I'll suggest notifiying the USCIS, because you had to subimit a AOS (Affidavit Of Support) and you ARE responsible for the person(s) doing while they are in the country.


What is an Affidavit of Support for immigration ?

If you are bringing a relative to live permanently in the United States, you must accept legal responsibility for financially supporting this family member. You accept this responsibility and become your relative's sponsor by completing and signing a document called an affidavit of support. This legally enforceable responsibility lasts until your relative becomes a U.S. citizen or can be credited with 40 quarters of work (usually 10 years.)


For Whom is an Affidavit of Support for immigration required?

You must complete and submit affidavit of support form if you are bringing a relative to the United States. An affidavit of support, is required for all immediate relatives of U.S. citizens (which include parents, spouses, and unmarried children under the age of 21, including orphans) and relatives who qualify for immigration to the United States under one of the family-based preferences:

First Preference: Unmarried, adult sons and daughters of U.S. citizens. Adult means 21 years of age or older.

Second Preference: Spouses of lawful permanent residents and the unmarried sons and daughters (regardless of age) of lawful permanent residents and their unmarried children.

Third Preference: Married sons and daughters of U.S. citizens, their spouses and their unmarried minor children.

Fourth Preference: Brothers and sisters of adult U.S. citizens, their spouses and their unmarried minor children.

Mine was just like that one, but it listed the consulate as Santo Domingo.

And, after a couple of weeks I got a letter from the NVC that contained the case number that was assigned to the Dominican Republic.

If yours isn't like that I would contact USCIS for clarification.

Cases sent to NSC automatically get transferred to the California Service Center (CSC). CSC is extremely backlogged currently which is the cause for your delay. Since they have cashed your checks they have your petition and likely have mailed your NOA1. You will probably receive it in the next week and will be able to check your status at that time.



I find that weird, because I received NOA1 and my check was chashed before it was transfered... I also got notification of the transfer, online and snail mail. All I can say is be patient so far... you've done everything, but keep checking for that check cashing, that was my first clue of the processing.

The best way for you to find out if the money order has been chashed y by calling the 1-800 number, that's on the back of the money order stub... it will ask you to enter the money order number, then tell you if it has been cashed, and if so, it will also tell you when it was chashed, I think you are in the "safe-zone" still.

After you get the NOA1, go to the USCIS website and create a portfolio, so you can check your case and best of all... receive e-mails. That's how you are going to be able to know, when they "touch" you (not on e-mails, but on the website... yes!) or when they've mailed something out.

I understand it's nerve recking... hang in there, it won't take that long.

Applying for a Non-Immigrant Visa

Part One: Do I need a visa?
Under the Visa Waiver Program, Australians and nationals of 26 other countries, including the UK and New Zealand, can travel to the U.S for tourism or business stays of less than 90 days without obtaining a visa if certain requirements are met.

Part Two: What do I need to apply for a U.S. visa?

So I called USCIS, since I have not bothered them or anyone here for last 4 months. Been trying to be patient... Try is the key word here!

They told me they are only working up to April at this point in time. I asked her if this means that last one the need to finish is still in April or none have made it past. She swore to me no one at the California service is past April. That has to be not true after looking here, correct?

I file July 17 and just hoping to hear something before mid December.

ThailandNVC Case # Question

Petition filed January 10, 2012 CSC, NOA1 Received January 13, 2012. NOA2 Approval July 2, 2012. Here's my question: I called the NVC and got our case number. I used a Visa prep service that says I need to wait until the Bangkok Embassy sends her the instruction packet before we can submit Packet 3. My fiance has Packet 3 ready to send and is getting her Police Clearance on Friday so all we'll need is the medical, do I have to wait until the Embassy contacts my fiance before sending in Packet 3? Thanks for your help.



If you have your NVC case number, I'd send it. By all means. Some people don't get their packet until like 2-3 months later or never at all. Don't wait for it. If you have everything and you're confident that everything is there and ready, send it on its way!

Yeah I don't think its an issue either. My fiance Western Union sent me money from Canada last week and it was a small amount $100. So I don't think its a huge deal. But I had a bill that had to be paid before I got my paycheck and he sent it to me. So I don't think you have anything to worry about. It was more like $5000 they might have an issue.

My fiancee (Vietnamese) and I are living in Hanoi and will be married in a week or so (it just depends on how long the final approval takes). If she sends a small amount of money to me via PayPal, will it raise red flags? I'm talking in the hundreds ($200-500 or so). We want to start paying down my credit card debt, and she can send me money via her PayPal account to my PayPal account, and then I can transfer that directly to my checking account and then to my credit card. After we get married, we'll start the CR-1 petition within a month or two. Please let me know your thoughts on this. I know Vietnam is a "high-risk" country for fraud, and I'm scared that the PayPal transfer(s) will raise a red flag. Thanks a lot.



Great question! However, I think you are ok! USCIS doesn't really look at Paypal. But I'd definitely tell them what it was for if for some chance, they asked. BUT the only concern is (and you'll be fine if you have a bona fide relationship) is that it could be used as some form of "payment" for marriage. Unfortunately, this has to be considered in the immigration process because it happens. Not saying this is your intentions at all, but it does happen. Not just in your country but ALL countries. I don't think Vietnam is considering any more high risk than any other country.

5-6 years would be your out of status time, I am thinking thats going to be a 10 year ban. I'm not 100% sure. Someone can correct me if I'm wrong. But if you are being asked to leave the country you might have a lifetime ban. Someone with more knowledge on that can correct me.

 

But sure sounds like a lifetime ban. There might be waivers available as well.

Sounds like by not removing conditions your GC expired. Therefore, you are out of status right then and there. You were allowed in the country based on your marriage to your first wife. Therefore, had to remove conditions with her or without her if you could prove that you entered into the marriage in good faith.

 

Getting a new wife voided your visa because you are no longer married to your first wife and you didn't have permission to stay after your visa expired 2 years after your marriage. Looks like your current wife should be packing up to head to Nigeria. I don't think you have options for coming back to the US for a while.

I went to my fiance's interview. It was something that we could experience together. Going in there and being able to support my fiance emotionally was the best feeling in the world. When we were approved, we both smiled and cried and hugged each other because we both knew at the same moment that the journey we had been on was finally done. It was 100% worth the expense of going and we got to spend a few nights in Montreal which was beautiful. It was all about the experience together. I wouldn't change it for the world.

Word of advice: we went for my husband's AOS interview Tuesday. He was so nervous! Poor guy. But the interviewer said she had a few more checks to do after we left so we didn't get an instant approval. On our way home about an hour later we got an email saying we were approved and his card was in production.

 

Nervousness is the biggest thing. Some nervousness can be expected. Your life revolves on their decision. But be yourself, be polite, professional. Dress professional. (This shows them you are serious about your intentions). Know your information. Know your fiance's information. If your fiance is going with you, that's even better. Show mutual intentions.

 

Good luck. Don't overanalyze questions or think too hard. Gut instincts are good.

The most frustrating thing for us, was when we went to the DHL/Loomis pick up to get my fiance (now husband)'s passport and visa package, and the damn company OPENED the sealed envelope that you ARE NOT supposed to OPEN! I was so mad! I went to the place (because I was still in Canada visiting when this happened) and told him that if we had to go to Montreal again (another 7 hour one way trip) he'd be paying for it. And it was a holiday week (Thanksgiving) when all this happened, so I FINALLY got a reply 2 days later from Montreal after sending them emails with the word EMERGENCY in it trying to figure out what to do!.

 

They said to send it back and it took them like 2-3 weeks to get it back to us. I was seriously so angry. I've never been that angry before in my life. And Montreal does not make it easy at ALL to get ahold of them.

 

Our AOS went flawlessly though. So once this is done, hopefully your AOS will go as smoothly as ours did. We got green card in less than 90 days from application. So good luck!!!

I'd recommend against transfering. By the time that is all done, you'd have been able to get an interview in Montreal.

 

Montreal for us was like 3 months out I think. We got approved NOA2 August 2nd I think and interivew was way in November. The week of Thanksgiving.

 

And that was like the only appointment left for another 3-4 months.

 

Good luck!!! Take the first available appt there is and run with it. I wouldn't go through the hassle of changing consulates

CanadaSarnia/Port Huron crossing

Well, it's been almost 2 years to date since my husband (Canadian) and I(USC) crossed back into the US and got married, and we're FINALLY visiting Ontario again, making our usual journey through Michigan and crossing at Sarnia/Port Huron. I'm curious though, and want to ask: to those that have crossed there recently - anything new or different? We're already batting a thousand because my passport is still in my maiden name, but we're taking our marriage license and IDs and all that fun stuff to prove the name change, so I'm hoping we won't have too many problems. But yeah.. I heard something back about them asking new questions or something about his status in the US (permanent resident, obviously) so I figured I'd go ahead and ask to play it safe! :D

I cross once a month from Michigan to Ontario at Port Huron to visit my fiance and its pretty painless. They ask "Where are you going? Why are you going there? When will you come back? Do you have a job? Where do you work?" things like that. I'd definitely bring marriage cert and as long as the Canadian Citizen has AP I think you're good to go.

CanadaWaiting on Montreal for packet 3.. any tips?

Hi. I've been receiving alot of differing information from DoS as far as which day my case was actually sent to Montreal. First they told me that it had been sent on the 2nd of Jul and now they are saying that only the electronic copy had been forwarded and that paper had left that friday - the 6th. If that's the case and DHL usually takes only 2 business days to get there. I'd be at a week since receipt of hard copy (give or take). I'm getting really impatient to receive the packet 3. I asked the last attendant DOS if it would hinder anything to send my packet 3 before they logged that packet 3 had been sent on their end. She assured me it wouldn't. If anything needed to be added or modified they would let me know at that time. Has anyone else done this? Is it wise to go ahead and send the packet 3 requirements (as they are available online) before it's logged in their system?



Most people don't even wait for Packet 3 to get to them. I know I'm not! Once I know its been sent to the embassy I am sending everything out and getting ready for packet 4 so that my fiance can do his medical and interview. He is also going through Montreal so please keep me updated on how it goes! :) Good luck!

Amberlynn... here is the comment made today by someone else on VJers' as copied below... so now I am confused on how much longer when all this started in January 27th 2012

As far as how long it will take, the Immigration Timeline at the top has all sorts of statistics you can look at. As of right now, the average between NOA2 and Consulate is 28 days, and the time to interview from then is about 79 days at Montreal (on average). I would estimate about 4 more months from now until the interview when you add in the RFE wait.

Thanks again... I just wanted to share what I got and why I was anxious to move from montreal embassy to vancouver.



If you go look at other peoples timelines for the same petition you've filed and see how long their interviews took. Thats the best way I'd recommend. You can go to the timelines and search specifically from NOA2 to Interview. I can also let you know as we just got our NOA2 Friday. And its on its way to the NVC now. I can let you know as you're a little behind us. But from what I've heard and read as long as you are flexible and don't care what time or day, you'll get one soon.
