Hello everybody!

Last week my NOA2 got approved; I am so happy about it!
Now I have a question concerning the further procedure. From what I understand I will be contacted by the embassy in Frankfurt when they received my documents.

How will Frankfurt contact me? Via regular mail?

I saw that some of you know when the NVC received and sent your documents. How did you get this information? Did you call them? Do I have to take any action concerning the NVC?

You didn't file a "NOA2" so a NOA2 can't be "approved". Your Petition got approved. NOA2 just means second notice from USCIS which could have been an RFE.

Yes, of course. When you call the NVC to ask if your case has been sent on they will tell you the status.

By the way, our Approval Notice also said it was being sent to the consulate. Many seem to now. Its no indication of any problem just an erroneous statement by the USCIS.

The NVC is only a mail stop for K visas, the NVC will receive the file and only do the following 2 things:

  • Assign a case number
  • Send it to the appropriate Embassy or Consulate

The case number you received was likely from the NVC, not USCIS.

Despite what your notice says, USCIS never sends anything to a Embassy or Consulate directly.


Yes, usually only a quick stop but some cases are pulled for "additional Processing" which can delay the forwarding to the consulate by seversl weeks (in our case it was delayed 50 days).

You are confused too. A NOA2 does not "get approved". Petitions get approved. "NOA2" is a term invented here on VJ ans has no official meaning. It just means second notice (From I-797c)which could be an RFE or an approval notice. You will receive many more I-797c forms as you continue through AOS and ROC.

AP happens at the NVC stage, not at the USCIS. They are not in AP. They have already received their NOA2 (second notice) it was their RFE.

Usually, your Approval Notice (assuming the RFE was answered appropriately)would be issued within a couple of weeks. Good luck to the OP.

NOA2 could be an RFE - it just means second notice. One more example of why NOA1, NOA2, etc. should not be used and Receipt Notice, Approval Notice or RFE Notice should be used.

You have to receive the hard copy of the RFE. After that you will know what the USCIS is requested. As soon as you get the mail, you have to respond to get a quick review from the USCIS. Most of the time NOA-2 comes between 2-4 weeks of the RFE review.

Actually, in this case, the RFE was their "NOA2" which just means second notice (Form I-797 C). But yes, the Approval Notice should arrive a couple of weeks after the RFE is answered satisfactorily.

Reallly? For Manila? I have never heard of this being an issue for Manila. Maybe things have changed. Its funny, I attended my then fiancee's interview and they did not ask for or look at any of our evidence of an ongoing relationship. I guess we just looked like we were made for each other. :D

Don't even think about leaving the US not even Hawaii or puerto Rico! That was the first thing the immigration officer told me and my husband when I got here to the US. he said you can wait until you have your residency or your AP it won't be as long as it would be to be denied entry and start all over again. I got my green card in 3 months. The wait is not that long and is not worth the risk.

Hi, can anyone relate to my status? I received my approval notice on June 27th,saying that my petition had been forwarded to NVC, So,I emailed NVC on July 20 just to check the status. They sent me a reply saying that there is no any record of my application in the system. So, they asked me to send a copy of the approval letter. Does anyone else have the same experience?



You should call the NVC to verify when your petition has beedn sent on to your consulate.

The terms "NOA1", "NOA2", etc. have no officlal meaning and really should not be used on VisaJourney as evidenced by your question.

NOA means notice of action (all issued on USCIS Form I-797c). The first notice you receive is the receipt notice for your petition submission and payment. I don't think it really matters if you lose it.

The second notice you receive is an RFE or an Approval Notice. People always refer to NOA2 as an approval notice but that's not always the case. My approval was the third notice I received because I also had an RFE.

You will receive many more "NOAs" as you proceed through AOS and removal of conditions. There's no need ot refer to them by number. Just refer to them as receipt notices, approval notices, requests for evidence or whatever they actually are.

American fiances are usually allowed into the actual interview in Manila. I attended my fiancee's interview and it was a breeze. They did not ask for any proof of relationship at all - but of course be prepared.

You can leave .. you just can't get back in. You will need the greencard or advanced parole to re-enter the country.

There is no need to have any document notarized in the normal K-1 process. I think the old form I-134 had a place for a notarization but the new form does not. A notarization does not "help" your case in any way so don't bother with it.

So me and my fiance are almost 2 months in after getting our NOA1 hardcopy. Recently ive been thinking about the interview alot (even though its far away) and someone told me that the beneficiary and the petioner BOTH have to be at the interview. I was told that the beneficiary has an intervew in the room with the interviewer alone and then the petitioner has an interview or will be asked questions by the same interviewer while the beneficiary is waiting in another room. the reason for this is to compare answers from the beneficiary and petitioner to make sure its not a sham marriage.

No, the petitioner is not interviewed separately and no, its not required that the petitioner attend the interview. It is always a good to attend if you can. Depending on what consulate you are going through, it could greatly help your chances if both attend the interview.

there could be many reasons why one is denied

the NOA1 is not is not an approval - it simply means that USCIS has recieved your petition and will begin adjudicating
once your I129-F is approved then you will recieve an NOA2
but even with the NOA2 that is no guarantee to recieve the visa
you could still be denied during the interview process
nothing is guaranteed until the visa is in hand and there are still more processes to go through stateside

Yes it is random and nothing to worry about (except the delay). We were "stuck" at the NVC 50 days. Just keep calling once or twice a week to know when your case has actually been sent on. They always said I would be notified when my case was sent on but they never did.

The USCIS may only be concerned with 3 years but the IRS will want tax returns for all years you had a filing obligation but neglected to file - No statute of limitations on that.

I notarized my entire K-1 package - but I had access to a notary public (no fee) - but it wasn't required - but so far - my case has been running smooth and on time.


How do you notarize an entire package of papers?? A notary public authenticates the execution of a document (verifies that you signed it). Did you sign every page of your petition package and then get every signature notarized?
