PhilippinesMet only once , is this a red flag?

I would agree with the "zero issue" sentiment.  Although I did attend my then fiancees interview, they did not ask for ANY proof of an ongoing relationship (only one prior in person meeting).  Of course we had a lot with us and everyone should, but one meeting in itself is not an issue and doesn't mean more scrutiny.

Philippines1040 vs IRS Transcripts
Tahoma gives great advice (as always).

It seems incredible to me that transcripts (alone) would not be enough. (But I too read the VJ post where a 1040 was requested). A transcript, issued by the IRS is an exact summary of what was filed with the IRS. Why would a paper copy of the 1040 be of any use? Most people efile and don't ever sign a tax return or really need to even have a paper copy of their tax return. (I haven't filed a paper return in at least 10 years). I can produce a paper 1040 that says anyhting I want. The transcript is what was actually filed with the IRS.

Just makes no sense to me.

PhilippinesSome Useful Links

thanks. we had a guide in the past, but it would be time consuming for any member to do something similar for the process at the present time. perhaps a thread where members could post links to useful information would be helpful to those going thru the process in this forum.

Yes that guide is now way out of date.

How do we get this pinned at the top of this forum?

Thanks for your work.

PhilippinesPhilippine Travel Tax - Pay every time you leave?

My wife (then fiancee) paid the travel tax when she left the Philippines for the USA the first time in 2009.  She didn't think she paid it when she left after visiting in 2010.

She is there now and is returning to the US in 10 days.  She is still a citizen of the Philippines (US green card holder).  Will she have to pay the travel tax when she returns?

Hi All,

I just received an RFE from CSC yesterday (3/19/09) dated March 14th. Basically, I was given a Supplemental Form for 129f where I am being asked whether I met my fiancee through a marriage broker and questions about any past criminal conviction. I have answered them when I submitted my petition, so I m not quite sure why they want me to answer the same questions once again. Anyway, they are just simple check one of the boxes kind of questions, so it's not complicated. I sent the reply to the RFE this morning (3/20/09) and according to the Post Office they should receive it within 2 days.

Has anybody been given the same type of RFE and how long did it take for CSC to approve the petition after they receive the required document? Since mine is not at tall complicated, I don't see why my case would be delayed further so I'm hoping to receive the approval soon.

I'm really hoping they won't take too long. I can't help to get so anxious. C'mon CSC!!! hehe

I didn't receive the same RFE but it was also something very simple. I returned the RFE on March 4. I was approved on the 13th and we received the hard copy yesterday (20th). Hopefully you will be approved soon. For some reason, I got no email notification of the approval - would have been one less week of worrying! Good luck.

Yes, if your case status says that you were approved then you were approved. Give the NOA2 a bit more time. You will want to call if it doesn't come in say another week or so as you will need it for AOS.

thanks Kimandruss.im just worried coz our harcopy on NOA2 was not coming yet.do u know where can i checked if they forward it now on NVC.do they send the NOA2 hardcopy to my fiancee in america or here in the philippines or do they send it to both of us.thanks

The NOA2 hardcopy is mailed to the USC only. You can call the NCV to find out when your file is sent on to the consulate (sorry - I don't have the phone number handy).

K-1 Fiance(e) Visa Case Filing and Progress ReportsReceived NOA2!! But I have an important question
Thanks for the reply.

Apparently, some Notices state: ""We have sent the original visa petition to the Department of State National Visa Center ......... NVC will then send the petition to the U.S. Embassy or Consulate where your fiance (e) will be interviewed ......."

Don't know why some are worded differently. I suppose its just another mystery of the USCIS that no one can understand wink.gif

K-1 Fiance(e) Visa Case Filing and Progress ReportsReceived NOA2!! But I have an important question
First and foremost, I am elated that our petition was approved! A couple of odd things though:

I am signed up for email alerts and I checked for touches online. I had touches and an email notification for an RFE a few weeks ago. But the approval notice arrived in the mail today with no change to the status online and no email alert.

Also, the notice (I-797) states "The above petition has been approved and forwarded to the listed consulate". There is no consulate listed on the Notice so I assume it refers to the consulate listed on my petition (Manila).

The notice does not state that the petition was sent to the National Visa Center (NVC).

Can others who have recently received their NOA2 check to see if the wording on their Notice mentions that the petition was sent to the NVC? Thanks.

QUOTE (bobb @ Apr 16 2009, 09:08 PM) <{POST_SNAPBACK}>
Received my email notification of NOA2 from CSC on 4/03.
Call automated number for NVC and no record of it being received yet - 9 business days.
I entered my WAC # on the I-797 NOA2 notice I received in the mail in the automated setup.

Do I have to wait for the 4 weeks until I call to speak to a warm body? Seems to me most people are showing much shorter times from Service Center to NVC.

You need to speak to a person at NVC. They probably already have it and will tell you if it has been sent on to the foreign consulate yet. The automated system does not work for K visas.

Thanks Chris

Its happening more and more that there is a delay at the NVC. You should call them once or twice a week. Are you saying that your case is not yet recieved by the NVC or not yet released by the NVC?

You should join this thread of others waiting at the NVC.

This is our first post in this thread but wanted to mention that we received our NOA2 hardcopy yesterday (no change to status online or email although we did receive an email notice for the prior RFE).

We were approved in 98 days - probably would have been 83 days if no RFE!

Good luck to all of those still waiting.

It would really help us still waiting to know what your RFE was for? If you wouldn't mind sharing?

Congratulations on your approval! That was still really quick even with RFE!!!!

Thanks for the congrats. RFE was for failing to include an IMBRA waiver for filing limitations. Won't affect many here.

Ok, seriously what is with the hostility??? Wow, you have to wait a few extra months. Not as bad as a lot of people in this situation. The USCIS sucks but it's life and you chose this path so deal. Until last year, there were lots of people stuck in FBI name checks for their green card waiting for years. In many countries people are stuck in AP for months to years.

Try looking on the bright side. You found someone you love and wants to marry you. Lots of people the world over don't ever find that. Ya, you guys have more hoops to jump through but at the end a few months WON'T matter (trust me, I've been where you have been). When your fiance gets here and you are married you will be a part of a whole other culture. Your kids will have dual citizenship and a hole new world perspective. You have all these plusses, no need to focus on all the negatives.

I agree with you. I have no problem whatsoever following a process or waiting my turn in line, but I have no patience when the process is broken or does not treat everybody equally (like when people cut in line at the ballpark).

For example, if my name is stuck at the FBI (which I doubt) I want to know about it and I would not mind that others get approved faster. But keeping everybody in limbo land just for the fun of it, is messed up.

In a country in Europe (which I will not mention, but belongs to the original 15 of the Union) when you are doing immigration stuff they tell you (your SO) come back in two weeks and when you go back everything is ready. There is no this "lottery" game as in the USA. In fact, in that country you can bring your SO, live with him/her as long as you want without marrying, and s/he will never be deported as long as s/he lives with you. A common partner is as important as a legal partner.

Many times, applying for immigration benefits in the USA is like playing the lottery, and this is very frustrating, because there are real people involved. The lottery analogy comes to mind because very often we go to this or that website or call a call center to verify if "our number" is on the list of "winners."

So when did you file? What did you file for? timeline.gif

Well, we passed our interview on Tuesday in Manila. Apparently they value very highly the fact that I attended my fiancees interview as neither the pre-screener or the CO asked for any evidence of relationship. I had letters of intent and many emails, photos, etc. but they were not requested at all.

Strangely enough, the CO was from the city right next to where I live (Muskegon, MI; I live in Grand Haven).

Thanks to all here who helped us be 100% ready for our interview.

Hopefully we will return to the US together on July 4th. kicking.gif

To the OP: If you were not ready to wait six months for your approval (which the USCIS states is the normal processing time) then you shouldn't have submitted a petition. There is no "right" to a speedy immigration process. Yes, its not fun waiting, but it is what it is.

Trust me, after you are united with your loved one, the bad feelings will quickly fade. I was stuck at the NVC for 50 days just a few monts ago ... Simply a distant memory now.

All petitions must go through the NVC before going on to the foreign consulate. Our letter said that too but we in fact were held up at the NVC for 50 days.

You should call the NVC and ask if your package has been sent on to Manila yet.

K-1 Fiance(e) Visa Case Filing and Progress ReportsGot noa2 today

Words can't say how happy and blessed I feel. Today the USCIS website said the noa2 is approved and the letter will be coming in the mail.

I know its still along journey left to go but does anyone have any sugestions how long the wait might be from here? Will the medical exam and interview be coming up fairly soon now?

Wow I am stoked my heart goes out to all that are waiting :)

First off - congratulations!

Just want to point out that your "noa2" was not approved. The second notice of action you received was your petition approval. Your first notice of action was your receipt notice. In my case my "NOA2" was a RFE and my approval notice was actually my third notice of action.

I know this won't happen but it would be nice if we all dropped the "NOA1", "NOA2" terms all togther and just referered to receipt notices, approval notices or RFE's.

A NOA2 does not "get approved". Your Petition was approved. NOA2 means second notice from the USCIS which isn't necessarily an approval notice.

Congrats on your Approval Notice.

"NOA2"s don't get approved, petitions do ... But congrats on your approval notice anyhow.

K-1 Fiance(e) Visa Case Filing and Progress ReportsNoa2!!!

Got an email from my dad saying this came in the mail today

One part of this process over! On to NVC!!!!

Did you notice that nowhere on your I-797C does it say "NOA2"? Why do so many VJ members use that term??

Congrats on your APPROVAL NOTICE!

K-1 Fiance(e) Visa Case Filing and Progress ReportsNOA2 APPROVED

Today I checked the USCIS website and it says my NOA2 was approved on January 3rd. This has to be one of the happiest days in my life 110 days from NOA1. Vermont is really pushing out the applications now.

One thing I did not recieve a text or an email regarding the approval, is this normal??

It says they mailed out the approval notice. But I am confused why I did not recieve an email or text as I did with the NOA1?

NOA2's don't "get approved" - Petitions get approved. "NOA2" just means second notice (which could have been an RFE).

Congrats anyway!

K-1 Fiance(e) Visa Case Filing and Progress ReportsThe best Valentines gift !!!!
I assume you mean APPROVAL NOTICE (a second notice, i.e."NOA2" could be an RFE too).

Congrats!

K-1 Fiance(e) Visa Case Filing and Progress ReportsCan NVC stop the package from being forwarded to the Embassy?

Not every petition undergoes the additional steps that are being labelled as "AP" on this thread. There is some additional processing which happens at random. My petition experienced this, and it was in this state for about two and half weeks in December 2011. I went from being told it was ready to ship to the embassy to "extra processing" for those two and half weeks, and only then did I get the consistent answer of "on its way to the embassy" from NVC's phone help.

This is true. Every petition undergoes "processing" at the NVC but not all undergo "Additional or Administrative Processing" at the NVC.

We were delayed 50 days for AP. Just keeep calling as often as you choose to confirm that you are out of AP and that the petition has been sent on to your consulate. They say they will notify you when its sent on but in our case they did not.

I assume you meant RFE not RMF(?).

Assuming the RFE can be quickly resolved you are likely a few weeks from approval. I wouldn't be too upset.
