Ok, the NVC has *finally* gotten my case and assigned a case # (MNLxxxx). I have a few questions on the next steps for a K1 in the Philippines.

hello, your fiancee will have to wait for a letter from the US Embassy informing her that she can now ask for a sked interview and medical exams , would take about 3 weeks , since she is in Leyte maybe more, I am not sure .



You do NOT have to wait for the letter from the embassy. Once you know that your file has left the NVC you can begin calling the embassy to ask when you can schedule the interview. Then the easiest way is for the USC to call the number to obtain the PIN and schedule the interview. My fiancee never received the letter from the embassy because we had scheduled our interview before it was even sent out.

Did you do the quit claim deed to you and your wife as joint tenants? I can see the use of this for removing conditions but wonder if it is needed legally (meaning if you died, your assets would pass to your wife anyway or via a will). I was thinking about doing this too.

My husband (the USC) and I bought a house together a few months after AOS, so we're including evidence of joint home ownership with our ROC package. This is the first home that either of us has purchased. We have a thick package of papers that we went through and signed when we bought the house, but I don't think any one of them is the deed.

Can we send in some of the papers from that package that have both of our names on them, or do we need to go to the city clerk's office and get an official paper that is the deed? Join home ownership is the strongest piece of evidence showing co-mingling of assets, so I want to get this one right.

Regardless of filing for removal of conditions, you should have a copy of your deed. The original should have been sent to the city or county clerk's office for recording and then the original should have been sent back to you for safe keeping.

Well, most of the members will say "it is optional" which is, but I included the letters for the peace of mind and had the letters notarized. I think it is up to you..


So you had the people who wrote your affadavits go to a Notary Public and sign them there? :wow: Affidavits are optional but notarization is completely unnecessary and won't help your case. I just don't want others to bother with that or think its necessary.

1. I can't find anything on the form that says how much it is? Are there two checks to send again? One for the fee and one for biometrics?


You must not have a copy of the instructions as it is very clear and easy to find. I suggest you Google "I-751 instructions" and download and print them. They also list what is required as evidence which would answer some of your other questions.

You did not get a denial, you got an RFE. You did not go to an interview, you went to a biometrics appointment.

Stop now and read the guides here and the instructions before answering the RFE because that will be very important. If you are not capable of understanding this, then I suggest you pay someone who does.

Children are not a requirement in any way. That is a suggested type of evidence. Read, study, or get help.

Getting a permanent green card is a two stage process if you are newly married. For marriages less than 2 years old when the AOS application is approved you get a 2 year conditional green card. The condition is that after 2 years you need to re-apply for a permanent green card by submitting an I-751 application verifying your marriage is/was valid and not entered into for immigration purposes. The I-751 requests a lot more details about your married life, but in many cases the application is approved based solely on the documents presented and no interview is needed. Your current green card will expire 2 years after the date it was issued. You need to have filed the I-751 within the 90 day window before the green card expiry date. It is important that you file BEFORE the green card expires as filing late can lead to your application being denied due to late filling.

When the I-751 is approved you will be an unconditional permanent resident and receive a green card that is valid for 10 years. You will have to renew the green card in 10 years if you don't become a citizen, but your permanent resident status is permanent. It doesn't expire in 10 years - only the card :) .

Unfortunately, yes there is another fee to be paid - the application fee and the biometrics fee - and you will have to do biometrics once again. You can download the forms and instructions from the USCIS website and you will get the most up to date forms and information: http://www.uscis.gov

Joint bank account has nothing to do with how much money you have. Does your wife have her own account? If not, how does she access cash if not a joint owner of your account?

Did you forget to include a copy of marriage license? Add eachother to your bank accounts then have the bank print out a statment there show bother of your names. Have friends and family write affidavits to attest your relation ship with one another. Do you have pictures of you guys together with your family together. Do you have pictures from your guys's wedding? Have your spous's name added to all the utilities.


Copy of marriage license would normlly be sent for AOS not ROC.

That is just crazy!! Why would a lender need to see any of those (other than a picture ID)?? We refinanced in July and they only asked for ID.

You can send it anytime beginning 90 days before your green card expires. No need to sent it exaclty 90 days before. Some people do things last minute; shouldn't surprise you.

I know this is an old thread and all, but I have just received my green card and been wondering whether to take it with me everywhere or leave it inside our apartment and keep a copy in my wallet. Based on what I've read in this thread, I think I'm going to keep my green card in a safe place, even though I'm legally required to have it with me at all times. The $450 replacement cost made the decision very easy to make! :yes: Plus, this is San Francisco. It doesn't seem to be a place where immigrants are pulled over on the street and asked for proof of legal status.

I like your attitude and wish more people here on VJ would follow the law by the letter. I used to carry my Green Card with me "at all times" as the law requires. When going to the beach I had it dangling on a chain around my neck and that really got me the looks from the Hispanic community, like showing off. I didn't care. More complicated was wearing it in the shower, but again I had it dangling around my neck, but that was nothing compared to having sex. Here the card was smashing in my wife's face when I was on top, but the other place to put it would really be in the only body cavity I could use when not talking or moaning, but hat would make some kind of sex impossible or rather painful. So, again, I'm glad you have found a solution to carry the Green Card "at all times." Have you ever had surgery with the card dangling around your neck, by the way?

the process can sometimes but not always take 90days they just want o have the space to do the removal before your CR expires. hopefully you will here something before the 30days is up but if you dont I would call the USCIS and ask them for and extension. my friend got her permanent resident approval 40 days after she sent her petition.

To the original poster, filing anytime during the 90 days preceding expiration of the green card is fine. The only "issue" is that you will get your new green card later.

The process takes much longer than 90 days for most. Your receipt notice extends your green card for one year. Its not necessary to actually receive your new green card before the old one expires. (And no need to ask for an extension(?)).

Hi Everyone! :dance:

Can't believe it's been almost 2 years since I've filed for AOS. Now it is time to file ROC for hubby! But as I'm organizing everything, I have a few questions in regards to the Affidavits from friends and family.

Do the Affidavits need to be notarized? I see many people get it notarized but is it really necessary? If it is then I will ask they get their affidavit notarized although everyone I will request to submit for us is pretty busy with work. If it is not necessary is a little sworn statement at the end of the Affidavit enough? Please let me know. :)

I am hoping to submit at least 2 Affidavits from our 2 best friends and 1 from my mother. I think this should suffice.

When I say longer than usual / expected, I meant if you still has not receive any decision for longer than PROMISED 6 months beginning the day where you initially sent in your 751, then you qualify for the list.

Yes, there's no reason not to but many people seem to think you must file exactly 90 days before your card expires. Your status is automatically extended for one year anyhow.
