I don't have my wife on Credit Card accounts. As an immigrant, she would not qualify for my high credit since she has none.


I've never heard of not being able to add another user (such as a spouse) to your credit card. My wife had no assets when she came here and obviously no credit. She has been added to several of our credit card accounts.

Is the I-797 the same as NOA1? I can't remember from 2 years ago. We got our I-797 on Saturday


All notices from USCIS are on Form I-797c. The first notices you received for the original petition filing, AOS and now ROC are all receipt notices referred to as NOA1 on VisaJourney (but the terms NOA1, NOA2 have no official meaning).

Hello and thanks in advance for any replies. I have searched this topic and did find much good information but I just want to ask questions very specific to our situation.

We have applied for a K-1 visa. So I underdstand that the whole purpose of the visa is for my fiancee to come to the US to get married. But of course we would also like a "wedding" in the Philippines too. This "wedding" would be after the visa is issued and immediately before we travelled to the US.

We are Catholic. Is it possible to have a non-legal religious ceremony in the Philippines? Is there any danger in doing this? Would/could a priest perform a marriage that was not legally binding?

We believe the waiting time for an appointment date is approximately three (3) to five (5) months from the date the case is “documentarily qualified.” As soon as an appointment date does become available, NVC will forward the case to Embassy Manila. NVC will also send the petitioner and/or the authorized agent/representative an appointment package.

I don't believe it takes 3-5 months to schedule the interview after the NOA2 does it??

I also am not clear of when the interview date is given. Does the beneficiary submit all forms and documents (Birth cert, CENOMAR, DS-156, DS-156K, DS-157, I-134) to the embassy before the interview? And then an interview date is given? And additional documents, such as proof of ongoing relationship are brought to the appointment only?

My case status still stands at saying that a RFE was sent back in February. We were approved in May and my fiancee has been here sicne July 4th. For some, it just never gets updated. Nothing to be concerned about.

Receipt number is NOT your case number. Your receipt Number is shown on your NOA1. Your Case number will be on your letter from the NVC after you are approved.

The longest documented cases here on VJ of being stuck in AP for K-1 visas is about 50 days. Just keep calling the NVC every week to find out when your case has actually been sent on.

To answer the OP's question, no there is probably no recourse. The longest documented stay in AP here on VJ is 52 days. Jsut keep callng the NVC and keep the faith.

Even if you do get stuck in AP for 50 days you are way ahead of most people.

When you call Tuesday, don't ask if its in AP, ask if its been sent on to the consulate (think popsitive) good.gif

Very unlikely that they would call you - in fact most people get no notice at all when they are finally reseased from AP. You just have to keep calling.

Yes, strangly enough, the approval notices from the USCIS are not even consistent. Some say the case has been sent to the NVC and some say it was sent to the foreign consulate (which is false - all approved applications go to the NVC first).

More power to you for contacting your representatives. Maybe if enough do that the USCIS & NVC can revise their wording on approval notices and actually contact petitioners when the case has been sent on.

I apologized if I upset her by calling, but I just wanted to know why I was having o wait while others were being sent to our consulate almost every day. No, even though they promise every time you call, I have never heard of anyone being notified in any manner that their case has been sent on. The only way to know is to keep calling.

Yes, everyone in AP has received the approval notice from USCIS and the NVC letter saying their case will soon be sent on to the foreign consulate.

It really is too bad that they can't inform you that you are in AP and its ridiculous that they tell you every time you call that you will be notified when you are released when in fact no notice is ever given.

Yes, everyone gets that letter saying that your case will be sent on soon whether you're in AP or not.

I know its incredibly frustrating but it seems like such a distant memory to me now ... Just hang in there and call the NVC at least once a week. The longest documented stays in AP here on VJ are about 50 days (me included). It will all be worth it in the end. good.gif

I have never heard of anyone getting a notification from the NVC that they are out of AP (even though they promise it every time you call). You must keep calling to know you are out.

I was promised every time I called the NVC (about 20 times over 50 days) that I would be notified when my case was sent on to the consulate. Of course I never received any notification. You must call to find out when your case has moved on.

Well, I just wanted to update folks of some good news....
we finally had our embassy interview, and we PASSED!!! My fiancee Thanti had a straightforward interview, after all the hassle we had at NVC and then getting Packet 3/4 at the embassy in Bangkok. She'll pick up her passport with the K-1 visa on Wed, board a flight on Thursday night, arrive in Chicago on Friday morning, and be here with me in time for fireworks on the 4th of July on Saturday. So, things do have a way of working out well in the end if you're patient. Need lots and lots of patience.

Just to follow up, we were approved on Tuesday and picked up the visa today (Thursday). They did not ask for any evidence of relationship at all since I was there.

The time spent at the NVC seems like a distant memory now ...
