We are going to get the SSN tomorrow for my fiancé and his daughter.

I hope we have all the necessary paperwork and the wait is not too long.

you need the EAD but employers will allow with just ssn (your own risk)

File the entire package for green card, work and travel with all the required documents as soon as you are married on paper.

my fiancé just received his visa today so hopefully we can get him on a flight here ASAP

We applied very next day after arrival for SSI number

the card wont come for 7 to 10 days but we asked for the number and they gave it to us, it is needed for marriage license.

now we will do the name change on the SSI Card for the marriage name.

as soon as you get the SSI number they can work according to the SSI office people.

We are going for her drivers license next. She has been very busy "remodeling" our home! :-)

I-485 is adjust of status to obtain GR. I would recommend to apply I-131( AP),and I-765 (EAD) along with I-485 because it is free when you apply with I-485 together.

I-751 is Lift Condition Application, you dont need it until 90 days before her GR expiration date.


The fee for I-485 is 1070 ( include biometric fee).




Thanks, for the advice, I will send these as soon as I get the official copy of the filed marriage license back from the clerk of courts office. We are trying to plan a trip to Vancouver in June.

I hope the higher fee is to promote prompt service :-)

I answered your other post. Technically, what you've applied for with the I 130 is a CR1/IR1 immigrant visa, not a K type visa at all. CR1 is if you have been married for less than 2 years, IR1 is more than 2 years. Both are immigrant visas, which means that your spouse will get a green card upon arrival (basically).

In a few months, you will (assuming all your info is in order) get the NOA 2, which will be approval of your I130 petitions. Then your case is sent to the NVC where you will provide your financial evidence that you can support your family, and your wife will (or you will on her behalf) file the visa application. Once that is all accepted, your petition will be sent to the US embassy in VN. Your wife and child will have to have a medical exam, and an interview (which you don't have to attend, I don't think, if you don't want to) and then if all goes well, her visa will be issued and she can join you in the US.

It is unlikely that your mom will be able to cause too many problems for you. Honestly, it's hard for us to get ahold of anyone official - harder still for her, who doesn't have access to your case numbers etc.

It would, however, be a good idea to collect up some photos of the two of you together and any other evidence you have of a bonafide (ie: real) relationship.





I have to agree with all you said, and would also add special emphasis to the statement about photos and other evidence time stamps, etc.

Also take care of the address change with USCIS and ask them to be sure it is corrected. I did the same and had corrected even got the paper reciept of the change and still the original mistake was left for my wife's then fiance' address and the consulate recieved the wrong address not the correction and they mailed the interview package to the wrong address.

How long does it take from interview to visa in hand, assuming she doesn't live in Ho Chi Minh City?

I would wait and bring her home, Linh had to go back for some small item but it caused a one week delay, they lost copies of something and had to get from her. Plane tickets are expensive and vacation is hard to schedule. Also allow 3 hours from point of entry and following connecting flight... don't try to bring in "bird nests" hehe. don't ask me why I know LOL.

VietnamK1 VISA Interview - Is an Engagement Ceremony absolutely needed before the interview?

If one person asks the other to marry, and the other says yes, then they are engaged.  No ceremony is relevant.....I've actually never heard of an engagement ceremony before reading your post (tho the existence of such things doesn't surprise me.)

 

Just remember, that once you begin the K1 Visa path, if you get married before the visa is granted, then you'll have to start all over again with a CR-1 visa.  I mention this because you say something about an engagement ceremony and then you mention a wedding ceremony.

 

You will need pictures of you and your fiancee together, of course...

An engagement ring and reciept as well is nice evidence but proof of face to face meeting is required, dated photos of you two together, and plane ticket stubs, iteneraries etc.

They will not even ask about Dam Hoi until the interview and it is certainly not required. They will ask about when the Marriage will take place and even then if no date is set there is no show stopper. I think you should start the process as the process timeline can randomly vary by a lot. Some folks get the interview 7-8 months after initiating the process or can be much longer like mine at 15 months. So my advice is to start early as possible. It sucks to be apart.

Hi all,

 

My fiancee and I met when she came to the U.S. under a J1 visa. We lived together for the one year and one month she was in the U.S. After she finished her internship program, we had a couple of weeks to travel in the U.S. before she returned home in August 2013.

 

In December 2013, I filed a K1 visa petition and we just received NOA2 at the end of June 2014. Now we are waiting for NVC to transfer our case to the Consulate in Vietnam and then get ready for the interview.

 

So my question is?

Is it necessary for me to go to Vietnam to visit her and her family and/or go with her to the interview in HCMC? Does it hurt our case if I don?t visit? Could it be a red flag for the official?

 

I've never been to Vietnam or anywhere that far away before. The longest distance I have travelled was from New York to Switzerland and Italy. I don?t really like flying to begin with and I'm a big tall guy, so it's not comfortable being on a plane, especially for the 20+ hours it will take to get to Vietnam. I also don't have many vacation days left for the rest of this year, so it would be nice if I don't have to go but can wait for her to arrive back in the U.S. and we can be together again. So then, in the immortal words of the Clash, should I stay or should I go?

To answer your main question is it necessary.... nope it wont raise a red flag with the consulate

and if you were to go I would wait until she had visa in hand and go get her and fly back with her.

Besides it would help set your inlaws-to-be minds at ease that you care enough to meet them assuming you havent yet done so.

We got a written response on the I 485 delay and it was titled potential interview waiver. and goes into not needing a waiver but 6 months delay....and no mention of biometrics appointment.....and no mention of the travel documents or work.....Linh is now afraid to travel without a green card even with travel documents because many airports and not properly understanding travel documents.... poor her this really sucks for her. Cant work, can't drive, She passed the driving school stuff but cannot test with the state until she gets a green card. If there is a way of getting her a Louisiana driving license at least she can go to the mall and spend money even if she cannot earn it Lol.

POE customs can take some time. I booked a flight that had 3 hour layover there, with earlier delays it ended up 2 hours actual. barely enough time for our final flight. And exhausting!

Dave, you should consider meeting her there as all her checked baggage will be offloaded and inspected and have to be rechecked.

you will be needing lots of fresh vegitables, the usuals, including fresh ginger root, mustard greens, salad greens, mushrooms, Fish, fresh or frozen, lots of seafood, lol, unseasoned ground pork, whole chicken, as she will cut it much differenly than US butchers, (cuts the bones makes way better broths!) and something that my wife loves that is a bit expensive in vietnam and rare to find... good beef steaks, t-bone, ribeye etc. She may also want beef stew meats, pork tails, pork riblets. Also lots of different rice noodles. You may want to wait and take her shopping and let her do as she pleases. Both us supermarket as well as asian markets. Congratulations to you both!

Like Rich said chances are 100%. I am 51 and Linh is 37 and she has been here for 5 months now. No red flags and in my "older age" we are trying at children! Good luck in the process don't fret about any RFE's they happen and cause delays... don't be bashful to ask questions all will be fine!

BatonRouge Bill, where are you guys in the process? Our case is complete at NVC on July 2nd, and we are waiting for interview date to be schedule now

I received a RFE in the mail Monday for three things her commit to marry, my commit to marry and more evidence of an inperson meeting. I sent a lot of photos but they were not dated, it said the photo dates can be hand written on the photos so that is what I'll do also for some reason my airline ticket stubs had month and day not year and they mentioned that. I found some that had the baggage claim sticker on them with the month day and year so ill send that also, we also took a flight from Dalat to hcmc but I didn't keep the stubs.... Linh will try to go to the airline and get some kind of record. I have the email from them showing we took the flight. Also hotels would not give us a written record of us both in the same hotel...  they would have had to report us to the police. they only turned in her name as the occupant. but I do have the email vouchers with both our names on them. I wish we would have held up a poster with the place and date written on it and had our photo taken, it's something.

So ultimately still on NOA1 and really worried that I may have wasted 7 months if they reject the evidence.

Just type out a letter similar to the one shown in the example and have your fiance sign and mail it to you.  You'll need the original signature, so have her send it express mail if possible!  Good luck!

Where did the idea first come first serve go? When you call the customer service, they keep telling you applications are processed on first come first serve basis. Now I have stopped checking the status because it is too frustrating and annoying

I certainly share in the frustrations of those who have earlier dates but know it's probably just how the government workers in vermont filled the boxes...randomly without care or organization, and may have included a few bed bugs. I am a December 4th NOA1

The USCIS plays games in order to make their slow processing times appear better on their annual report to congress. I called on the june 28 and they told me over the phone I had an RFE....

it did not show up on my status nor did I get an email until July 3rd and was recorded on the postal copy as july 3rd, on july 13 I overnight my response return reciept and they signed for it on the 15 and officially recieved it on the 17th per the status. I had my Senator follow up and their response to her was an RFE on June 28th, (not july 3rd) and to allow them 30 to 45 days to respond. Status it shows received on july 17th and to allow up to 60 days for response.  Ultimately you need to stay on top of RFE to keep it on top of the desk and not returned to a box. Call your senator asap and have them constantly keep sending in requests.
