K-1 Fiance(e) Visa Process & ProceduresI864 HELP!
Hello, I am a frequent visitor of this site and it has helped me so much in my journey so far. Since I have not found the answer to a specific question, I have decided to finally create an account and ask it myself. Here is my current situation:

I brought my wife (fiance at the time) here on a K1 visa and we got married on 2-2-2013. We have no children or dependents. Now it is time to start filing for AOS. I am currently double checking, triple checking, and quadruple checking my i485 packet to make absolutely sure that everything is filled out correctly and I am having trouble understanding some questions in part 3 and part 5 of form i864(affidavit of support)

Part 3, question 10 states. "Enter the total number of immigrants you are sponsoring on this form from Part 3, Items 8 and 9." Then there are two boxes to fill out. My question is, do I enter a value for question 8 in the first box, and another value for question 9 in the next box?

What I have now is in the first box [1] (for my spouse)and in the second box [0] (for dependents) because as I understand it, it is asking two seperate questions. Is this right?

Then the same applies for me in part 5 question 21.h I put [1][1] as derived from 21.a [1][0] and 21.b [0][1]. The rest of the 21 questions were answered with zeros Will USCIS see this as me trying to sponsor 11 immigrants or was this filled out correctly?

My deadline to file is 3-9-2013. Any and all help is greatly appreciated

I&B: Thank you so much for this very informative post. It has been very helpful to me and my fiancé. He already contacted his representative yesterday (along with your analysis) and we've gotten a reply from them today. He's going to sign and send out the privacy/release form that has been given to him. We're an October 2012 filer, and is just right on the 5-month mark. We didn't seek help for our case to be expedited though, we simply asked them for an investigation -- an explanation from USCIS about these unfair delays. We know that there are a lot of people who filed before us and we made it a point to mention this in our letter. Again, thank you for your hard work on this file. :)

I got this notification few hours ago. "On May 28, 2013, your address was changed relating to the I129F, PETITION FOR FIANCE(E) that you filed." DId you get this notification anytime when USCIS found out that your case was sent to NRC instead of NVC?

 

 

Nope, we didn't get that. That seems peculiar. Your petition was already approved, right? Do you have NOA2 already?

OMG, OMG, OMG I just gave NVC a call after replying to your post. They said they received our case today... yayyyy!! But they will take 10-20 business days to put it in their system, which is a bummer. I am still happy that they found it. It took exactly 2 months for NVC to get our file; I would have had my interview by now if this delay wouldn't have occurred. But everything happens for the best. Maybe this was meant to happen. I hope they don't delay this process any further now :|

All the best. My petition (NOA2 dated April 23rd) was also accidentally forwarded to NRC. I have been calling all the offices all the time but no one knows how it can be transferred from NRC to NVC. I have been told it should appear in NRC's system before anything could be done.

 

I really cannot understand why people at USCIS "accidentally" send out approved petitions to NRC. They clearly are unorganized and this inefficiency is costing us valuable time and a whole lotta stress.  I've read (at least on these forums) that there have been quite a number of cases like mine that were sent to NRC. sad.png

 

I'm sorry that this happened to you too, but do everything you can till you get a hold of your case. Like what emma1990 said, call your representative. Call USCIS and NVC. Email NVCResearch. Exhaust all possibilities.

My file also got sent to NRC instead of NVC. I got my NOA2 on March 27th, 2013. I called NVC, USCIS and got the congresswoman involved. Nothing seems to have helped. The file still must be sitting at NRC. Could you please tell me how I can get this moving? Right now, I feel very helpless. Who is Maria? And how can I contact her? It's actually Erika. I'm usually the one posting here on VJ. Maria is the NVC Call Center Night Manager. She will be able to help you out. When you call NVC at about 7-8pm EST, ask if you could be transferred to Maria the Night Manager. Hope this helps! :)

NVC hasn't received my case yet, and I called USCIS and talked to a tier 2 and they told me all they can tell me is that it was approved and to give it 30 days for NVC to get it. They said they were unable to tell me whether it was shipped yet or not.

 

Try calling NVC and ask for a Manager. Explain the situation. They should have more information for you.

 

In our case, the one who helped us was Night Manager "Maria". She has really been helpful and was able to locate our case file. She just called Chris tonight and told him that they've already received our Case from NRC and will be assigning us a Case Number soon.

Much to my dismay, Chris got a call from NVC Night Manager tonight saying that our petition was shipped to NRC a.k.a. storage facility instead of NVC. (And USCIS claimed that it was sent to NVC!)

 

I imagine that if our case got shipped, there must be some other cases out there that got "accidentally" shipped to NRC too! Heads up to those who got approved and haven't gotten their Case Numbers yet. (Most of the people I know near our NOA2 date has obtained their case numbers already.)

 

Be pro-active. Check the whereabouts of your case. Call USCIS and NVC.

yep...I'm still waiting, too.  I know I posted about it here already but it's frustrating so I guess I still need to vent.  NOA2 was April 11 2013.  The first time I called I was told it can take up to 90 days to receive a case number which I think is baloney.  The lady told me I have to wait until after 90 days to inquire about it.  Sounded like wrong information to me. So I called back, of course, and was told to send the scan to the research email address.  Which I did.  I called again today and the lady was very rude and snappy.  She asked me if my approval letter stated that my case was forwarded to the consulate in the country pertaining to our case.  I said it's a K1 and it doesn't go straight to the consular... it goes to NVC for a case number.  That's when she yelled at me.  lol. "I KNOW THAT! BUT THATS JUST IMMIGRATIONS WAY!" she yelled into the phone. (whatever that means)  Then she started rattling off some script (she was interrupting me and talking over me) about sending an email to that research email address.  I told her yes, I've done that already.  She replied "Oh you have? Did you get an auto response? I said yes I did.  She said then I just have to give it more time.  I asked if she knew what the time frame was for researching it and she yelled NO and hung up.  ClockWatch2.gif  Should I ask for a tier 2 person? Should I call USCIS to see if it has even left there?  Sigh.... I just hope it isn't lost or at the wrong place. 

 

It happened to my fiance too. He was being cut off while explaining the situation. And the operator was being rude to him. So he asked for the Manager. 

 

Call USCIS, get information from their Tier 2/Manager if your case has already been sent to NVC. Then call NVC and ask for a Manager and give them that information. 

Do you still remember the name of the person that was rude to you? Next time you call, ask for their name and their ID Number (if applicable) so that if they become rude to you, you'd have a name to tell / report to their supervisor.

Our case file was sent to NRC and not NVC, and we caught it right away. Don't just wait. Call both USCIS and NVC to find out where your case actually is. It worked for us. :)

I sent a email to NVCResearch@state.gov and referenced the days when the files were sent to the NRC, As I am in that group, I'm rather concenred. Did they say anything about all of them getting transferred back to NVC?

 

 

Also talked to USCIS, They told me 60-90 days to get to the NVC, while the NVC is saying 15 days... Can someone introduce the left hand to the right hand?

 

I'm sorry I wouldn't be of much help. USCIS/NVC never mentioned about 'other files' being sent to NRC. Though, it is quite probable that there have been a bunch of cases that were sent to NRC. I mean, our case wasn't probably singled out, right?

 

Try to call them over and over until you get your answer.

 

NVC Call center Manager was the one who told us that our case was shipped to NRC. USCIS only claimed it has been shipped out on May 4th to NVC but, we all know now that that wasn't true. I don't think they do "work together". So much back and forth calls were needed to make on our end just to find out where our case was.

 

Some posts I've read on here before suggested to contact your representative just to find out where your case actually is.

Our NOA2 was April 25th and days after calling NVC and USCIS... When everybody else in our "group" (NOA2 April 24,25 and 26) was getting their MNL Case Numbers... We knew something was wrong.

 

We learned that our case was forwarded to NRC and not NVC. After numerous angry calls, by May 6th, Chris was put through a Night Manager / Supervisor at the NVC Call Center. She was very helpful and assisted us throughout the ordeal. May 8th, Chris received a callback from that Manager and told him our case was acquired from NRC and was already at NVC. May 9th, we got our case number.

Simple question in return.  IF you got married in the Philippines would you be allowed to change your first name(s) ?     There is your answer here in the states also.

 

To change your first name will require a lawyer and a trip to see a judge.

 

There is no real issue changing your middle name and last name (traditional Philippine way).  My wife did it after our marriage, moving her surname to her middle name and took my surname.

 

 

Then, I guess I really have no choice but to keep it. laughing.gif Was worth a shot asking though.

 

And yes, the legal name change here is a long process. Grar at Spaniards.

 

Ok, then just to be clear:

 

When getting and/or applying for SSN/EAD/AP/AOS, I would use this format?

 

First Name: Maria Erika

Middle Name: Reyes

Last Name: Smith 

 

No issues with having a two-part first name, right?

HAH! Finally found a thread where I can ask my question on a specific name change. I've been trying to look for similar threads and only found this today.

 

Anyway, I'm still in the process of my K1 Visa, but I wanted to go on ahead and research about AOS and name changes after marraige.

 

My first name is Maria Erika (Yes, two-part first name). I have no problems dropping my current last name to my fiance's last name when we do get married.

 

Question is: Can I drop "Maria" upon applying for SSN, EAD/AP/AOS? 

 

Current Name

First Name: Maria Erika

Middle Name (let's just say...): Blanco

Last Name: Reyes

 

We'll get married and change my name to: (Just so there's no more confusion with two first names)

First Name: Erika (this is what I go by anyway)

You need to do CFO to get a passport if I remember correctly.

 

 

AFAIK, my fiance never did a CFO before getting her passport.

 

 

Hank_ is correct. For IR1/CR1 applicants (the spouses), CFO is required for the release of passports. It was actually mentioned in the CFO Seminar we attended.

It happened on the same day. But this one in Luzon. Near Polillo Island. Magnitude 4.4

 

Most of the quake was felt in Makati, Taguig, Mandaluyong, Quezon City, Quezon Province, Pasig, and some parts of Rizal (Antipolo and Cainta), based on my Facebook feed.

 

It was strong enough but didn't last for so long. One of my friends said it was like somebody had "pushed" her from where she was standing.

 

As for me, I'm staying in the Manila/Pasay Area, on the 10th floor, and felt just minor movements.

Yes, There's a tracking number for that. It should be on the receipt that 2Go gave your husband. The US Embassy usually gets it within 24 hours of sending the documents.

 

Ask your husband for the Tracking Number and trace it here: http://supplychain.2...trace/index.asp

 

In our case, I sent our documents on a Saturday, so the US Embassy received it the Monday after that. :)

After paying the driver of the white Toyota Vios, with plate number TYR 919, upon arriving at his boarding house along Quirino Avenue in Manila, he stepped out of the taxi to get his luggage from the trunk.

The cab immediately sped away. He ran after the car to call the driver?s attention. The driver of a passing truck witnessed the incident and honked after the cab driver as well, to no avail.

While Olis managed to keep his laptops safe, his clothes, documents, and other gadgets were gone.

Okay my wife passed her interview on the 9th.  It is now the 11th and we called MOA office of 2Go.  Not there yet.  Called embassy and they said it had not left the Embassy yet.  Anyone know how long it takes to get the visa to 2Go at MOA? Our flight is scheduled for Tuesday, we will have to go to CFO to get her sticker put on her visa. CFO class already completed and she has certificate in hand. CEAC site says this:

^ Hank is correct. It would also be wise to reschedule your flight. Sorry. :(

 

Just to give you an idea, but keep in mind that every case is different. 

 

I was interviewed on June 13th and was issued a 221g. Complied and was approved on July 5th (Friday).

 

June 13 (Thursday) - AP

July 5 (Friday) - Ready (Probably means getting ready for Final Processing)

July 8 (Monday) - AP "Final Processing" Said to check back after 2 days.

July 10 (Wednesday) - Issued

July 12 (Friday, TODAY!) - Ready for Pick up at MOA. Tracked it through UStraveldocs.com and 2GO using UID found in the confirmation letter. Got the 2GO text at 5pm.

 

So from CEAC Status "Ready" to "Pick up" text from 2GO = it's 5 business days after for me.

Thanks everyone for the advice and input. I really appreciate that you shared your thoughts in here. He was very depressed that moment (he severely injured himself recently dislocated his arms during a contact sport but he's perfectly fine now) when I didn't realized that telling him the fees would aggravate his emotion. And of course, I put set things aside when I felt a sudden change in his tone and thought that he might not really pay at all and there I panicked and posted in this forum lol (this is really a wonderful forum as you really get to share your thoughts ad feeling and read each other's experience). There are just some time that you clash with one another, different culture as we are.

 

Things gone well the day after by comforting him. He was able to send money and I was able to set-up an appointment for the interview. He then told me that he just reserved the wedding reception on 2nd week of Sept but set my expectation that it might change depending on when will I be getting my Visa. He told me to hurry the paperwork and he misses me :-)

I'm the K1 Applicant as well and I've paid all the fees after the I-129F filing (Medical, Visa Application Fee, etc). Christopher and I have talked about finances. We both covered each other when it came to filing fees, airline tickets for vacations and such, housing arrangements when visiting me and I him. We both know that I wouldn't be able to work right away in the US (except for my freelance design gigs). And when I do get the work permit (EAD), We both are going to be working together. We have laid out a plan on our finances and actually keep them on a shared spreadsheet.

 

OP, You and your fiance should have a clear understanding on both your finances. And I do agree with all the other poster's insights on how this could possibly be a problem for you and your fiance in the future. Have a talk with your fiance. There are still other 'fees' to keep in mind as mentioned above (AOS, ROC, etc.) other than these medical and K1 Visa fees. What about plane tickets? What happens after you move? Are you going to work? Discuss it with your fiance soonest.

 

I hope you get to resolve this as soon as possible though.

If I'm not mistaken, what the article talks about is for the Tourist Visa Extensions. Noting the article:

 

"...in implementing extensions of stay in the passports of foreign tourists"

 

"David said the Long Stay Visitor Visa Extension (LSVVE) project was launched to spur tourist arrivals in the country by giving foreigners the privilege to prolong their stay here without the need to frequent the BI office."

 

The Original Article I posted is about Visa-On-Arrival. Meaning you automatically get 30 days instead of 21. And if you want to extend, you get to apply at the Bureau of Immigration (BI) office, hence your article saying "need to frequent" the BI Office. This is a 6-month extension including your visa-on-arrival of 30 day. Of course there's a fee, though I'm not sure how much this extension costs.

Apparently, with Visa on Arrival, the extension is only 38 days on top of the 21 days already given. With the article you posted, it would be an extension of the Visa on Arrival days to 6 months.(which is still not reflected on the website, as it was updated on February 27, 2012. LOL)

 

Also this is different from the PH Tourist Visa that you apply for while you still are in the US. Meaning before you land in the Philippines.
 
My fiance availed of this Multiple Entry Tourist Visa last year and he had 59 days of stay for $80/90 . I forget exactly how much. He stayed here for 3 months. He didn't have to extend his visa. All we had to do was travel outside the Philippines, and then he got another 59 days.

Yeah, I'm now worried about this. It's the most powerful storm of the world in 2013 and passing between Taiwan and Philly on Saturday, putting my flight to Manila on Sunday night and our interview Wednesday both in jeopardy.

MANILA, Philippines ? The Batanes Group of Islands continue to bear the wrath of Typhoon Odette, as it maintains its strength and continues to move toward the extreme northern Luzon area.

Storm warning signal number 4 remains hoisted over Batanes.

In its Friday 11pm bulletin, state weather bureau PAGASA said that Typhoon Odette (international name Usagi) was located 120 kilometers east of Basco, Batanes, as of 10 pm, September 20.

It packs maximun sustained winds of 205 kph near the center, and gustiness of up to 240 kph.

It is forecast to move west northwest at 19 kph. It is seen to leave the Philippine Area of Responsibility (PAR) on Saturday evening, at 270 km west of Basco or at 150 km southwest of southern Taiwan.

I would guess you are only a couple days from getting that special text/phone call from 2GO saying the package is ready for pickup.

 

There have been a couple of issued -to- delivered in the last few days.  good.gif

^Hank is correct, It should be issued in the next few days.

 

We had our interview and approval Sept. 25.  Visa status changed to AP Sept. 26.  Status changed to "Issued" Sept. 27.  Traveldocs tracking website stated that visa is "with post" Sept. 28 (today).

 

Our visa is slated to be delivered to the Mall of Asia, which we hope to pick up next week sometime.

 

A few questions:

 

Will traveldocs tell us when it is ready for pickup at the Mall of Asia?  If so, what does it say?

 

If not, I hear that the 2GO website is notoriously unreliable, so how will we know when it is ready?  Are they reliable in texting?  Do they use the phone number Mylen provided in her application forms?

 

How many days does it typically take from the day it is "Issued" to the day it is ready for pickup in the MOA?

 

I assume it is now safe to make plane reservations for Mylen and wedding reservations back home?

My visa got issued on a Wednesday, and it was ready for pick-up by Friday.

 

It's currently Saturday there, so you'll probably be getting a text next week. If you're using an AndroidOS smartphone, you can download TrackPack. That's what I used to track it. It's not always the UID that they use for tracking. Make sure you create tracking entries on all three possible tracking codes:

1.) MNL Case Number
2.) Passport Number
3.) UID

See which one activates in the next few days.

Exactly. There's always two sides to a story. For sure, Philippine media would latch onto it (and possibly blew it up). You know, Filipina being treated badly, drama, etc.

If she works for ADB and from a well off family, then it's possible that she has connections including the media (particularly ABS CBN) that's why the story ran. Haven't seen any other news outfits that ran the same story though. Will check.

Now, I'm not saying it didn't happen, but all people can do is just speculate.
