Just keep calling the NVC every few days until you are told that your case has been sent on. We were stuck at the NVC 50 days. Everytime I called they told me they would inform me when my case had been sent on but they never did. Just keep calling and good luck.

Actually, they already received their "NOA2" (it was the RFE). NOA2 means second notice, not approval notice. Instead of NOA1, and NOA2 just say receipt notice, RFE or approval notice - it would end a lot of confusion.

H&R Block does not provide tax transcripts (the IRS does). The copies of the returns prepared by H&R Block are fine of course.

Typically the only thing that needs to be notarized is just the I-134.


The I-134 no longer needs to be notarized (there in so place on the form for it). The old form which expired 4/30/07 did have to be notarized.

What exactly has to be notarized?? Your signature on your US tax return? Most aren't signed at all these days as they are e-filed. And yes, the actual I-134 no longer needs to be notarized so I'm confused.

So you are saying that you have unreported income on prior tax returns? Yes, that's a problem. Any reported income must be verified by a tax return. Unless you can show the minimum required amount of income as reported on a tax return you wouldn't qualify (unless you had a co-sponsor).

I received the hard copy of our RFE today. Its a simple request that I can mail back tomorrow.

They provided an envelope with a different PO Box number than where my K-1 petition was sent (and the envelope says "ATTN: RFE").

My question is whether I should send it certified mail, return receipt requested.
The last thing I want is to mail it back and have it get lost obvioulsy.

I guess I answered my own question - But any comments would be appreciated.

My question is, should I even complete the lines that ask for amount I have on deposit in savings banks, value of personal property and real estate value and mortgage amount? There have been many posts recently in the Philippines forum about interview experiences at the Manila embassy. (Actually, this thread should probably be moved there). They have all seemed very favorable and there were comments about how nice the COs were. The fact that you are in the US service should not be a detriment at the US embassy now should it?? Your fiancee will be interviewed by an American not a Filipino.

The amount of money your fiancee has will have no bearing at all on your approval.

Call the NVC at (603) 334-0700. They will ask for your Receipt Number (show on NOA1 & NOA2) and both of your birth dates. They will tell you when it was received at NVC and when it has been sent on to your consulate.

Yes, they will send a snail mail but by calling you will find out sooner

Just keep calling - It has taken me only abut 5 minutes to get through. Yes, the WAC number is the receipt number.

If you have an MNL #, that means your paperwork has been sent through the NVC to Manila. You can call the Department of State to see where you're at in the process... 202.663.1225 (press 1, 0). You will need your MNL case number in order to find out any information. Best of luck to you!


Having your case number does not mean it has been sent on yet (even when you get a letter from the NVC stating they will send it on within one week). Many people recently are getting hung up at the NVC for "additional processing". You should call the NVC at (603) 334-0700 to find out if the case has actually been sent on to the the foreign consulate.

Gross receipts per your Sch C is not the same as income. There is also a differnce between your business deductions on Sch C and your standard or itemized deductions. The standard deduction is not reflected on line 22. Its after your adjusted gross income, on line 40.

I'm no tax attorney, but I think deductions presume expenses are being paid, and the money spent is not going to be taxed. The presumption is that what's left after deductions is what you have available to support yourself and your spouse, which is your adjusted gross income.

Will you be penalized? No, you're getting a tax break for your deductions. Will the consulate hold it against you if those tax breaks mean your AGI is too low to support your fiancee? I would think the answer is yes.


The bolded sentence is incorrect. Adjusted gross income is before you take the standard or itemized deductions. They do not care about how many deductions you have. They look at your income. To the original OP, you won't get penalized for taking deductions but the problem is your income comes from Schedule C. Gross income is not the same as taxable income. They have to look at your net income after your business deductions on Schedule C. And then later, you take the standard deduction or itemized deductions to deduct your home mortgage interest and property taxes, etc.

What's left after deductions is not "what you have available to support yourself and your spouse". The amount before deductions is what you have available for support. After all, paying your mortgage is part of supporting yourself.

Gross receipts per your Sch C is not the same as income. There is also a differnce between your business deductions on Sch C and your standard or itemized deductions. The standard deduction is not reflected on line 22. Its after your adjusted gross income, on line 40.

In my experience, both my NOA-1 and NOA-2 arrived via regular mail and I did not have to sign for anything. One day after my APPROVED NOA-2 arrived I also received a letter from The National Visa Center (NVC) that they received my package and had forwarded it to the appropriate Embassy (Moscow in my case). The NVC will notify you of a DHL number that will be used to track the package from the Embassy to your fiances doorstep.
It took approximately 6 months from getting the NOA-1 till the NOA-2. Once you get the NOA-2, be warned that things move ALOT faster. Time from NOA-2 to having a scheduled interview date at the embassy was 4 days!! So be prepared for WARP speed once you get notice of approval.
