Again its not asking how you initially met or how long you have known each other, etc. One of the basic requirements for K-1 petition approval is that you must have met in person within 2 years of filing the petition. That is all this question is asking for. If you have been together in person more than once in the past 2 years pick the time for which you have the most evidence of meeting in person. You will attach documentation to support the in-person meeting you choose to meet this basic requirement.

(There may be a need for "front loading" in a very few consulates. This is a completely different issue than the basic meeting in person requirement).

At the interview, it is likely that they will then ask how you initially met and you will then also provide evidence to support a legitimate relationship.

We never provided any information regarding how we initially met. I think our CO asked during the interview how we met, we said online and I think we named the web site and that was it.

Don't provide more that what this question is asking for. It won't help your petition approval.

I think it'd be best to write about how you two met. Like did you meet him through a friend, or on a social networking website (Facebook, MySpace etc), how long you dated before you decided to get married etc. Basically talk about the circumstances regarding the first meeting and how you decided to be a couple etc.


None of this is being asked. Just the circumstances of meeting in person within 2 years of filing the petition should be briefly explained.

For example: I flew to the Philippines on XX date returning to the US on XX date. I spent my entire time in the Philippines in the company of my fiancee and her family. That's it - nothing more.

They DO NOT want to know how you first met. They want to know when/where you met in order to meet the requirement of having met in person within 2 years of filing the petition. Its not necessarily the first time you met (which could have been more than 2 years prior to fling).

They are also not asking how you met (through a friend, online, or whatever). No need to explain your love affair or anything more than the meeting you are using to meet the 2 year requirement.

The letter or intent does not have to be "orignal" in any way except for the signatures. The example letter here on VJ is just fine. And the color of the ink does not matter either!

Let me restate what I said "I suggest you use blue ink." I used black ink on my forms and with todays computer technology, they might have to look at it under a magnifying glass to make sure it is not a copy. I did use black ink on mine and my I-129F was accepted. I just suggest it is easier for the person that reviews your forms if it is in blue ink. I don't think there is any such requirement though.


They have color copiers today too. :whistle:

As stated, nothing requires notarization in the normal K-1 process..

Also, birth certificates, etc. would not be able to be notarized. (A certified copy is something entirely different). A notarization is a validation that you yourself signed some document but does not in any way guarantee that the document is authentic or accurate. Signatures get notarized not the document itself.

My fiancee' finally got her k-1 visa approved.
we are currently waiting for her passport and the visa to be delivered.
they said it will take 3 days at least.
but anyhow, we are going to LAX together.
What i want to know is can we actually line up together for immigration on citizen And PR line?
see, my fiancee's english is poor so i would feel more comfortable we can actually go through together.
And the form i-94, do i get that during the flight?
i am little lost here.

You will likely be able to go through the same line but you will have to ask which line to go through. There are always people there helping with the lines. We were told to both go through the visitors line.

They asked for my passport copy (since I wasn't able to provide when I first filed :bonk: ) Asked for letters from at least 2 witnesses of our relationship (my mom and her brother provided) and proof of relationship that we Physically met w/in the last 2years.. and yes, the proof I provided from my trip after I filed was just an addition. I mostly provided evidences from oct2009-oct2011. I've been with my fiance "physically" from oct2009-march2011. And our letters of intent (proof to marry) was already provided when I first filed.


Proof of relationship and proof of having met in person within 2 years of filing the petition are 2 different things. As JimVaPhuong said, they are likely not asking for proof of relationship.

You filed in October 2011. You visited in February of this year, correct? But, had you visited during the 2 years immediately preceding your filing in October? If not, you were not eligible to file and your petition will be denied.

Not true. Petitioner is always allowed into the embassy and ususlly allowed into the interview in Manila. I was with my fiancee every step of the interview process.

Wrong (again). The so-called "NOA1" is simply a receipt for your petition fee. Thay have not adjudicated anything yet. If the check is for the right amount, made out correctly and you signed your forms, they issue the receipt notice. They have no idea about your relationship yet.

They never did send us an notice. They said the would, but nothing ever came. The only way we knew, is that having been there almost 8 weeks, we were in the habit of ringing every other day. ONe fine night, they just told us we were out of AP and been sent on.


Ditto - even though they told us they would notify us they never did. After 50 days (and calling twice a week) we finally heard the magic words that our case had been sent on.

If you are in AP you should keep calling so that you know when you case has actually been sent on.

I am starting a new job next week that earns commissions on what I sell. She is saying that the commissions I would earn from working would not count toward the 125%. She said it needs to be a fixed income and commissions do not matter. Is this true? I find it hard to believe.

Any income is taxable income and would count toward determining if you meet the poverty guidelines.

No, it is not an official term. But on VJ, it makes it easier to separate it from an RFE or a denial. Calling an RFE the NOA2 would confuse people, so we don't. People go buy the guides and the guides call an approval the NOA2. It's really no big deal.

If you call the USCIS, please don't refer to a "NOA2" as its a made up term with no official meaning. What you need is your Approval Notice.

You will definitely need a hard copy of that.

Why is this the first i'm hearing of an Evolution of Relationship letter? I don't see in on the VJ guides. Is this just something you decided to do?


I had never heard of a evolution of relationship letter until a few months ago here on VJ. It was never mentioned when I went through the process a couple years ago. It may be important in a very few consulates but I don't think its required for most. Unless its mentioned in the instructions I would not include it.

I also want to point out aagain that in question 18 thtey are asking how you MET IN PERSON, not how you initially met (on-line or whatever). I think most are giving a lot of information that is not being asked or needed for this question.

Evidence of relationship is provided at the interview. There are a very few consulates where "front loading" of the petition package with evidence of relationship information is necesary.

No such thing as over kill. put "see attached" then on the paper put "I-129F question 18" at the top of the page. I used a couple of paragraphs to describe why I was visiting Kazakhstan, how we met and then how we are where we currently are as there was a 3 year span between meeting and corresponding via e-mail and then meeting again. I put as much detail as I could to show two people meeting, then "talking" to each other regularly via e-mail, meeting a couple more times and deciding to get married encluding the proposal. In our case we met four times before filing--2003, 2008, 2009, and 2010. I would paint a picture of two people who happened to meet and fall in love and decided to spent the rest of their lives together. Be specific, to the point, and try to keep it under a page--think of it as a resume as you want this person to feel that these two people belong together. It may not be a requirement for approval of the petition, but this file follows you throughout the process and someone reading it will see a truely ligitamate relationship and the rest of the process goes smoothly--at least that is what I believe and so far it has for us.

I've know it's fine to explain this on a separate sheet of paper, but am I supposed to write "see attached" in the box for question 18, or do I at least write "yes we have met within 2 years" then write "see attached". And most importantly, how long can this description be? I was thinking about typing up 2 or 3 paragraphs (maybe a little less than 1 page) trying to be as descriptive as possible and explain how we began talking and lead them up to the time I first flew to her country.
Does this sound about right? Overkill?


You don't need to explain how you began talking or how you originally met, just how, when and where you met in person. Keep it short & sweet. The question is only to meet the 2 year requirement of meeting in person prior to filing the petition, not to explain your love story.

A Form I-797c is a Notice of Action. It is not necessarily a "NOA1". NOA1, NOA2, etc. have no official meaning. Your first notice is usually just the receipt notice for the petition filing fee. Your second notice will be an RFE (request for evidence)or the approval notice. You will receive many more Forms I-797c as you proceed through adjustment of status and removing of conditions.

I don't have any problem with the USCIS ... yet. We were approved in 98 days and it would have been sooner if it was not for a RFE that was just my not reading the instructions thoroughly.

I do have a problem with the NVC however. My case was delayed 50 day because ... Who knows. Whatever "additional processing" is, it should not take anywhere near 50 days. And everytime I called them they verified my phone number and email... and of course they don't notify you when you case is finally sent on.

All in all, the process has worked OK so far. The interview and AOS still to come ...

As was stated, nothing needs to be notarized.

Maybe its different abroad, but in the US, a notarization means that a signature has been verified to have come from the person signing the document. The signing has to be done in front of a notary public. The notary does not certify the validity of the document signed whatsoever and it would not make sense to have a copy of a document notarized. Only a signature can be notarized.
