going to be REALLY tough to get approved.

Your best bet would be to get married and file AOS. You can stay in the US at that point. The only issue you might have, is if you are required to get police certificates from every country you've live in since you were 16. But I am not sure if that is required for AOS since I am going the K1 route. But if you are going to do it, you should do it before you leave on VWP.

Thanks for the advice ! A first step on what looks like a long but rewarding journey. The next question I have is about submitting copies of our chats online for the last 6 months. Is this something I can just submit with the I-129-f, or do I need to send a copy to my fiance? Also, it is probably about 600 pages. Is it o.k. to just take samples from each week, or better to send the whole thing? Thanks much ! I already feel like I have support where none existed just yesterday !

A friend who introduced my Fiance and me told me I had to come to this site. I have already gained a lot of knowledge thanks to you all. We are at the point of filling out the I -129f and the G-325 A forms. The G-325 A says at the bottom to "Be sure to put your name and Alien Registration number in the box outlined by the heavy border below". We don't have an Alien Registration number ! I thought this was the start of the K- 1 Visa process. We surely want to be complete on all the forms, but this is just confusing. Anyone been down this road that can offer advice is appreciated.

I will hold off on the other 199 questions for now ! Thanks for this forum.



What we did, was just put my fiance's name. After you get NOA2...there will be an A# about your fiance's name. I'm PRETTY sure thats the A# but I believe thats something they fill in later on. I could be wrong. But just don't put anything there. I didn't. Got approved. :)

You don't lose your position in line. Its like a holding file...but the advice of "Send it in" isn't good. Because of the chances of getting it actually into your file, is slim to none. Just wait to see what happens. I sent proof of his bus ticket to see me, and all the gas receipts that I spent for driving to him every month.

We got approved. So just hang in there and see if you get an RFE. I doubt you will get one as long as her flights to you that you sent proof of was in the last 2 years of filing your petition. Thats the most important thing.


EDIT: You are NOT required to have visited the USA during your relationship. Please don't think that. You are ONLY required to have MET in person at least once in the last 2 years.

Actually that should be sufficient because thats proof with her ticket stubs to London that she went there and you've met each other. I'd certainly hang on to your stuff, maybe even make photocopies so you have them for the interview. But you should be ok. Worst case, you get an RFE (Request for Evidence) and she has to send it in. But you should be fine! Congrats on starting your journey! Hope it goes well.

Here's a scenerio:

If my fiance sends me money to drive to his house for the weekend. We just happen to have sexual relations while I'm there (like any couple does), is that prostitution?

Something to consider before you all go judging and making assumptions about people and their relationships. We are here to help each other through this grueling process. Not judge people based on their relationships or questions. Thats the USCIS's job and the Embassys. People need to become more open minded to diversity as there are hundreds of countries represented on this forum.

Not everyone is coming from the same place. We don't have to like someone's opinion or prospective, but we should respect it.

Your beliefs aren't the same as the next person. Don't throw your beliefs at them and demand they believe the same thing.

Heres the million dollar question that I just realized:

I currently live with my parents. I work full time and make $30K a year while taking care of them as they are not in good health. My fiance is going to be living with us until his green card arrives.

For the number of dependents, do I need to include them? Even if I don't really pay to support them? They have their pensions from the military? I do pay rent and help out with bills, but if I wasn't there, they wouldn't need my help financially? And I wouldn't need theirs?

Or do I just look at the poverty levels for me and another (my fiance)?

NOTHING is 100% guaranteed until your visa is approved at the consulate, you have your visa sealed envelope and passport back IN HAND. After that, plan a wedding. We got our visa approved, passport and visa package arrived 2 days later. The shipping company opened our sealed envelope. So we had to send it back to the consulate. Nothing is a 100% guarantee with time. You're best bet is to just wait. You have 6 months from the time your visa is issued to move. And then anotehr 90 days to get married. Thats 9 months almost. Trust me when I say that you're best bet is to wait. I know it isn't easy. Trust me. Its not easy at all.

We are POEing on Sunday, we don't even have a set plan 100% yet except that it is February 16th. One year exactly we met in person. That's all we know. Our whole journey from I-129F File to having Resealed envelope back from consulate was 7 months, 2 days. And that was with NOA2 only 88 days after NOA1. Consulates get backed up. We waited longer for an interview after NOA2 then we did from NOA1 to NoA2.

Just hang in there. It'll be ok. Don't make any cemented plans.

Here's something to think about too. This happened to us.

 

My fiance and I went to pick up his passport and yellow envelope from the courier 2 days after our interview....the courier opened the sealed envelope that says DO NOT OPEN. So we had to have them send it back to the embassy, we had to figure out how to contact the embassy because they of course don't have phone numbers to tell them we were sending it back to be resealed and not that we had changed our minds or something. Took 2-3 weeks to get it back. Could have been longer if I didn't have my congressman on top of the situation. 

 

Anything can happen.

Just a heads up, it took longer from NOA2 to Visa in hand than from NOA1 to NOA2. So the embassy can take way longer than USCIS. 

 

Always very risky to make plans until visa is in hand. Hopefully it will work out for you, but always beware that things need to be flexible.

I know that I had no RFE but I put n/a or non on everyline that didn't apply. DIdn't leave one out because you can get an RFE if not since there is no answer they can assume there is an answer and wasn't placed. So I guess it worked for me.

 

I second this. If there is something that doesn't apply to you like minor children..etc. always put NONE or N/A on that line so there isn't anything that can be misinterupted on the applications and forms.

Not in Colorado but exch State I am sure varies.

 

Each state is a little different. If this person lives in California or Florida though, good luck! They are the WORST to try to get insurance licenses in. California wants to know everything down to if you've ever had a bounced check.

Why are you going to SCHOOL for life insurance sales? I work in life insurance. I read a book for 2 weeks, went to the Department of Insurance in my State, took my state exam, passed and am licensed in all 50 states. Doesn't make sense to me.

 

Your life insurance license might be effected by the deportation. That's pretty serious. Just saying.

1. Marriage Licenses are only good for at most 33 days.

 

2. If you quit your job in Canada and come to the US to visit every two weeks, good luck getting in.

 

3. If you get married now, and file Spousal Visa, you will still need to be separated but it takes about the same time as K1 but you get a green card right away and don't have to wait for AOS.

 

4. From your timeline it shows one of you lives in Niagara Falls the other in PA. At most you're looking at 6 hour trip depending on where you live. (My husband lived in St Catharines and I live in Western Michigan 7 hour trip I made it every three weeks for a weekend because it was worth it, so if your fiance makes good money in Canada, he can help with your trips to visit or vice versa).

 

5. If your fiance in Canada is coming to the US every 2 weeks and then going back to Canada for a weekend, that is showing he is actually residing in the US and not Canada. Therefore, visa/immigration fraud.

I was just reading the post of another member... she got a letter from NVC saying that the case was approved and that they were sending it overseas to be processed with no NOA2... so don't think that your case is not being processed just because you don't get the NOA2.

Everything you say is true as far as not being primary evidence, but I have to say that it's a good idea to do so... my attorney sent five (5) sworn (notarized) statements by relatives and friends that know about our relationship.

If an attorney did/suggested it... must be a good idea!
