We are waiting for a set interview date from the US Embassy in Manila. Should I just send my Fiancee up to manila and have her stay there to do it all at once? She lives in Cebu, and I was thinking since she has to go to St Luke's Hospital and do her physical, that maybe it was best to have her do that, stay there for the other 5-7 days in a Hotel, and then do the interview at the Embassy. Any suggestions on all this? Should I have her just fly up anytime now and do the Physical, and then fly back to do the interview? Please advise! Thanks

Just wait until you have a confirmed interview date. The medical exam is always scheduled for the day before the interview. As soon as you have the interview date, you can plan her trip - good luck!

Not true! The medical takes 2 days in the Philippines. You need time for the results to get to the Embassy. 10 before the interiew is probably close to the minimum time needed - 2 weeks is much safer.

US Embassy and Consulate DiscussionNVC "Further Processing"... heeeeeelp
QUOTE (James08 @ May 23 2009, 12:14 PM) <{POST_SNAPBACK}>
We received our NOA2 Notice of Approval on May 6. I have received no notices from NVC and the automated NVC system still gives a response stating that our paperwork has not been received by NVC. However... this week the live operator told us that our file had been received May 19 and we should look for it to head to Manila in a few days. When we called again Friday a live operator gave us our MNL2009 case number but said " Your file has been selected for further review.". When I inquired as to exactly what that means and what we can expect it became clear that she knew no more than I did what that means. Other than the two conversations with NVC call center and the approval notice hard copy we have received no info from USCIS or NVC. Any help? Thanks.

Sad to say that you are in "additional processing" and might be delayed up to about 50 days. You should call the NVC once a week or so and ask if your case has been sent to Manila yet.

I hear that the Embassy in Manila really takes a microscope to your K-1 application and makes it very difficult to get Visa. Is this true?

You should really ask in the Philippines forum but ... Just about every K-1 interview experience from Manila I have read here on VJ has been pretty positive. No problem if your relationship is legit and your I-134 is in order.

How is that? This is the form they sent us in packet 4 from the Consulate via email. They sent the same version to my fiance by mail.

The current version of the form has no place for a notarization. Current form I-134 Instead, it is signed under penalty of perjury.

If you choose to use the older version it does have to be notarized however.

Along with the documents I sent to my fiancee for her interview is the I-134. It has been filled out and notarized, but as it's a 2-page document, I had printed 2 pages, rather than 1 2-sided page.

Since this is an "official" notarized document, should I have made it one 2-sided page instead?

We are concerned and wondering if I need to rush another one to her printed "back to back" instead of 2 separate pages.

Thanks,

Steve

You are using an outdated form. The I-134 no longer needs to be notarized. But you should have no problem with filing 2 separate pages.

They will not have your 3 ring binder. They put all petitions in their standard file format. Yes, the CO wil have your file with all your documents submitted with the petition at the interview. Of course there are many other forms and documents your fiancee will have to bring to the interview.

Is the OP wanting to amend his tax return because he actually has income earned that was not reported on his tax return? Or does he want to amend just to report additional income to meet the income requirements required for a K-1 visa?

If its the first case, then I would amend my return. If its the second then Gary covered that very well.

My fiancee had her medical exam this week. All went well but I was just wondering if this is required of immigrants from all countries (or only third world countries?). What is the purpose of the exams? I realize that you don't want someone with bubonic plague entering the country but why are only immigrants required to have this? (I assume people coming over on tourist or work visas don't have to have this).

And is it possible to "fail" the exam? Then what?

It seems like a somewhat antiquated requirement to me. I guess its nice to know that your fiancee or wife has no major health issues but ...

In lots of countries diseases we have conquered here (TB is a good example) are very prevelent. The US does not wanted any untreated carriers of these diseases immigrating to the US. It is one reason YOU do not need to worry about TB, polio, smallpox, etc. Yes, it is required for all immigrants (legal immigrants)

It is possible to fail or be delayed if you have communicable and/or untreated diseases. They do not care anout cancer, heart disease, diabetes, or other non-communicable disease.

And I just noticed the "anitquated" comment. It may be antiquaited HERE because of these kinds of rules, but let me assure you, there are many places which have problems with diseases we don't even think about any more. TB is not at all uncommon in Ukraine, for example.

Thank you for your reply. Very good point about my antiquated comment.

Thank you for your responses. I thought that was correct, but with so much run around I have started to question everything. Is the answer the same for the affidavit of support? The example form here shows the current finacee´s name under having filed a petition.

The I-134, Question 10 states "I have submitted a visa petition on behalf of the following person". So you would list the beneficiary on the visa petition you filed.

I am applying for K-1 visa for my Brazilian fiancee . My income for the past 3 years is approximately 150k dollars. I have earned much more than the requirement this year ,to date approx 85k dollars. I have the letter from my empoyer stating my salary of 160k annually and that I am full time employee. Also the previous 3 years tax returns show the same . I estimate the interview to be approximately mid November. I would like to travel to Brazil mid-September and remain until the visa is granted . Will I encounter problems at the interview since I would have no current income or pay stubs. If anyone has experience with this problem please advise. Timatayo

If you are a full time employee, how is it that you have no current income?

Something doesn't sound right.

He's saying he will have no recent pay stubs as he will be abroad from mid-September to the interview in November.

I don't think it will be a problem at all.

The I-134 is required when the beneficiary attends the interview at the foreign consulate. The I-864 is required when you file for adjustment of status after marriage.

1. I will in no way be able to do the affidavit of support, I am depending on a family member or friend to do so. I work in Peru and my income is not "verifiable" nor is it substantial enough if it were.

US Embassy and Consulate DiscussionQuestions about I 134

Hello!

My fiance and I are filling out form I-134 and we have two questions:

on part 7, "I own real estate valued at" Do we still need to fill this out even if mortgage is more than the house is worth and on the process of selling the house?

and

on part 9 "I have previously submitted affidavit of support for the following person(s)"
He submitted and affidavit of support 8 yrs ago for a previous marriage. Will this affect our application in any way? Does the income requirement increase because technically it is for two people ( I think I read somewhere that he is still resposible for ex-wife). And ex-wife now has a stable job and supports herself?

Thanks!

If the petitioner's income meets the guidelines you do not need to complete any information at all regarding bank accounts, home values or any other assets.

US Citizenship General DiscussionInterview Locations in Michigan?
We have not yet applied for naturalization but I was wondering about interview locations in Michigan.

We live in West Michigan and there is an USCIS office in Grand Rapids that we went to for our AOS & ROC biometrics appointments. For the AOS interview, we had to go to the office in Detroit.

Do they conduct the natutalization interviews in GR or will we have to go to Detroit for that?

Where did you get those? And would the DOS accept a certified copy of your naturalization certificate for your first passport application?

In Michigan all certified copies are obtained through the county government of where the "event" took place (birth, marrigae, death, etc.). I think I ordered certified copies of our daughter's birth certificates through their web site. I did a quick gooogle search and it looks like WI counties offer the same thing

Haven't been through naturalization yet - don't know the answer to your second question.

US Citizenship General DiscussionMarriage certifcate lost

Our register of deeds use to do that, bring in any document and a dollar, she would copy and file it, if you ever lost it. If lost, she would make a copy from her file, stamp it with her seal and sign it, was suppose to be just as good as the original. Did take in my wife's and stepdaughter's foreign birth certificates in after so many years. They don't do that anymore and haven't done this for years I was told. This would be a certified copy.

This led to a net search on this subject, from what I found, certified copies no longer exist in this country. Can you find such a thing as a certified copy? And one that is acceptable to agencies like the DOS? All government agencies we dealt with, want to see the original. But this is just experience, not fact.

I have certified copies of our marriage license, my birth certificate and our daughter's birth certificate. Yes they are accepted just as if they were an original. They are a certified copy of the original. What happens if you lose an original? Of course there has to be another acceptable substitute.

US Citizenship General DiscussionMarriage certifcate lost

Certified copies are history in the state of Wisconsin, and any copy of a marriage certificate can carry a $10,000 fine with it. Took no gamble and sent in an original, plus brought in another original in for the interview that had to be shown. Not only that, but our divorce papers, original from our previous marriages.

What does "Certified copies are history in the state of Wisconsin, and any copy of a marriage certificate can carry a $10,000 fine with it" mean? You can be fined $10,000 for what?

And how do you have more than one original? In most states, a certifeid copy is exactly the same (legally) as the original. Seems strange that WI would not have a process for issuing a certified copy of a marriage license or a birth certificate or a death certificate.

US Citizenship General DiscussionN-400 July 2013 Filers

Well... after being the first in line we may be the last ones to get to an oath ceremony.  The interview was supposed to be today in Detroit but with all the snow and extreme cold it was not worth the drive (3 hours one way with clear roads).  I was not going to risk driving my wife and 2 year old in such bad conditions.  The Detroit office was actually closed yesterday and I was hoping it would be closed again today.  Who knows, we could have drove all that way and not known that they decided to close again today after we left home.

No biggie...Its not like we are waiting for a visa.  I assume it will be at least 60 days before we get a rescheduled date (we have to mail the original appointment notice and a letter of explanation to the Detroit office).

Stay tuned...

US Citizenship General DiscussionN-400 July 2013 Filers

Finally received our interview date: 1/7/2014.

Can someone please update our status?  I haven't followed this thread much lately and I'm  not sure some lines are now in red.

Thanks!

I now see that it says 5 months processing times for the Detroit office for N-400.  So I'm not sure why they say to call if no scheduling notice received in 90 days.

I'll be so happy when we're done with the USCIS!

You can be in line for more than 90 days too. It depends on your local office and the their current speed. The 90 days does not apply to the inline status. For example Miami is currently processing close to 2 1/2 months behind. So I could be inline for 75 days before it goes to schedule. NY city is even way behind than Miami.

So it all depends on your local office backlog.

Thank you for your reply.

So why do they tell you to call if you are past 90 days?  (The 90 days apparently does apply to in line status)

"On July 29, 2013, your N400, APPLICATION FOR NATURALIZATION was placed in line for interview scheduling. When scheduling is complete, you will receive a notice with a time and place for your interview. If you have not received the notice within 90 days of the date above, please call customer service at 1-800-375-5283 for further assistance".

It seems like who ever receives your call could look up you case and tell you the status.  We were one of the first of the July filers to get placed in line.

So we are past 90 days since being placed in line for the interview.  As suggested when you check your case status online I called the 800 number to report that we are over due.

The first guy we talked to put us on hold a couple of times and then said he needed to transfer us to an immigration agent.  The recording said the estimated wait tme was 87 minutes!  There was an option to leave a call back number which we did but they did not call back.

Is anyone else past the 90 days in line without an interview date?  What else can we do?  Thanks in advance.
