Personally, I think its better to send in a correct package rather than find out the hard way (via a RFE) that you overlooked something.

There's no substitute for reading the instrustions yourself and following them explicitly. Seriously, if you can't find who to make the check out to in the instructions, you are going to have a lot of problems on your journey.

Not true!! First of all, no visa has been issued - the petition has not even been approved yet. And there is no required 2 year waiting period between filing petitions. If you file a second petition within 2 years of a previoulsy approved petition (or file more that 2 in your lifetime) you need to request a waiver under IMBRA .

Once they have the necessary information, there's no need to add anything else. They simply want to know when and where you met in person.

If I don't report the back taxes, should I even report that I had a job back then?

Taxes are not an issue for you. The "statute of limitations" on personal taxes is 3 years and at no point will you be asked to produce tax returns for more than the past three years (usually one year is all you give copies of).

I doubt it would be necessary to list a teenage babysitting job on the G-325 but if you want to...go ahead. If you have no employement history extending back 5 years...oh well. I am sure it is the same with many young people who were recently students. Just go back 5 years and fill out the G-325 as truthfully as possible.


I don't believe the statute of limitations applies to non-filing of returns which might technically be fraud. You might not even owe taxes depending on how much you earned however.

You will not find it anywhere, it is the number that Vermont or California center gives you when they log in you files. Leave it blank


It is your Alien#, and everyone has one ... Your Green card or US citizenship certificate all contain this Alien#. Also the same Alien# you put the top of this form (G-325A), and this Alien# identify you or your fiance(e).


Everyone does not have one. A foreign beneficiary will know there's when they receive the approval notice (NOA2)

It would help if the original poster filled in their time line.

No, do not use all caps. I have seen on some forms where they want the surname in all caps only. It will be indicate on the form.

Answer all questions. If the question does not apply put "n/a". If the answer is none (such as prior spouses names) put none.

Of course you can use abbreviations for streets, etc. And yes you can add a supplement if there is not enough space. See the sample forms in the guides.

You will get no additional letter from the NVC saying that your case has actually been sent on to the foreign consulate, even though they promise that they will every you call to check on your case. You have to keep calling until they say its been sent on.

Guys, if you are in the U.S. you can get most of these forms in groups of five from the USCIS website. Theres a link there that says "forms by mail". The G-325'a come as a set of four pages with carbon paper between each sheet. Also you can be assured they are the right forms since they come straight from USCIS. There is no charge for any of these forms.

Just a little advice. Before this process is over, you will need LOTS of passport photos, like 12-15 (depending how many the medical clinic wants and the forms you file with AOS) so you may as well get some done now, correctly, and have them if you get an RFE. When we started this process we made about 15 or so photos (I forget exactly) and used the same ones from the petition to the AOS. There was ONE left when we got done.


We have a lot of extra photos that we could use for AOS but the forms say the pics must have been taken within 30 days of the filing. What are the chances that they would know (or care) that the pics are the same as submitted previously with either the I-129F of the visa application??

The NVC does not send out anything that confirms that your case has actually been sent on to the foreign consulate. Everyone gets a letter with their case number and a statement that it will be sent on within two weeks but that is not necessarily true. Some get stuck at NVC for "additional processing". They promised me every time I called to check status that they would notify me when it was sent on but they never did.

Our marriage certificate just shows my name as my maiden name and doesn't indicate in any way whether I am changing my name or not. But maybe that differs between states??

So I will have to wait until I have EAD/GC to change my last name on SSN, I can't do it earlier? I asked the people at the SS office when I applied for SSN in my maiden name and they said I first have to register my new name with immigration so that they can see the new name in the computer. All you have to do is put your new name on the AOS forms and go from there. There is nothing on you marriage paperwork that shows the name change at all, they always show the maiden name and are filed like that with the state. It may be different in some states but I highly doubt it. When you get your EAD go to Social Security office and change name, same with DMV.

Then, how does your name get legally changed at marriage?? Some people do not take their spouses name, some hyphenate using their old & new last names and most take their spouses last name. How does the State or whoever know what last name you have chosen?

It went to the NVC - no matter what the approval notice states, all visas go to the NVC first. You should call the NVC in a few days to confirm when it is actually sent on to Manila.

Well hopefully your case has been sent on to the consulate but that letter is no guarantee that it has. You need to call the NVC to confirm that it has been sent on. They send that letter to everyone - even those that get selected for "additional processing" which can cause a delay of several weeks.

So, I met with an attorney yesterday to begin and the attorney says me and my fiancee have to have known each other for two years before sending off the I-129 petition. If not, it will not get approved. I told the attorney that it was my understanding that we only have to have met once within two years of applying. The attorney says those statements are essentially the same, and that we have to have known each other for two years before even applying.

I checked the US Dept of State website (http://travel.state.gov/visa/immigrants/types/types_2994.html#Filing) for info on K1 visa, and with regards to a fiance(e) it says:

"In general, the two people must have met in person within the past two years."

Am I wrong or is the attorney incorrect? Do I have to know my fiancee for two years before even applying? I do not interpret this statement to mean we have to know each other for two years before applying. The operative word is "within". "Within two years" could mean I met her anytime between right now and two years ago and still apply for the K1.

I was blown away by the attorney's statement, as I have known my fiancee for less than two years. I thought I knew what was going on, but now I am a bit confused. If the attorney is indeed wrong, I wasted $100 on a consultation fee for bad advice, from an immigration attorney who should know.

Please let me know what is correct.

Just stating a fact. By the way, we had a beautiful wedding 2 weeks ago and couldn't be happier. Sorry you are so bitter.
